Mr. Ray will introduce the Employee of the Month for June 2006.
7. Consideration and appropriate action relating to a request for Council approval of the
Consent Agenda. All matters listed under "Consent" are considered by the City Council to
be routine and will be enacted by one motion. Any Councilor may, however, remove an

No. 6 (Pleasant View Estates Addition) sufficient to pay the interest, principal, and

units in a senior living facility, located on three acres immediately west of Rejoice Church,

living facility, located on three acres immediately west of Rejoice Church, on the north side

Housing Incorporated.
9. Consideration and appropriate action relating to a request for Council adoption of
Resolution No. 2006-14, a resolution in support of an award of tax credits to Vintage
Housing, Incorporated for the development of Prairie Village, a 40 unit senior living
facility, located on three acres immediately west of Rejoice Church, on the north side of E.
106th Street North and west of the Owasso Expressway.

The Owasso City Council met in regular session on Tuesday, May 16, 2006 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall

E. Adoption of Resolution No. 2006-09, a resolution approving the City of
Owasso's continued participation in the Metropolitan Tulsa Home Consortium
and authorizing the Mayor to execute the Metropolitan Tulsa Home
Consortium Agreement.
F. Adoption of Resolution No. 2006-11, a resolution requesting assistance from
the Oklahoma Department of Commerce "Small Cities Community
Development Block Grant"
G. Adoption of Resolution No. 2006-12, a resolution committing funds in the
amount of $66,450.00 as the required match for the Small Cities Community
Development Block Grant.
H. Approval of a Citizen Participation Plan for the FY 2006 Community
Development Block Grant program and authorization of the Mayor to execute
all related documents.
L Acceptance of the Barnes Elementary 'Sanitary Sewer Interceptor Line,
consisting of approximately 565 linear feet of eight -inch, 1,178 linear feet of
ten -inch, and 2,871 linear feet of eighteen -inch PVC sanitary sewer line.
Mr. Guevara moved, seconded by Ms. Kimball, to approve the Consent Agenda with claims
totaling $367,559.04, self-insurance medical claims & fees totaling $41,445.37, and payroll
claims totaling $347,332.32.

ITEM 17. REPORT FROM CITY MANAGER.
Mr. Ray stated, in regards to an article in the Tulsa World newspaper about Change Orders, that
he hoped Owasso citizens understood that Change Orders that are accepted by the Owasso City
Council are determined by actual cost. This article indicated that some change orders were based
on estimates.
Mr. Ray also said, in response to a question from Councilor Gall regarding the timeline for the
water line from Tulsa, that he had visited with City of Tulsa representatives regarding this, and
hoped to have an update in the near future. He also stated that he had met with City of Tulsa
regarding the water rate increase and was hoping to hold them to the increase percentage they
had mentioned 8 months ago.

Councilor Kimball welcomed Boy Scout Troop 80 to the meeting, and complimented them on
their presentation of the colors & flag salute and their decorum in the Council meeting.

At the May 16, 2006 meeting, the Owasso City Council approved an Annexation request (OA 06-06)

In 1995, homeowners in the Pleasant View Estates Addition approached staff concerning the
ability to connect to City sewers in order to alleviate septic system problems in their subdivision.
The addition was outside the City limits at that time, but collection lines were designed in
conformance with established city criteria. The area was recently annexed into the city.
The homeowners elected to form a Sewer Improvement District (Tulsa County Sewer
Improvement District No. 6) and issue bonds to finance construction. On February 18, 1997,
Council agreed to accept, operate and maintain the system contingent upon the vote of the District.
In March 1997, the District held an election to consider the transfer and conveyance of the sewer
system to the city. The District agreed to the consolidation.
The "Agreement for Consolidation of Sewer Improvement District with City of Owasso and for
Connection of Sanitary Sewer Systems to Existing Excess Capacity Sanitary Sewer System" was
approved by Council on April 21, 1998. That agreement provided that the City would:
1. Accept the sewer system and consolidate the District with the City, and
2. Collect a reimbursement from properties subsequently connected to the system that utilize
excess capacity. Reimbursements to be calculated in the amount of $1,338.58 per acre and
be applied solely to amortization and satisfaction of the bonded indebtedness.
3. Give notice, equalization and levy of assessments for satisfaction of bonded indebtedness.
On August 6, 1998, the District transferred all assets of the District, to the City of Owasso. The
amount received from the District paid the first payments of bonds and interest, which were due
November 1, 1998. Each year, the City Council authorizes the assessment of the consolidated
Sewer District for each property owner. The last assessment paid the bond interest due on May 1,
2006 and will pay the bond principal and interest due on November 1, 2006.
ASSESSMENT FOR 2006:
In order to assure the continued flow of money from the District to pay for the interest and
principal of the bonds, it is necessary to assess the homeowners on an annual basis. In calendar
2007, the amount of principal and interest due is $5,000 and $1,170, respectively. In addition,
10% may be collected to set aside as a reserve for any nonpayment of assessments.
This year, each homeowner assessment will be a total of $617.00, which includes $500.00 for
principal, $117.00 for interest. This amount must be assessed now to receive payment in early
2007. Upon acceptance, staff will mail notifications to homeowners in Pleasant View Estates
concerning assessment and also to the Tulsa County Treasurer for actual assessment.

The staff has been contacted by Vintage Housing, Inc. about a proposed tax credit apartment
development. The development proposes 40 units in a senior living facility on three acres immediately
west of Rejoice Church, on the north side of East 1066' Street North just west of the Owasso
Expressway. The proposed name of the development is Prairie Village.
Rejoice Church proposes to donate the three acres to Vintage Housing, Inc. so that a senior living
facility can be built near their location. The development of the apartments would help to facilitate the
extension of sanitary sewer service towards the Rejoice property, enabling the future expansion of the
church and school.
In accordance with Ordinance No. 808, adopted February 15, 2005, the apartment development must
be included within a Planned Unit Development (PUD). A PUD for this project is currently under
design, and it is anticipated that the Planning Commission and City Council will be able to consider
approval of the PUD in June. If the PUD is approved, the property would then be platted and a site
plan would be developed for the project. The use would be in compliance with the Owasso Master
Plan, and the staff believes that the subject property should be developed.
The Oklahoma Housing Finance Agency (OHFA) is the jurisdiction that approves tax credits for
developments like Prairie Village. Every year, OHFA reviews applications from throughout, Oklahoma
and allocates tax credits based on a set of competitive criteria. Many of these criteria are directly
related to the support that communities are willing to give the developments.
One threshold criterion set forth by 0HFA is the adoption of a "Local Resolution of Support" from the
municipality in which the development is located. Such a resolution would state that the City Council
supports favorable consideration to be given for a tax credit award for the development, Ordinance
No. 502, adopted May 16, 1995, states that a resolution could only be considered after the City
Council conducts a public hearing related to the proposed development.

In order to further facilitate the development of the senior living facility, it is anticipated that future
action will be requested for the City of Owasso to create a tax incentive district, which would provide
ad valorem property tax relief for a period of five years. For the district to be created, the City Council
would first be required to create a local review committee and appoint one Council member to serve
on that committee. The local review committee would be comprised of representatives from each
property tax beneficiary, such as Owasso Public Schools, Tulsa County, and the health department.
Separate agreements approving the creation of the tax incentive district would be required from all
beneficiaries; each organization would have the power of veto. After the committee's development of
a project plan, and the presentation of that plan at two separate public hearings, the City Council would
be requested to pass an ordinance creating the district. The staff expects the request for the creation of
the tax incentive district will be made in the Fall of 2006.

award of tax credits to Mintage Housing, Incorporated for the development of Prairie Village.

Pursuant to statutory and Charter provisions, an annual operating budget for the General Fund,
OPWA Fund, OPGA Fund and other funds of the City has been developed and transmitted for your
review. The Municipal Budget Act requires that a public hearing on the proposed budget be
conducted by the City Council not less than 15 days prior to the beginning of the budget year. Notice
of the date, time and place of the hearing together with the proposed budget summary must be
published not less than five days before the hearing. The governing body must adopt the budget by
resolution at least seven days prior to the beginning of the fiscal year. The adopted budget must be
filed with the State Auditor & Inspector on or before July 1 St
The proposed budget summary and notice of the June 61h public hearing were published in the Owasso
Reporter on May 23, 2006. The public hearing provides an opportunity for citizen comment and
questions relating to the proposed budget. The proposed budget has been available for public review
at City Hall, at the Owasso Library and on the City's web site.
Resolutions adopting budgets for fiscal year 2006-2007 will be on the City Council, the OPWA and
the OPGA agendas in two weeks on June 20th.

A City of Owasso sponsored fireworks display is planned to be conducted on Friday evening June
30, 2006. City Code requires approval from the City Council for any public display of fireworks
within the city celebrating Independence Day. A copy of that section of the City Code as it relates to
fireworks displays is attached for your information and review.
Representatives of both the Fire and Police Departments have been consulted in order to coordinate
the event and address safety concerns. It appears that those issues concerning public safety are being
adequately addressed.
The City sponsored celebration will be limited to the fireworks show. Imperial Fireworks Company
will once again present the fireworks display. The display will be open to the public and will be
located at the Owasso High School stadium. Gates to the stadium will open at 6:00 PM
RECOMMENDATION:
Staff recommends Council approval of the City sponsored fireworks display on June 30, 2006.

SECTION 10-304 FIREWORKS PROHIBITED
A. Except as provided in Subsection B of this section the sale, use, display, firing,
igniting, lighting or discharge of fireworks within the city is unlawful and an offense.
B. The following are exceptions to the prohibitions in Subsection A:
1. The firing, igniting or lighting of the following are exempt from the prohibition
contained in Subsection A of this section: sparklers, fountains, pinwheels and all such types of
fireworks that are not explosive or noise making in character and are stationary. Not included in
this exception are Roman candles, bottle rockets and sky rockets;
2. The city council may, for the common good, approve and sponsor a public
display of fireworks within the city celebrating Independence Day. The public display of
fireworks must meet each of the following requirements:
a. The group organizing the event and igniting the fireworks must obtain
the city council's specific approval for the event;
b. The event must be open to the public, free of charge;
C. The use, display, firing, ignition, lighting and discharge of the fireworks
must be done in the presence of an authorized representative of the city fire
department; and
d. The group(s) organizing the event and igniting the fireworks must
indemnify and hold the city harmless for any damage caused by the event and
provide an insurance policy, with the city named as an insured, covering and
protecting the city from liability to the extent it is not immune by state law.

The Owasso Golf and Athletic Club has submitted a letter requesting City Council approval of a
public fireworks display. The display is planned to be conducted on Saturday evening, July 1, 2006.
City Code requires approval from the City Council for any public display of fireworks within the city
celebrating Independence Day. A copy of that section of the City .Code as it relates to fireworks
displays is attached for your information and review.
Representatives of both the Fire and Police Departments have been consulted in order to coordinate
the event and address safety concerns. It appears that those issues concerning public safety are being
adequately addressed.
The Owasso Golf and Athletic Club sponsored celebration will be presented by Western Enterprises.
The display will be open to the public and will be located on the driving range at the Owasso Golf
and Athletic Club facility on E. 86th Street North between N. 129"' and N. 1451h E. Avenues. The
show is scheduled to begin at dusk.
RECOMMENDATION
Staff recommends Council approval of the Owasso Golf and Athletic Club sponsored fireworks
display on July 1, 2006.

SECTION 10-304 FIREWORKS PROHIBITED
A. Except as provided in Subsection B of this section the sale, use, display, firing,
igniting, lighting or discharge of fireworks within the city is unlawful and an offense.
B. The following are exceptions to the prohibitions in Subsection A:
1. The firing, igniting or lighting of the following are exempt from the prohibition
contained in Subsection A of this section: sparklers, fountains, pinwheels and all such types of
fireworks that are not explosive or noise making in character and are stationary. Not included in
this exception are Roman candles, bottle rockets and sky rockets;
2. The city council may, for the common good, approve and sponsor a public
display of fireworks within the city celebrating Independence Day. The public display of
fireworks must meet each of the following requirements:
a. The group organizing the event and igniting the fireworks must obtain
the city councils specific approval for the event;
b. The event must be open to the public, free of charge;
C. The use, display, firing, ignition, lighting and discharge of the fireworks
must be done in the presence of an authorized representative of the city fire
department; and
d. The group(s) organizing the event and igniting the fireworks must
indemnify and hold the city harmless for any damage caused by the event and
provide an insurance policy, with the city named as an insured, covering and
protecting the city from liability to the extent it is not immune by state law.
