The Owasso City Council met in regular session on Tuesday, September 7, 1993 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p. m. on Friday, September 3, 1993.

ITEM 5: REQUEST APPROVAL OF THE CLAIMS
John Phillips moved, seconded by Charles Bums, to approve the following claims as submitted:
(1) General Fund $57,351.58; (2) Workers' Compensation Self-Insurance Plan $2,506.18;

ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE ''
GRANTING OF AN EASEMENT TO THE OWASSO PUBLIC GOLF
AUTHORITY.
On August 7, 1992, the Owasso Public Golf Authority opened bids for the construction of an
underpass under 86th St N. At that time an easement was not obtained from the city. However,
city staff did review the proposed project. In order to clean up the project, a request has been ~
made to grant the easement. Charles Bums moved to approve the granting of an easement for
the tunnel underneath 86th St N and to authorize the mayor to sign the necessary document.
Motion was seconded by Mary Lou Barnhouse.

ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
AWARD OF A CONTRACT TO PURCHASE A CHASSIS AND REMOUNT
AN EXISTING AMBULANCE "BOX" UPON SUCH CHASSIS.
Bids were opened on August 4, 1993 for a chassis remount on medic-one. Four bids were
received and have been reviewed. Only one company, First Ambulance Center of Tennessee,
complied with all the bid specifications. Base bid was $35,928.00, with optional equipment at
$3,440.00. Following discussion, Mayor Randolph moved, seconded by Charles Bums, to
approve a contract in the amount of $39,368.00 to First Ambulance Center of Tennessee for the
purchase of a chassis remount of ambulance "box" as specified in the bid documents.

' ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
PURCHASE OF EQUIPMENT FOR POLICE VEHICLES.
' The police department recently purchased four new police patrol vehicles, which have now been
pin-striped and are ready for emergency equipment to be installed. Sealed bids were opened on
August 31, 1993 for the emergency equipment, with two vendors submitting bids. Tuxall
Uniform and Equipment submitted a bid of $4,659.92 and Phillips Police Equipment submitted
a bid of $5,720.00. Mayor Randolph moved, seconded by Charles Bums to award the bid for
police vehicle emergency equipment in the amount of $4,659.92 to Tuxall Uniform and
Equipment Inc.
AYE: Randolph, Burris, Bowen, Barnhouse, Phillips

Notion carried 5-0.
ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A POLICY
PROVIDING FOR THE REMOVAL OF TREES FROM EASEMENTS AND
ADJOINING PROPERTIES.
Because of problems with trees whose roots or branches have caused damage to city
infrastructure, it has become necessary to develop a written policy and procedure for the removal
of trees that are determined to be potentially damaging to public utilities, infrastructure, or
rights-of--way. Mr Cates and the staff developed such a policy that will utilize the nuisance
provisions of the Code of Ordinances in dealing with the removal of trees. Charles Bums
moved to approve the policy statement and procedures for removal of trees. Motion seconded
by John Phillips.
AYE: Bums, Phillips, Barnhouse, Bowen, Randolph
NAY: None
Motion carried 5-0.
ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE CREATION OF A CHARTER REVIEW COMMITTEE.
Councilor Bums requested that a charter review committee be appointed to review the charter
and make recommendations to the City Council for changes. Mr Phillips commented that a
charter review was conducted in the fall of 1990, but there were only minor changes
recommended and they were not submitted to a vote of the people. Mr Bums moved that a
charter review committee consisting of two councilors and three citizens be appointed to review
the charter and bring recommendations to the City Council, who would then make a decision
regarding calling an election. Motion was seconded by Mary Lou Barnhouse.

Motion was defeated 3-2.
Mr Burris then asked how many signatures would be required on an initiative petition. Mr Cates
responded that it would require 25 % of the registered voters in the last election.

SUBJECT: RENEWAL OF SITE AGREEMENT FOR SENIOR NUTRITION
PROGRAM

~ BACKGROUND
The Owasso Senior Nutrition Program will celebrate its first anniversary on October 14. During
' this first year the program has consistently averaged between forty-five and fifty seniors in daily
attendance. Based upon my knowledge of the participants I would estimate that these numbers
divide fairly evenly into the three major target categories for nutrition programs: those of low
income, those with need for socialization, and those with need for a more balanced diet. The
program can certainly be judged to be a success in terms of meeting these needs and in its
contribution to the cheerful participation of its patrons.
An accompanying indirect effect of the Nutrition Program has been the increased use of the
Community Center by the Seniors. Many of those who eat and who would formerly have come
to the Center only on Wednesdays and Fridays now come every day. Duplicated attendance per
week averages over 250 persons, as opposed to an average of 260 to 270 persons per month
prior to the inception of the program. In addition the average number of riders on the Senior
Citizens Van has risen from about 125 duplicated passengers per month to approximately 400
per month.
Much of the success of the Nutrition Program can be attributed directly to the nature of the
program itself and its appeal to the targeted populations mentioned above. However, a good
portion of its appeal is based upon the experience, knowledge and cheerful demeanor of the
Owasso Site Director, Mrs. Perry (Babs) Cline. Mrs. Cline has skillfully and carefully
navigated and negotiated the program's way through its foundational year. She is to be
commended for her leadership and a job well done.
RECOMMENDATION
The staff recommends continuation of the Nutrition Program for the coming year, October 1,
1993 through September 30, 1994. It further recommends authorization by the City Council for
the Mayor to execute the Site Agreement for this period between the City of Owasso and the
Tulsa Community Action Agency, the sponsoring agency of the Tulsa Senior Nutrition Program.

~ I am attaching for your consideration the 93-94 Site Agreement for the Senior Nutrition Program
with an accompanying memorandum to the City Council. As you will recall from our meeting
' with Paul Shireman, we had some shared concerns about the Nutrition Program that we had
talked about addressing via modifications to the Site Agreement.
' I met today with Ron Cates to discuss these concerns, namely, the need for the City to retain
the right to use of the Nutrition Site space upon special occasion, the problem of fundraising by
^~, the Nutrition Program, and the method of collection of donations by the Program. Regarding
the first two concerns, Mr. Cates pointed out that according to the Site Agreement, we already
have the desired control regarding these matters. The Agreement does not specify provision of
a particular space, simply "space." This leaves us free to temporarily relocate Nutrition
activities if necessary. Second, fundraising, while not prohibited by the Agreement, is neither
allowed nor envisioned by it, so it is already within our purview to forbid or control it.
Mr. Cates suggested that the final matter concerning the collection of donations might, at this
point, be most fruitfully approached in a more conciliatory manner than that engendered by the
alteration of the Site Agreement. His suggestion was that we mention in an accompanying letter
our concerns about the method of collections. This would call attention to what probably is very
likely a problem throughout the Nutrition Program. It would give them a chance to deal with
this problem and, perhaps, if necessary, even alter the general Site Agreement.
I believe that there is wisdom in Mr. Cates' suggestions and would recommend that we follow
them. To that end, I am attaching the Site Agreement unaltered, with the recommendation that
we present it as is to the Mayor and Council for their consideration.
I am also attaching a draft copy of a letter that I propose to send to Mr. Bruce Niemi to
accompany the Site Agreement when we send it to TCCA. Please give me your thoughts and
suggestions regarding it.

SITE AGREE~NENT

Tulsa Community Action Agency, Inc. (TCAA) and Sit}r of Owasso (Site Sponsor)
enter into the following agreement for the project year beginning October 1 1993 and
ending September 30. 1994.
TCAA AGREES TO:
~ ~ 1) Provide a paid staff member 3~hours per week to operate the Nutrition
Program. Employment of new staff will be the responsibility of the Nutrition
Program, however, input from the Site Sponsor would be considered.
2) Provide sufficient training, supervision, and consultation to ensure that quality
nutrition services are to be provided to participants.
~ 3) Provide General Liability Insurance coverage for the time period and area
occupied by the program.
4) Provide necessary supplies, equipment, and prepared meals to serve~Q
' Congregate Meals weekdays and Q Home Delivery Meals weekdays
for a total of ~Q meals.
5) Provide Nutrition Education to Congregate and Home Delivery participants.
~ Facilitate Transportation, Recreation and Senior Citizen Information
programs to participants, within limits possible at the location.
6) Provide "light" janitorial duties such as sweeping ahd emptying trash.
THE SITE SPONSOR AGREES 1'O:
1) Provide space at no cost to participants for service of ~ Congregate
and Home Delivery meals on weekdays, 52 weeks per year, with the
exception of mutually agreed upon holidays.
2) Permit use of this space for a minimum of four hours each day the program
operates.
3) Pay all utilities without recourse to nutrition participants or Tulsa Senior
Nutrition Program.
4) Provide general janitorial care of the building such as cleaning bathrooms,
trash and trash pickup, and heavy floor cleanup and care.
IT IS MUTUALLY AGREED THAT:
,. 1) Either party may terminate this agreement by providing the other party thirty
days written notice.
2) Implementation of this agreement is dependent on mutual availability of
funding.
~ 3) All equipment purchased by the program for use at the facility remains the
property of the Tulsa Senior Nutrition Program.

Enclosed please find an original copy of the Owasso Senior Nutrition Site Agreement, signed
by Mr. Robert Randolph, Mayor of the City of Owasso. Please receive it as an indication of
our overall pleasure with the success of our first year as a Site Sponsor for the Tulsa Senior
Nutrition Program. As you can see from the enclosed copy of the Accompanying
Memorandum to the City Council of Owasso, we believe that the addition of the program has
greatly enhanced our ability to serve the senior population of the Owasso area.
Although we are very pleased with the program, we have a couple of items of concern.
First, there is a change in the Site Agreement from last year to this in regards to the number
of hours per week that a paid staff person is provided to operate the program. Although we
do not doubt that our Site Director may well work 35 hours per week, a word of explanation
would be appreciated as to why there is such a large jump from 20 hours to 35.
Also, although we are certainly laypersons when it comes to the administration of a nutrition
' program, we do have some questions about the manner in which donations for meals are
collected by the local nutrition sites. It appears to us, both here and in other sites we have
visited, that what are referred to as "donations" are actually treated more in the manner of
"payments" for the meals. Many, if not most, of the seniors seem to regard "their $.75" as
payment due. Perhaps, something could be done in regards to the way in which the
' collections are made that would alleviate or at least reduce this perception. If so, it would
have the effect of both encouraging those with means to give more than the minimal $.75 and
also ensuring that those who might not be able to afford even that amount not be kept away
~ due to embarrassment because of inability to donate.
We have in the past and intend again to discuss this matter with Mrs. Cline. We understand
that the way she deals with this area of the program is quite common if not universal
~' throughout the Tulsa Nutrition system, so we certainly do not fault her for it. However, we
would hope that in Owasso and elsewhere discussion might be fostered and guidelines issued
' that would better contribute toward the goal of the program both to reach the maximum
number of participants and to encourage the greatest amount of monetary support from those
~ with ability to donate.
A word of thanks is certainly due for the provision of Mrs. Cline as our Site Director. Babs
is a wonderful person who greatly contributes to the success of the Owasso program. We
feel we are privileged to have such an enthusiastic and generous-spirited person to help us in
our attempt to better serve the citizens of Owasso and the surrounding area.
Finally, thank you to you and the rest of the TCCA board for the time you give to work with '
this and the other programs you oversee. We appreciate your efforts! We know that these
last few months have not been easy ones, and we applaud you in your struggles to provide
better oversight for this and other areas under your care.

BACKGROUND:
Ram Plaza PUD 11 is a 9.24 acre tract located at the northwest corner of 86th Street North
and 129th East Avenue. The final plat and covenants for Ram Plaza were approved by City
Council at the June 15,1993 Council Meeting. Modifications were made on the plat and
covenants and brought before the City Council on August 17,1993 for approval. The City
Council review the modifications and approved them as submitted.
Construction began shortly thereafter on the water and wastewater lines for Ram Plaza. They
are now complete and have been inspected, tested, and approved by the necessary
departments. All construction has meet the standards set forth by the City.
RECONINIENDATION:
The staff recommends Council acceptance of the water and wastewater improvements
constructed by Ram Plaza.

BACKGROUND:
The final plat for Double Oaks III was approved by the City Council on June 1,1993.
The Oklahoma State Department of Health approved the construction plans for Double Oaks
III on June 16,1993. The Oklahoma State Department of Health issued two permits, one for
the water lines (Permit No. WL000072930396, PWSID No. 3007218), the other for the
sanitary sewer lines (Permit No. SL000072930395, 5-21310), for construction.
The water lines were inspected by staff during the construction, and the staff conducted the
appropriate testing. The construction of the sanitary sewer was inspected by the staff along
with monitoring the contractor pulling the mandrel through all sanitary lines for alignment.
The construction of the lines, materials used and testing has met and/or exceeded the design
standards of the City of Owasso.
The streets and storm sewer system for the above mentioned addition are in the ground and
all current conflicts or concerns have been addressed and are being repaired as of this date.
The inspection of the material and methods used are in accordance with the City's standards
and are acceptable. The necessary bonds are in place and on file.
RECOMMENDATION:
The staff recommends Council acceptance of the streets, water and wastewater improvements
constructed by Double Oaks III.

SIIBJECT: Double Oaks III Sanitary Sewer Inspection
All sewer lines have passed the Mandrel test as of September 3,
1993.
The following is a list of repairs or alterations that need to be
made at the manholes:
Manhole #1 - cut out needs to be made in 12" pipe
Manhole #2 - manhole appears to be low
Manhole #3 - may be low, check after final grade, check
for infiltration
Manhole #4 - manhole is low
Manhole #6 - infiltration
Manhole #7 - infiltration
Manhole #8 - infiltration
Manhole #12 - infiltration
Please recheck all manholes after final grade to make sure they are
not below grade. Alter any manhole that is below grade.
No lot owner shall plant any trees or shrubbery in dedicated utility easements or rights-of--way
which would potentially endanger, threaten, or harm any utilities located within said easements
or rights-of--way.
If it is determined by the municipality that any trees or shrubbery located within said easements
or rights-of--way are damaging or endangering utilities in said easements or rights-of--way, the
city shall have the right to remove said trees or shrubbery upon five (5) days notice thereof at
the lot owner's expense, or within such time the lot owner may remove same.

~ BACKGROUND:
The Owasso Planning Commission reviewed the preliminary plat for Barrington Point at its
June 15, 1993 meeting. At that meeting, the Owasso Planning Commission unanimously
~ recommended approval of the preliminary plat for Barrington Point subject to the conditions of
the Technical Advisory Committee being met prior to final plat submittal. A copy of the staff
memorandum from Barrington Point's preliminary plat review is enclosed for your information.
The developer, Mr. Kourtis, had requested prior to the September 16, 1993 Planning
1~ Commission meeting that the area contained within the Barrington Point preliminary plat be
platted in three separate phases. Contained within your packet are plats for Barrington Point,
Barrington Point II, and Barrington Point III.
.~ The final plats for Barrington Point were presented to the Technical Advisory Committee at its
August 4, 1993 meeting. At that time, several changes requiring additional easements were
recommended by the Technical Advisory Committee. All the plats included within your packet
contain these changes.
The Engineering Department has reviewed the submitted construction plans and detailed drainage
report. The review of the construction plans yielded several minor corrections being requested
by the department. A copy of these changes in enclosed within you packet for your information
and review. However, these changes should not be viewed as major by any means, or changes
which would require this project from being approved. Several small changes were also
required to be made to the drainage report in effort to make it more explanatory.
The Owasso Planning Commission reviewed the final plats for Barrington Point I, II, and III,
as well as their covenants, at its September 16, 1993 meeting and unanimously recommended
approval of the final plats.
RECOMMENDATION:
Based upon the review by the Technical Advisory Committee, the Engineering staff, and the •
Owasso Planning Commission, staff recommends approval of the final plats for Barrington Point,
Banington Point II, and Barrington Point III, providing all minor corrections are made to the
construction plans prior to any construction occurring.

The City of Owasso initially received a preliminary plat for Barrincton Point in l~iay for review
at the Technical Advisory Committee and Planninc Commission meetings. Due to several
"chances" recommended at the TAC meeting and due to staff's recommendation of the developer
providing access to unsubdivided land to tape east, s`aff recommended that I~Sr. Kourtis resubmit
the preliminary plat for Barrncton Point in order to address these concerns and to allow the
Planning Commission to view both Barrington Point and Windsor Lake III together as they ere
abutting properties. T'ne enclosed preliminary plat has addressed those chances previously
recommended by staff.
At the June 2, 1993 TAC me~tirc, the Ba.:incton Point preliminary plat was reviewed again.

On drainage plans, indicate what to do with structures that will tie to future phases if
those phases are built immediately after said phase.
On water plans show fill areas, use tees at all intersections, plugs at end of phase line.
Dimension all lines to property line, etc.
On sanitary sewer plans show dimension and extensions of all lines and manholes,
lampholes, etc. All lalnpholes over 100 feet shall be changed to manholes. Check to
make sure all manholes to manholes are not longer than 300 feet.

SUBJECT: FINAL PLAT -WINDSOR LAKE II ERTENDED
DATE: September 17, 1993
BACKGROUND•
' The Owasso Planning Commission reviewed and approved the final plat for Windsor Lake II at
its May 20, 1993 meeting. At that meeting, the developers of Windsor Lake II requested that
four (4) lots in the southwest portion of the subdivision be removed from that plat to be added
to either a future subdivision or recorded separately at a later time. Apparently, construction
problems existed with the proposed roads abutting these lots.
' Since that time, all construction problems have been resolved. The developers are requesting
these lots be platted now as they are buildable and/or sellable lots. All easements shown on the
enclosed plat, as you may recall, were recorded by separate instrument so that none of the
' construction plans from Windsor Lake II would need adjustment. There have been no changes
to these easements.
Staff did, however, have one recommended correction to the plat submitted. On Lot 1 of Block
1 and Lot 1 of Block 3, the building lines are shown as 30' B/L and 15' B/L. The two building
~ lines shown as 15 feet should be changed to 25 feet in order to remain consistent with future
development to the west of Windsor Lake II Extended.
All improvements have been completed by the developers and inspected by the Engineering
department. The Owasso Planning Commission unanimously recommended approval of the
Windsor Lake II Extended final plat at its September 16, 1993 meeting, including staff s
recommended change in two building lines from 15 feet to 25 feet.
RECOtiIVIENDATION•
Staff and the Owasso Planning Commission are recommending approval of the final plat of
' Windsor Lake II Extended providing that the two building lines shown at 15 feet be changed to
25 feet.
