Amending a Previously Adopted Ordinance (#53) Relating to the Vacation of Right -of-
Way Between Blocks 9 & 10 of Greenlee's Addition.

14. Consideration and Appropriate Action Relating to a Request that the Staff be Authorized
to Develop Documents to Present to the City Council Providing for a Conditional Grant
to the Owasso Public Golf Authority in the Amount of $400,000, Such Grant to be
Returned to the City of Owasso in Addition to Interest Payments as Required by the
Grant Documents.

Staff has developed a concept for presentation to the Council regarding an investment
policy that will produce a higher yield on invested funds. Staff will recommend that the
Council authorize the staff to develop documents relating to such concept for presentation
to the Council at the June 1, 1993 meeting.
15. Consideration and Appropriate Action Relating to a Request to Designate the Mayor as
the City's Certifying Officer as Provided for by the National Environmental Policy Act
for the Purpose of Signing Certain Documents to Complete the Requirements of the Max
Buchanan CDBG -ED Grant, Project #5252.

16. Consideration and Appropriate Action Relating to a Request that a Finding of "No
Significant Impact on the Environment" Will Occur as a Result of the Max Buchanan
Project #5252 CDBG -ED92.

Staff will recommend that the Council approve the INCOG report and finding of no
significant impact on the environment as a result of the Max Buchanan project and that
the Mayor be authorized to execute such document.
17. Consideration and Appropriate Action Relating to a Request for a Finding by the City
Council that Administrative and Engineering Services Relating to Project #5252 CDBG-
ED92 (Max Buchanan Infrastructure Grant) are Exempted from the Requirements of the
National Environmental Policy Act of 1969 Due to the Nature of These Activities and
in Accordance with "24 CFR, Part 58 ".

Engineering services from the requirements of an environmental impact study and that
the Mayor be authorized to certify such exemption.
18. Consideration and Appropriate Action Relating to a Request for Council Authorization
for the Mayor to Execute an Environmental Certificate for Project #5252 CDBG -ED92
(Max Buchanan Infrastructure Grant).

' Tuesday, May 4, 1993
The Owasso City Council met in regular session on Tuesday, May 4, 1993 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, April 30, 1993.

FMayor Marlar called the meeting to order at 7:00 p.m.

City Attorney Ron Cates administered the Oath of Office to Ms Barnhouse and Mr Burris and
they were seated at the Council bench.
Councilmember John Phillips presented a placque to retiring Mayor and Councilmember Patricia
Marlar in appreciation for her six years of service to the citizens of Owasso.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ADOPTION OF A POLICY PROVIDING FOR VACANCIES IN THE
MEMBERSHIP OF THE CITY COUNCIL
Mr Cates and Mr Ray presented this item as the result of the expressed intention of a
councilmember to resign his position, thereby creating a vacancy on the Council. Several
options were discussed. Charles Burris moved to adopt the policy statement attached to, and
made a part of, these minutes. Motion seconded by John Phillips.

REPRESENTATIVES OF GROUPS OF EMPLOYEES PURSUANT TO TITLE
25 O.S.. SECTION 307 -B(2).

DRAINAGE DITCH PARALLEL TO FORREST DRIVE

BACKGROUND
On Tuesday, May 11, the attached letter was delivered to City Hall by Ms Patricia Marlar on
behalf of the other signatories. Ms Marlar indicated that the people who signed the letter were
intent on addressing the Council, and requested that a Council agenda item be developed in order
that the three people may have such an opportunity. On Wednesday, May 12th, I called Ms
Marlar for the purpose of suggesting that an appropriate first step would be for the three citizens
to meet with me and other staff members for the purpose of discussing their concerns. Ms
Marlar was of the opinion that the goal of the three was to get the Council's attention because
there was evidently some reluctance on their part to accept commitments from the City Manager
relative to their concerns. Evidently there is some concern that the Council would not
understand the level of seriousness they attach to their problem, and they are afraid that the
Council will not grasp the full problem without a face -to -face meeting. Additionally, Ms Marlar
stated that they had tried to get in touch with members of the Council, and with the City
Manager to discuss the matter, but were unsuccessful in reaching the Council or in getting a
meeting with the City Manager. (While I'm not aware of attempts to reach to Council members,
I do know that Marcia received one call from Ms Wampole and offered to set a meeting for us
to discuss her concerns.)
It is my understanding that these citizens wish to make the Council aware of the fact that the
drainage ditch that parallels Forrest Drive was full of water during the past few days, and that
there should be some effort made to ensure funds are available to make improvements to the
ditch in the upcoming budget. There apparently is also a concern that the City does not properly
mow the drainage area. Those indications were from my conversation with Ms Marlar and may
not be inclusive of their concerns.

1. Last year we implemented a regularly scheduled mowing program for this area in
response to concerns voiced by homeowners early in the Spring. This year we have made plans
to privatize the mowing of that area after discussions with Councilor Barnhouse about the need
for more regular mowing. '
2. It is the intent of the staff to present a budget proposal that includes an allocation of
resources to a long term, multi -year channel improvement program for the drainage ditch south '
of Fourth Street. Because budget figures are not yet finalized, it is premature to commit to a
specific budget amount, and we have not completed a prioritization of drainage projects at this
point.
RECOMMENDATION
The staff recommends that the Council instruct the staff to meet with the citizens for the purpose '
of discussing in detail their concerns and developing additional recommendations for addressing
those concerns.

Solicitation of Bids
DATE: May 10, 1993
BACKGROUND:
The staff has completed the contract documents and bid specifications for the asphaltic concrete
paving of the West 26 feet of the existing entrance road to the Owasso Sports -Park.
The gravel base has been laid and compacted since the Sports -Park dedication in April of 1992.
Therefore, very little work is needed to get the surface prepared for the asphaltic surfacing that
is requested.
The specifications for the contract is for 4" of asphaltic concrete Type "A" for the entire length
of the entrance road from 116th Street North, Southerly to the entrance of the parking area.
Only 26 feet will be paved leaving the remainder to do at a later date. The staff feels that the
Westerly portion should be done first, then the East or remaining part at a time in the future.
Having only a part of the entrance road completed now allows us to provide adequate access for
current park usage and saves us up front cost. It will also allow the flexibility to expand the
road as the overall plan of the Sports -Park is completed and additional usage
occurs.
Using the Type "A" asphaltic concrete will allow traffic flow and at the same time cut down on
the significant dust winds that are presently existing. Once the entire entrance road has the initial
base of Type "A ", the city can come back at a later date and provide the final wearing surface
of possibly 2" of Type "C" or "B" asphaltic concrete.
SCHEDULE:
It is anticipated that the following schedule can be met provided the City Council agrees to allow
the staff to proceed. The schedule is as follows:
Go to City Council to authorize solicitation on 5 -18 -93
Out for public bidding on 5 -20 -93
Bid opening on (after 21 days) 6 -10 -93
Go to City Council for award on 6 -15 -93
Award the contract on 6 -16-93
Begin construction on 6 -21 -93
Anticipated construction completion on 6 -30-93
COST:
The initial proposed cost estimate was done around March of 1993 and was based on the City
providing the asphaltic concrete (26 feet wide and 4" thick) and the contractor providing the
labor and equipment. The proposed approximate cost breakdown is as follows:
estimated cost for labor and equipment by contractor $6,300.00
estimated cost of materials (based on 1400 tons Q $14.50 /ton) $20,300.00
total: $26,600.00
The above costs are reflective of current prices from the local plants in Tulsa County.
RECOMMENDATION:
The staff recommends authorization from the City Council to begin the process of soliciting bids
for the asphaltic concrete paving of the Owasso Sports -Park entrance road.

BACKGROUND
The Tulsa Youth Services Project Safe Place was established in order to give troubled teenagers in the
greater Tulsa area a place to go when they need help. Safe Place operates a shelter in downtown Tulsa
that gives teenagers a place to go. Safe Place offers counselling for both the teenager and their
families. Teenagers may come to the Safe Place to help them with any kind of trouble that they may
be having.
Some of the most common problems addressed by the Safe Place Program are: runaways, substance
abuse, physical abuse and suicide. Safe Place is designed to make crisis intervention and counselling
available. When a young person goes into a Safe Place and asks for help, an employee will call Youth
Services. The Youth Services staff will then phone a trained volunteer who will immediately go to the
Safe Place to assist the youth. The volunteer will either wait with the child until a parent arrives,
transport the child home or to the shelter, or take other appropriate action.
The Owasso Firefighters approved to work with the Safe Place Program in a Union Meeting. The
Firefighters thought that this would be a good program to help the young people of our community.
Tulsa Youth Services provides all the needed training and materials to the Safe Place (Owasso Fire
Department). Two Firefighters from each shift will be selected to be trained as a Safe Place volunteer.
The program will be started early this summer after the Firefighters have been trained. When the
appropriate training has been done, Tulsa Youth Services will install a two foot by two foot diamond
shaped sign on the outside of the fire station to identify the Owasso Fire Department as a Safe Place.
The Owasso Police Department was informed on the program and have advised us they would support
the Safe Place Program.

PROJECT SAFE PLACE
PURPOSE: This operating procedure contains guidelines and
information on the Tulsa Youth Services, Project
Safe Place.
OBJECTIVE: To insure that teenagers utilizing the Safe Place
Program are handled correctly and that the
emergency operations of the Fire Department are
not compromised.
PROCEDURE: Teenagers needing assistance and wanting to
utilize the Safe Place Program will be assigned to
a firefighter /medic by the on duty officer. Tulsa
Youth Services will be notified and will send a
volunteer councellor to the Fire Station.
I. Assignment of Firefighter /Medic
The Firefighter /?Medic assigned to the teenager
must have received training from Tulsa Youth
Services as a Safe Place Volunteer.
A. The Firefighter /:Medic shall take the teenager
to an area in the fire station that will
offer the teenager privacy and will not
interfere in the operations of the station.
II. Call in of Volunteer Firefighter
A. The on duty officer shall call in a volunteer
firefighter /medic to assure that there is not
a loss of available manpower should an
emergency- or fire call come in.
B. The volunteer will respond to the alarms
only. The paid firefighter /medic will remain
with the teenager.
III. Notification of the Owasso Police Department
A. Owasso Police Department will be notified
that a teenager is in the fire station
requesting help. This is to insure in the
case of an emergency, the teenager can be
accounted for.
B. An�-time that the teenager, teenager's family,
or teenager's friends become violent or the
firefi -,hter /medic feels that the incident may
become hostile, Owasso Police -'Department must
be contacted.

Notification of Tulsa Youth Services
A. The firefighter /medic will contact the Tulsa
Youth Services and advise them that there is
a teenager requesting to use the Safe Place
Program.
B. Tulsa Youth Services will give the
firefighter /medic the following information
about the volunteer they are sending:
1. Name
2. Age
3. Social Security- Number
4. Type of vehicle
5. Estimated time of arrival
Transfer of teenager to Tulsa Youth Services
A. If the Tulsa Youth Services volunteer does
not present all of the needed information,
the teenager will not be allowed to go with
the volunteer. Also, Owasso Police Dept. and
Tulsa Youth Services will be notified. '
B. If the volunteer from Tulsa Youth Services
has all the needed information, and the teen-
ager is still wanting to use the Safe Place '
Program, the firefighter /medic will turn the
teenager over to the Safe Place volunteer.
Age Requirements
The Safe Place Program is designed to help kids ,
from the ages of 12 years to li years old.
A. Tulsa Youth Services will direct the teenager
over age 11 to other agencies.
B. Any child under age 12 requesting help should
be directed to the Owasso Police or Tulsa
Youth Services will help them with another
agent, .
Special Circumstances
in case the firefighter /medic feels that the
teenager is in danger or that an angry parent/
family member is in the station, Owasso Police
must be notified.

Dear Chief Allen:
SAFE PLACE is a project of Youth Services of Tulsa to
provide neighborhood access for teens who need help.
Until November, 1992, all SAFE PLACES had been QuikTrip
stores. As of December all fire stations in Tulsa also
became SAFE PLACE locations. Recently, the Jenks fire
stations became a SAFE PLACE location. QuikTrip provided
money, in -kind donations of printing and video
development, and employee time to ensure the
implementation of the program. Youth Services of Tulsa
is asking the fire stations of Owasso to also become a
SAFE PLACE.
The statistics show SAFE PLACE has been effective in
teens getting help when they need it. Most often the
teen has a home situation that dictates that he or she
find a place which is safe until the problem at home is
resolved. Approximately 168 youth have asked for help at
a SAFE PLACE since the inception of the program in March
of 1991. Each SAFE PLACE location has had no more than

Youth Services has presented information to more than
14,000 middle school and high school age children which
enables them to access services and to avoid becoming a
victim of abuse or violence.
The process is simple. The teen enters a designated Safe
Place and tells the person in charge that they need help.
The designated person in each place will see that the
child is in a secure place and call the Youth Services of
Tulsa's shelter. The shelter will assess the situation
and send a trained volunteer to transport the youth to
the Youth Services of Tulsa's emergency shelter. The
only responsibility for the SAFE PLACE location is to
provide a place for the teen to wait until the volunteer

can get to the location. As coordinator of the program,
I will provide the necessary training to personnel in the
locations designated.
I am enclosing the SAFE PLACE brochure and a brochure
about Youth Services. There are 74 volunteers available
to transport youth, and the personnel at the SAFE PLACE
site has access to trained personnel at our shelter at
any time.
I am looking forward to working with you to establish a
second SAFE PLACE location for teens in Owasso.

DISCLAIMER OF INTEREST

BACKGROUND
The City has been served as a co- defendant in a legal action wherein the U.S. Department of
Housing and Urban Development is seeking foreclosure on property owned by LaDonna E
Daniels and a John Doe. The HUD routinely includes the City and utility providers as
defendants because of the possibility that there may be either special assessments against the
property by the City, or easements granted to utility providers. Additionally, the County
government is generally named for the same reasons.
The staff has reviewed the property files for any City special assessments and, finding none,
referred this matter to the City Attorney for his review and recommendation. The City Attorney
has recommended that a simple "disclaimer of interest" be filed with the District Court, thereby
removing us from further direct involvement in the matter. The disclaimer is a document that
simply states that the City has no claim against the property and no interest in the property in
any form. Such filing effectively removes the City from the legal action and allows the matter
to continue without further involvement from the City.
It should be noted that we are expecting several more of these types of cases from HUD.
Evidently the agency is in the final stages of a major foreclosure program in Tulsa County. Mr
Cates has visited with HUD attorneys and has discovered that they are proceeding with these
actions on an alphabetical basis. In an effort to make the entire process more efficient and less
burdensome for each of the area cities, Mr Cates has recommended that HUD group its
foreclosures by City rather than alphabetically. Such an approach would allow each city to take
care of the problem at one time with a single allocation of resources rather than the "one -at -a-
time" approach now used. HUD attorneys have agreed that there is some merit in Mr Cates
suggestion and have indicated their position would be to implement such an approach in future
cases. The bottom line is that there will be more of these actions.

OWASSO AND F.O.P. LODGE #149

BACKGROUND:
On March 2, 1993 the Council authorized the City Manager to conduct labor contract
negotiations with the F.O.P. and I.A.F.F. pursuant to the laws governing such negotiations.
At that time the Council also established parameters for those negotiations. This year the only
parameter set by the Council was a directive to contain salary increases to a total of 3.5 % (of
current personnel costs).
Negotiations have now been concluded with F.O.P. Lodge #149 representing the certified police
officers employed by the City of Owasso. A tentative agreement has been reached between the
negotiators and, in fact, that agreement has been ratified by a vote of the lodge.
The tentative agreement gives salary increases totaling 3.7% over current personnel cost levels.
While that increase is .2% more than the established parameters, it is the staff's opinion that the
extra cost was well spent in that we were able to "buy" some language out of the contract that
we had tried to get removed for the past three years. Additionally, there is language in the new
contract that "requires" a reopener of negotiations in January, 1994 for the sole purpose of
discussing the use of a 28 -day work period (such change, if approved, will have significant
benefit to the City in terms of the ability to manage).
The total new cost of the proposed contract is $23,818.24 or an increase of 4.02 %. The
difference between the cost of the salary increase and the total cost takes the form of; 1)
increased health insurance cost, 2) increased pension contribution required by state law, 3)
increased cost of supplemental retirement due to salary increases, and 4) increased holiday pay
cost due to salary increases. A spreadsheet has been attached indicating the specific cost of the

contract. Please note that the negotiated salary increases vary from 3 % to 5 % within the
department and that probationary employees automatically receive increases upon completion of
one year of service (after certification).
Overall, this contract continues the steps initially established over five years ago in the City's
salary enhancement program. I believe the contract is one that benefits both the employee (with
higher wages) and the City (by removing adverse language). The City staff and F.O.P.
negotiators worked diligently to quickly conclude the negotiation process. Appreciation is due
to the F.O.P. negotiation team and the staff team that worked together to produce a quality
contract in a very professional manner. If you have questions or concerns about the contract

RECONUgENDATION:
The staff recommends Council approval of a contract between the City of Owasso and F.O.P.
Lodge #149 and that the Mayor be authorized to execute such document.

IBACKGROUND
' At 3:40 p.m. on Tuesday, April 27 I was informed by Fire Chief Bob Allen that one of our two
ambulances, "Medic One ", had been taken out of service due to a fuel system problem. The
' ambulance had been taken to Don Thornton Ford for an analysis of the problem and a cost
estimate of repairs. Chief Allen later received a call from the service department of Don
Thornton Ford informing him that a fuel injector pump had to be replaced for the vehicle to be
' operated. Further, Chief Allen was informed that the estimated cost of the repairs was $1200.
Chief Allen then contacted me with the information and a brief explanation of the situation and
said the ambulance service would be affected if one ambulance was not available for calls.
Generally, the loss of one ambulance results in the City's inability to adequately respond to
multiple injury accidents and a significant reduction in emergency response time if the first
' ambulance is already out on call. In both of those situations, a request for assistance would be
made to another ambulance service. Using another service results in response time increasing
to an unacceptable level.
Il Based on Chief Allen's information, I was faced with two options. First, I could have observed
the strict letter of the ordinances and simply put off the repairs until the next Council meeting
(seven days away) or order the repairs in violation of the authority given by the Council relative
to spending limits.
Given the nature of the repairs, the fact that the cost was very near the allowable spending level,
and what I considered to be an emergency, I opted to authorize the expenditure of funds in
excess of my spending authority. At 5:30 p.m. I signed a requisition and authorized the
' expenditure of $1200 in emergency repairs to Medic One (see attached).

It should be noted that a request for ratification is simply a method used to ensure that the
Council is aware of the situation and offer the opportunity for a denial of the action based on
the fact that such action is clearly in violation of the law.

BACKGROUND:
In 1964, property owners within Greenlee's Addition requested the closing of public right -of -way
it (Carlsbad Street) abutting their properties. Ordinance No. 53 was adopted by the Town of
Owasso to assist property owners in accomplishing this task, as it would be necessary for the
property owners to process this action through district court. This process never was undertaken
by the property owners.
Recently, a descendant of one of the original property owners felt it important to follow through
with this original request. Upon beginning that process, it was discovered that the original
ordinance, Ordinance No. 53, contained an error in the description of what was to be closed.
Ordinance No. 460 corrects this original error. In addition, Ordinance No. 53 also contained
an additional public right -of -way area to be closed, and this area is repeated again in Ordinance
No. 460. Staff has reviewed all areas to be closed and has no objections to the original requests.
Copies of Ordinance No. 53 and the area of right -of -way being closed are attached for your
information and review. If you have any questions whatsoever, please do not hesitate to contact
me.

SUBJECT: REQUEST FOR AUTHORIZATION TO DEVELOP LOAN
DOCUMENTS FOR LOAN TO THE OWASSO PUBLIC GOLF
AUTHORITY

BACKGROUND
The City of Owasso maintains 12 funds that currently have reserves or contain restricted monies
(money that can be spent only for a specific, designated purpose). During the past year these
funds have increased to a level that allows the City to begin making long -term investments that
' produce a higher interest income for the City. At the current level of $1,218,857, the staff is
convinced that there should be some effort to find an investment opportunity that would increase
the yield to the City. There has been, however, a real problem in finding such an opportunity
' due to low interest rates and legal restrictions on how public funds may be invested.
Based on a research of current City deposits, the staff has calculated that the average interest
rate is 3.2 % and that our maximum rate is 3.375 %. The simple fact is that investment rates are
very low and indications are that they will remain low for some time. Additionally, the
restrictions relating to required collateral for municipal investments makes it even more difficult
' to procure better rates for City money. For example, the law requires that every City dollar
placed in bank deposits be collateralized 100% by a pledge of government securities. (State Law
defines the class and character of acceptable securities that may be pledged.) This requirement
' makes municipal investments somewhat expensive to banks and results in interest rates lower
than those received by the individual investor (generally 1/2 % lower).
' In last year's audit, a comment was listed that was critical of the rates received on City
investments, even though the return was at a level consistent with normal rates during that
period. The staff immediately began exploring methods of increasing the yield on investments.
During that same period, there was a marked increase in the amount of money in the pooled
cash account referred to above. That increase resulted primarily from adding our Workers
Compensation self - insured fund and an increase in the General Fund Reserves. All of these
factors combined to give the City, for the first time in over ten years, an opportunity to use
pooled funds as long -term investments in an effort to increase interest revenues.
However, even though the City is finally at a point that allows for better investments, the market
interest rates are at such a low point that even the best municipal investment opportunities are
still yielding a maximum of only 3.7 %. (Treasury notes are currently listed at 3.21 % and
Murchison Investment Bankers is offering government backed investments for 3.41 % on a one
year commitment.) After exploring several opportunities, and discovering that our return on
investments was not going to be substantially different from using current methods, the staff
began to seek an alternative that would produce a higher yield in a depressed investment climate.
The result of that process was a suggestion that our City invest in a safe, revenue producing
project that would benefit the community and return a higher yield to the City. Initially, the
staff investigated the possibility of loaning money to the OPWA as a part of the recent five
million dollar water and wastewater loan. However, the interest rate available for the portion
of the loan that the City could have funded was lower than the rate currently available from
traditional deposits. The next alternative researched by the staff produced better results. The
Owasso Public Golf Authority was in the process of evaluating the sale of "completion bonds"
in order to raise additional funds for the golf course project and to provide cash for start-up of
the course.
It quickly became apparent that the City's need to produce a higher yield on investments and the
OPGA's need to procure funds to complete the golf course was a good match. The obvious
advantages for such a relationship prompted the staff to pursue the issue of a possible investment
of City dollars in the golf course, a community enhancement project.
After staff discussion and consultation with the City Attorney, the OPWA Financial Advisor
(Keith McDonald), and Bond Counsel (Alan Brooks), it was determined that there were no legal
barriers to prevent such a relationship nor would such a loan have an adverse impact on existing ,
bonds or indebtedness. There was, however, a recognition that the actual agreements required
for such an investment would require substantial legal and research work to ensure proper
safeguards for the invested dollars. Mr Cates, Mr Brooks, and Mr McDonald (Leo Oppenheim)
have agreed to work together to produce such an agreement should the Council wish to pursue
this arrangement.
CONCEPT
A
The Concept of this investment is based on the following factors and assumptions:
1. If the OPGA issues completion bonds, they would spend approximately $50,000 in
issuance cost and pay an effective interest rate of approximately 7.5 %.
2. The current average interest rate on City investments is 3.2% with a maximum potential
of 3.7 %.
3. No more than 40% of the pooled funds should be in long -term investments, thus a ceiling I
of $487,500 should be placed on those dollars in long -term investments.

' 4. Maximum loan be set at $400,000.
' 5. A City may not loan money, therefore the use of a "Conditional Grant" would be utilized
as the vehicle for the investment. Please note that the City has used this method in the
past to fund certain projects (OEDA, OPWA).
' 6. Recommended Grant conditions are:
' A. Interest rate of a minimum of 5.5 % to the City.
B. A portion of the loan proceeds to be immediately set aside to be used for first
OPGA bond payment due July 1, 1994.
C. Default on existing OPGA bond payment would be preceded by a notice to City
and opportunity for City to protect its investment through management control of
the Authority's assets (same as bondholders protection; default allows Trustee
' Bank to assume management control).
D. Interest only payments for first three years (FY93 -94, 94 -95, 95 -96), with interest
and principal payments beginning in fourth year and extending through a tenth
' year.
E. OPGA Trustees modify Trust indenture to provide for reduced Trustee terms
(now 15 years).
F. An early "call" on the debt allowed if City shows cause and after OPGA makes
other arrangements for replacement funding.
G. An early "pay -off' of the debt by the OPGA without penalty.
H. Sign -off on the Conditional Grant by Financial Advisor and Bond Counsel of
OPGA, OPWA, and City Attorney.
I. Access to OPGA financial records by City Representatives.
COMMENTS
1. It should be noted that there is some risk associated with an investment of this nature.
The loan will not be secured by a primary mortgage on any assets. In the event of default, the
only method to protect the investment would be to "bail out" the OPGA and assume management
of the Trust assets (golf course).
2. The staff has reviewed the management firm's "proforma" and believe it to be accurate
and based on sound management data from other area operations. Based on a five year
proforma, there should be no problem with a payment structure as contemplated in 6 -D (above).
3. At least $173,000 be set aside by the OPGA in the Trustee bank for a portion of the first
payment on the 1992 bonds (required to have $203,000 by July 1, 1994). By setting aside most
of the first payment, there is more assurance of adequate notice prior to a possible default. This
set -aside is much like the reserve requirement of most bonds (however, $173,000 is substantially
more, percentage -wise, than most reserve requirements).
4. The staff views this as a very unique investment opportunity that meets the criteria
outlined in the initial goals of the program. It benefits the City investment plan; it supplements
the General Fund, thus helping to meet growth demands; it saves the OPGA money in bond
issuance cost and interest cost.
5. The success of this plan, if adopted, could certainly set the stage for other innovative
investment opportunities utilizing a stronger entrepreneurial basis for our decision malting
process relating to investment.
6. This program can be equated to our innovative programs in self - insurance, environmental
programs, technology programs, salary enhancement program, capital outlay subsidy program,
privatization programs, and the quality initiative now under way. It has great potential.
REQUEST
This request is for Council approval of the above concept and authorization for the staff to
initiate the development of the documents necessary to implement the investment.
NOTE: Please note that the legal cost of drawing the necessary documents would be
charged to the OPGA and would be drawn against the proceeds of the loan. Nonetheless, a
substantial amount of money will be spent developing the documents ($1500). Additionally, the
staff will devote several hours to the project. It is essential that a Council direction to develop
these documents be an indication of your receptiveness to the concept.
RECONQI IENDATION
The staff recommends that the Council authorize the staff to develop documents relating to such
concept for presentation to the Council at the June 1, 1993 meeting.

IINTRODUCTION:
' There is a series of steps that have to be taken in order for the Oklahoma Department of
Commerce (ODOC) to release the Community Development Block Grant (CDBG) funds for the
infrastructure improvements connected with the Max Buchanan site development. The same
1 series of steps were completed when the staff was finalizing the Woods Precision Products, Inc.
loan package approximately 18 months ago. Each step requires formal action by the Council,
but are generally considered to be "house cleaning" type actions.
First, an Environmental Review Record has to be prepared. This record consists of a request
for review being sent to various state and federal agencies and a documentation of their
responses in the form of a statutory checklist and an environmental assessment. The INCOG
staff has prepared the record as a part of their administration services contract with the City.
They have determined that this project will have no significant effect on the environment. As
a result of this determination the Council is in the position to designate the mayor as the
certifying officer to sign the Environmental Certification and Release of Funds Request and to
' make findings of No Significant Environmental Impact and Exemption of Administrative and
Engineering Services.
In addition, the Council must approve (1) an Antidisplacement Plan, even though no
displacement will occur as a part of this project and (2) a Management Plan (Project Schedule)
outlining the timing of events that must occur during the life of the project. INCOG staff has
prepared these documents as a part of their contract with the City (see attached letter from Andy
Armstrong, INCOG).
It is anticipated that future actions will have to be taken by the Council to complete other
r/ requirements for "Release of Funds" that are not directly related to environmental concerns.
However, at this point the following is a specific explanation of each current request by agenda
item.
ITEM #14
DESIGNATION OF MAYOR AS CERTIFYING OFFICER
BACKGROUND: I
Federal and state regulations require that each grant recipient designate a certifying official. '
This official is typically the mayor when the recipient of a grant is a city. The certifying official
(through use of the staff and contractually with INCOG) assumes responsibility for the
environmental review process, making findings, and signing certifications. '
RECOMMENDATION:
The staff recommends that the Council designate the Mayor as the City's certifying official for
documents required by the CDBG grant and authorized by the Council.
ITEM #15
NO SIGNIFICANT IMPACT ON THE ENVIRONMENT FINDING
BACKGROUND:
This is a finding that the "project is not a major federal action which will have a significant
effect on the human environment and that a request to the State for the release of project funds
will not require an Environmental Impact Statement ". In order to make this finding it is
necessary to complete a Statutory Checklist, an Environmental Assessment Checklist, and
maintain documentation of the Environmental Review Record information. All of these have
been completed by INCOG, reviewed by the staff, and the documentation has been placed in the
project's permanent file. Attached is a copy of the Statutory Checklist completed by Andy
Armstrong of the INCOG staff.
RECOMMENDATION:
The staff recommends that the Council approve the INCOG reports and finding of no significant
impact on the environment as a result of the Max Buchanan infrastructure project and that the I
Mayor be authorized to execute such document.
ITEM #16 '
ADMINISTRATIVE AND ENGINEERING SERVICES EXEMPTION
BACKGROUND:
This finding is that the administrative and engineering services for the Project #5252 CDBG-
ED92 (Max Buchanan Infrastructure Grant) are exempt from the requirements of the National
' Environmental Policy Act (NEPA) of 1969. INCOG has reviewed the federal regulations and
determined that these activities (administration and engineering) are identified by 24 CFR, Part
58 as being activities which are exempted from NEPA. Attached is the Finding of Exemption
' signed by Andy Armstrong.
RECOMMENDATION:
' The staff recommends Council approval of the certification of exemption of administrative and
engineering services from the requirements of NEPA and the Mayor be authorized to execute
' such document.

EXECUTE AN ENVIRONMENTAL CERTIFICATE

BACKGROUND:
The Environmental Certification is a document that identifies that the city has carried out its
responsibilities for environmental review in accordance with all state and federal regulations and
that it was determined that a full Environmental Impact Statement is not required. In simple
' terms it is saying that we have completed Items #14, 15, & 16 above (see attached
Environmental Certification).
' RECOMMENDATION:
' The staff recommends the City Council authorize the Mayor to sign the Environmental
Certificate as required by grant conditions.

REQUEST FOR RELEASE OF FUNDS
BACKGROUND:
The Request For Release Of Funds is a document that identifies that the City has completed all
the requirements of the grant; whether they are state, federal, or local grant conditions. This
document has been completed by INCOG and is included as an attachment.

RECOMMENDATION:
The staff recommends that the Council authorize the Mayor to execute a "Request For Release
Of Funds" as required by grant conditions for Project #5252 CDBG -ED92.

ANTIDISPLACEMENT PLAN
BACKGROUND:
The Antidisplacement Plan address the actual or unexpected demolition of low /moderate - income
dwelling units. There will be no demolition of dwelling units because of the construction of this
project. However, it is required that a plan be approved that states that demolition is not
planned and if unexpected demolition should occur all federal regulations will be followed to
mitigate any adverse impact (see attached Residential Anti- Displacement And Relocation
Assistance Plan).
RECOMMENDATION:
The staff recommends Council adoption of an Antidisplacement Plan for the Max Buchanan
project (Project #5252 CDBG- ED92), and that the Mayor be authorized to execute such plan
document.
ITEM #20
MANAGEMENT PLAN
BACKGROUND:
The Management Plan is a document that address the scheduling of the funding and construction
process. It identifies approximate completion dates for each step of the process from Release
of Funds to Project Completion and Document Closeout. The attached plan consists of two
parts, Part I is a written schedule and Part II is a graphic schedule. The plan was prepared by
INCOG and reviewed by the staff and is suitable for adoption.
RECOMMENDATION•
The staff recommends Council approval of the required Management Plan and that the Mayor
be authorized to execute any documents relating to that plan.

As a part of the initial requirements of the Community Development Project referenced
above the City of Owasso must show that it has met Federal Environmental Regulations
it as required by the National Environmental Policy Act (NEPA) of 1969 by preparing an
environmental review record.
INCOG staff has prepared the environmental review record which is attached to this
memorandum. This process is primarily a request for review and consuitation sent to
various state and federal agencies and a documentation of their responses in the form
of a statutory checklist and an environmental assessment.
For the purpose of environmental review administrative and engineering activities are
t considered to be exempt from NEPA review. The infrastructure activities, due to an
extension of new service capabilities, requires an assessment. The INCOG staff ha.s
core -iNie«� t. e review process ano nas determined that the project wjil have no
' significant effect on the environment. Therefore, it is requested that the City Council
take the following action:
1. Designate the City's Chief Executive Officer, the Mayor, as the certifying
officer tinder the National Environmental Policy Act of 1969 to assume
overall responsibility for the environmental review process.
A. Make a Finding of No Significant Impact on the Environment for the
CDBG Project.

RESIDENTIAL ANTI - DISPLACEMENT AND RELOCATION ASSISTANCE PLAN
The City of Owasso will undertake Community development activities funded through the Community Development
Block Grant program. No demolition or conversion of low /moderate - income dwelling units is anticipated by
the City of Owasso in conjunction with the activities assisted with these funds. Under Section 104 (d) of
the Housing and Community Development act of 1974, as Amended, if such demolition or conversion unexpectedly
occurs, before obligating or expending funds that will directly result in such demolition or conversion, the
City of Owasso will make public and submit to the Oklahoma Department of Commerce the following information
in writing:
1. A description of proposed assisted activity;
2. The location on a map and number of dwelling units by size (number of bedrooms) that will be
demolished or converted to a use other than as low /moderate - income dwelling units as a direct result
of the assisted activity;
3. A time schedule for commencement and completion of the demolition or conversion;
4. The location on a map and number of dwelling units by size (number of bedrooms) that will be
provided as replacement dwelling units;
5. The source of funding and a time schedule for the provision of replacement dwelling units;
6. The basis for concluding that each replacement dwelling unit will remain a low /moderate - income
dwelling unit for at least 10 years from the date of initial occupancy, and;
7. Information demonstrating that any proposed replacement of dwelling units with smaller dwelling
units is consistent with the housing needs of low /moderate - income households in the jurisdiction.
If displacement of low /moderate - income households occurs in conjunction with the community development
activities funded with CDBG funds, the City of Owasso will provide relocation assistance, as described in
570.496(b)(2) to each low /moderate - income household displaced by the demolition of housing or by the
conversion of a low /moderate - income dwelling to another use as a direct result of assisted activities.

A. Environmental Review - A portion of the street extension
project is located in the 100 year floodplain. An
environmental assessment was prepared because of the size
and scope of the extension project. There is a Finding of
No Significant Impact.
B. Total Project Funding - In addition to the grant funds of
$151,203, the Owasso Economic Development Authority will
' contribute $350,000 in local leverage funds and Tulsa
County and /or the State Department of Transportation will
provide $68,756.
