The staff will recommend City Council approval of the final plat for Oak Tree Business
Park as recommended by the Owasso Planning Commission. The subject property is
located south of East 96th Street North and west of the Owasso Expressway, containing
one lot on 15.7 acres, more or less.

SUBJECT: FINAL PLAT - OAK TREE BUSINESS PARK
DATE: September 30, 1996
BACKGROUND
The City of Owasso has received a request to review the final plat for Oak Tree Business Park.
The subject property is located in a portion of the NWA of Section 20, Township 21 North,
Range 14 East, Tulsa County and consists of 1 lot totalling 15.70 acres, more or less. The
applicants are the Owasso Economic Development Authority.
The subject property is currently zoned Planned Unit Development, of which this portion is
designated for Commercial Development. The end use of the subject property will be an office
and vehicle fleet storage facility for Oklahoma Natural Gas and is estimated to employ
approximately 30 to 45 people. While the proposed use is not commercial (the use would be
classified in the Owasso Zoning Code as Office), it is less intense than a commercial use and
it is within the guidelines of the PUD and the Owasso Zoning Code.
The preliminary plat was reviewed by the Planning Commission and approved at the March 12,
1996 regular meeting with the conditions that the Technical Advisory Committee's
recommendations be met by the applicant. The final plat was reviewed by the Technical
Advisory Committee at their regular meeting on March 27, 1996. At that meeting, neither the
staff or the utility companies suggested any comments and /or corrections.
In review of the plat, I feel it is important to highlight a requirement mentioned by staff at the
Planning Commission meetings when the Oak Tree Business Park plat was reviewed.
Acceleration /deceleration lanes at the entrance of the subject property will be required. These
lanes will be required as a portion of the street construction and will not be permitted to be
deviated in any manner. This is consistent with requirements placed on other projects
developing along arterial streets in Owasso.
Construction plans have been submitted by the applicant and permits to construct have been
issued by the Department of Environmental Quality for the construction of the sanitary sewer
and water lines. These permits are attached for your information and review.
RECOMMENDATION
Staff recommends approval of the final plat for Oak Tree Business Park.

Pursuant to O.S. 27A 2 -6 -401, the City of Owasso is hereby granted this permit to construct
3992 I.f. of eight (8) inch sewer line and appurtenances to serve the Oaktree Business Park,
located in the NW /4 of Section 20, T -21 -N, R -14 -E, I.M., Tulsa County, Oklahoma, in
accordance with the plans and specifications approved on September 3, 1996.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in
accordance with Discharge - OPDES (NPDES) rules OAC 252:605 and to comply with the
state certification laws, Title 59, Section 1101 -11 16 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receive supervision and
inspection by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date
of approval or the phases not under construction will be resubmitted for approval as
a new project.
3) That no significant information necessary for a proper evaluation of the project has
been omitted or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less,
sanitary protection will be provided in accordance with OAC 252:655- 9 -1(h) of the
Standards for Water Pollution Control Construction Standards.
5) That tests will be conducted as necessary to insure that the construction of the sewer
lines will prevent excessive infiltration and that the leakage will not exceed 200 gallons
per inch of pipe diameter per mile per day.

6) That the State Department of Environmental Quality shall be kept informed of
occurrences which may affect the eventual performance of the works or that will
unduly delay the progress of the project.
7) That the permittee will take steps to assure that the connection of house services to
the sewers is done in such a manner that the functioning of the sewers will not be
impaired and that earth and ground water will be excluded from the sewers when the
connection is completed.
8) That any deviations from approved plans or specifications affecting capacity, flow or
operation of units must be approved by the Chief Engineer before any such deviations
are made in the construction of this project.
9) That the recipient of the permit is responsible for the continued operation and
maintenance of these facilities in accordance with rules and regulations adopted by the
Environmental Quality Board, and that.this department will be notified in writing of any
sale or transfer of ownership of'these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or
liabilities which the permittee may be under pursuant to prior enforcement action taken by
the Department.
1 1) That any notations or changes recorded on the official set of plans and specifications
in the State Department of Environmental Quality files shall be part of the plans as
approved.
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue
will constitute acceptance of the permit and all conditions or provisions.

the State Certification laws, Title 59, Section 1 101 -1 1 16 O.S. and the rules and regulations

purposes.

WHEREAS, The OEDA, the Owasso Chamber of Commerce, the Owasso Reporter, and the
City of Owasso have developed a special business recognition program as a
means of honoring the valuable contributions of local, community - minded

by its business owners and employees and their active support of community
events; and

The Owasso City Council met in regular session on Tuesday, September 17, 1996 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, September 13, 1996, and
Addendum to Agenda posted on the City Hall bulletin board at 2:00 p.m. on Monday,
September 16, 1996.

ITEM • EXPLANATION OF SPECIAL PROJECT BEING UNDERTAKEN BY ETA
U SORORITY AND THE OWASSO HISTORICAL SOCIETY.
Ms Peggy Robinson explained the Main Street Improvement Project, and more specifically the
' project whereby a mural will be painted on the south side of the Historical Society building.
She introduced Ms Judy Kimball, a local artist, who presented a rendering of the mural. She
said that October 26th has been designated as "Paint a Share Day ". Shares will be sold for
t$2.00 each and will allow participants to paint a piece of the wall. Mr Glen Gibson, president
of the Historical Society, was also present.

ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
ACCEPTANCE OF IMPROVEMENTS TO THE WATER AND SANITARY
SEWER SYSTEMS CONSTRUCTED TO SERVE COVENTRY GARDENS
TULSA COUNTY, OKLAHOMA.
Coventry Gardens is located 3/4 mile west of Garnett Road on East 96th Street North. It is
outside the present Owasso city limits, but the systems were designed and constructed in
conformance with existing city standards. Final inspections have been conducted and all items
on the resulting punch list have been completed. DEQ construction permits have not been
received, but application has been made and staff recommended acceptance of the systems
contingent upon receipt of the DEQ construction permits. Mr Ramey moved, seconded by
Mr Standridge, to accept the water and sanitary sewer systems for Coventry Gardens contingent
upon receipt of DEQ construction permits.

ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO
ORDINANCE #530, AN ORDINANCE AMENDING THE OMRF
RETIREMENT PLAN AND PROVIDING THAT PERSONS IN THE PLAN
MAY RECEIVE PARTICIPANT LOANS UTILIZING VESTED RETIREMENT
FUNDS AS SECURITY FOR SUCH LOANS.
The City Council adopted Resolution #96 -07 in May 1996 approving a proposed amendment to
the OMRF Trust Indenture to allow participating employees to obtain loans from their accrued
benefits under the plan. OMRF approved the amendment, and the City of Owasso must amend
its Defined Contribution Plan to allow employee loans. Ordinance #530 amends the Defined
Contribution Plan, authorizing participant loans. Mr Ramey moved, seconded by Mr
Standridge, to approve Ordinance #530.

COMMUNITY DEVELOPMENT:
PLANNING COMMISSION - The Owasso Planning Commission will hold its next regularly
scheduled meeting on Tuesday, October 8, 1996 at 7:00 p.m. in the Owasso Community Center.
At that meeting, the following items will be reviewed:
Preliminary Plat- Brentwood Park - A request for a preliminary plat approval of an 8.41
acre parcel containing 20 lots zoned RS -2 (Residential Single - Family Medium Density).
The subject property is located immediately east of Brentwood Estates.
PARKS:
PARKING LOT IMPROVEMENTS - The recent rains have delayed the completion of the City
Hall /Community Center and both Elm Creek parking lots. While all three of the parking lots
have been overlaid, the City Hall parking lot still needs some additional striping which requires
dry conditions. The Elm Creek south parking lot still requires a coat of sealant. The staff is
hoping these improvements will be completed sometime next week, weather permitting.
In addition, Mr Warren is working with Mr Lutz to develop a bid packet for additional parking
at the Sports Park. The additional parking lot would be of a gravel nature, located on the east
side of the entrance road, and be utilized for soccer and flag football.

AMBULANCE - On October 4, 1996, Fire Department personnel will be going to Florida to
accept delivery of the new ambulance. Expenses will be the responsibility of the vendor. We
anticipate the ambulance to be in service the week of October 14, 1996.
WASTEWATER TREATMENT:
SLUDGE DISPOSAL DEMONSTRATION TEST - Last week a company in Tulsa (Primenergy
Inc) contacted the Public Works Department to obtain some sewage sludge from our treatment
plant for a demonstration project. Primenergy is a designer and manufacturer of sludge
(biomass) energy conversion equipment and is attempting to determine if their equipment is able
to be used as a viable alternative for sludge landfilling. They "burn" sludge to reduce the
amount needing disposal and may be able to produce cogenerated power or steam as a product,
depending on the heat producing value of the sludge.
In August, Primenergy tried City of Tulsa sludge. Largely due to moisture content in the
sludge, however, the burn was unsuccessful. The Oklahoma Department of Environmental
Quality (ODEQ) referred Primenergy to Owasso. Preliminary testing of our sludge indicated
our material should be very acceptable for another demonstration test.
Mr Carr has been working with Primenergy to develop a working agreement for the use of our
sludge (see the attached draft letter). The staff believes successful operation of this innovative
type of process could be a valuable means to reduce disposal costs. In conversation with the
ODEQ, it was stated that Owasso is the generator of the sludge and is ultimately responsible for
the safe handling and disposal of unused sludge or ash from the demonstration facility.
Therefore, the staff has been proceeding to cooperate with Primenergy while having Mr Cates
review their letter of agreement concerning regulatory and legal issues that could occur.
Primenergy is interested in approximately 30 tons of sludge for their test. This quantity equals
the amount of material on four (4) sludge drying beds at the plant. Based on our average
disposal costs at Quarry Landfill, each bed costs Owasso about $45 for disposal. The staff
estimates that allowing Primenergy to use our sludge will result in a disposal cost savings of
approximately $150 for a successful test.
ISTREETS:
CITY LIMITS SIGNS ON HIGHWAY 169 - At the request of the Public Works Department,
the Oklahoma Department of Transportation (ODOT) erected signs both north and south of the
city limits on Highway 169. The installation was completed on September 24th. The city
provided the logo and ODOT supplied materials for the signs.

BACKGROUND:
The furniture in the lobby at the Community Center was purchased over 15 years ago. Although
this furniture is structurally sound, the upholstery is worn out from years of use. This furniture
is used by the senior citizens, as well as other groups utilizing the Center.
COMMENTS:
There are currently three couches, two ottomans, and three chairs in the Community Center
lobby. The cost to purchase new furniture would be between $4000.00 and $7000.00, depending
upon the grade of furniture, while the cost to reupholster the furniture would be less than
$2,000.00. Therefore, the staff requested quotes from three local upholsters. The following
quotes, which include material and labor, were received:

Community Center budget.

BACKGROUND:
The tables and chairs in the dining room at the Community Center are used every day. Most
of these tables and chairs are over 10 years old and have been moved around a lot. Many of
the chairs are getting to the point where they are not safe.
COMMENTS:
Community Center staff called recreation and community centers in Tulsa and inquired as to
their use of round tables. We asked if the tables are serviceable, if they promote better
communication, if they are easy to move, and if the staff and customers prefer round or oblong
tables. The staff at the Centers using round tables responded that the conversation appears to
be easier for their senior citizens because they are able to see everyone at the table, they are
easier to use when the seniors are playing games, and they seem to be easier for the staff to
move and store. After visiting with the staff at the different facilities, we believe it would
benefit our Center to purchase round tables.
The staff requested quotes for padded chairs with double rivets on the frame, four -hinge
construction, and a 35 -year guarantee. Quotes were also requested for 60" round tables seating
6 to 8 persons, constructed of 5 -ply plywood with a .30" thick Phenolic backer sheet laminated
to the underside and edges protected with bullnose vinyl T- molding.

correspondence is a typical system description and general information concerning our
gasification technology.
As we discussed, Primenergy will furnish the trucks to haul the subject material from your
treatment- facility to- ours, unload and store the material inside an enclosed building. This building
houses the demonstration facility and is located inside a perimeter fence-and is secured from the

PRIMENERGY'S
DEMONSTRATION FACILITY
Primenergy is the designer and manufacturer of biomass energy

RE: Biosolids Gasification Demonstration Testing
Dear Mr. Carr:
As per our conversation, Primenergy, Inc. would like to obtain approximately thirty (30) tons of
the biosolids material from your treatment facility.
In conversation with Mr. Dan Hodges of the Oklahoma Department of Environmental Quality,
the City of Owasso would manifest the biosolid waste to Primenergy, with a manifest
continuation to a designated land fill. After the receipt of material and prior to ultimate disposal
in the land fill, the "care and custody of the biosolids would be the responsibility of Primenergy.
A copy of this correspondence was forwarded to Mr. Hodges. He has initialed his approval of the
content.
The material provided would be utilized in our gasification demonstration unit located at 3201
North Toledo in Tulsa. This facility has been permitted by the Oklahoma Department of
Environmental Quality as a "test facility" to evaluate gasification of different types of biomass as
potential renewable alternate fuels. The gasification reaction occurs in a proprietary designed
vessel in which a portion of the feed material, in this instance biosolids, are oxidized to produce
heat that will cause the remainder of the feed material to pyrolyze. This pyrolytic reaction
releases the carbon and hydrogen volatiles contained in the feed. The gases produced in the
gasifier are ducted to a secondary combustor where they are oxidized. The heat of oxidation is
recovered in a waste heat recovery boiler. The feed material is significantly reduced in volume,
creating an ash that has been sterilized by heating to 1300 ° - 1500 °F. Attached to this
correspondence is a typical system description and general information concerning our
gasification technology.
As we discussed, Primenergy will furnish the trucks to haul the subject material from your
treatment facility to ours, unload and store the material inside an enclosed building. This building
houses the demonstration facility and is located inside a perimeter fence and is secured from the
public .

During the demonstration test, Primenergy will obtain various engineering data necessary to
design equipment for biosolids energy conversion. Included in our testing protocol is a
requirement for third party stack emissions, sampling for five (5) identified air pollutants and,
with specific regard to biosolids, air monitoring for metals. Prior to our testing, we have sent
a representative sample of the City of Owasso's biosolids material to an analytical laboratory to
test the material for the presence of metals, BTU content, and moisture content.
Following the tests, we will send a sample of the ash material to the analytical laboratory for
a toxic leachate testing procedure (TCLP) to determine the presence of leachable metals. After
receipt of the analytical results, Primenergy will haul the remaining material to the land fill
disposal point designated by the City of Owasso. In consideration for the City of Owasso's
participation, Primenergy will offer to compensate the City for the costs of disposal of the ash
material generated by this demonstration test.
We anticipate that the demonstration tests will occur within five (5) days subsequent to our
receipt of the material from the City. Completion of the tests should occur within three (3)
days after start-up.
The City of Owasso will be provided copies of all analytical tests performed on the biosolid feed,
the generated ash, the air quality reports from the gasification tests and a copy of the land fill
receipt.
We extend to your office and any officials of the City of Owasso an open invitation to visit our
demonstration facility and corporate offices during the demonstration test, or at your
convenience. Primenergy appreciates the support of the City of Owasso in our quest to prove
that renewable biomatter energy sources, such as municipal sludge, are a viable solution to our
future energy demands.

On Friday of last week, we received from your office a request for additional information and
declaratory statements from Primenergy with regard to our biosolids gasification testing. Please
consider this correspondence as an addendum to our prior correspondence dated 23 September
1996.
* Company History and Qualifications

* Liability and Indemnification
Primenergy shall defend and indemnify the City of Owasso, its officials, officers, employees and
agents from and against legal liability for damages arising out of the use transportation, storage
and disposal of wastewater biosolids in connection with the Biosolids Gasification
Demonstration
Testing Project ( "the Testing Project ") more particularly described in the letter dated 23
September 1996 from Primenergy to the City of Owasso, including but not limited to any claims,
costs, attorney fees or other expenses of whatever nature where such liability is caused by the
negligent act, error or omission of Primenergy or any person or organization for whom
Primenergy is legally liable, provided, however, that Primenergy shall not be liable for, and the
aforesaid indemnity shall not apply to, the negligent acts, errors or omissions of the City of
Owasso or any person or organization for whom the City of Owasso is legally liable.
* Compliance with Laws
During the use, transportation, storage and disposal of the waste biosolids in connection with the
Testing Project, Primenergy will comply with applicable regulatory requirements including
federal, state and local laws, rules regulations, orders codes, criteria and standards.

* Co- mingling of Biosolids
To affect adequate pre - heating of the gasification system, Primenergy uses rice hulls as an initial
feed stock. In addition to completion of the pre - heating requirements of the primary process
equipment, the use of a known, benign biomass initial feed stock conserves the biosolids for
demonstration testing, evaluation and environmental profiling. However, as a result of this
initial pre -heat requirement, the first charge of biosolids will, by the nature of the process, be
co- mingled with the biomass, rice hulls. This co- mingling will occur only at the first portion
of the demonstration test and only for a short duration, as we shift the operation to pure biosolids
feed.
*Landfill
We have contacted the Quarry Landfill and made provisions for a direct billing for disposal costs.
Please review this addendum at your earliest convenience, and advise, if all issues have been
adequately addressed, the time frame of availability of the dried biosolids. We would like to take
advantage of the dry weather conditions this week, if possible.

We have approached the City of Owasso, Public Works Department at the suggestion of the
Oklahoma Department of Environmental Quality (DEQ) to obtain a quantity of municipal biosolids
for testing as a renewable energy source. We are working closely with the DEQ and the State
Department of Commerce and other agencies to validate an alternative to land filling and land
application of municipal sludge in an environmentally friendly manner.
Primenergy is a designer and manufacturer of biomass energy conversion equipment. Our
proprietary process design incorporates a low temperature, air starved, gasification of biomatter
to produce an energy source for electricity generation, steam production, process heat, or any
combination of these useful forms of energy. The biomass fuels include such agricultural by-
products as rice straw, rice hulls, peanut hulls, wheat straw, wood wastes, and other herbaceous
wastes as well as other biomatter wastes, such as sewage sludge.
We have operating plants located both domestically and internationally. Currently, we are
completing the engineering design and are in the preliminary construction stages of two new
facilities located in Arkansas. One of these will consume six hundred (600) tons per day of rice
hulls, cogenerating over twelve megawatts of power and seventy -five thousand pounds of medium
pressure steam.
The primary advantages of Primenergy's proprietary biomass gasification conversion technology
are:
• Low Emissions
We employ a concept called staged combustion. Without going into a detailed
engineering dissertation, the emissions of NOx, SOx, CO, and non - methane
hydrocarbons (all USEPA controlled air pollutants) are significantly lower than
competing technologies and other gasification systems.

Compared to fluidized beds and their air movement horsepower, our system is
negligible.

• Biomass Residence Time Control
Our patented gasifier agitation method can control the residence time of feed and
therefore, carbon ash quality.
• Proven Results
No other competing technology has our track record of operating time or on line
capacity. Our equipment in Mississippi is gasifying 330 tons per day of rice hulls.
The equipment we have under contract for Arkansas with convert 600 tons per day
of rice hulls into useful energy.
• Reduction of Greenhouse Pollutants
The conversion of biomass products to alternate fuels replaces the need for
combustion of fossil fuels, reducing net carbon dioxide production.
Located at our Tulsa offices, we have a full scale biomass demonstration gasification system. This

We have obtained municipal biosolids from the City of Tulsa; but, that material had been through a

utilize its biosolids in our effort to prove a beneficial reuse of this material consistent with the
