OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, April 19, 1994 The Owasso City Council met in regular session on Tuesday, April 19, 1994 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, April 15, 1994. ITEM 1: CALL TO ORDER Mayor Randolph called the meeting to order at 7:00 p.m. ITEM 2: FLAG SALUTE The flag salute was led by City Manager Rodney Ray. ITEM 3: ROLL CALL PRESENT Bob Randolph, Mayor John Phillips, Vice Mayor Mary Lou Barnhouse, Councilor Rex Bowen, Councilor Charles Burris, Councilor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, Council Clerk A quorum was declared present. ABSENT ITEM 4: REQUEST APPROVAL OF THE MINUTES OF APRIL 5 .1994 REGULAR MEETING. John Phillips moved, seconded by Rex Bowen, to approve the minutes, by reference made a part hereto. Owasso City Council April 19, 1994 ITEM 5: REQUEST APPROVAL OF THE CLAIMS John Phillips moved, seconded by Mary Lou Barnhouse, that the following claims be approved: (1) General Fund $14,410.79 (2) Workers Comp Self- Insurance $1,126.72; (3) Ambulance Service Fund $1,743.52; (4) E -911 $1,736.96; (5) Community Center $50.00; (6) Cemetery Care $427.50; (7) Capital Improvements $2,988.75; (8) Park Development $40.00; (9) Ambulance Service Capital Improvements $10,340.75; (10) Interfund Transfers $3,342.39; (11) City Garage $6,923.60; (12) General Fund Payroll $92,760.20; (13) City Garage Payroll $3,080.98. AYE: Phillips, Barnhouse, Bowen, Burris, Randolph NAY: None Motion carried 5 -0. ITEM 6: READING OF MAYOR'S PROCLAMATION. Mayor Randolph invited DARE Officer Randy Cunningham and a group of DARE students, to join him at the front of the room. The Mayor read a proclamation proclaiming Thursday, April 21, 1994 as Drug Abuse Resistance Education Day in the City of Owasso. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR FINAL ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT BETWEEN THE CITY OF OWASSO AND LAMAR INDUSTRIES FOR SPORTS PARK LIGHTING PHASE II, AND AUTHORIZATION FOR FINAL PAYMENT AND RELEASE OF RETAINAGE TO THE CONTRACTOR. Mr Munn stated that the contractor, Lamar Industries, has completed the specified scope of services and all contract requirements for this project. He recommended acceptance of the project and release of funds. Mayor Randolph moved to accept the lighting portion of Phase II for the Owasso Sports Park and release the $24,357.00 remaining on the contract. Motion seconded by Charles Burris. AYE: Randolph, Burris, Bowen, Barnhouse, Phillips NAY: None Motion carried 5 -0. 2 Owasso City Council April 19, 1994 ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR FINAL ACCEPTANCE OF WORK PERFORMED UNDER A CONTRACT BETWEEN THE CITY OF OWASSO AND BUILDERS UNLIMITED INC FOR CONSTRUCTION OF A SHELTER AT ELM CREEK PARK. AND AUTHORIZATION FOR FINAL PAYMENT AND RELEASE OF RETAINAGE TO THE CONTRACTOR. Builders Unlimited has completed the work on the park shelter at Elm Creek Park and requested acceptance and release of all funds. Mayor Randolph moved, seconded by John Phillips,. to accept the park shelter at Elm Creek Park and release the full payment of $41,115.00. AYE: Randolph, Phillips, Burris, Barnhouse, Bowen NAY: None Motion carried 5 -0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REOUEST FOR COUNCIL APPROVAL OF A PROJECT DESIGN FOR IMPROVEMENTS TO THE INTERSECTION OF MAIN STREET AND 76TH STREET NORTH AND AUTHORIZATION FOR THE STAFF TO SOLICIT BIDS FOR THOSE IMPROVEMENTS. Mr Munn presented a summary of the improvements to be made to 76th Street North. Approximately $114,077.00 remains in the 1988 Bond Issue to fund the project. Construction costs are expected to be approximately $100,000.00, with right -of -way acquisitions and utility relocation costs at approximately $14,000.00. Charles Burris moved, seconded by Rex Bowen, to accept the construction plans and specifications and authorize solicitation of bids for the 76th Street North Phase II improvements. AYE: Burris, Bowen, Barnhouse, Phillips, Randolph NAY: None Motion carried 5 -0. .K7 Owasso City Council April 19, 1994 ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #481. AN ORDINANCE RELATING TO THE EMPLOYEE RETIREMENT SYSTEM AND AMENDING SUCH PLAN. Ms Dempster explained that the proposed ordinance updates the defined contribution plan document for the municipal retirement fund. Charles Burris moved to approve Ordinance #481. Motion seconded by Rex Bowen. AYE: Burris, Bowen, Phillips, Barnhouse, Randolph NAY: None Motion carried 5 -0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #482. AN ORDINANCE REZONING A TRACT OF PROPERTY NORTH OF THE NORTHEAST CORNER OF 96TH STREET NORTH AND GARNETT ROAD FROM AGRICULTURE (AG) TO A PLANNED UNIT DEVELOPMENT (OPUD -12). On April 5, 1994, the City Council approved a rezoning request of a 160 -acre tract from AG to PUD. Ordinance #482 formally adopts that action. Mayor Randolph moved, seconded by Charles Burris, to approve Ordinance #482. AYE: Randolph, Burris, Phillips, Barnhouse, Bowen NAY: None Motion carried 5 -0. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE APPROPRIATION OF FUNDS WITHIN THE CEMETERY CARE FUND: AMENDMENT OF THE ADOPTED BUDGET FOR THAT FUND, AUTHORIZATION FOR THE STAFF TO SOLICIT BIDS FOR THE REPLACEMENT OF FENCING PROTECTING THE CEMETERY. Mr Ray said that staff members had been meeting with a group of citizens interested in improving the image and maintenance of Fairview Cemetery. One of the concerns expressed by that group is the appearance of the chain link fence along the south side of the property. They feel that the fence should be of a wrought iron type with an appropriate gate. They also feel that the fence on the north and east sides of the property should be replaced with a screening fence. There is sufficient funding in the cemetery care fund to cover an appropriation for the project. Staff requested an amendment to the FY 1993 -94 Cemetery Care Fund Budget by appropriating $15,000 for a Capital Improvement Fencing project; and authorization to solicit 4 Owasso City Council April 19, 1994 bids for the construction of fencing on the south, north and east sides of the cemetery, with the south fence being of an ornamental type, including gate, and the north and east portions of the fencing comprised of a six foot chain link with plastic screening slats. Mayor Randolph moved, seconded by Charles Burris, to approve an amendment to the Cemetery Care Fund Budget by appropriating $15,000 to a capital improvement project; and approval for the solicitation of bids for the fencing project. AYE: Randolph, Burris, Bowen, Barnhouse, Phillips NAY: None Motion carried 5 -0. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR RENEWAL OF THE E -911 INTERLOCAL AGREEMENT. The City of Owasso executed an Interlocal Governmental Agreement on January 17, 1989, joining 26 other governmental entities in an enhanced emergency phone system. The agreement provides for a 3 % surcharge on local telephone bills to fund the system, and must be renewed annually prior to May 1 in accordance with a ruling by the State Attorney General. Mayor Randolph moved, seconded by Charles Burris, to approve the Notice of Renewal of Interlocal Agreement. AYE: Randolph, Burris, Phillips, Bowen, Burris NAY: None Motion carried 5 -0. ITEM 3: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION 94 -05, A RESOLUTION APPROVING THE INCURRING OF INDEBTEDNESS OF THE OWASSO ECONOMIC DEVELOPMENT AUTHORITY BY THE ISSUANCE OF REVENUE BONDS OF THE AUTHORITY NOT TO EXCEED $7,000,000, WAIVING COMPETITIVE BIDDING AND AUTHORIZING THE SALE OF SUCH BONDS AT A DISCOUNT. Mr Ray presented the resolution, which would allow the issuance of revenue bonds by the Owasso Economic Development Authority to provide funds to acquire, construct, equip and furnish a manufacturing facility in Owasso for National Steak Processors Inc. The reception is open to all citizens of Owasso and will provide an opportunity for the public to meet their policymakers. Barring any unforseen problems, it is expected that the "swearing in" ceremony and Council meeting will not require more than twenty minutes; meaning the reception will begin about 7:30 p.m. or earlier. LEGISLATION - Cost of publishing legal notices will increase as a result of the passage of HB 1143. Both Senate and House have passed the Bill, and it now awaits the Governor's signature. If he signs it (and he has indicated he will), the fee for legal notices (Planning Commission, bids, etc) will go from ten cents per word to eleven cents per word for the first run, and from nine cents per word to ten cents per word for all subsequent runs. Actually, the law does not mandate the increase, but allows a higher rate. Expect every newspaper to charge the maximum allowable rate. Hardest hit will be county government, with municipal government close behind. FEDERAL LEGISLATION - Senate Bill S -1825 (Bumpers, Ark) is gaining support in Congress. The bill, entitled "Tax Fairness for Main Street Act of 1994 ", would require local and state sales tax charges on out of state mail order purchases. Currently, our local merchants must charge CITY MANAGER'S REPORT April 29, 1994 Page 2 71 /2 % sales tax on all purchases, but mail order sales are exempt because of interstate commerce regulations (or lack thereof). If passed, the Bumpers Bill will go to the House where Oklahoma Congressman Mike Synar has agreed to sponsor the legislation. This Bill has been nurtured by the Oklahoma Municipal League and the National League of Cities. Similar bills have been proposed in the past; however, three years ago Senator Bumpers became involved, and it now appears that success is possible. Calls or letters to senators and representatives are encouraged. A vote may be held in July or August. DEPARTMENT OF TRANSPORTATION - Mr Compton, Mr Carr and I attended a recent meeting conducted by the DOT to discuss the future alignment of State Highway 20 between Claremore and Highway 75. Represented at the meeting were Skiatook, Collinsville, Owasso, and INCOG. Evidently the state is ready to start the process of public hearings and route evaluation. INCOG transportation planners have been asked to develop several alternative routes for the group to review. Please note, there is a chance for something very different from what we may have expected to come from this process. Some options for alignment are: 1) utilization of 116th Street from Claremore to Highway 75, 2) utilization of 106th Street from Claremore to Highway 75, 3) northwestern angle from Keatenville Hill to Highway 75, and 4) develop route from Claremore southwest to Port of Catoosa, then west on 46th Street to Highway 75. As you can see, some of the options could cause conflict and strong disagreements between communities. Also note, the Director of State DOT (Jack Crowley) pointedly told Collinsville Mayor -elect Jack Hodges that Highway 20 would not be located on Collinsville's Main Street and would not come through downtown. The staff will keep you apprised of developments. Progress will be slow and the process will take about two years. Right -of -way will not be purchased until 1998. Owasso's goal has always been to improve Highway 20 in order to link Mid - America Industrial Park in Pryor to Cherokee Industrial Park in North Tulsa. Now, because of National Steak and Poultry, we have an interest in improving Highway 20 so Wichita, KS routes are efficient. COMMUNITY DEVELOPMENT: BOARD OF ADJUSTMENT - The Owasso Board of Adjustment met Tuesday, May 26th and reviewed a request for a home occupation to conduct a home day care activity. The applicant's home is located in the Copper Meadows subdivision and the request was approved, subject to review by the Board in one year to insure that no problems are created for the neighborhood. CAPITAL IMPROVEMENTS - The FY95 Capital Improvements Committee has been meeting during January, February, and March to conduct the sixth annual capital needs review process. The staff has been directed to prepare a final report for the committee to review. If approved, this report and the recommendations contained within it will be transmitted to the City Council CITY MANAGER'S REPORT April 29, 1994 Page 3 for review and action. CODE COMPLIANCE CROSS - TRAINING - A goal of the Community Development Department is to establish a consolidated full- service code inspection and enforcement division. It would be the intent of this division to provide for the safe, compliant construction of the community's building environment. The responsibilities of this new division would include the current duties of the Building Inspector, Code Enforcement Officer, and Engineering Inspector. In addition, the division would coordinate the necessary inspections conducted by the Fire Department. A principle reason for the consolidation would be to provide for mutual back -up within the division's personnel. In order for the mutual back -up concept to work, division members will need to be cross - trained. Please note, the new division is the result of reorganizing the department; no new personnel will be added to accomplish this goal. Sheryl Duggan, Engineering (infrastructure) Inspector, has been participating in a BOCA self - study training program. Upon completing each of the four study programs (building, mechanical, plumbing, and electrical) and passing a written test, Sheryl will be certified to conduct inspections on 1 & 2 unit dwellings. Sheryl has completed her study program on building inspections and took her test Saturday, April 23, 1994. It will be three to four weeks before the results of the test are known. However, whether Sheryl does or does not pass her test on the first try, I see this as a success story because of her willingness to assist the City in providing better services to the citizens and, at the same time, expand her education. Two zoning cases will be reviewed, as well as a site plan, which will feature the new offices of Kourtis Development, a computer based retailer, and additional lease space. This will be located on North 128th East Avenue. Final plats are anticipated to be reviewed for Double Oaks Extended, Central Park - Phase I, and Nottingham Estates. A preliminary plat for Phase I of Bailey Ranch Estates will also be reviewed. This is a part of the 159 -acre tract recently annexed and is located on the east side of Garnett Road between 96th Street North and 106th Street North. OWASSO SUBDIVISION REGULATIONS & DESIGN CRITERIA - The subdivision regulations and design criteria are currently in the final refinement stage of a lengthy review and input process. Area developers, along with the Community Development and Public Works staff, are conducting a series of working meetings in order to produce a document that maintains quality development standards while also being sensitive to development scheduling and costs. FIRE HYDRANT DATABASE - As previously reported by Chief Allen, the Owasso Fire Department is facing a rating evaluation from the Insurance Service Organization (I.S.O.). As a part of that evaluation, the Engineering division is preparing a map showing water pressure contour lines. The purpose of the map is to clearly show water pressure levels in the different parts of town. Having that data in map form enables the Fire Department, the Public Works Department, and the I.S.O. evaluators to have a better understanding of needs and problem areas relating to water pressure and volume. An additional benefit of the project will be to assist in the future development of a master plan for water service. CEMETERY: CLEAN -UP DAYS - On Saturday, April 9, a "clean-up day" was held at Fairview Cemetery. Approximately ten citizens spent the day mowing, trimming, weeding, painting, and generally "sprucing up" the cemetery. Mr Heath and Ms Boutwell were on hand to assist and coordinate the efforts. Another clean-up day is planned for Saturday, May 21. Since this will be close to Memorial Day, it is anticipated that there will be greater citizen participation. If you have questions, please contact Ms Boutwell. POLICE SERVICES: TRAINING - To date all commissioned officers have completed ASP (expandable baton) training and spring firearms certification. This is an example of the training needs currently being addressed within the police department. Other training needs are being reviewed and will be addressed as resources permit. EMERGENCY PREPAREDNESS EVALUATION - In May, the police department will be assisting in setting up a mock disaster drill in Owasso. The purpose of this exercise is to test the readiness of all emergency services in the event of a disaster or catastrophic event. Police, fire and ambulance will be responding. The sirens will sound in order to kick off the exercise and to test the equipment. Coordination with civil defense director Tom Schick and Howard Stamper is being conducted so that the city will be able to update the current emergency operation policy and procedures. SENIOR CRIME FAIR - On April 22, 1994 (Friday), the Owasso Police Department hosted the first annual Owasso Senior Crime Fair at the Community Center. Over 150 seniors turned out and reported the event a huge success. Over 35 vendors from the Owasso area were there to provide information or services to the seniors who attended. STREETS: 96TH AND GARNETT INTERSECTION - Tulsa County is in the process of completing design drawings. They plan to utilize their own personnel for construction, with work to be completed by the beginning of the 1994 -95 school year. Specifications for signalization of the intersection will be provided to the City of Owasso by Tulsa County Engineering. However, it will be necessary for us to bid the installation. SWIMMING POOL: MANAGEMENT CONTRACT - On May 17, 1994, the staff will present to the City Council for their review and action, the 1994 Pool Management Contract. This is a contract between the City of Owasso and the YMCA of Greater Tulsa to provide management services for the summer operations of the swimming pool. A new requirement this year is the preparation of a written Management Plan. This plan will be presented to the Council along with the contract. PARK MAINTENANCE: PLAY EQUIPMENT - The park maintenance staff has scheduled the installation of new play equipment in Elm Creek Park to occur within the next two weeks. It will be located in the same general area where the old merry-go -round was located. The merry-go -round was removed because of safety and liability concerns. ECONOMIC DEVELOPMENT: NEWS CONFERENCE - The OEDA has scheduled a news conference for Thursday, May 12, 1994 to announce the relocation of a California -based company and, initially, 200 jobs to Owasso. We are pleased to be able to inform you of this matter and to also identify that three additional companies have submitted business plans to the OEDA for their review. COMMUNITY PROSPECTUS - Mr Rooney is in the process of producing a community prospectus. This document will include demographic, socio - economic, and general information about Owasso and the surrounding area. WHIRLPOOL PROJECT - A pool of speakers has been identified and are available to meet with local civic clubs and citizen groups to provide information relating to the half -penny sales tax election called for June 14th. The steering committee set up to coordinate the sales tax campaign has requested that Owasso contribute $5000 of the $150,000 needed for the campaign. Private sector companies wishing to assist in that effort can contact the Owasso Chamber of Commerce and arrange to contribute. WATER DISTRIBUTION: NEW WATER LINES - A 4" water line will be installed to connect some of the recently acquired Rogers County Rural Water District #3 customers to city water. Estimated cost of materials is approximately $2200.00. We anticipate presenting a request to the City Council at the second meeting in May for authorization to purchase the materials. KNEBEL SUBJECT: TWO ADDITIONAL PHONE NUMBERS AT CITY HALL DATE: April 18, 1994 BACKGROUND Over the last several years, it has become a common occurrence that all five phone lines at City Hall are simultaneously in use. Whenever this situation occurs, citizen /customers trying to contact City Hall get a busy signal. Until the Owasso Fire Department moved to their new facility, the Toshiba phone system at the City Hall facility was at full capacity serving a total of twelve lines for access to the Fire Department, Civil Defense, and City Hall. The five lines (telephone numbers) utilized by the Fire Department have been moved to the new facility and thus the Toshiba system now has renewed capacity. CURRENT STATUS AND OPERATION As per your request, City Hall employees and our citizen /customers now have access to two more phone lines. Previously, there were five lines (2251, 2252, 2253, 2254, and 2255) available for use. The addition of two new phone numbers (272 -4955 and 272 -4956) should alleviate the "all lines busy" situation. These new phone numbers are utilized as line 6 and line 7 respectively on the individual phone sets. Southwestern Bell will assign the first six numbers to a "hunt group" tomorrow (Tuesday, April 19). What this means is that if a person dials 272 -2251 and the line is busy, the call will automatically roll to 2252, and if that number it is busy it will roll to 2253, etc. Line 7 (272 -4956) has been left out of this group to assure there will be a line open for at least one outgoing call.
