Bailey Water Tank Site Adjournment S.\1gendasTouncil Work Session\2006\0613. doc CITY OF TO: THE HONORABLE MAYOR AND COUNCIL FROM: ; r , r FIRE CHIEF DEPARTMENT OF HOMELAND SECURITY SAFERAO BACKGROUND: The Fire Department seeks to apply for Department of Homeland Security Staffing for Adequate Fire and Emergency Response (SAFER) Grant Program. The proposed application is for funding for career firefighter positions within the Owasso Fire Department. SAFER GRANT PROCESS: Fire departments are able to request grant monies under two broad categories in the Staffing for Adequate Fire and Emergency Response (SAFER) Grant Program: hiring of career firefighters and recruitment and retention of volunteer firefighters, The Owasso Fire Department proposes the funding of six (6) additional firefighters which will complete the hiring process for fire station #3, as well as ensure adequate staffing levels for the two current fire stations. Created by Congress in 2003, the SAFER Grants are meant to help communities with career, volunteer and combination fire departments to "meet industry minimum standards and attain 24-hour staffing to provide adequate protection from fire and fire-relatcd hazards, and to fulfill traditional missions of fire departments that antedate the creation of the Department of Homeland Security." GRANT FUNDING: The SAFER program funds fircfighter positions not currently budgeted at the following rate per awarded firefightcr: Year 1: 90% of the actual cost. Year 2: 80% of the actual cost Year 3: 50% of the actual cost Year 4: 30% of the actual cost Year 5: no federal funding. ADDITIONAL, COMMENTS: One of the central goals of SAFER is to better prepare fire departments in responding to emergencies. To this end, the Owasso Fire Department's grant application will provide the staffing necessary to protect the City of Owasso and surrounding area out of the City's three fire stations (as of August, 2007). Additional staffing after this grant opportunity will hinge upon the construction of fire station #4. Staff is prepared to submit the grant application provided there are no concerns expressed by the City Council on Tuesday evening. If the City of Owasso is a recipient of the grant, an action item will be placed on the City Council Agenda at that time. i TO: THE HONORABLE MAYAND COUNCIL CITY OF OWASSO FROM: BRADD K. CLARI FIRE CHIEF E It DATE:2006 BACKGROUND The Fire Department applied for and received a grant from the Department of Homeland Security Commercial Equipment Direct Assistance Program (CEDAP). The grant award is for the acquisition of a hydraulic pump and rescue tools for use at rescue incidents involving entrapment of occupants. The value of this grant award is approximately $20,000. CEDAP GRANT PROCESS Emergency responder agencies are able to acquire specialized commercial equipment through a direct transfer program initiated by the Department of Homeland Security's (DHS) Office of State and Local Governinent Coordination and Preparedness (SLGCP). Through a Congressional mandate, the new DHS program will transfer technologies directly to smaller jurisdictions and eligible metropolitan areas. One of the central goals of CEDAP is to assist smaller jurisdictions who cannot otherwise afford state-of-the-art equipment for their roles in important homeland security missions. The CEDAP acquisition process does not require matching funding from the municipality nor does it require emergency response beyond what the current services provided by the City of Owasso. HYDRAULIC RESCUE TOOLS The grant award is for ANIMUS hydraulic spreaders, cutters, and rams. The ANIMUS rescue tool system will be an addition to our current tool capability, and will be stored and utilized on Fire Station #3's fire engine, if accepted. It is predicted that the acquisition of this tool system will be beneficial in the Insurance Services Office (ISO) grading of the City of Owasso, as well as the service delivery program of the Owasso Fire Department. The City of Owasso has previously received an award through the CEDAP program, when a Bullard Thermal Imaging Camera (TIC) was secured for the Fire Department. GRANT FUNDING: The CEDAP acquisition program requires no matching funds from the City. DHS will purchase and transfer the tool system, if accepted. RECOMMENDATION Staff intends to recommend City Council acceptance of the grant at the June 20, 2006 regular Council Meeting. !.5. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. ANNEXATION REVIEW P OCE S The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the request. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. .ANALYSIS The City of Owasso is requesting to annex approximately 3.5 acres of property, located at the southwest corner of East 100th Street North and North 145th East Avenue. It is the City of Owasso's intent to develop the property as its 3rd fire station. Construction is scheduled to begin in the summer of 2006, with a predicted completion of fall of 2007. Prior to construction, a site plan will be submitted to the Planning Commission for consideration. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. The Prairie Village PUD proposes 40 apartment units for senior citizens with low to moderate incomes. The staff has verified that federal guidelines would prevent the development from changing in the future to allow non -senior citizens to occupy the apartments. Undeveloped SURROUNDING LAND USE North: Undeveloped South: Large Lot Residential East: First Freewill Baptist Church & Rejoice School West: Large Lot Residential/Undeveloped _CONCEPTOF A PUD, The concept of a Planned Unit Development is to provide a creative alternative to conventional development where a particular tract is under common ownership or control and where a detailed development plan, outlining the development of the tract as a unit is proposed and submitted for public review. The use of a PU_D technique is a way to amend a zoning ordinance in accordance with a complete and coordinated plan of development for a larger parcel, rather than piecemeal individual changes using the variance process. The supplemental zoning district PUD must be approved by the City Council as a prerequisite to the Planned Unit Development. Ordinance No. 808, adopted in February, 2005 requires all now multi -family developments be included within a Planned Unit Development. ANALYSIS: OP UD 06-02 (Prairie Village) is a proposed planned unit development (PUD) comprised of approximately 3.5 acres. The development concept behind the Prairie Village PUD is for a proposed housing development for seniors. The 3.5 acre site is located on East I Oe Street North just west of Highway 169. The site has approximately 396 feet of frontage along East 10 th Street North. The proposed development consists of a two story building, including parking and drives. A conceptual Site Plan is attached for your review as Exhibit "A". The applicant is proposing a 35,000 sq. ft. building containing 40 dwelling units and related amenities. Unless modified by the Planning Commission, the proposed structure will consists of wood construction with 80% exterior brick masonry and 20% cementations board siding. All site lighting, landscaping, and signage will be in accordance with the requirements of the City of Owasso. As the market has evolved, the property owners feel it is appropriate and feasible to develop the area for residential purposes, as prescribed by the Master Land Use Plans of both Tulsa County and the City of Owasso. The staff concurs that a transitional use would be consistent with the development pattern taking hold in north Owasso along the Owasso Expressway and this pattern of growth is compatible with the Owasso 2015 Land Use Master Plan. According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on any PUD application and determine the following: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PI D is consistent with the stated purpose and standards of the PUD ordinance. a. To permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. To permit flexibility within the development to best utilize the unique physical features of the particular site; c. To provide and preserve meaningful open space; and d. To achieve a continuity of function and design within the development. FUTURE PLANK INg-ISSUVIS' Future planning issues must still be considered if the PUD is approved. If approved, the applicant must submit a plat, site plan, and infrastructure plans that must be approved by the City of Owasso. Sidewalks will be required along all public rights -of -way associated with the subject property. Perimeter sidewalks must be installed at the time of overall development, while the internal walks may be constructed as individual lots are developed. The applicant has identified the terrain of the area as relatively flat terrain. The existing soils on the site would appear to create no unusual development problems that are not typically encountered in development in and around the City of Owasso. Storm water detention is required and will be further defined at the platting stage. The developer will be responsible for extending sewer to the site. The staff published legal notice of the PUD request in the Owasso Reporter and mailed notices to property owners within a 300' radius of the subject property. The site is approximately 3.5 acres parcel of land located on E. 106`h Street North just west of Highway 169. It is bounded on the East and North by a Rejoice Baptist Church & School and on the West by vacant land. The site has approximately three hundred ninety -six (396) feet of street frontage along E. 106t' Street North. The proposed development consists of a two-story building, including parking and drives. A Conceptual Site Plan is shown on Exhibit "A" This building contains 40 units and related amenities. It has approximately 35,500 square feet of building area. Unless modified by the Planning Commission, the building framing will consist of wood construction with 80% exterior brick masonry and 20% of cementitious board siding. The exterior elevations of the buildings will be submitted to the City when design is available. Site lighting will be provided in accordance with the requirements of the City of Owasso. The Prairie Village landscaping plan will be designed to enhance the street frontage, screen the view of interior parking from the residential areas, and to create a pleasant environment within the site. The planting theme will highlight the site entries and building, and will utilize plant selections indigenous to Northeast Oklahoma that are durable and require low maintenance. All landscaping shall be provided in accordance with the Owasso Zoning Ordinance, except as noted herein. The frontage along E. 1061h Street North will have a ten (10) foot wide landscaped edge. The landscaped area will be planted with trees and shrubs that meet or exceed the requirements of the Owasso Zoning Code. The interior parking areas will include landscaped planting islands and shade trees, with a minimum of I tree per 15 parking spaces, and no parking space more than 75 feet from a landscaped area. Along the North and West sides of the property, a landscape buffer is proposed between this development and the adjacent properties. In this landscape buffer at least I tree per 25 lineal feet shall be installed along the entire property, and at least one-half of the trees shall be evergreen. An attempt will be made to save the existing large trees along the West side of the property. All trees will be selected from the approved tree list contained in the Owasso Zoning Code; trees required by code will be planted at a minimum size of 2" caliper. Shrubs required by code will be planted at a minimum 3-gallon container size. All landscape areas will be irrigated with an automatic irrigation system, and maintained per requirements of the Owasso Zoning Code. A detailed Site Plan is required for approval by the City of Owasso Planning Commission prior to the issuance of a building permit on this development. The applicant shall submit the Site Plan to the City and supply all information required. All trash dumpsters shall be screened with an opaque fence that is at least 6-feet high and taller than the proposed dumpster. A Site Grading & Utility Plan will be submitted to the City of Owasso Public Works Department for approval. The Conceptual Grading & Drainage Plan is shown on Exhibit B. The storm water from drainage areas will be conveyed downstream toward the off -site detention pond to be constructed by others. The Conceptual Site Utility Plan is shown on Exhibit C. All utilities are available to serve this development. Drainage and utility plans will be prepared in accordance with the City of Owasso requirements. These areas include property that is undeveloped and surrounded by municipal boundaries, the right-of-way of Hwy. 169, two elementary schools, and a church. Specifically, the areas of property are: 1. The new Barnes Elementary School 2. The right-of-way of Hwy. 169 south of East 76th Street North to the railroad overpass 3. Hodson Elementary School 4. 10 acres at 9302 North 129th East Avenue, between the Home Depot and Central Park 5. The Episcopal Church of the Holy Cross 6. The undeveloped tract at the southeast corner of East 96t1' Street North and North 129th East Avenue 7. The properties on the north side of East 96th Street North between I" Baptist Church and Hwy. 169 S. The right-of-way of Hwy. 169 from East 96th Street North to East 126th Street North The staff arrived at the determination of properties that should be annexed by evaluating recent growth patterns and the level of service that could be provided to the areas of annexation. Particular weight was given to properties that are completely surrounded by corporate limits, and weight was also given to undeveloped acreages. The staff has contacted the property owners affected by the proposed annexation and told them of the possibility of the City of Owasso annexing their property. Further, the staff has prepared a map of the proposed annexation and arranged for legal descriptions of the properties to be prepared. CONSENTUAL ANNEXATION — In most cases, before a city may annex territory, it must obtain the consent of the owners of at least a majority of the acres to be annexed to the municipality. The state law goes on to prescribe requirements for notice and a public hearing on the proposed annexation. However, there are two ways that a city can annex territory without having to obtain consent for a majority of the acres. ANNEXATION OF TRACTS LESS THAN FIVE ACRES EACH — If the territory to be annexed is subdivided into tracts or parcels of less than five acres and contains more than one residence, then the city is not required to obtain consent for a majority of the acres. THREE -SIDED ANNEXATION — The second type of annexation where consent is not required is one where three sides of the territory to be annexed are adjacent or contiguous to the property already within the city limits. In this type of annexation, the adjacent city property on each side must be at least 300 feet wide at its narrowest point (excluding adjacent right-of-way). ANNEXATION SERVICE PLAN — Before the city publishes and mails public notice of the annexation hearing, the city must prepare a plan to extend municipal services including, but not limited to, water, sewer, fire protection, law enforcement and the cost of such services appropriate to the proposed annexed territory. This annexation service plan must be made a part of the city's capital improvements plan, and the plan must be implemented within 120 months (10 years). The staff finds that, using the guidance of the Oklahoma Statutes, the City of Owasso could annex four of the eight properties listed above without being required to obtain consent for the annexation of a majority of the acres included within those properties. The staff has been told by representatives of Owasso Public Schools and the Oklahoma Department of Transportation that their four properties, the two elementary schools and the highway right-of-way, will receive annexation consent. The City of Owasso can annex the four remaining areas of property, located near the intersection of East 96"' Street North and North 129t' East Avenue, by way of the three -sided type of annexation. LAND USE - Within the annexation ordinance, the City of Owasso has the choice of either incorporating the properties as AG Agricultural or as the zoning the properties have been given by the County. The staff intends to recommend that the properties be annexed with the zoning classification given to them previously by Tulsa County. The 10 acres at 9302 North 129t" East Avenue and the Episcopal Church are each zoned AG Agricultural. The properties located at the intersection of East 96"' Street North and North 129t" East Avenue are zoned CS Commercial. It should be noted that annexation does not change the current land use of the properties. If a property that is annexed is occupied by a residential structure, that structure may remain and the use of that structure may continue indefinitely. Similarly, if a property is being used for the upkeep of livestock, the keeping of livestock may continue indefinitely. r First, the City Council, by adoption of a resolution at a regular meeting, must direct the city staff to prepare and publish notice of two public hearings concerning the annexation. This resolution must also direct that an annexation services plan be prepared for the affected properties. The Planning Commission would conduct the first public hearing and make a recommendation regarding the annexation to the City Council. The City Council would conduct the second public hearing, followed by its consideration of possible action related to the annexation. Finally, an ordinance effectively annexing the properties would have to be adopted. It is the staff s findings that the eight areas of property under consideration for annexation are a part of the Owasso community and ought to be a part of the Owasso incorporated area. After all, the two schools serve Owasso residents, the highway right-of-way is sandwiched by Owasso's corporate limits, and the residents who live in this territory shop in Owasso, go to church in Owasso, are part of the Owasso school district, have the Owasso zip code, and in large part consider themselves to be contributing parts of Owasso. This annexation would be another step in a continuing attempt to make the city's boundaries more uniform, and to remove many of the gaps within Owasso's corporate limits. Past decisions by the Tulsa County Board of Commissioners, made contrary to the designs of the Owasso Master Plan, have shown that it is reasonable that the City should examine unincorporated parts of the community throughout the area for the purpose of bringing uniformity to the city boundaries. Owasso has prepared an annexation services plan as part of the annexation process, and this plan will have to be implemented as part of the Capital Improvements plan within ten years. The annexation services plan is included as an attachment to this memorandum. Owasso fire and ambulance service already serve the area. Police and Community Development services will extend to the territory immediately upon annexation. Water lines are in place and currently serve the area. Sewer mains lie in the immediate vicinity of the areas and will be extended to the properties at the owners' request and expense. Refuse collection service will be made available to the properties, but not mandatory; the City of Owasso will not forcibly take over the area from existing refuse collection providers. The roads and stormwater drainage systems within the territory will be maintained to the levels of their current condition. The staff that prepared these recommendations represent Community Development, Public Works, Police, and Fire. In studying the possible annexations that the City could undertake to expand its corporate boundaries, the staff initially determined what properties the City might be able to annex immediately. Using a map of the city limits, the staff examined first those properties that are either bordered by adjacent city limits on three sides or are divided into tracts not more than five acres each. The map is attached with this memorandum. Further, the staff looked at the existing gaps in the city limit boundaries to determine what areas would be most desirable for annexation. Once the possible annexation areas were determined, the staff organized the different areas into three prioritized tiers of importance. Properties included within Tier 3, the highest priority areas, are those properties that the staff feels should be annexed quickly, so that municipal enforcement over development can occur as the properties develop. Particular weight was given to properties that are either completely surrounded by corporate limits, and weight was also given to undeveloped acreages. Properties included within Tier 2, the medium priority area, are those properties that the staff believes should be studied further before annexation, or that must wait until other properties are annexed so that the City can then legally pursue the annexation of the Tier 2 properties. Properties included within Tier 1, the lowest priority area, are those properties that the staff does not believe should be annexed at this time. These lower priority properties tend to be already - developed, outlying subdivisions that do not by themselves form a gap in the corporate limits. HIGH PRIORITY ANNEXATION AREAS: As shown on a second map attached with this memorandum, the staff has identified 21 different locations of property that are included in the list of high priority annexations. It should be noted that the Owasso Expressway right of way doesn't fall into either of these categories; consent from ODOT would be required. As shown on the third attached map, there are six identified locations that the staff believes should be annexed into Owasso, but either need to wait for the high priority annexations in order to be possible, or need further study because of right-of-way considerations. These locations are listed as follows: 1. Property between Honey Creek and Railroad 2. Properties along Tulsa County's 92 nd Street, east of Mingo 3. Territory between Owasso Expressway and Baptist Village 4. Graceland Acres 5. Three tracts between Garrett Creek and North 12qh East Avenue 6. Property roughly north of Bailey Ranch Estates and the Owasso Hospital, roughly east of North Garnett Road, south of East 126t" Street North, and roughly west of North 129t" East Avenue Locations 1, 2, and 4 are recommended to be medium priority annexation areas because these areas are located along lines of right-of-way currently maintained by Tulsa County, and would represent an increased cost of maintenance for the City of Owasso should they be annexed. The territory between the Owasso Expressway and the Baptist Village is shown as a medium priority area because the vast mixture of uses and zoning classifications in this limited area warrant further study, so that the City of Owasso knows the exact situation of the property before any annexation. Locations 5 and 6 represent a large portion of the community that should be incorporated, but must wait until the first annexations take place in order to be legally feasible. The staff has already begun the process of contacting property owners from the list of high priority areas and told them of the possibility of the City of Owasso desiring to annex their property. After making contact with the property owners, the staff will bring forward annexations for the City Council to consider over the next several months. In the event that the property owner does not give consent for the City to annex a property, the staff will ask that the City Council pass a resolution directing that public hearings be held by the Planning Commission and City Council to gain public input on the annexation. An annexation services plan will be required, and the Planning Commission and City Council will consider the annexation similarly to those properties recently processed on East 96th Street North. The staff plans to proceed with the annexation plan outlined unless there are concerns expressed by the City Council. No action is required by the City Council at this time. I DATE: June 7, 2006 On October 14, 2003, the citizens of Owasso approved the extension of the third penny sales tax. The Capital Improvements Committee recommended that Fire Stations Two and Three be acknowledged as a Level 1 priority. The goal was for all Level 1 priorities to be constructed or underway during the first three years of the extension. In April of 2005, the City of Owasso entered into a contract with BILL, Inc. for the purposes of providing engineering and architectural services for Station No. 3. BILL, Inc was also the firm selected by the City of Owasso to remodel the former City Mall into what is now known as Station No.2, which was completed in the summer of 2005. The original contract amount was for $79,800 to cover architectural, civil, structural, mechanical, electrical, interior design, and cost estimating. An additional estimate of $10,000 was included to cover the survey and gco--technical costs. Therefore, the anticipated total cost of the contract was $89,800. Upon a change of leadership in the department, as well as the desire for the Police Department to develop "sub -stations" to address future growth needs in their operations, it became apparent that the contract for architectural and engineering services would need to be amended in order to incorporate those changes. In addition to these items, staff also felt it necessary to explore the opportunities of geothermal heating and cooling of the facility, as well as the potential of polysteel construction. On May 17, 2006, staff conducted a meting with Mr. Kim Reeve to review the contract amendment, as well as ensure that concerns were addressed regarding alternative methods of construction, heating and cooling, and future expansion. Additionally, staff felt it was important for the $10,000 for the surveying and geo-technical costs to be included in the bottom line of the contract total, not as a separate "add on" as was presented in the original contract. The contract amendment submitted by BILL, Inc has increased $53,200; $10,000 of which is the survey and geotechnical costs included as an "add on" in the original contract. Staff has reviewed the proposed contract amendment, and due to the increase in the size and scope of the eventual structure, is comfortable with the amendment. FUNDING: Funding for the Fire Station No. 3 Project was established at $1,200,000. To date, $196,617 has been spent on the acquisition of the land and associated expenses. Additionally, of the original $79,800 architect and engineering budget, $15,960 has been spent for conceptual design and drawings. RECOMMENDATION: Staff intends to recommend Council approval of the amendment to the contract for architectural and engineering services for Fire Station No. 3 for the amount of $133,000 at the June 20, 2006 Council meeting. SCOPE) DATE: June 8, 2006 BACKGROUND: In July 2005, the City Council commissioned the preparation of construction documents for the reconstruction of deteriorated roadways serving the Three Lakes Village residents. On January 17, 2006, following the completion of engineering and advertisement, the rehabilitation work (which includes removal and replacement of over 5,300 square yards of existing pavement complete with new curb and guttering) was awarded to Austin Paving, LLC in the amount of $308,869.40. Initial demolition for this Contract revealed the presence of significantly differing sub -surface conditions, unsuitable for road construction. In response to these conditions, staff recommended the installation of perforated pipe edge drains (located along the back of the curb in the aggregate base course) to drain excess water in the sub -grade and base courses. In addition to the pipe edge drains, staff recommended an enhanced version of the geotechnical fabric reinforcement proposed in the initial design to address the low strength of the sub -grade soils. Staff has also recommended additional project scope to relocate the remaining water services in the neighborhood and selective repair of structures and pipes in the existing storm water drainage system. During its regularly scheduled meeting of April 18, 2006, Council approved an additional appropriation of $120,000 from the reserve balance of the General Fund for the purpose of funding these additional scope items. CONTRACT CHANGES - Based on Council's approval of a change and expansion of the scope of the project, staff prepared contract documents for "Three Lakes Village Roadway Improvements — Contract II (Revised Scope)." This Contract was advertised on May 9, 2006 with a Bid Opening date of June 12, 2006. Since this contract is bid publicly on an equivalent basis as the previous contract, it is possible that a Contractor other than Austin Paving (the original successful bidder) may be the successful bidder for this contract. Contract II documents reflect an effort to separate the project into two separate, dcfinable phases in order to eliminate, as much as possible, extensive coordination between the possible two Contractors. This was accomplished in two ways: Three Lakes Village Streets Three Lakes Village Roadway Improvements Contract II (Revised Scope) Page 2 of 2 o Redefining the scope of the initial contract with a series of additive and deductive change orders o Narrowly defining the scope of the second contract to only those items which precede the principle paving operations of the Phase I contract in sequence or location. The redefined scope of the initial contract calls for removing (by deductive change order) all items not associated with base preparation and paving and adding (by additive change order) pay items associated with the proposed enhanced geotechnical reinforcement and edge drain system. These change orders are being negotiated prior to acceptance of bids for Contract II. Engineer's Estimate of Probable Cost for the net change to Contract I through additive and deductive change orders is $37,619, which represents a net change, by change order, of 12.2 % of the original contract. Contract II provides for all pay items associated with demolition of paving and drives, utility relocation, storm drain installation and repair, dry well construction as well as excavation to the sub -grade elevation. These items include some enhanced scope but are principally items removed from the scope of Contract 1. The intended "finished product" of Contract II is a smooth -graded sub -base, suitably prepared to serve as the initial surface for paving operations. Engineer's Estimate of Probable Cost for Contract II is $82,333. Total cost of the revised scope of Contract I and the additional scope of Contract II is $ 119,952. A mandatory pre -bid meeting was held at the Owasso Community Center on May 30, 2006. The only bids honored at the bid opening will be from those bidders having a representative at this mandatory meeting. Three Contractors, including Austin Paving (the successful bidder for the initial contract) attended and are approved as potential bidders. Bids are to be opened on Monday, June 12, 2006 at 2:00 PM CDT. A bid tabulation will be available for Council review at the June 13 work session. FUNDING: FY 05-06 appropriations for this project include funding in the amount of $310,000. Additional funding in the amount of $120,000 will be obtained from the reserve balance of the General Fund as approved by Council. CITY ENGINEER SUBJECT: AGREEMENT ,,R FACILITIES GASRELOCATION WITH OKLAHOMA NATURAL GASCOMPANY 8 6NORTH ,,.MINGO ROAD INTERSECTION DATE: June 6, 2006 BACKGROUND As part of the projects approved under the Oklahoma Department of Transportation (ODOT) Local Government Program, this project involves the widening and signalization of the intersection at E. 86"' Street North and N. Mingo Road. Although originally programmed for construction under the 1998 Bond, the work was delayed to allow for the completion of other capital improvements projects. Final design for the initial scope of the project by CH2MHil1 was completed in April 2002. This design provided for a typical rural asphalt intersection, without sidewalks, curb and gutter and camera operated signals. Following the completion of E. 76t" Street North Widening, City of Owasso staff contacted ODOT to begin construction of improvements at E. 86th Street North and N. Mingo Road intersection. ODOT personnel indicated that funding would be available after November 2005, and Advertisement for Bids would be scheduled following receipt of funding. A June 2005, design review personned in preparation of Advertisement for Bids revealed that the proposed intersection and signalization improvements no longer meet City standards. In August 2005, staff solicited proposals from both CH2MHil1 and C2A Engineering for additional design work including preparation of documents for the construction of a five -lane, four-way concrete intersection, complete with sidewalk, curb and gutter and drainage improvements, intended to bring the project into conformance with current City standards as well as accommodate future changes in traffic flow patterns when the land located directly south of the existing intersection developed. Council approved an engineering services contract with C2A Engineering during its regularly scheduled meeting of October 18, 2005. UTILITY RELOCATION - Since that time, design work and document production for the project have been completed and final documents have been submitted to ODOT for review. A utility relocation meeting was held on February 22, 2006 and final drawings were issued to utilities for review on April 13, 2006. All utilities were given notice to begin relocation for the project on May 13, 2006. Page 2 Agreement For Gas Facilities Relocation 86`" Street North & Mingo Road Intersection American Electric Power — Public Service Company of Oklahoma (AEP-PSO), Southwestern Bell (SBClAT&T), Washington County Rural Water District No. 3, Oklahoma Natural Gas (ONG) and Cox Communications have engineered the relocation of utilities to allow for the construction of the improvements. All utilities, except for ONG and Washington County Rural Water District No. 3, are located within the public ROW and have no dedicated easements, thus relocation will be at no expense to the City. ONG currently owns approximately 1,336 linear feet of low and medium pressure distribution pipelines as well as a 2" gas regulator and service with a 2" relief valve to be relocated within the limits of the project. Of the total length, 1,216 linear feet are located outside the public ROW and within a privately owned easement. This portion will have to be relocated at an estimated cost to the City of $190,626.00 including material, labor, and contract administration. AGREEMENT FOR GAS FACILITIES RELOCATION: The Agreement (see Attachment A) contains language outlining how ONG will be reimbursed for the work and what the relocation costs will be based on: ® The City will reimburse ONG within thirty (30) days of completion of work, which is estimated to be mid -August. ® Relocation costs will be based on actual relocation costs. ® ONG will award and pay for the work based on competitive bids or continuing contract, whichever is deemed most practical and economical by ONG. ® If the contract is awarded at a higher amount than the estimate, ONG will send the City a written notice, and the City will have the right to terminate the agreement within ten (10) days of receipt of notice. ® ONG easements shall be considered to retain precedence so that any City project in the fixture requiring additional relocations of the same facilities shall be paid by the City. The City Attorney has reviewed this agreement and found it acceptable. FiJNDING: Sufficient funds remain in the Capital Improvements Fund for this project. RECOMMENDATIONS. Item 1: Staff recommends Council approval of authority for the Mayor to execute the Agreement for Gas Facilities Relocation between Oklahoma Natural Gas Company and the City of Owasso for 86"' Street North and Mingo Road Intersection Improvements. City of Owasso, Oklahoma, a municipal corporation, hereinafter called "City," has requested Company to relocate these facilities to accommodate the proposed construction of the referenced project as shown on plans therefore, the latest of which were received electronically by Company on April 27, 2006. City agrees to reimburse Company in the extent and manner hereinafter stated for that portion of the cost of relocating said facilities which is for the benefit of City. Company proposes to perform the necessary relocation of its facilities in substantial accordancewith the five plan sheets and the one -page cost estimate, all dated May 1, 2006, of which four copies each are attached. Company will bear the cost of relocating the portions of the facilities which do not occupy private rights -of -way. Such relocation costs will be based upon, but not necessarily limited to, material suppliers', work contractors', and equipment -rental invoices; and at then -current rates and prices, company's transfer and stores expense charges for warehoused materials; payroll time sheets; indirect labor charges; auto, truck, and equipment use records; expense statements; and standard allocated overhead charges. Company's award of and payment for contracted work will be based upon competitive bids or continuing contract, whichever appears to the Company will be most practical and economical. It is further understood, and City by acceptingthis proposal agrees, that City will reimburse the Company in accordance with this agreement within thirty (3 0) days after the said relocation work has been completed and Company's statement for City's costs thereof has been submitted. Company agrees that in the event Company should determine prior to commencement of construction that the revised estimated amount of the reimbursement by the City may exceed the estimated cost as stated herein, Company shall notify the City of such determination in writing.
