MINUTES OF REGULAR MEETING
Tuesday, February 15, 1994
The Owasso City Council met in regular session on Tuesday, February 15, 1994 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4 :00 p.m. on Friday, February 11, 1994, and
Addendum posted at 5:00 p.m. on Monday, February 14, 1994.
ITEM 1: CALL TO ORDER
Mayor Randolph called the meeting to order at 7:00 p.m.

tITEM 4: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A CITY
ATTORNEY OPINION THAT THE CITY COUNCIL WARD 3 COUNCIL
t SEAT IS VACANT AND DIRECTING THE INITIATION OF A PROCESS TO
FILL THAT SEAT.
City Manager Rodney Ray presented this item relating to a City Attorney opinion that the Ward
3 City Council seat was vacated when the Councilor in that ward was elected to, and accepted,
Ia position on the Rogers County Rural Water District Board. Mr Ray referred to City Attorney
Opinion No 93 -07, issued on December 3, 1993, in which the city attorney discussed sections
of state law that, in his opinion, do not allow a person holding the office of Owasso City
Council Member to also be a member of the Board of Directors of a Rural Water District. The
ICity Manager stated that it was his opinion this issue must come to the Council to ensure that

the risk faced by the City does not impose some cost to the taxpayers in the future. City
Attorney Ron Cates briefed the Council on his opinion letter, a copy of which had been provided
to Council members at the time it was rendered and again prior to this meeting. Mr Cates
referred to 51 O.S. Section 6 of the state statutes, an Attorney General opinion, and the case of
Gibson v Crowder, a copy of which was also provided to Council members prior to this
meeting, and said that whenever an individual occupies an office and then takes another office
that is subject to those provisions, then that person ipso facto vacates the first office. He stated
that, based upon the events related to him by Mr Ray, it is his opinion that whenever Mr Burris
took the seat on the rural water district board that the seat on the City Council became vacant.
Mr Burris made a statement to the Council in which he questioned the reason the situation came
about. He also mentioned employment contracts between the City and staff members, and a
$20,000 shortage in the police payroll account. The City Manager interrupted an exchange
between Mr Burris and the Mayor, and stated that this meeting was not the appropriate forum
to discuss those issues not related to the agenda item or listed as an agenda item for the Council.
With no other comments forthcoming from the Council or audience, Mayor Randolph moved
to begin the process to fill the vacant seat in Ward 3, following established procedure by
advertising for letters of interest from qualified electors in Ward 3, and that the seat be filled
at the March 1, 1994 City Council meeting. Motion seconded by Mary Lou Barnhouse.

ITEM 7: READING OF MAYOR'S PROCLAMATION.
Mr Ray Fisher joined Mayor Randolph at the front of the room for the reading and presentation
of a proclamation, which proclaimed February 13 -19, 1994 as Child Passenger Safety Awareness
Week in Owasso.
ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR APPOINTMENT OF AN AUTHORIZED AGENT BY THE
CITY OF OWASSO FOR THE PURPOSE OF RECEIVING
CORRESPONDENCE AND OTHER INFORMATION FROM THE
OKLAHOMA MUNICIPAL RETIREMENT FUND.
Michele Dempster presented this item, requesting that she be approved as authorized agent for
the Oklahoma Municipal Retirement Fund. Such action would update OMRF files. Mayor
Randolph moved to approve Ms Michele Dempster as authorized agent for OMRF. Motion
seconded by John Phillips.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
RESOLUTION NO. 94 -02, A RESOLUTION APPROVING AMENDMENTS
TO THE OKLAHOMA MUNICIPAL RETIREMENT FUND TRUST
INDENTURE AS PROPOSED BY THE TRUSTEES OF THE OKLAHOMA
MUNICIPAL RETIREMENT FUND, AND AUTHORIZING THE MAYOR TO
EXECUTE SUCH DOCUMENTS AS MAY BE NECESSARY TO EVIDENCE
THE APPROVAL OF THESE AMENDMENTS BY THE CITY OF OWASSO.
Ms Dempster presented this item. Six amendments have been proposed to the OMRF Indenture.
The amendments do not affect the city's contribution rate nor the benefits received by the
retirees. The amendments must be approved by 2/3 of all participating employers to become
effective. John Phillips moved, seconded by Mary Lou Barnhouse, to approve Resolution No.
94 -02.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE PURCHASE OF LOCKERS FOR THE NEW CENTRAL
FIRE STATION.
Bids for lockers for the new fire station were opened on February 9, 1994. Three bids were
submitted, with two being rejects as not complying with instructions provided in the bid
document. Chief Allen recommend the expenditure of $5130 to Murray Womble Co for the
purchase and installation of lockers for the new fire station. John Phillips moved, seconded by
Mayor Randolph, to approve the expenditure as requested.

ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT FOR THE CONSTRUCTION OF A PARK
SHELTER IN ELM CREEK PARK.
Bids were opened on February 8, 1994 for a park shelter for Elm Creek Park. Four bids were
received, with Builder's Unlimited submitting the lowest and best bid. John Phillips moved,
seconded by Rex Bowen, to approve a contract to Builder's Unlimited, Tulsa, OK, in the amount
of $41,826 for the construction of a park shelter at Elm Creek Park.

ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL ACCEPTANCE OF IMPROVEMENTS TO THE
WATER, WASTEWATER, STORMWATER, AND STREET SYSTEMS
CONSTRUCTED BY THE DEVELOPERS OF BRENTWOOD ESTATES, AN
ADDITION TO THE CITY OF OWASSO, OKLAHOMA.
This item, presented by Mr Munn, requested acceptance of the onsite infrastructure
improvements in Brentwood Estates. All items have been completed and inspected by the proper
city departments. John Phillips moved to accept the onsite infrastructure improvements to
streets, storm sewers, water and wastewater at Brentwood Estates. Motion seconded by Mary
Lou Barnhouse.

ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST TO VACATE A PORTION OF A UTILITY EASEMENT
LOCATED ALONG THE WEST 17.5 FEET OF LOT 5. BLOCK 2, ELM
CREEK COMMERCIAL CORNER.
Mr Mark Weir, owner of Elm Creek Mini - Storage, has requested that the City close a 17.5 foot
utility easement located along his western property line at 8502 N 128th E Ave (Lot 5, Block
2, Elm Creek Commercial Corner). According to Mr Rooney, the Technical Advisory
Committee reviewed the request. PSO had a concern regarding the location of a utility pole and
City staff was concerned about a drainage structure, both located in the subject area. PSO
requested that the northerly 35' of the easement be maintained, and the City requested
maintenance of the southerly 17.5'. Mr Weir has agreed to leaving those portions of the
easement open. If approved, the applicant will have to carry out legal action to foreclose on the
City's right to reopen the easement. Such actions are normally handled as "friendly" cases. Mr
Cates advised that the minutes should reflect that the proper wording of the agenda item is
"CLOSE" instead of "VACATE ". John Phillips moved to approve the request to close the
utility easement located along the west 17.5 feet of Lot 5, Block 2, Elm Creek Commercial
Corner, less and except the southerly 17.5 feet and the northerly 35 feet. Motion seconded by
Mayor Randolph.

ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST TO ABANDON A PUD APPROVED BY THE CITY OF OWASSO
IN 1992 CONSISTING OF SINGLE FAMILY. MULTI FAMILY,
COMMERCIAL AND OFFICE DEVELOPMENT, LOCATED BETWEEN
86TH STREET NORTH AND 96TH STREET NORTH, EAST OF THE
LAKERIDGE ADDITION. IF APPROVED, ZONING WOULD REVERT TO
ITS ORIGINAL CLASSIFICATION OF RS -3.
' The Owasso City Council approved OPUD -10 in December of 1992. The owners of that
property have now requested that the PUD be abandoned and the zoning revert to its original
classification of RS -3. They wish to develop the property in a manner consistent with an RS -3
' zoning district similar to the Lakeridge Addition. Planning Commission has unanimously
recommended that OPUD -10 be abandoned. John Phillips moved to approve the abandonment
request for OPUD -10. Motion seconded by Rex Bowen.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST TO REZONE A TRACT OF LAND CONTAINING 12.69 ACRES,
MORE OR LESS, FROM OL (OFFICE LOW INTENSITY) AND CS
(COMMERCIAL SHOPPING CENTER) DISTRICT TO RS -3 (RESIDENTIAL
SINGLE FAMILY HIGH DENSITY) DISTRICT. GENERALLY LOCATED
NORTH OF SMITH ELEMENTARY SCHOOL.
This item is a result of the abandonment of OPUD -10. Because there was an underlying and
separate zoning case for commercial and office development as part of the PUD, staff requested
that the applicant also submit a rezoning request for that separate zoning case. A condition of
the PUD was that the commercial area could not develop until the service road is constructed.
With the abandonment of the PUD, that property could develop prior to completion of a service
road. If the property reverts back to RS -3, the entire tract would be zoned as it was prior to the
PUD, with no commercial zoning. Mr Phillips asked why rezone if commercial zoning is
desirable as stated in the memorandum to the Council. Mr Rooney said that in order to prevent
that area from developing commercially before the service road is completed, staff felt it was
necessary that the property revert back to RS -3. John Phillips moved, seconded by Rex Bowen,
to approve the rezoning from CS and OL to RS -3 in Case No 94 -01.

ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF THE OWASSO SPORTS PARK PHASE II GRADING AND
DRAINAGE PROJECT.
Continental Concrete Company has completed the scope of services specified in their contract
for grading and drainage at the Sports Park and requested final payment. Mr Munn stated that
all the work under contract has been completed. Rex Bowen moved, seconded by John Phillips,
to accept the grading and drainage of Phase II of the Owasso Sports Park and to release the
$22,500 remaining on the contract.

ITEM 17: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
EXPENDITURE OF FUNDS FOR THE REPAIR OF STREET DEPARTMENT
EQUIPMENT, AND APPROVAL OF A "SOLE SOURCE" DETERMINATION
REGARDING THAT EXPENDITURE.
The 1984 John Deere Backhoe used by the street division has developed some major problems
and was transported to Keystone Equipment in Sand Springs to determine the extent of repairs
needed. The minimum amount for repairs needed to get the backhoe into operation is $4010.46.
Since the backhoe had to be dismantled to determine the needed repairs, the cost to reassemble
without repairs would be $975. Staff requested a sole source bid because of the expertise
required and because the backhoe had been dismantled. The street division budget contains the
funding necessary to the repairs. John Phillips moved, seconded by Rex Bowen, to approve a
sole source expenditure of $4010.16 to Keystone Equipment to repair the backhoe.

ITEM 18: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE EXPENDITURE OF FUNDS FOR THE PURPOSE OF
CONSTRUCTING WASTEWATER IMPROVEMENTS TO PROVIDE
SERVICE TO THE FIRE STATION, AND APPROVING AN AMENDMENT
TO THE AMBULANCE SERVICE CAPITAL FUND BUDGET FOR THE
FIRE STATION PROJECT.
Staff requested Council approval of an expenditure of $16,700 to extend a sanitary sewer gravity
flow line to the fire station, and the authorization of that expenditure from the Ambulance
Capital fund. John Phillips moved to approve the expenditure for the purpose requested, and
amendment of the Ambulance Capital Fund budget in the amount of $16,700. Motion seconded
by Rex Bowen.

The Rotary Club has begun planting trees on the northeast corner of 86th St N and Highway
169. They will be planting 6000 trees. A Summary Judgment has been entered in the case of
Hiatt vs City of Owasso.
ITEM 20: REPORT FROM CITY ATTORNEY
The City Attorney requested that the minutes reflect that Council members were provided with
City Attorney Opinion No 93 -07 and Oklahoma Supreme Court decision in the case of Gibson
v Crowder, No. 32299, prior to the Council meeting.

VACANCY

BACKGROUND:
On February 15, pursuant to advice and opinion of the City Attorney, the Council directed the
staff to initiate the process for filling a vacancy on the City Council in Ward Three. The
adopted policy (see attached) requires that certain information relating to the process be
published. The staff, in conjunction with the Owasso Reporter did, in fact, caused the required
information to be published (see attached).
As of Friday, February 25, at 5:00 p.m., the following persons had submitted "letters of

Pursuant to the requirements of the policy, the staff has verified the addresses and are of the
opinion that all of the interested parties have, in fact, listed addresses that are located within the I
boundaries of Owasso's Ward Three.
Please note that the City Attorney was notified at 4:00 p.m. on Thursday, February 24, that a
"Temporary Restraining Order" has been granted to Mr Burris prohibiting the City from filling
the vacancy until further order of the Court. The Court further ordered a hearing for the
requested injunction be scheduled for 9:30 a.m. on Tuesday, March 1, 1994.
Therefore, in anticipation of the outcome of the hearing, the agenda for March 1, 1994 will
include an item allowing the Council to fill the vacancy (please note that the temporary
restraining order did not say there was no vacancy, it simply ordered the Council not to fill the
vacancy until the Court issued a further order subsequent to the March 1st hearing). Should the
Court rule against the City, the agenda item will be removed until a permanent hearing has been
scheduled. In the event the Court does not grant the injunction, the Council may then act on
March 1 st to fill the vacancy.

Owasso Ok. I am interested in the now vacant city council seat
for Ward Three. I would like to be considered for this position.
I had my home built in Three Lakes in 1985 and we have livdd
here ever since. I am married to Beulah Rice who works at Hillcrest
Hospital as a Registered Nurse for 27 years.
I am retired from the Tulsa Police Dept. Where I served 20 years.
12 years as a Patrolman and 8 years as a Detective. I am now employed
by the U.S. Postal Service for the past 9 years. I will be eligible
to retire from there in Nov. 1995.
I would like to get involved in the future and the growth of
Owasso. I am a registered voter in precinct # 755. Iwould feel it
a privilege to be considered for this position. And would do my best
if given this opportunity to serve.

have lived in Ward 3 since coming to Owasso in 1991.
Currently I am employed with Wyeth-Ayerst Laboratories as a
Pharmaceutical Sales Representative. I am familiar with many
of the physicians and small business owners in Owasso. I have
respect for them the same as they respect me. I feel that
with the management skills required by my career, these same
skills and respect for people and there respect for me would
make me an outstanding candidate for Owasso City Council Ward
3.
I feel that a 10 page letter would only be redundant in my
desire and capabilities. My wife and I have discussed the
City Council position and the effects it would have on our
family, the conclusion of our discussion was "GO FOR IT."

area and have lived here all my life. I have lived in and
operated my chiropractic practice in Owasso for seven years.

Street and plan to construct a new professional building to
house my practice and other tenants. I have made this
substantial investment in Owasso because of my belief in
Owasso's promising future.

OWASSO CITY COUNCIL
POLICY STATEMENT
It shall be the Policy of the Owasso City Council to fill vacancies
in its membership, when such vacancies occur after the close of a
regular filing period for candidates for Council and the unexpired
term of the vacancy extends beyond the time when the terms for
Council members elected that year begin, utilizing the following
process:
Section A - A vacancy in the Council membership shall be
declared by the receipt of a properly submitted
resignation from a member of the Council in writing
setting forth an effective date, or by a vote of the
Council if such vacancy is caused by appropriate
Council action pursuant to law; or by a vote of the
Council if such vacancy is otherwise created wherein
such written resignation is not received but an
obvious vacancy is created.
Section B - Upon declaration of a vacancy, as described in
Section A(above) the Council shall, by majority vote
instruct the City clerk to cause to be published in
a newspaper of local circulation a notice of such
vacancy and a request for persons interested in
being considered as candidates to fill the vacancy
to file "letters of interest" with the Clerk during
an established ten -day acceptance period, such
period to begin no later than five days after
publication of the notice of vacancy.
Section C - The notice of vacancy shall be written and published
in a manner to communicate, at a minimum, the
following information:
1. The number of the Ward(s) wherein the vacancy
has occurred.
2. A map of the Wards of the City and a general
description of the political boundaries of the
Ward(s).
3. A statement of qualifications as stated in
Section 2 -1 of the Owasso City Charter.
4. The address of the City Clerk and the manner of
marking the envelope containing the "letter of
interest ".
5. The beginning date and ending date and ending
time that "letters of interest" are to be
accepted.
6. A request for information relative to the
address of the interested citizen, the voting
precinct of the interested citizen, and any
other information the interested citizen should
wish to include in their submittal provided
however that such submittal shall not exceed
ten total pages of standard 8 1/2" x 11" size
paper or copies.
7. A tentative date, established by the Council,
for action on filling the vacancy to be taken
as an agenda item of the City Council, notice
to clearly state that such date is tentative
and, due to various reasons, could be altered
to a later date.
Section D - All "letters of interest" shall be received by the
City Clerk or designee and thereupon shall be noted
the date and time of receipt as well as the name of
the person receiving the submittal. Such notations
to be directly upon the "letter of interest" and
not on the envelope in which the letter was
contained.
Section E - Upon receipt of a "letter of interest" the City
Clerk or Designee shall consult a Ward map or other
instrument to determine if the address listed as the
citizen's residence is within the boundaries of the
Ward in which the vacancy is declared to exist. In
all cases such verification shall be noted directly
upon the original "letter of interest" in a manner
to denote whether or not the listed address is or is
not considered to be within the affected Ward. In
all cases wherein the initial determination by the
Clerk or designee is that the listed address is not
within the Ward which has been declared to be vacant
a follow -up verification by the City Planner or
designee is required before such is noted on the
"letter of interest ".
Section F - Upon completion of the requirements of Section E the
City Clerk or designee shall cause to be made
duplicates of the submittal in the exact number as
of the remaining Council members and in as exact
form as possible. Each submittal shall be bound in
a manner to insure the integrity of the submittal,
but in no event shall any changes be made in the
manner of the submittal presentation that would
enhance or detract from the original submittal.
Section G - The City Clerk or designee shall, at the close of
business (5:OOpm) each day during. the ten day

members all submittals received during that day. In
no event shall any submittal be delivered to any
Council member on any date other than the date the
submittal is received. Provided, however, that in
the event a remaining Council member has notified
the City Clerk that the delivery of submittals to
him /her received on a certain day should be delayed
due to his /her request, such request to be noted in
the master file maintained for each vacancy. The
original of each submittal shall be retained by the
Clerk /clerk designee in a master file containing all
notices, documents, publications, notes, and
submittals of the selection process from its
inception.
Section H - The Council shall direct the City Manger to place an
item on the Council agenda for action within
fifteen days of the date of the close of accepting
"letters of interest ". In the event actual action
on the item is not taken by the Council, such item
shall either be continued to a date specific or
shall be continued to the next regularly scheduled
Council meeting.
Section I - Upon action by the Council and the successful
selection of a successor to the position, such
person shall immediately be administered the oath of
office and seated as a member of the City Council.

Present police department facilities do not have the space to
adequately secure bicycles, motor parts, electronic equipment, etc.
which are recovered by the Owasso Police Department.
Currently the department rents storage space at a facility in German
Corner. This unit is used to store recovered stolen property, found
property and large pieces of evidence.
A public auction will be held on an annual basis to remove these
items, however in the interim, this property must be secured.
To date the City has expended approximately $1,650.00 for storage
space since November 1991. Currently the city is paying $60 per month
for the present storage space.
The possibility of purchasing a portable unit has been researched.
A unit may be purchased from Midwest Portable Buildings located in
Tulsa, for a cost of $1,150.00.
The proportion of the building is 12' X 14'. The unit can be located
in the rear segment of the police department lot and should meet the
needs of the department in the accumulation of property until auctions
can be held. In that it is portable, it may be relocated if necessary.

Although the current status of the police budget is not fit, approval
of this expenditure would save the city money in the future.
Midwest Portable Buildings can deliver the unit as soon as the funds
are made available. The current storage unit is paid until the 16th
of March.
RECOMMENDATION:
Staff recommends the consideration of purchase of a portable building
from Midwest Portable Buildings, in Tulsa, Oklahoma for the amount of
$1,150.00.

SERVICES

BACKGROUND:
The renovation of existing space currently used by the fire department to house their firefighting
vehicles has been listed on the City's capital improvement plan for three years. Anticipating the
planned completion of the new fire station scheduled for March 31st, the City Council
appropriated $90,000 in the 1993 -94 budget to design and construct a multi -use Council /Court
Room using that space. The relocation of the Council /Court activities from the Community
Center to the City Hall facility will provide additional use alternatives for the people who use
the Center. Additionally, the new space can be designed to accommodate a broad variety of
uses. The current plan lists uses by the City Council, Municipal Court, Planning Commission,
Board of Adjustment, Personnel Board, and Committees, and will also be designed to allow
training courses for up to seventy persons. Once completed, the project will "free" the
Community Center to further broaden the senior, youth and community activities offered at their
facility. The Community Center's space and time, now allocated on a priority basis to
government functions, can be made available to other community groups and citizens as was the
Center's original intended use.
In January a committee was formed to provide input to the renovation project. The committee
membership included the prime users of the proposed room for the planning phase of the project.

The committee met on several occasions and made visits to two other municipal facilities to gain
additional information. Additionally, the committee reviewed price proposals from several
architectural firms that had been asked by the staff to submit quotes.
To date the committee has developed a basic concept plan for the facility that will be used by
the selected architect as a starting point for their work. Additional direction in the areas of use,
material, lighting, audio and visual, and public access has been developed by the committee.
In order to progress beyond the initial concept, it is the opinion of the committee and staff that
a professional should now be retained to begin the detailed design and preparation of
construction plans.
After an initial meeting with the architect who designed the new fire station and a review of that
firm's price quote, the staff recommended to the committee that additional firms be asked to
review the project and quote a price.
Five firms submitted quotes based on their review of the project (please note that the project
consisted of two parts, one is the detailed design of the Council /Court Room, and the second
portion is the development of a master plan for the eventual renovation of the two floors in City
Hall that will contain office space once the fire department is relocated). Those quotes are as

The above firms represent a good cross - section of the industry, from a one person, in home
operation to a very large, multi -state company with more than fifty architects. The staff
reviewed the quotes and met with three of the five companies. Based on that review, the staff
recommended to the committee that the lowest bidder did not have the experience and support
believed necessary to complete the job for the price quoted. Additionally, the staff
recommended that the committee select the firm of Holmes Architectural Services Inc as the
contractor for the project. The Holmes company emphasizes renovation projects as their
specialty and provided substantial references for similar projects. On February 16, the
committee voted to recommend to the City Council the selection of Holmes Architectural

Services as the architect for the design of construction plans for the Council /Court Room and
to develop a master plan for the remainder of City Hall.
COST:
The recommended proposal includes a per hour fee for the projects with a cap at of $8,000 for
the Council Room and $2,500 for the master plan. It is possible that the projects could actually
cost less than the quoted cap. However, in no case can the cost be in excess of the quoted cap
of $8,000 and $2,500.
FUNDING:
Funding for this project is provided by the Capital Improvements Fund. The 1993 -94 budget
contains a $90,000 appropriation to the City Hall renovation project. The Capital Improvements
Fund receives its revenue from the dedicated one cent sales tax set aside for capital projects
(other funded projects this year include the new fire station and additional improvements to the
Sports Park).
RECOMMENDATION:
The staff and design committee recommend that the Council approve an agreement between the
City of Owasso and Holmes Architectural Services, Inc in an amount not to exceed $10,500 for
the purposes outlined in the attached scope of services, and that the Mayor be authorized to
execute such document.

construction of the renovation of the three truck bays now occupied by the Fire
Department. The approximate area is 50' X 60' or 3000 Sq Ft.

3. COMPENSATION
Compensation shall be on an hourly basis not to exceed $8,000.00.
Hourly rate basis at:
Principal $55.00
Architectural /Engineering $35.00/$45.00
Drafting $30.00/$40.00

B. MASTER PLAN
1. SCOPE OF WORK
Provide space planning for the first and second floors of the existing City Hall.
The approximate area is 4,000 sq ft per floor.
2. COMPENSATION
Compensation shall be on a lump sum fee basis of $2,500.00.
C. Additional work not included in this Scope of Work will be billed at an hourly rate or
quoted on a lump sum basis. Such work may include:
1. Printing in excess of two sets
2. Revisions after work completion
II. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors and assigns.
III. This instrument contains the entire Agreement between the parties, and no statement,
promise or inducement made by either party, or the agent of either party, that is not
contained in this written Contract shall be valid or binding.
IV. This Agreement shall not be enlarged, modified or altered except in writing, signed by the
parties and endorsed hereon.
V. This Contract shall be governed by the laws of the State of Oklahoma both as to
interpretation and performance.
