MINUTES OF REGULAR MEETING ~ Tuesday, April 20, 1993 ' The Owasso City Council met in regular session on Tuesday, April 20, 1993 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p. m. on Friday, April 16, 1993. ITEM l: CALL TO ORDER ' Mayor Marlar called the meeting to order at 7:00 p. m. ITEM 2: PRESENTATION OF ESSAY, "WHAT AMERICA MEANS TO ME" ' WINNER OF OWASSO SERTOMA CLUB'S NATIONAL HERITAGE MONTH ESSAY CONTEST ~ Mayor Marlar introduced Jimmy Barrows, a student at Owasso Middle School. Mr Barrows read his winning essay. Cindy and Tim Barrows, Jimmy's parents, were also present. ITEM 3: FLAG SALUTE .r ' Brownie Troop #184 posted the colors and led the flag salute. Participants were Jamie Gittelman, Susan Helf, Megan Knebel, Allison Phillips, Amy Yeldell, & Marie Bear. Troop #184 is led by Robbie Gittelman & Patty Helf. Bob Randolph moved, seconded by John Phillips, to approve the minutes, by reference made a part hereto. AYE: Randolph, Phillips, Smalley, Gittelman, Marlar NAY: None Motion carried 5-0. ITEM 6: REOUEST APPROVAL OF THE CLAIMS John Phillips moved, seconded by Bob Randolph, to approve the following claims as submitted: (1) General Fund $19,312.34; (2) Workers' Compensation Self-Insurance Plan $4,319.97; (3) Ambulance Service Fund $362.68; (4) E-911 $1,742.44; (5) Capital Improvements $14,000.00; (6) City Garage $1,277.97; (7) General Fund Payroll $85,087.77; (8) City Garage Payroll $3,394.56. It was noted that the actual amount of the Treasurer's transfer from the April 6, 1993 Council meeting was $225,578.49. At that meeting the transfer was approved in an amount not to exceed $260,000. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR BUDGET AMENDMENTS TO THE FY 1992-93 ANNUAL OPERATING BUDGET. Ms Bishop requested the following amendments to the operating budget: increase General Fund revenue by $41,662 in the "reimbursements and refund" line item; decrease appropriations in the Court Department by $4,100; increase appropriations in the Police Department by $25,500; increase appropriations to the General Government Department by $14,262; increase appropriations to the Swimming Pool Department by $6,000; decrease appropriations to the Street Department by $18,100; increase appropriations to the Garage Department by $18,100; and increase transfer from General Fund to Garage Fund by $18,100. The total revenue & transfer increases in the amount of $59,762 and the total request for expenditure increases in the amount of $59,762 result in a new effect on the budget bottom line of $0.00. Jim Smalley moved to approve the budget requests as recommended. ITEM 8~: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A MANAGEMENT AGREEMENT BETWEEN THE CITY OF OWASSO AND THE YMCA OF GREATER TULSA INC ^ Mr Compton discussed the management contract between the YMCA of Greater Tulsa and the City of Owasso for the management of the pool operations. The YMCA will provide management services for the complete operation of the pool and will receive the net cash receipts derived from the operation of the pool and expanded program. The City will provide supplies, maintenance, and capital outlay expenditures. John Phillips moved to approve the management ~ contract with the stipulation that an evaluation of the program be conducted at the end of the first year, with a report to the Council. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE EXPENDITURE OF FUNDS FOR THE REPAIR OF THE MUNICIPAL POOL. Mike Knebel presented a list of four repairs and necessary tests needed to determine the integrity of the existing filer system at the pool. Quotes were received from several vendors, with the following recommendation being made by staff: purchase wafer valves and an internal splash plate from United Industries Inc, Wichita, KS at a cost of $875; purchase replacement media for the existing filter vessel from Arkola Sand & Gravel in Fort Smith, AR at a cost of $456.60; and $4100 to Atlas Utility Co, Tulsa, OK to include purchase and installation of piping and valves. John Phillips moved to approve the expenditures as listed in the agenda. Motion was seconded by Bob Randolph. AYE: Phillips, Randolph, Smalley, Gittelman, Marlar NAY: None Motion carried 5-0. 3 ii Owasso City Council April 20, 1993 ITEM 1 ~QNSIDERATION AND APPROPRIATE ACTION RELATING TO THE RENEWAL OF AN AUDIT CONTRACT BETWEEN THE CITY OF OWASSO AND STANFIELD & O'DELL INC. Ms Bishop presented this item. By City Charter, the Council must designate an accountant to make an independent audit of all accounts and financial transactions of the city. Stanfield & ~ O'Dell served as auditors for the city for the fiscal year ended June 30, 1992. In July of 1992 they proposed to provide audit services to the city for three fiscal years, renewable at the option of the city. The fee is $13,000 plus expenses not to exceed $500 for each of the three years. Staff recommended renewing the contract with Stanfield & O'Dell, P.C. for the purpose of a conducting an independent audit for the fiscal year ended June 30, 1993 for a fee not to exceed $13,500. Jason Gittelman moved to approval renewal of the contract per staff recommendation. Motion was seconded by John Phillips. AYE: Gittelman, Phillips, Randolph, Smalley, Marlar NAY: None Motion carried 5-0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ADOPTION OF A 1993-94 CAPITAL IMPROVEMENTS PLAN. ' The report of the Capital Improvements Committee for FY 1993-94 was presented to the Council at the April 6 meeting. It included committee recommendations for approval of an updated project list, revenue projections, and funding allocations. Bob Randolph moved to adopt the CIP report as the 1993-94 Capital Improvement Plan and to direct the staff to include the committee recommendations in the 1993-94 annual budget. Motion was seconded by John Phillips. AYE: Randolph, Phillips, Smalley, Gittelman, Marlar NAY: None Motion carried 5-0. 4 Owasso City Council . ~ .xs April 20, 1993 ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A CONTRACT FOR PURCHASE OF REAL PROPERTY BETWEEN THE CITY t OF OWASSO AND BETTY AND HAYWARD SMITH AND AUTHORIZATION OF PAYMENT BY THE CITY OF OWASSO PURSUANT TO AGREEMENTS BETWEEN THE CITY OF OWASSO. DEPARTMENT OF ' TRANSPORTATION. AND BETTY AND HAYWARD SMITH At the February 16, 1993 meeting, the City Council authorized the staff to initiate all necessary ~ documents and negotiations to finalize the acquisition of property for the location of a fire station facility. That directive has been accomplished with the following agreements being reached: 1. Mr Smith will convey 1.2 acres by warranty deed and .4 acres with quit claim deed (the ~ building will be located on the 1.2 acres, thus our requirement for the warranty deed for that portion of the property). 1 2. The remaining right-of--way property south of the fire station will be used to retain storm water from both the City property and Mr Smith's property and will remain as public ' right-of--way held by DOT. 1 1 1 1 1 1 3. The City will pay Betty and Hayward Smith a total of $5200. 4. The City will extend water and sewer service to the northern line of the property. 5. The City staff will support annexation of all of the property into the corporate limits of Owasso. 6. The City staff will support a rezoning of all of the property from "AG" to "CG" classification. 7. Mr Smith will grant a drainage easement to the City. Council discussed title insurance, with the City Attorney recommending that title insurance be acquired. John Phillips moved to approve the purchase contract with Mr & Mrs Smith, to authorize the City Manager and City Attorney to execute the document and close the purchase, that payment in the amount of $5200 be authorized to Betty and Hayward Smith, and that management acquire title insurance before proceeding. April 20, 1993 ITEM 13: REPORT FROM CITY MANAGER Mr Ray expressed appreciation to Mayor Marlar and Vice-Mayor Gittelman for their years of service to the community. Both are retiring from the Council. ITEM 14: REPORT FROM CITY ATTORNEY No report. ITEM 1 UNFII~IISHED BUSINESS None. ITEM 16: NEW BUSINESS Councilman Smalley announced his intent to resign from the Council effective May 20, 1993. He has sold his residence and will be moving from Ward 5. ITEM 17: ADJOURNMENT Jason Gittelman moved, seconded by Jim Smalley to adjourn. CATES CITY ATTORNEY SUBJECT: SELECTION PROCESS FOR FII.LING VACANCIES ON CITY COUNCIL DATE: APRIL 29, 1993 BACKGROUND: On April 20, 1993, during a regular meeting of the Owasso City Council, Councilor James Smalley notified the Council, in writing, of his intention to resign his position on May 20th two days after the Council meeting on May 18, 1993. Upon receiving that notification, the Council directed the staff to research the proper method(s) for filling Council vacancies and to submit a recommendation for such to the Council at the May 4, 1993 meeting. The staff s research of this issue indicates that authority for the Council to fill vacancies in its ~ membership is found in two places. 1) The Charter, Section 2-10 (page C-7), provides that the Council "by majority vote of its remaining members, shall fill vacancies in its own membership for the unexpired term(s), or until successors are elected...". 2) Additionally, 11 O.S., Section 8-109, provides that "when a vacancy occurs in an office of an elected municipal official... the ~ governing body shall appoint... a person to fill the vacancy until the next general municipal election... Any vacancy shall then be filled at the next general municipal election... by election of a person to complete the balance of the unexpired term. If the vacancy has not been filled within sixty (60) days after it occurs, the governing body shall call for a special election... for the purpose of filling the vacancy for the duration of the unexpired term.... " OPTIONS: Based upon this research, it appears that the Owasso City Council may utilize one of the following options to address a vacancy in its membership: SELECTION PROCESS APRII. 26, 1993 PAGE TWO Option #1 - A vacancy may be filled by a vote of the City Council to name a successor to a Councilor who has resigned or otherwise left the office vacant, provided such action is approved by a majority vote of the remaining members (not a majority of those present). If this alternative is utilized, the successor is selected to serve only until the next scheduled municipal election. Option #2 - The Council may call a special election for the purpose of filling a vacancy provided that such special election must be held more than 120 days prior to the beginning of the filing period for the next general municipal election. In the event of such election, the successor is elected for the balance of the unexpired term. Option #3 - Take no initial action for a period of sixty days, then, either comply with the law by calling a special election or await a legal action requiring the call of an election. COMMENTS FROM THE CITY MANAGER: The following comments are from the City Manager and reflect observations developed after legal consultation. 1. Over the past several years the Council and staff have worked to institutionalize those processes that are used on a reoccurring basis. The reason for such a philosophy is to establish a rational process that will help to ensure consistency in the business of governing. By establishing a clearly defined policy that outlines the process for filling a Council vacancy, the chances are that such policy will become the naturally accepted method of addressing that issue each time such action is necessary. Therefore, each time a successor is selected, the community will come to expect use of the same process and will have some assurance that each vacancy is dealt with in the same manner and consistent with the laws governing those actions. Such policies also tend to discourage political manipulations for advantage of one person or special interest group and work to encourage a "level playing field" . 2. Option #2 and #3 have associated costs. Option 2 would require an expenditure of approximately $4,000 (estimate) to pay election expenses incurred by the County Election Board. Option #3 would incur both legal costs and ultimately, the same election costs as option #2. 3. It should be noted that Option #1 requires the Council to make the final decision relative to selecting a successor and that such decision may be accompanied by a certain level of disharmony between Councilors as well as between the Council and certain interest groups or individuals. While there is no "cash" cost associated with this method, there is a risk in terms of how the decision made by the Council will impact other decision-making processes and relationships. -..- .,. SELECTION PROCESS APRII, 26, 1993 PAGE THREE RECOMMENDATION: The staff recommends that the Council adopt the attached policy relating to the filling of vacancies in its membership. ATTACHMENTS: 1. Section 2- I I Counci f: avorum. rules. yeas and nays. A majority of all of the members of the council shall constitute a quorum, but a smaller number may adjourn from day to day or from time to time. The council may determine its own rules. On the demand of any member, the vote on any question shall be by yeas and nays, and shall be entered in the journal. Section 2-12 Ordinances: enacting clause. The enacting clause of all ordinances passed by the council shall be, "Be it ordained by the Council of the City of Owasso, Oklahoma", and of all ordinances proposed by the voters under their power of initiative, "13e it ordained by the People of the City of Owasso, Oklahoma". Section 2-13 Ordinances: passage, when in effect. Every proposed ordinance shall be read, and a vote of a majority of all the counci Imen shall be required for its passage. The vote on final passage of every ordinance shall be by yeas and nays, and shal{ be entered in the journal. The mayor shall have no power of veto. Within ten days after its passage, every ordinance shall be published in full or by number, title, and brief gist in a newspaper of general circulation ~ within the city. Every ordinance except an emergency ordinance, so published, shall become effective thirty days after its final passage unless it specifies a later time; provided that a franchise for a public utility shall not go into effect until the ordinance granting it has been published in full in a newspaper of general circulation within the city and has been approved at an election by a vote of a majority of the qualified 'r' electors voting on the question. Section 2-14 Ordinances: emergency. An emergency ordinance is an ordinance which in the judgment of the council is necessary for the immediate preservation of peace, health, or safety, and which should s 3ECTION 8-107. REMOVAL OF OFFICERS A municipal elected official may be removed from office for any cause specified by applicable state law for the removal of officers, and by the method or methods prescribed thereby. SECTION 8-108. ABSENCE FROM GOVERNING BODY MEETINGS Whenever a member of the municipal governing body is absent from more than one-half of all meetings of the governing body, regular and special, held within any period of four (4) consecutive months, he shall thereupon cease to hold office. SECTION 8-109. VACANCIES IN OFFICE A. when a vacancy occurs in an office of an elected municipal official except the mayor, the governing body shall appoint, by a majority vote of the remaining members, a person to fill the vacancy until the next general municipal election, or the next biennial town meeting if the municipality is subject to the Oklahoma Town Meeting Act, Section 16-301 et seq, of this title, and to serve until a successor is elected and qualified. Any vacancy shall then be filled at the next general municipal election or biennial town meeting by election of a Berson to complete the balance of any unexpired term. if the vacancy has not been filled within sixty (60) days after it occurs, the governing body shall call for a special election or a special town meeting for the purpose of filling the vacancy for the duration of the unexpired term unless said vacancy occurs or said election would occur within one hundred twenty (120) days prior to the first day of the filing period for the next general municipal election or within one hundred twenty (120) days prior to the next biennial town meeting. If a vacancy is not filled by the special election or at a special town meeting, it shall be filled by appointment as provided for in this subsection. 9. If a majority of the offices of a governing body become vacant more than s ixty ( 50 ) days before the beginning of a regular filing period for general municipal elections or more thar. sixty (50) days before the biennial town meeting, the remaining members of the governing body shall call for a special election or a special town meeting, if the municipality is subject to the Oklahoma Towr. Meeting Act, to be held as soon as possible in the 8-3 II 1 OFA880 CITY COIINCIL POLICY STATEMENT It shall be the Policy of the Owasso City Council to fill vacancies in its membership, when such vacancies occur after the close of a regular filing period for candidates for Council and the unexpired term of the vacancy extends beyond the time when the terms for Council members elected that year begin, utilizing the following process: Section A - A vacancy in the Council membership shall be declared by the receipt of a properly submitted resignation from a member of the Council in writing setting forth an effective date, or by a vote of the Council if such vacancy is caused by appropriate Council action pursuant to law; or by a vote of the Council if such vacancy is otherwise created wherein such written resignation is not received but an obvious vacancy is created. Section B - Upon declaration of a vacancy, as described in Section A(above) the Council shall, by majority vote instruct the City clerk to cause to be published in a newspaper of local circulation a notice of such vacancy and a request for persons interested in being considered as candidates to fill the vacancy to file "letters of interest" with the Clerk during ~ an established ten-day acceptance period, such period to begin no later than five days after publication of the notice of vacancy. Section C - The notice of vacancy shall be written and published „r in a manner to communicate, at a minimum, the following information: ~ 1. The number of the Ward(s) wherein the vacancy has occurred. 2. A map of the Wards of the City and a general ~ description of the political boundaries of the Ward(s). '~ 3. A statement of qualifications as stated in Section 2-1 of the Owasso City Charter. 4. The address of the City Clerk and the manner of marking the envelope containing the "letter of interest". Section D - 5. The beginning date and ending date and ending time that "letters of interest" are to be accepted. 6. A request for information relative to the address of the interested citizen, the voting precinct of the interested citizen, and any other information the interested citizen should wish to include in their submittal provided however that such submittal shall not exceed ten total pages of standard 8 1/2" x 11" size paper or copies. 7. A tentative date, established by the Council, for action on filling the vacancy to be taken as an agenda item of the City Council, notice to clearly state that such date is tentative and, due to various reasons, could be altered to a later date. In all cases wherein the initial determination by the Clerk or designee is that the listed address is not within the Ward which has been declared to be vacant a follow-up verification by the City Planner or designee is required before such is noted on the "letter of interest". Section F - Upon completion of the requirements of Section E the City Clerk or designee shall cause to be made duplicates of the submittal in the exact number as of the remaining Council members and in as exact form as possible. Each submittal shall be bound in a manner to insure the integrity of the submittal, but in no event shall any changes be made in the manner of the submittal presentation that would enhance or detract from the original submittal. Section G - The City Clerk or designee shall, at the close of r business (S:OOpm) each day during the ten day acceptance period deliver to the remaining Council members all submittals received during that day. In no event shall any submittal be delivered to any Council member on any date other than the date the submittal is received. Provided, however, that in the event a remaining Council member has notified the City Clerk that the delivery of submittals to him/her received on a certain day should be delayed due to his/her request, such request to be noted in the master file maintained for each vacancy. The original of each submittal shall be retained by the Clerk/clerk designee in a master file containing all notices, documents, publications, notes, and submittals of the selection process from its inception. ~ Section H - The Council shall direct the City Manger to place an ~ item on the Council agenda for action within fifteen days of the date of the close of accepting "letters of interest". In the event actual action on the item is not taken by the Council, such item shall either be continued to a date specific or shall be continued to the next regularly scheduled Council meeting. RAY CITY MANAGER SUBJECT: REQUEST FOR APPROVAL OF CONTRACT BETWEEN THE CITY OF OWASSO AND F.O.P. LODGE #149 DATE: APRIL 29, 1993 BACKGROUND: ~ On March 2, 1993 the Council authorized the City Manager to conduct labor contract negotiations with the F.O.P. and I.A.F.F. pursuant to the laws governing such negotiations. At that time the Council also established parameters for those negotiations. This year the only parameter set by the Council was a directive to contain salary increases to a total of 3.5 % (of ~ current personnel costs). Negotiations have now been concluded with F.O.P. Lodge #149 representing the certified police officers employed by the City of Owasso. A tentative agreement has been reached between the negotiators and, in fact, that agreement has been ratified by a vote of the lodge ~ The tentative agreement gives salary increases totaling 3.7% over current personnel cost levels. While that increase is .2 % more than the established parameters, it is the staff's opinion that the extra cost was well spent in that we were able to "buy" some language out of the contract that we had tried to get removed for the past three years. Additionally, there is language in the new ,~ contract that "re wires" a reopener of negotiations in January, 1994 for the sole purpose of discussing the use of a 28-day work period (such change, if approved, will have significant ~ benefit to the City in terms of the ability to manage). The total new cost of the proposed contract is $23, 818.24 or an increase of 4.02 % . The ' difference between the cost of the salary increase and the total cost takes the form of; 1) increased health insurance cost, 2) increased pension contribution required by state law, 3) increased cost of supplemental retirement due to salary increases, and 4) increased holiday pay ' cost due to salary increases. A spreadsheet has been attached indicating the specific cost of the APPROVAL OF F.O.P. CONTRACT ' APRIL 29, 1993 PAGE TWO contract. Please note that the negotiated salary increases vary from 3 % to 5 % within the department and that probationary employees automatically receive increases upon completion of one year of service (after certification). i Overall, this contract continues the steps initially established over five years ago in the City's salary enhancement program. I believe the contract is one that benefits both the employee (with ~ higher wages) and the City (by removing adverse language). The City staff and F.O.P. negotiators worked diligently to quickly conclude the negotiation process. Appreciation is due to the F.O.P. negotiation team and the staff team that worked together to produce a quality contract in a very professional manner.
