OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, December 1, 2009 The Owasso City Council met in regular session on Tuesday, December 1, 2009 in the Council Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 6:00 p.m. on Friday, November 27, 2009. PRESENTATION OF CHARACTER CERTIFICATE Mayor Cataudella presented a Character Certificate of Responsibility to Tom and Barbara Keenze, owners of the Dry Cleaning Station in Owasso. The Keenze's have received numerous awards from the Oklahoma Department of Environmental Quality for taking proactive measures to ensure environmentally safe business operations. ITEM 7. Garnett Regional Detention Facility to Cherokee builders of Tulsa, Oklahoma in the amount of $1,525,006. Mr. Bonebrake moved, seconded by Mr. Guevara, for City Council approval to award the Garnett Regional Detention Facility to Cherokee Builders, as recommended. Mr. Gibson presented information related to the fiscal year audit and discussion was held. Ms. Hess commented that an item would be placed on the December 15, 2009 regular City Council agenda requesting Council acknowledgement of receiving the audit report for FY 2008 -2009. ITEM 3: CONSIDERATION PRESENTATION PROVIDED BY THE ASSISTANT CITY MANAGER FOR ADMINISTRATIVE SERVICES FOR THE PURPOSE OF REVIEWING VARIOUS CITY POLICIES, PROCIDEURES, AND FUNDS. Councilor Bonebrake arrives at 6:08 pm. Ms. Bishop provided information related to the Open Records Act. ITEM 4: DISCUSSION RELATING TO ADMINSTRATIVE ITEMS A. PROPOSED BUDGET AMENDMENT — REFUSE DEPARTMENT Ms. Bishop reviewed the item; explaining Funds were included in the FY 2008 -2009 budget for the purchase of two (2) refuse collection vehicles in the amount of $476,412. Due to the extensive amount of time necessary to build each refuse truck, the staff did not take delivery of the vehicles until FY 2010. Therefore, the requested budget amendment is in effect a carryover Owasso City Council December 8, 2009 of funds. Ms. Bishop further explained that an item would be placed on the December 15, 2009 OPWA agenda requesting Trustee action to approve the budget amendment. ITEM 5: DISCUSSION RELATING TO OPERATIONAL ITEMS A. PLANNING ITEMS: Annexation Requests — OA 09 -05, OA 09 -06, OA 09 -07 Proposed Planned Unit Development — OPUD 09 -01 Proposed Final Plat — CVS Pharmacy Mr. Lehr reviewed each item. A) The following planning items were considered at the December 7, 2009 Planning Commission: a request for annexation OA 09 -05, consisting of approximately 10 acres located a quarter of a mile south of East 116th Street North and North Garnett Road; a request for the annexation OA 09 -06, consisting of approximately 5 acres located at the southeast corner of East 106th Street North and North 145th East Avenue; and a request for annexation OA 09 -07, consisting of approximately 60 acres located at the northwest corner of East 106th Street North and North 1451 East Avenue; a request for OPUD 09 -01, consisting of approximately 16 acres with underlying zoning designations of Multi- Family Residential and Commercial General Districts and located at the northwest corner of East 116th Street North (State Highway 20) and North 145th East Avenue; and, a request for review of the CVS Pharmacy Final Plat, proposing one commercial lot on 1.624 acres, located on the southeast corner of East 96th Street North and North 129th East Avenue. It was explained that staff anticipates bringing an action item before the Council during the December 15, 2009 regular meeting requesting consideration and appropriate action. ITEM 6: DISCUSSION RELATING TO CITY MANAGER ITEMS A. REQUEST FOR APPOINTMENT TO THE VISION 2025 SALES TAX OVERVIEW COMMITTEE B. CITY MANAGER REPORT A) Mr. Ray explained that staff anticipates bringing an action item before the Council during the December 15, 2009 regular meeting requesting Council confirmation of the Mayor's appointment to the Tulsa County Vision 2025 Sales Tax Overview Committee. B) Under the City Manager's Report, Ms. Bishop provided the City Council with a sales tax report. ITEM 7: REPORT FROM CITY COUNCILORS No reports were provided. To be eligible for retirement benefits through OMRF an employee must have a minimum of five years of employment. Once an employee has five years of service the employee is considered vested and is eligible to receive pension benefits. Upon death of an active employee who is vested, the employee's spouse is entitled to the employee's pension, payable for life or until remarriage. Eric Wiles was an active employee and had been employed with the City for an excess of five years when he passed away on October 31, 2009. Therefore, both of the necessary requirements have been met for his spouse to receive the monthly death benefit from OMRF. RECOMMENDATION: Staff recommends approval of request to receive a death benefit from the Oklahoma Municipal Retirement Fund from the spouse of Eric Wiles. Mike Gibson from Cole & Reed, P.C. met with members of the City of Owasso's Audit Committee on December 3. Members of the Audit Committee are Jon Sinex, John Manning, Kevin Cavanah, Guy Nightingale, and Dennis Phillips. Mr. Gibson presented the audit report and responded to questions from the Committee. The property is located at the northwest corner of East 116th Street North (State Highway 20) and North 145th East Avenue. The site is currently undeveloped and zoned Agricultural. LOCATION: The subject tract is located at the northwest corner of East 116th Street North (State Highway 20) and North 145th East Avenue. EXISTING LAND USE: Undeveloped CONCEPT OF A PUD: The concept of Planned Unit Development is to provide a creative alternative to conventional development where a particular tract is under common ownership or control and where a detailed development plan, outlining the development of the tract as a unit is proposed and submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete and coordinated plan of development for a larger parcel, rather than piecemeal individual changes using the variance process as provided by the Board of Adjustment. The supplemental zoning district PUD must be approved by the City Council as a prerequisite to the Planned Unit Development. ANALYSIS: OPUD 09 -01 (Encore at Elm Creek) is a proposed planned unit development (PUD) comprised of approximately 16.549 acres of land. The development concept behind Encore at Elm Creek is for a mix of Multi - Family Residential and Commercial General use pursuant to the provisions of the Owasso Zoning Code. The proposed use consists of two development areas. Development Area "A" is designated for Multi- Family Residential uses, and encompasses 14.614 acres of land. Development Area `B" will facilitate commercial uses in the future. Development Area "B" encompasses 1.935 acres of land. The site is currently vacant land covered with vegetation. Development Area "A" has approximately 1230' of street frontage along north 145th East Avenue and approximately 50' of street frontage along East 116th Street North (State Highway 20). A portion of the south side of the subject tract extends to East 116th Street North (State Highway 20). The property abuts a single - family dwelling to the north, zoned Agriculture; on the west the property abuts a vacant tract, zoned Agriculture. The east side of the tract abuts North 145th East Avenue. The City of Owasso is a rapidly expanding suburban area. The Planned Unit Development is located in an area of Owasso that is, and will continue to experience continuing growth. As the market has evolved, the property owners feel it is appropriate and feasible to develop the area with multi - family residential and commercial uses. The staff concurs that a development of this nature is consistent with other developments in the Owasso area, as well as immediate needs for apartment housing and commercial space. The intention of the PUD is to unify the two tracts into one development and provide a higher standard of development. According the Owasso Zoning Code, the Planning Commission shall hold a public hearing on any PUD application and determine the following: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of the surround areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance. FUTURE PLANNING CONCERNS: Future planning issues must still be considered if the PUD is approved. If approved, the applicant must submit a preliminary plat, infrastructure plans, and a final plat that must be approved by the City of Owasso. Sidewalks will be required along all public rights -of -way associated with the subject property. Perimeter sidewalks must be installed at the time of overall development, while the internal walks may be constructed as individual lots are developed. The applicant has identified the terrain as relatively flat terrain. The existing soils on the site would appear to create no unusual development problems that are not typically encountered with development in and around the City of Owasso. On -site detention is required and will be further defined at the platting stage. The City will require, through engineering review and inspections, that the rate of storm water runoff after construction be no greater than the runoff prior to construction. Any future development on the property will be provided sewer service by the City of Owasso, and water by Rural Water District No. 3 of Washington County. The subject tract is subject to the Storm Siren Fee of $35 per acre, and the Elm Creek Interceptor payback fee of $1,580 per acre. The staff published the required legal notice of the OPUD -09 -01 in the Owasso Reporter and mailed notices to property owners within a 300' radius of the subject property. Staff has received phone calls and visits in regards to this application. Staff has answered questions and provided any requested information to all of those who have inquired. PLANNING COMMISSION: The Owasso Planning Commission met on December 7, 2009 at 6:00 P.M. At that meeting the Planning Commission unanimously approved the request. The planting theme will highlight the site entries and buildings, and will utilize plant selections indigenous to North East Oklahoma that are durable and require low maintenance. In addition, at least one tree per 50 lineal feet of landscaped edge shall be installed in this area, and at least one half of the trees shall be evergreen. In order to screen the facility from the north, we are proposing an 8 -foot tall privacy fence along the northern boundary. Detail of the fence will be presented to City Staff for approval during the site plan review process. LIGHTING: All Outdoor lighting shall comply with Chapter 19 "Outdoor Lighting" of the Owasso Zoning Code. TRASH CONTAINERS: Outside trash containers will be located in designated areas within the development, and will be screened from the view from the residential area and roadways. SIGNS: All Signage shall comply with Chapter 18 "Signs" of the Owasso Zoning Code. GRADING & UTILITY PLANS A Site Grading & Utility Plan will be submitted to the City of Owasso for review and approval. The Conceptual Drainage Plan is shown on Exhibit B. The Conceptual Site Utility Plan is shown on Exhibit C. All utilities are available to serve this development except Sanitary Sewer. Plans are currently in development to bring sanitary sewer to the site. Drainage and Utility plans will be prepared in accordance with the City of Owasso engineering requirements. Existing topography of the site ranges from elevation 713.00 at the Southeast corner of Development Area B to elevation 693.00 at the North Property line of Development Area A. The site is not located within the FEMA floodplain. There is a 4 -inch water lines located on the West side of 145th East Avenue. There is also an 6 -inch water line that currently located along the south right -of -way line of State Highway 20. These lines will be upgraded to 12 -inch water lines along the boundaries of the development. There are plans to construct an 8 -inch sanitary sewer line to be stubbed out at the Northwest corner of Development Area A. All other utilities and communication services are available and accessible to Encore at Elm Creek. ACCESS AND CIRCULATION Ingress and egress to Encore at Elm Creek will be from both North 145th East Avenue and East 116th Street North (State Highway 20). FEARY PROJECT ADMINISTRATOR SUBJECT: ACCEPTANCE OF FY 2008 -2009 CIP STREET REHABILITATION PROJECT AND AUTHORIZATION FOR FINAL PAYMENT DATE: December 15, 2009 BACKGROUND: The Capital Improvements Fund allows for the expenditure of funds for the repair and /or resurfacing of residential and non - residential roadways throughout the City. In June of 2009, city staff opened bids from five (5) contractors and presented a recommendation to Council that the contract be awarded to Pavement Conservation Specialists, Incorporated (Tulsa OK) in the amount of $259,125.00. The City Council awarded the construction contract on June 16, 2009. The project area consisted of Elm Creek Estates and Original Town from Atlanta to Carlsbad on both 3rd and 4th Streets as well as Beaumont from 3rd to 4th. The nature of the work to be completed consisted of concrete patches with an asphalt cap, concrete drive approach repair /replacement, and curb and gutter repair /replacement. In October, Public Works staff evaluated the feasibility of making much needed repairs to the asphalt surface on E. 96th Street North between the HWY 169 Overpass and existing concrete surface west of the JC Penney site. These repairs would be of the same nature used in Elm Creek estates and Original Town and would be type I patches with no curb and gutter replacement. Staff performed a cost analysis and realized that the work could be done under the existing contract with PCSI, Incorporated and would not require re- bidding because it is an existing unit price contract. The only formality needed to utilize the current agreement was authorization from Council to revise the existing contract. City Council did authorize the revised scope of work and authorized additional funds from this budget line item to be payable to PCSI, Incorporated under the existing contract and not to exceed $419,125.00. The additional work was performed and completed in a timely manner. FUNDING: Funding for this project is included in the Capital Improvements Fund budget. RECOMMENDATION: The staff recommends City Council acceptance of the contract work and authorization for final payment to Pavement Conservation Specialists, Incorporated in the amount of $189,261.55 bringing the contract total to $398,401.81.
