N 3. 0 CALL TO ORDER ROLL CALL Approval of Minutes from the November 17, 2008 Regular Meeting — Trish Hauser moved to approve the minutes of November 17, 2008. Ken Foster seconded. AYE: Foster, Ramey, Hauser, Laakso NAY: None The motion carried 4 -0. OBOA -08 -13 — Request for a special exception to allow a church to locate on property zoned AG (Agriculture), on properties located at 13918 and 14008 East 96th Street North. Joe Ramey presented the item and Larissa reviewed the staff report. The applicant is requesting a special exception to allow a church to locate on property zoned AG (Agriculture). The property is undeveloped and contains approximately 11.5 acres of land. The case was brought before the Board of Adjustment on November 17, 2008. The item was tabled to facilitate discussion between abutting homeowners and future developing team. Items of concern were drainage, location of the trash container, parking, buffering and overall design. The architect has redesigned the structure to have Mansard roofing and a mix of rock. Notification letters were mailed to property owners within 300 feet of the property and the request was advertised in the newspaper. The staff recommends approval of OBOA 08 -13. The following are comments from several surrounding property owners: James Hess — 9323 North 139 East Ave — He is not opposed and appreciates the opportunity to meet with the church committee. He is enthusiastic about the proposed detention pond. The property owners would like to see the voluntary setback changed to a mandatory setback. He would prefer to have trees planted along the southern boundary of the property instead of fencing. These abutting property owners have existing privacy fences. Mark Allen — 3116 Viewmont Ct, Edmond, OK — He explained that the fencing on the BOARD OF ADJUSTMENT December 23, 2008 Page 2 of 2 east and west sides would be placed toward the parking spaces in order to block out car headlights. The color tones have been decided upon and described to the Nottingham Homeowners Association members. Ken Foster moved to approve the special exception request with the following conditions: • Fencing (5 ft) along the eastern boundary shall be constructed when single family development begins and indicate fencing on final plat. • Trees shall be placed along the southern boundary of the property. • Fencing (5 ft) along the western boundary shall be placed towards the parking spaces in order to restrict headlights. Tammy Laakso seconded the motion. A vote on the motion was recorded as follows: AYE: Foster, Hauser, Ramey, Laakso NAY: None The motion carried 4 -0. 5. Other Business 6. ADJOURNMENT — Tammy Laakso moved for adjournment, seconded by Trish Hauser. A vote on the motion was recorded as follows: AYE: Ramey, Foster, Hauser, Laakso NAY: None The motion was approved 4 -0 and the meeting was adjourned at 6:30 PM. Date
