All matters listed under "Consent" are considered by the Trustees to be routine and will be enacted by one motion. Any Trustee may, however, remove an item from the Consent Agenda by request. MEETING OF THE OWASSO ECONOMIC DEVELOPMENT AUTHORITY MINUTES OF MEETING Thursday, March 12, 2009 The Owasso Economic Development Authority met in regular session on Thursday, March 12, 2009 in the Main Conference Room at Owasso City Hall per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 5:00 PM on Tuesday, March 10, 2009. ITEM 1: CALL TO ORDER & ROLL CALL Chairman Charney called the meeting to order at 10:04". Mr. Wiles provided a review of the February building pen-nit report and infonnation relating to the upcoming Planning Commission items for April 2009. March 12, 2009 ITEM 4: REPORT FROM PUBLIC WORKS DIRECTOR Mr. Stevens gave a project status report on various capital improvement projects and other Public Works related items. ITEM 5: REPORT FROM ECONOMIC DEVELOPMENT DIRECTOR Ms. Harkins reviewed the Director's Report included in the agenda packet. Also discussed were changes to the current website in order to provide more detailed information regarding Owasso's Business Incubator. ITEM 6: REPORT FROM OEDA MANAGER Mr. Ray provided information on the following items: E. 86th Street North & N. Garnett Intersection improvements, the Federal American Recovery and Reinvestment Act, and Bell's Amusement Park. Discussion was also held regarding visuals and reports distributed by Dr. Mark Snead at the Economic Summit and the possibility of bringing someone from the OSU office to provide explanation and answer questions. Mr. Kimball leaves at 10:55am. ITEM 7: REPORT FROM OEDA TRUSTEES No Report provided. Dr. Spriggs asked for clarification of the E. 76th Street Sewer Interceptor Project. Final loan documents were approved by the OEDA in May of 2005. The City of Owasso invested $2,000,000 in the RAN issued by the OEDA. Additionally, the City of Owasso transferred $71,250 to the OEDA to fully fund the expected five -year expenses for interest on the RAN and for a letter of credit on the Vanguard loan. The final agreements with all parties were signed on June 28" and funds were transferred June 30, 2005. A requirement of the loan was that an Irrevocable Letter of Credit be obtained from Arvest Bank and that the OEDA would be responsible for the associated fees to Arvest Bank. Vanguard began making quarterly $100,000 payments to OEDA on September 1, 2005 and made final payment for the balance of the loan in January of 2008. Because the loan was paid off early, the actual cost to the OEDA was less than the funds advanced by the City. $46,560.28 was expended for the letter of credit and for interest on the RAN leaving a balance of $24,689.72 unexpended. The balance of funds advanced to the OEDA by the City was transferred back to the City's General Fund in February of 2008. Subsequent to these events, Arvest Bank invoiced the OEDA $7,014.58 for the fees for the final period of the Letter of Credit. The period billed and the amount owed was disputed resulting in additional delay in bringing this item to the OEDA Trustees. After discussions with Arvest Bank by Angela Hess, City Finance Director, Arvest Bank has reduced the invoice to $2,535.42. In 2005, the City of Owasso had agreed to fund expenses to the OEDA associated with the Letter of Credit. The unexpended funds were returned from the OEDA to the City last year. In order to provide those funds to the OEDA again, a payment to the OEDA from the City of Owasso for $2,535.42 has been included on the City Claims List for consideration by the City Council on April 7. This request is for authorization for payment to Arvest Bank for the $2,535.42 invoice. RECOMMENDATION: Staff recommends OEDA Trustee approval of a payment of $2,235.42 to Arvest Bank for charges for the Letter of Credit issued for Vanguard Car Rental per the loan agreement. Avenue Widening Project (South of Home Depot to E 76th Street North) Council awarded the construction contract to Becco Construction in the amount $8,320,902.80 on August 21, 2007. - A Notice to Proceed was issued on October 1, 2007 with substantial completion (450 calendar Days) scheduled for December 23, 2008 and final completion (510 calendar days) scheduled for February 21, 2009. Excluding additional sidewalk replacement, the widening improvements from E. 76th Street North to E. 86th Street North are complete. - Utility Crews continue the installation of underground utilities from E. 89th Street North to E. 94th Street North. This phase of construction is expected to be complete by mid -April 2009. - In order to expedite final completion of the road improvements and reduce construction costs, the City has authorized Becco Contractors to close a section of N. 129th East Avenue, between E. 90th Street North and approximately E. 94th Street North, beginning April 6, 2009. The road closure will last approximately 45 days, but could be extended if adverse weather conditions limit construction. This road closure has been coordinated with Owasso Public Schools as well as all City of Owasso Public Safety entities. Through the course of this project, the contractor has received approximately 90 rain days resulting in a revised schedule for completion in May 2009. • E. 86th Street North Widening (from Main Street to N. Memorial Drive - Funding for the construction of this project is a result of a "matching grant "; 80% ODOT funding and 20% City funding. - An Engineering design for the project was completed in September 2008. - An Environmental Assessment was approved by ODOT in December 2008 and by the Federal Highway Department in February 2009. - Staff anticipates right -of -way negotiations and utility relocations to be completed in July 2009. - Staff anticipates construction to begin in August 2009. E. 106TH Street North and Garnett Road Intersection Improvement Project - A $750,000 grant from ODOT was approved February 2009. - On March 24, 2009, Council awarded an engineering design contract with PSA Dewberry. Staff anticipates the Engineering Design to be completed in October 2009. Staff anticipates right -of way negotiations and utility relocation to be complete by November 2009. Construction is expected to begin in January 2010 and completed by September 2010. Tulsa Community College /Tulsa Technology Center Road Construction Project On July 15, 2008, the City Council awarded an engineering agreement in the amount of $162,500.00 Crafton, Tull, Sparks. The Engineering Design is scheduled for completion in April 2009. - Staff anticipates construction to begin in June 2009 and completion by October 2009. Street Improvement /Repair Project (FY 2008 -2009) Street Repair: - On September 16, 2008, the City Council approved the street repair priorities for FY 2008 -2009. - On October 18, 2008, the City Council approved an interlocal agreement with Tulsa County for county personnel to perform the street overlay and resurfacing with materials purchased by the City of Owasso. - Staff anticipates seeking bids in April 2009 from private contractors to complete the needed base repairs. - Staff anticipates project completion in August 2009. Traffic Signal Enhancements: - On October 7, 2008, the City Council awarded an engineering agreement in the amount of $37,000 to Traffic Engineer Consultants, Incorporated. - In October 2008, the consultant began a traffic study and submitted their final report to city staff in February 2009. - Staff has completed their review of the report and has completed bid specifications for the recommended hardware and' installation services. Staff anticipates advertising for bids in late April 2009. - Staff anticipates project completion in July 2009. Wastewater Treatment Plant and 117th Street Lift Station Upgrade - The Engineering Design was completed in September 2008. - A Public comment period began August 29, 2008 as required by the ODEQ and ended October 13, 2008. - Staff anticipates advertising for bids in May 2009. - Staff anticipates construction to begin in June 2009 and Final Completion (480 calendar days) scheduled for October 2010. East 76th Street North Sanitary Sewer Interceptor - The Engineering Design was completed in March 2009. - Staff anticipates the Environmental Process to be completed by May 2009. - Staff anticipates advertising for bids in June 2009. - Staff anticipates Phase I Completion (North 143 d East Avenue to North 171St East Avenue) by February 2010; and Phase II Completion (North 171St East Avenue to North 193rd East Avenue) by September 2010. East 96 Street North Regional Detention (Phase II and III — Detention Facility/ Garnett Structure Modifications) - The engineering design was completed March 2009. - Staff anticipates advertising for bids in May 2009 and awarding a construction contract in June 2009. - Staff anticipates final completion (130 calendar days) in September 2009. HARKINS DIRECTOR OF ECONOMIC DEVELOPMENT SUBJECT: DIRECTOR'S REPORT DATE: April 9, 2009 CORPORATE RELOCATION AND JOB CREATION BioEDEN, Inc., an advanced bioscience and technology -based company specializing in banking Stem Cells from children's deciduous teeth for future therapeutic uses. The company currently employs eight scientists and hopes to grow to thirty in the next three years. Company representatives have been traveling abroad and finalized funding. Staff is working with the Oklahoma Department of Commerce to evaluate eligibility for incentives and programs. Staff will continue to pursue BioEDEN while actively recruiting other tenants for the business incubator. RETAIL DEVELOPMENT Smith Farm: JC Penney,Ross Dress for Less and Famous Footwear have been open for business for a month and have brought in record sales since opening doors. The Sevens: Tapp Development of Edmond is developing 7 -acres to include a hotel, retail and restaurant complex on the east side of Garnett, south Owasso Expressway. The three restaurant /retail areas have not been announced. They will begin the development this month. Tapp Development /Wal -Mart Neighborhood Market: Seventy percent of the former Albertsons grocery store will be a Wal -Mart Neighborhood Market. Tapp Development is working on securing a tenant for the other thirty percent. Tapp has purchased the neighboring 22,000 square foot Owasso Town Center shopping complex. Predictions indicate a Summer opening for the Wal -Mart Neighborhood Market. QuikTrip: A QuikTrip convenient store is locating on the northwest corner of 96th & Garnett. Construction is ongoing. Walgreens and McDonalds are under construction at Morrow Place, 116th Street N. and HWY 169. The Alabaster Grille has opened to provide fine dining in the former 3 Tomatoes & a Mozzarella location. HOTEL DEVELOPMENT The Marriott Towne Center is under construction in Tyann Plaza. The Sevens will feature a four - story, 94 -room LaQuinta Inn and Suites by Champion Hotel Development of Oklahoma City. It will be 17,000 square feet on approximately two acres of land. ECONOMIC DEVELOPMENT NOTABLES Staff is working with three different companies to bring in a potential total of up to 1500 quality jobs. As discussions develop, staff will provide updates. Staff will be meeting with companies at the Cherokee Industrial Park, Tulsa International Airport and Port of Catoosa this month to seek opportunities and gather information. Staff has also updated marketing materials and the Economic Development page of the City of Owasso website. Cluster industry materials are being developed.
