The following is submitted as an addendum to the Owasso Public Works Authority agenda filed
on Friday, March 20, 2009. Items numbered 1 -2 shall remain the same. Items numbered 3 -11
shall become Items numbered 4 -12 and a new Item number 3 is listed as follows:
3. Consideration and appropriate action relating to the election of Vice - Chairman.
Trustee Jon Sinex
The Vice Chairman of the OPWA has resigned the position of Vice - Chairman,
therefore election of a Vice - Chairman is necessary.

4. Consideration and appropriate action relating to a request for Trustee award of a bid for the
purchase of a new dump truck.

Staff recommends Trustee award the bid for the purchase of a new Dual Tandem Axle
Dump Truck to Frontier International of Tulsa, Oklahoma in the amount of $107,403.
5. Consideration and appropriate action relating to a request for Trustee award of a bid for the
purchase of two (2) new fully automated refuse collection vehicles.

Staff will recommend Trustees award a bid for the purchase of two automated refuse
collection vehicles to Crane Carrier Company of Tulsa, Oklahoma in the amount of
$476,412.
6. Consideration and appropriate action relating to a request for Council approval of
Resolution No. 2009 -02, a Resolution agreeing to file an application with the Oklahoma
Water Resources Board (the "OWRB ") for financial assistance through the OWRB State
Revolving Fund Program, with the loan proceeds being for the purpose of financing
stormwater system improvements and related improvements serving the City of Owasso,
Oklahoma; and containing other provisions related thereto.

The Owasso Public Works Authority met in regular session on Tuesday, March 3, 2009 in the
Council Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the
City Hall bulletin board at 5:00 p.m. on Friday, February 27, 2009.

Mr. Bonebrake moved, seconded by Mr. Sinex, to approve the OPWA Consent Agenda with
claims totaling $1,062,878.48. The payroll payment report for pay period ending 2/14/09 was
included for review.

ITEM 4. PUBLIC HEARING. The Owasso Public Works Authority will conduct a public
hearing for the purpose of receiving citizen comments and input relating to the
Environmental Information Document associated with the East 76`" Street Sanitary
Sewer interceptor.
Roger Stevens, Director of Public Works, presented the item to be discussed. Mayor Cataudella
opened the floor for Citizen comments and input.
Ten citizens addressed the Council with questions and concerns.
Mayor Cataudella then declared the Public Hearing closed.

SUBJECT: DUAL TANDEM AXLE DUMP TRUCK
BID AWARD
DATE: March 17, 2009
BACKGROUND:
The FY 2008 -2009 Wastewater Treatment Plant budget includes funds in the amount of
$120,000 for the purchase of a new dump truck. The new dump truck will be used primarily by
the wastewater treatment plant for hauling inorganic and organic material to the landfill. This
piece of equipment will replace the existing 1988 Ford dump truck that is currently shared
among all Public Works divisions. The 1988 ford dump truck will continue to be utilized by the
other divisions. The purchase of an additional dump truck will help increase operational
efficiencies and flexibility among Public Works.
SOLICITATION OF BIDS:
A notice to bidders was published in the Owasso Reporter on February 19, 2009 and February
26, 2009 to solicit bids for the purchase of a dump truck. A request for bids was also mailed on
February 19, 2009 to six (6) vendors. There were (9) bids received and publicly opened on
March 11, at 2pm. A listing of received bids is presented below:

As shown above, the lowest bid was submitted by Tulsa Freightliner for $97,371.00.
Unfortunately, the proposed bid did not meet several crucial specifications. The dump body that
was proposed by Freightliner is a square body with a 48" high tail gate. The specs called for an
elliptical bed with a 42" tail gate. The height of the tailgate on this truck is very significant, in
that a 48" tailgate will not fit underneath the sludge auguring system at the plant. Other
specifications not met include, the truck warranty, the mount for the exhaust and the hoist
capacity of the dump bed. Frontier International of Tulsa, Oklahoma, was determined to be the
next lowest responsive, responsible bidder with a bid amount of $107,403.00. After thorough
review of the proposed bid by Frontier International, it was determined by the Public Works
Staff and the recommendation of Support Services that the bid be awarded to Frontier
International. The bid submitted by Frontier International, provides the best vehicle and is in
conformance with the established specifications.
FUNDING SOURCE:
Funds for the purchase of one (1) dump truck are included in the FY 2008 -2009 Wastewater
Treatment Plant budget (line item 61- 450 - 54500) in the amount of $120,000.00.
RECOMMENDATION:
The staff recommends Trustee award the purchase of a new current model Dual Tandem Axle, 6
x 4, Dump Truck to Frontier International of Tulsa, Oklahoma in the amount of $107,403.00

NOTICE TO BIDDERS
Sealed Bids will be received by the Owasso Public Works
Authority at the Owasso City Hall, 111 North Main, PO Box 180,
Owasso, Oklahoma 74055 until 2:00 p.m. on the 1 lth day of March
2009, at which time and place said bid will be publicly opened and
read aloud. This will be for the furnishing of the following item:
One (1) Dual Tandem Axle, 6 x 4, 2 -Door Conventional
Chassis, GVW 56,000# Dump Truck for the Wastewater
Treatment Plant, per Specifications.
Further information and specification packets can be obtained by

Envelopes containing bids must be sealed and marked to identify

TECHNICAL SPECIFICATIONS
FOR THE PURCHASE OF
ONE (1) DUAL TANDEM AXLE, GVW 56,000# DUMP TRUCK
FOR THE WASTEWATER TREATMENT PLANT
GENERAL DESCRIPTION
The following is comprehensive list of specifications for one dump truck to be purchased for the
Wastewater Treatment Plant. In general, the vehicle proposed is described as a new current
model Dual Tandem Axle, 6 x 4, 2 -door convention chassis, GVW 56,000# dump truck. All
components of this vehicle shall be new and of original manufacture.
GENERAL PROVISIONS
1. TAX EXEMPTION — Purchaser is exempt from payment of all federal, state and local
taxes in connection with the purchase. Said taxes must not be included in bid prices. The
City of Owasso will provide necessary tax exemption certificates upon request.
2. PRICING — The price submitted in any proposal shall include all items of labor, materials,
tools, and other costs necessary to fully prepare the vehicles for delivery. Any items of
labor omitted from the specifications, which are clearly necessary for the proper delivery of
the vehicle, shall be considered a portion of such specifications although not directly
specified or called for in these specifications. Price quoted shall remain effective for a
period of thirty (30) days after opening of bids.
3. WARRANTY — A manufacturer's and/or dealer's warranty shall be supplied to cover
replacement parts and labor costs. The manufacturer agrees to promptly replace any part or
parts which by reason of defective materials or workmanship, or installation, fail under
normal use. Such replacement must be free of charge to the owner. Warranty will be for a
period of three (3) years or 300,000 miles on the truck, whichever comes first from the date
of delivery, and eight (8) years or 10,800 hours on the engine and five (5) years on the
transmission, from the date of delivery. The Owasso Public Works Authority shall expect
the dealer and/or manufacturer to have adequate stock of replacement parts available to
service the vehicle within a reasonable time.
Tires are exempt from this warranty, but must be covered by the tire manufacturer's
standard warranty and serviced by the local authorized dealer of the tire manufacturer.
4. BIDS — The purchaser reserves the right to reject any or all bids and to waive any or all
technicalities, informalities, or other minor deviations from the bid document.

5. INSPECTION — An acceptance inspection shall be conducted between the supplier and the
Authority before delivery will be accepted. The inspection date shall be at the Authority's
convenience. All discrepancies noted during the inspection shall be remedied at the
supplier's expense, prior to payment for this vehicle.
6. PAYMENT — As with all municipalities in Oklahoma, payment must be approved and
signed on a claims list by the proper city authority. Payment shall be made gnly after
complete and acceptable delivery of the vehicle, in accordance with these specifications.
The Owasso City Council /Owasso Public Works Authority meets regularly on the first and
third Tuesday of every month.
7. DELIVERY - Bidder shall provide delivery of the equipment to the Owasso Public Works
Authority within 120 days from the Notice of Award.
8. PRIME CONTRACTOR RESPONSIBILITY — If final delivery of the equipment includes
the use of services of another company, the Owasso Public Works Authority will hold the
bidder responsible for those outside services.
9. PROPOSAL EXPENSES — Expenses for developing the proposal are entirely the
responsibility of the vendor and shall not be chargeable to the Owasso Public Works
Authority.
10. PRIOR INFORMATION — Any information which may have been released either orally or
in writing prior to the issuance of this bid request shall be deemed preliminary in nature
and bind neither the Owasso Public Works Authority nor the vendor.
11. VENDOR CONTRACT — Any proposal accepted should be incorporated into the contract,
which the Owasso Public Works Authority will enter into with the vendor.
12. PROPOSED COST — It is not the policy of the Owasso Public Works Authority to
negotiate the price after the vendor is selected. The supplied bid form shall include one
price for the basic specified vehicle of all equipment and options. All bids delivered to the
Authority shall be sealed and visibly marked SEALED BID - DUMP TRUCK.

BACKGROUND:
Included in the FY 2008 -2009 Refuse Division Budget is $508,885 for the purchase of two (2)
new, fully automated refuse collection vehicles. These vehicles will be used as primary
collection vehicles in the automated collection system. Staff research concluded that utilizing
automated refuse collection vehicles provides the most efficient method of refuse collection,
while reducing workers compensation claims and injuries. Procurement of these vehicles is the
second step in the City's transition to automated refuse collection. The first being the award of
the Refuse Container Contract on July 1, 2008, which provided for the replacement of 7,000
refuse containers that were not functional in a fully automated collection system.
SOLICITATION OF BIDS:
A notice to bidders was published in the Owasso Reporter on February 19, 2009 and February
26, 2009 to solicit bids for the purchase of one (1) fully automated refuse collection vehicle with
an option for the purchase of a second identical vehicle. A request for bids was also mailed on
February 19, 2009 to eleven (11) vendors. The bid opening was conducted on Wednesday,
March 11, 2009 at 2:00 PM.
BIDS ANALYSIS:
On March 11, 2009, a total of seven (7) bids were received from vendors. Bids are summarized

Based on the evaluation and comparison of bids (in the opinion of the Refuse Division and
Vehicle Maintenance Department) the bid submitted by Crane Carrier Company for the
Crane/Heil in the amount of $238,206.00 each provides the best vehicle that is in conformance
with the established specifications and operational requirements.
FUNDING SOURCE:
Funding for the purchase of two refuse vehicles is included in the FY 2008 -2009 Refuse
Division Vehicle budget (61- 480 - 54500) in the amount of $508,885.
RECOMMENDATION:
Staff recommends Trustees award the purchase of two (2) fully automated refuse collection
vehicles to the Crane Carrier Company of Tulsa, Oklahoma for the Crane/Heil bid proposal in
the amount of $476,412 and authorization for payment.

TECHNICAL SPECIFICATIONS
FOR THE PURCHASE OF ONE (1) HIGH COMPACTION, FULLY AUTOMATED
REFUSE COLLECTION VEHICLE
GENERAL DESCRIPTION
The following is comprehensive list of specifications for the purchase of one (1) high compaction,
fully automated, refuse collection vehicle for single operator collection. This vehicle requires dual
driver (right and left side) controls and steering. All components of this vehicle shall be new and of
original manufacture. Prototype equipment will not be accepted.
The intent of these specifications is to set minimum requirements, not to otherwise limit bidding. In
as much as some designs of equipment vary among manufacturers, the Authority may accept bids on
equipment with minor deviations, which does not:
• Materially affect the ability of the product to achieve or accomplish a necessary function or
task in the manner required by the specifications.
• Compromise the safety of the user thereof.
• Produce higher latent or patent cost to the Authority in any of a multiplicity of ways.
Authority reserves the right to make the final judgment concerning what is or is not a minor
deviation and to award the bid to the bidder whose proposal best suits the needs of the
Authority for the product being purchased.
More than one bid proposal may be submitted.
GENERAL PROVISIONS
TAX EXEMPTION — Purchaser is exempt from payment of all federal, state and local taxes in
connection with the purchase. Said taxes must not be included in bid prices. Necessary tax
exemption certificates will be provided upon request.
2. PRICING — The price submitted in any proposal shall include all items of labor, materials,
tools, and other costs necessary to fully prepare the vehicle for delivery. Any items of labor
omitted from the specifications, which are clearly necessary for the proper delivery of the
vehicle, shall be considered a portion of such specifications although not directly specified or
called for in these specifications. Price quoted shall remain effective for a period of thirty (30)
days after opening of bids by the Authority.

3. WARRANTY — A manufacturer's and /or dealer's warranty shall be supplied to cover
replacement parts and labor costs. The manufacturer agrees to promptly replace any part or
parts which by reason of defective materials or workmanship or installation, fail under normal
use. Such replacement must be free of charge to the owner. Warranty will be a minimum of
one (1) year on all components and labor. A specimen policy of all warranty coverage on all
aspects of vehicle must be provided in the bid proposal The Owasso Public Works Authority
shall expect the dealer and/or manufacturer to have adequate stock of replacement parts
available to service the vehicle within a reasonable time. Tires are exempt from this warranty,
but must be covered by the tire manufacturer's standard warranty and serviced by the local
authorized dealer of the tire manufacturer.
4. BIDS — The purchaser reserves the right to reject any or all bids and to waive any or all
technicalities, informalities, or other minor deviations from the bid document.
5. INSPECTION — An acceptance inspection shall be conducted between the supplier and the
Authority before delivery will be accepted. The inspection date shall be at the Authority's
convenience. All discrepancies noted during the inspection shall be remedied at the supplier's
expense, prior to payment for this vehicle.
6. PAYMENT — As with all municipalities in Oklahoma, payment must be approved and signed
on a claims list by the proper city authority. Payment shall be made gWy after complete and
acceptable delivery of the vehicle, in accordance with these specifications. The Owasso Public
Works Authority meets regularly on the first and third Tuesday of every month.
7. DELIVERY — Bidder shall provide delivery of the equipment to the Owasso Public Works
Authority within 180 days from the Notice of Award. Failure to comply with specified
delivery term may result in the assessment of a $350 per day penalty for each successive
calendar day that expires after the time specified above. The 180 -day delivery period may be
extended if circumstances beyond the control of the bidder (forcemajuere) occur. Bidder shall
notify the Authority in writing within 30 days of any circumstances that may potentially
prohibit delivery of equipment within the specified term.
8. PRIME CONTRACTOR RESPONSIBILITY — If final delivery of the equipment includes the
use of services of another company, the Owasso Public Works Authority will hold the bidder
responsible for those outside services.
9. PROPOSAL EXPENSES — Expenses for developing the proposal are entirely the
responsibility of the vendor and shall not be chargeable to the Owasso Public Works Authority.
10. PRIOR INFORMATION —Any information which may have been released either orally or in
writing prior to the issuance of this bid request shall be deemed preliminary in nature and bind
neither the Owasso Public Works Authority nor the vendor.
11. VENDOR CONTRACT — Any proposal accepted should be incorporated into the contract,
which the Owasso Public Works Authority will enter into with the vendor.

12. PROPOSED COST — It is not the policy of the Owasso Public Works Authority to negotiate
the price after the vendor is selected. The supplied bid form shall include one price for the
basic specified vehicle of all equipment and options. All bids delivered to the Authority shall
be sealed and visibly marked SEALED BID.

Please note that these specifications establish minimum criteria and the bidder may exceed the noted
specifications. The specifications identify the characteristics desired by the Authority such that it is
the Authority's intent to receive bids for a refuse vehicle, which are similar to the specifications, with
an alternate bid for an identical second refuse vehicle.
Exceptions to these specific requirements must be clearly noted.

a. Cab Construction: Dual Drive RH Sit -Down type. Low Entry Tilt cab,
providing convenient and frequent access in and out, located low and
forward of front axle. A 19" floor height from ground (no steps allowed
in measurement) on both sides of cab is provided with standard front tires.

passage to both seat positions. Maximum interior space is provided with
the engine enclosure low and projecting no further forward than the

and correcting the fault can reset breakers. Dedicated electrical circuits

BACKGROUND:
In August of 2007, the OPWA Trustees and the City Council authorized a Revenue Anticipation
Note (RAN) to provide financing for the Garnett Regional Detention project. The $1,742,519.08
current balance of the RAN has provided funding for engineering, the land purchase and Phase I of
the project.
The OWRB (Oklahoma Water Resources Board) provides low interest long -term financing for water
and wastewater projects as well as urban stormwater and watershed management projects. Since
1992, all of Owasso's water and wastewater projects have been financed by the OWRB. Recent
changes in federal legislation have made financing through the OWRB especially advantageous at
this time. Financing this stormwater project through the OWRB would increase the amount in
Owasso projects that could be eligible for federal stimulus funding. Therefore, staff has reevaluated
the financing options for this stormwater project and believes that OWRB funding is the most cost
effective for this project.
Resolution No. 2009 -02 authorizes the application to the OWRB for financial assistance through the
OWRB State Revolving Fund for the purpose of financing stormwater system improvements.
Additionally, the resolution authorizes payment of a loan application fee to the OWRB and
authorizes Wells Nelson & Associates (Keith McDonald) to act on behalf of the OPWA.
If the application for funding is approved by the OWRB, authorization for the loan would require
additional action by the OPWA Trustees and the City Council at a future meeting.
RECOMMENDATION:
Staff recommends Trustee approval of OPWA Resolution No. 2009 -02 a resolution agreeing to file
application with the OWRB for financial assistance through the OWRB State Revolving Fund Program
for the purpose of financing the Garnett Regional Detention project and containing other provisions
related thereto.

PROGRAM, WITH THE LOAN PROCEEDS BEING FOR THE PURPOSE OF

WHEREAS, The Owasso Public Works Authority (the "Authority ") has under
consideration improvements to the storm water system serving the City of Owasso, Oklahoma, to
include improvements necessary to upgrade the stormwater system including stream channel
improvements, wetland mitigation, and construction of the 96th Street and Garnett Regional
Detention Pond, and other related engineering design and construction (collectively, the
"Project "); and
WHEREAS, it is deemed desirable for the Authority to give preliminary authorization for
the issuance of obligations for such purpose; and
WHEREAS, the Oklahoma Water Resources Board has made monies available to qualified
entities for the financing of certain qualifying projects; and
WHEREAS, the Authority hereby agrees to file an application(s) with the Oklahoma Water
Resources Board for financial assistance in the aggregate amount as, based upon engineering
studies currently in progress, will be sufficient to pay certain of the costs associated with the
referenced Project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
OWASSO PUBLIC WORKS AUTHORITY, THAT:
Section 1. Application. The Authority shall file an Application(s) with the Oklahoma
Water Resources Board seeking financial assistance through the OWRB State Revolving Fund
Program; and the Chairman or Vice Chairman and Secretary or Assistant Secretary of the Authority
are hereby authorized to execute said Application(s) for and on behalf of the Authority. The
Authority is further authorized to advance to the Oklahoma Water Resources Board the necessary

MEETING AGENDA

BACKGROUND:
The City Council, Owasso Public Works Authority and the Owasso Public Golf Authority are
broadly vested with authority under the City's Charter, the Oklahoma Constitution and
Oklahoma statutory law to adopt and implement efficient and equitable policies and procedures
governing their public meetings. Meetings of a public body should be conducted in an orderly
manner and in accordance with the rules of parliamentary procedure. Adherence to parliamentary
procedures enables a governing body to remain focused on a single issue until that particular
matter is fully resolved and to make informed decisions following due consideration of the
matter before the public body's members. Development of Policies and Procedures, based upon
the rules of parliamentary procedure, furthers a public body's foundational goal of conducting its
meetings with order and in a manner that allows for public participation, accountability and
additional transparency of government.
Items for discussion and items requiring action by the City Council, OPWA and OPGA have
traditionally been placed on the appropriate public body's agenda either by a City Council
member, a Trustee of the OPWA or OPGA, City Staff or at the request of a citizen residing in
the City of Owasso. In some instances, circumstances change following the original request that
an item be placed on a City Council, OPWA or OPGA agenda, and the City Council member,
Trustee, Staff member or citizen have subsequently desired to: 1) remove the item from the
agenda and reschedule consideration of that matter on a date certain in the future, or, 2) remove
the item from the agenda for an indefinite period of time without specifying the date upon which
the matter will be considered in the future. In the past, items have been removed from an agenda
upon the request of any City Council member or Trustee or upon recommendations from Staff.
Inevitably, however, some confusion has been created when items have been removed from an
agenda prior to the public body's meeting. Neither the City Council, OPWA nor OPGA have
previously adopted policies or procedures governing removal of items from an agenda, thus there
are currently no written policies or procedures mandating the process to be followed when items
are placed upon an agenda and later removed.
Pursuant to the City Council's request, Staff has reviewed removal policies utilized by other
municipalities, and has additionally researched the Oklahoma State Statutes, the City's Charter
and the Code of Ordinances for the City of Owasso to determine what options exist and the type
of policy that would most effectively enable the City Council, OPWA and OPGA to conduct
orderly and efficient meetings while striving to diligently represent the citizens of Owasso with
trust and respect. Accordingly, a policy has been drafted by Staff for consideration by the City
Council, OPWA and OPGA. The policy states that once an item has been placed on an agenda
and the agenda has been duly posted in conformance with the Oklahoma Open Meeting Act, the
item may be stricken from the agenda only upon request from the Council member, Trustee,
Staff member or citizen who originally requested that the item be placed on the agenda. When a
request is made by such a person, the item shall be removed from the agenda without the
necessity of a motion, second or majority vote.
A request to remove an item from an agenda may also be made by a Council member, Trustee,
Staff member or citizen other than the person who initially requested inclusion of the item on
the agenda. However, the item will only be removed if a motion to remove the item and
postpone consideration of the matter indefinitely is made during a City Council, OPWA or
OPGA meeting by a Councilor or Trustee and is approved. Once a motion to postpone the
matter indefinitely has been made, it shall require a second and must receive an affirmative vote
by a majority of the Council members or Trustees present at the meeting. The item may later be
placed on a subsequent agenda of the City Council, OPWA or OPGA if desired, or the item may
be removed from the agenda and never be placed on a subsequent agenda for consideration
It is important to note that parliamentary procedure requires a motion to table if a matter is to be
stricken from a current agenda and placed on a subsequent agenda on a date certain. In contrast,
a motion to remove an item from an agenda and indefinitely postpone also allows an agenda
item to be stricken from the current agenda but does not require that the matter be considered on
a specific date, or ever, in the future. A motion to postpone indefinitely is much more flexible
than a motion to table, and allows an item to be stricken from an agenda without requiring that it
be considered on a date certain in the future. A policy of this type allows matters to be removed
from an agenda without compelling the City Council, OPWA or OPGA to reschedule
consideration of the matter on a definite date in the future, and, in fact, does not require that the
matter ever be placed on a future agenda. Of course, nothing within the proposed policy
prohibits a Councilor or Trustee from moving that an item be tabled until a future meeting on a
specified date if the Councilor or Trustee wishes to do so, just as the policy does not prohibit the
item removed from the agenda from being heard in the future if a Councilor or Trustee wishes to
do so. The proposed policy merely provides an additional procedure through which an item may
be removed from an agenda without compelling the public body to consider that matter on a
future date.
RECOMMENDATION:
Staff recommends approval of Policy No. 2009 -01 governing the process to be utilized by the
OPWA Trustees, staff and citizens for removal of items from a meeting agenda.

POLICIES AND PROCEDURES
No. 2009 -01
Policy Statement:
The purpose of policies adopted and implemented by the Owasso City Council, Owasso Public
Works Authority and the Owasso Public Golf Authority are to develop efficient and equitable
procedures for the City Council and the Public Works and Golf Authorities to utilize during
meetings, and to provide general information regarding City Council and Authorities to the
public. This policy is not designed to create any additional rights or obligations and does not
confer any procedural rights upon any City Council member, Trustee, City staff or citizen
beyond the adopted procedures herein. Failure of the City Council, Public Works Authority or
Golf Authority to strictly follow the recommended procedures described herein shall not affect
the validity of any meeting or action taken by the City Council or Public Works or Golf
Authority. To the extent a conflict or discrepancy exists between the Policies and Procedures
adopted by the City Council, Public Works Authority and Golf Authority and the Owasso
Charter and/or Owasso Code of Ordinances, the Charter and Code provisions shall prevail.
Policy No. 2009 -1: Removal of an Item from an Owasso City Council, Owasso
Public Works Authority or Owasso Public Golf Authority Agenda; Motion to
Postpone Indefinitely.
Procedure:
A. Once an item has been placed on the agenda for a Owasso City Council, Owasso
Public Works Authority or Owasso Public Golf Authority meeting, and the agenda
has been duly posted to provide public notice in conformance with the City's Charter,
the City's Code of Ordinances and the Oklahoma Open Meeting Act, the agenda item
may be stricken only by the City Council member, Trustee, staff member or citizen
who originally requested that the item be placed on the agenda. If a request to
remove an item is made by such a person, the item shall be removed from the agenda
without requiring a motion, second or majority vote of that public body.
B. If a City Council member, Trustee, staff member or citizen desires to remove an item
from a City Council, Public Works Authority or Golf Authority agenda that he or she
did not place on the agenda, a motion to postpone consideration of the item
indefinitely must be made by a City Council member or Trustee during the meeting.
The motion shall require a second, and must be approved by a majority vote of the
City Council members or Trustees present in the meeting. If a request to remove an
item from an agenda is approved by a majority vote, the item shall be stricken from
the agenda, and consideration of the item shall be postponed indefinitely. The item
may be placed on a subsequent agenda by a City Council member, Trustee, staff
member or citizen.
