BACKGROUND
The City of Owasso has received request to review and approve the annexation of approximately
78.47 acres, located on the west side of North 129"' East Avenue, approximately '/z mile north of East
66"' Street North, just south of the Baptist Retirement Village.

DEVELOPMENT PROCESS -
The first step in the development of a piece of property in Owasso is annexation. Annexation is
the method whereby land located outside the City limits is made a part of the City. Property
owners and land developers sometimes choose to have their property annexed into Owasso in
order to receive Owasso municipal services, such as police and fire protection, refuse collection,
and sanitary sewer.
The second step in the development of a piece of property in Owasso is rezoning. In order to
develop the property, the land must be zoned for particular Lands of uses, such as residential,
office, commercial, or industrial. Rezoning decisions are made in accordance with the growth
policy displayed in the Owasso Master Plan.
The third step in the development of a piece of property in Owasso is platting. A preliminary
plat is required for any development that proposes to divide land into two or more lots.
Preliminary plats illustrate the development concept for the property, and are often modified
significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso
Planning Commission. Sometimes, difficult development issues such as existing utility lines,
wells, or casements are brought to light at the preliminary plat stage and must be remedied prior
to development.
ANNEXATION REVIEW PROCESS
The annexation process is initiated when a property owner submits a petition to the City of
Owasso requesting that the City bring the property into the City limits.
The applicant must submit as part of the request a signed petition requesting the annexation, an
accurate legal description and map of the property being requested for annexation and a certified
300' radius report so that staff may send legal notices to surrounding property owners. Upon
receipt of all appropriate materials the staff initiates the review process which begins with a
thorough analysis of the request.
The annexation request is then presented to the Owasso Annexation Committee for review and
recommendation. The Annexation Committee is made up of staff, elected officials and citizens.
The Committee reviews the petition for compliance with the Annexation Policy and establishes a
recommendation to the Owasso Planning Commission.
The Owasso Planning Commission holds a public hearing to determine if the property is
compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso
City Council.
The Owasso City Council will make the final determination to annex the property or refuse
annexation. If the property is annexed into the City limits an ordinance officially declaring the
annexation is written and adopted by the City Council. Once adopted the ordinance is circulated
to appropriate regional and national agencies for recording and altering maps.
ANALYSIS
The applicant is requesting to annex approximately 78.47 acres, located on the west side of North
129t" East Avenue, approximately % mile north of East 66`" Street North, just south of the Baptist
Retirement Village. It is the applicant's intent to develop the property for residential single-family
use. Phase one of the development containing approxamently 139 residential lots on 39.06 acres
is in the preliminary stages of development. The preliminary plat will be submitted to the
Planning Commission next month with the Rezoning application. The development will be
served water by Rogers County Rural Water District and sewer by the City of Owasso.
Staff published legal notice of the annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners within a 300' radius.
ANNEXATION COMMITTEE:
The Owasso Annexation Committee reviewed the request at its meeting on June 28, 2006. At
that meeting, the committee unanimously recommended approval of the annexation.
PLANNING COMMISSION.
The Planning Commission considered the annexation request at its meeting on July 10, 2006. At
that meeting, the Planning Commission unanimously recommended approval of the annexation.
RECOMMENDATION:
The staff intends to recommend approval of OA 06-09.

office, commercial, or i-ndustrial. Rezoning decisions are made iin accordance with the growth
policy displayed in the Owasso Master Plan. Specific development concerns, such as drainage,
traffic, water/wastewater services, and stormwater detention are not able to be considered at the
zoning stage of the development process.
The third step in the development of a piece of property in Owasso is platting. A preliminary
plat is required for any development that proposes to divide land into two or more lots.
Preliminary plats illustrate the development concept for the property, and are often modified
significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso
Planning Commission. Sometimes, difficult development issues such as existing utility lines,
wells, or easements are brought to light at the preliminary plat stage and must be remedied prior
to development.
After the preliminary plat has been reviewed by the City and various utility companies,
construction plans for the development's infrastructure are typically submitted. These plans
include specifications and drawings for stormwater drainage, streets and grading and erosion
control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of
other agencies, such as the Department of Environmental Quality for wastewater collection and
the US Army Corps of Engineers for properties that may be development sensitive.
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates
the layout and dimension of lots included on the final plat, right-of-way widths, easements, and
other physical characteristics that must be provided for review by the City. After obtaining
approval from the TAC and Planning Commission, the final plat is considered by the City
Council. If approved, the final plat is filed with the office of the County Clerk and governs all
future development on that property.
The fourth step in the development of a piece of property in Owasso is the site plan. Site plans
are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking,
access, landscaping, and building footprint are presented in the site plan. Once a site plan is
approved, the development is clear to apply for a building permit and to submit construction
plans for the building's foundation, plumbing, electrical system, and FIVAC.
ANALYSIS
The City of Owasso has received a request to review and approve the rezoning of two one acre
lots from (AG) Agriculture to (RE) Residential Estate. It is the applicant's intent to donate the
two one acre tracts to his children for the future construction of single family residential homes.
The request is consistent with the Owasso Land Use Master Plan as it calls for residential
development in the area. Letters were mailed to surrounding property owners and the legal
advertisement was published in the Owasso Reporter.
PLANNING COMMISSION:
The Planning Commission considered the rezoning request at its meeting on July 10, 2006. At
that meeting, the Planning Commission unanimously recommended approval of the rezoning.
RE COMMENDATION
Staf F, intends to recommend approval of OZ 06-04.

Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the
layout and dimension of lots included on the final plat, right-of-way widths, casements, and other
physical characteristics that must be provided for review by the City. After obtaining approval
from the TAC and Planning Commission, the final plat is considered by the City Council. If
approved, the final plat is filed with the office of the County Clerk and governs all future
development on that property.
ANALYSIS:
The applicant is requesting this review in order to facilitate a commercial development on 2.17
acres. Since this is a one lot development there is no preliminary plat required.
In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use
Master Plan, as the area is forecasted for commercial development. The proposed final plat
satisfactorily meets the requirements established in the Owasso Zoning Code. The development will be
served sewer by the City of Owasso and Water by Rogers County Rural Water District. Utility
easements are established throughout the proposed addition so as to adequately accommodate utility
services.
PLANNING COMMISSION:
The Owasso Planning Conu-nission considered the application at a public hearing conducted on
June 10, 2006. At that public hearing, the Planning Commission unanimously recommended that
the City Council approve the final plat,
RECOMMENDATION:
Staff intends to recommend approval of the Kum & Go final plat.

The staff has studied the possibility of annexing ten different properties in close proximity to the
city limits of Owasso. These areas include property that is undeveloped and surrounded by
municipal boundaries, the right-of-way of Hwy. 169, two elementary schools, and a church.
Specifically, the areas of property are:
1. 12919 East 96th Street North
2. 12901 East 96"' Street North
3. 12937 East 96"' Street North
4. 9302 North 129th East Avenue
5. 9441 North 129th East Avenue
6. 9309 North 129th East Avenue
7. The undeveloped tract at the southeast corner of East 96"' Street North and North
129t1' East Avenue
8. The right-of-way of Hwy. 169 from East 96th Street North to East 126th Street North,
and the right-of-way of Hwy. 169 from East 76th Street North to the fenceline at East
76th Street North
9. The new Barnes Elementary School, 7809 East 76th Street North
10. Hodson Elementary School, 14500 East 86th Street North
The staff arrived at the determination of properties that should be annexed by evaluating recent
growth patterns and the level of service that could be provided to the areas of annexation.
Particular weight was given to properties that arc completely surrounded by corporate limits, and
weight was also given to undeveloped acreages.
Within the annexation ordinance, the City of Owasso has the choice of either incorporating the
properties as AG Agricultural or as the current zoning classification given by the County. The
staff intends to recommend that the properties be annexed with the zoning classification given to
them previously by Tulsa County. The 10 acres at 9302 North 129t" East Avenue and the
Episcopal Church are each zoned AG Agricultural, as are the two properties at the southeast
comer of East 96"' Street North and North 129"' East Avenue. The properties located northeast
of the intersection of East 96t" Street North and North 129"' East Avenue are zoned CS
Commercial.
It should be noted that annexation does not change the current land use of the properties. If a
property that is annexed is occupied by a residential stricture, that structure may remain and the
use of that structure may continue indefinitely. Similarly, if a property is being used for the
upkeep of livestock, the keeping of livestock may continue indefinitely.
First, the City Council, by adoption of Resolution 2006-15 on June 20, 2006 has directed the city
staff to prepare and publish notice of two public hearings concerting the annexation. This
resolution also directs that an annexation services plan be prepared for the affected properties.
The Planning Commission conducted the first public hearing on July 10, 2006 and recommended
approval of the annexation to the City Council. The City Council would conduct the second
public hearing, followed by its consideration of possible action related to the annexation.
Finally, an ordinance effectively annexing the properties would have to be adopted.
It is the staffs findings that the ten properties under consideration for annexation are a part of the
Owasso community and ought to be a part of the Owasso incorporated area. After all, the two
schools serve Owasso residents, the highway right-of-way is sandwiched by Owasso's corporate
limits, and the residents who live in this territory shop in Owasso, go to church in Owasso, are
part of the Owasso school district, have the Owasso zip code, and in large part consider
themselves to be contributing parts of Owasso.
This annexation would be another step in a continuing attempt to make the city's boundaries
more uniform, and to remove many of the gaps within Owasso's corporate limits. Past decisions
by the Tulsa County Board of Commissioners, made contrary to the designs of the Owasso
Master Plan, have shown that it is reasonable that the City should examine unincorporated parts
of the community throughout the area for the purpose of bringing uniformity to the city
boundaries.
Owasso has prepared an annexation services plan as part of the annexation process, and this plan
will have to be implemented as part of the Capital Improvements plan within ten years. The
annexation services plan is included as an attachment to this memorandum. Owasso fire and
ambulance service already serve the area. Police and Community Development services will
extend to the territory immediately upon annexation. Water lines are in place and currently serve
the area. Sewer mains he in the immediate vicinity of the areas and will be extended to the
properties at the owners' request and expense. Refuse collection service will be made available
to the properties, but not mandatory; the City of Owasso will not forcibly take over the area from
existing refuse collection providers. The roads and stormwater drainage systems within the
territory will be maintained to the levels of their current condition.
The staff intends to recommend City Council approval of the annexation of the ten subject
properties.

Tire Protection — The City of Owasso already provides fire protection for the area.
Ambulance Service —"The City of Owasso already provides ambulance service for the
area.
Sanitary Sewer Service — Sanitary sewer service is available in close proximity to each of
the properties. Sanitary sewer service will be extended to the remainder of the properties
in the area at the property owners' request and expense.
Roads — Public roads in the area will be maintained to their current condition.
Stormwater Drainage — Stormwater drainage facilities in the area will be maintained to
their current condition.
Refuse Collection — The City of Owasso will make refuse collection service available to
any properties in the area that desire municipal refuse collection service. The City of
Owasso will not forcibly purchase the service area from existing refuse collection
providers.

BACKGROUND
Included in FY 2006-2007 Budget, the Capital Improvements Fund allows for the expenditure of
$ 1 million in the repair and/or resurfacing of residential and non-residential roadways throughout
the City. Rehabilitation sites are currently under evaluation and will be selected based on a
comprehensive assessment of roadways conditions (both residential and non-residential). The
selection process is aimed at maximizing return on investment by increasing roadway lifecycle
and minimizing future maintenance costs while enhancing overall roadway driving conditions
and public safety.
Seeking to further maximize return, on April 2006, the City of Owasso formally requested
assistance from Tulsa County in the completion of several roadway projects. Specifically, the
request included the use of County labor and equipment for the paving and/or resurfacing of
approximately eight lane -miles (or 6,400 tons of asphalt) of roadway surface (see Attachment A
for preliminary locations). The use of such equipment and labor is anticipated to reduce overlay
costs by as much as fifty percent.
On June 2006, Tulsa County submitted an Agreement to provide an asphalt overlay. In order to
formalize responsibilities (pending the selection and approval of sites), an Agreement has been
drafted with Tulsa County (see Attachment B) that includes the following:

® Tulsa County shall provide all necessary labor and equipment to complete the
projects; and
Duration of the Agreement shall be for a period equal to the time necessary to
complete the projects.

BACKGROUND:
As part of the projects approved under the Oklahoma Department of Transportation (ODOT)
Local Government Program, the work calls for the widening and signalization of the intersection
at E. 86t1' Street North and N. Mingo Road, complete with new sidewalk, curb and gutter and
drainage improvements (see Attachment A). Although originally programmed for construction
under the 1998 Bond, the work was delayed for several years to allow for the completion of E.
76th Street North and US Highway 169 Interchange, E. 86th Street North and Main Street
Intersection and E. 76th Street North Widening. Engineering design, first initiated in 1999,
resumed in July 2005 and was completed in June 2006. The project is scheduled to advertise for
Bids in November 2006 for a construction start date in January 2007.
In preparation for construction, American Electric and Power (AEP), Southwestern Bell,
Verdigris Electric Company, Oklahoma Natural Gas (ONG) and Cox Cable have engineered
relocation of utilities to allow for the construction of improvements. All utilities, except for
ONG's and Washington County Rural Water District No.3 (RWD #3), are located within the
public ROW and have no dedicated easements, thus relocation will be at no expense to the City.
On June 20, 2006, the City of Owasso agreed to the reimbursement of $190, 626 for the
relocation of 1,216 linear feet of pipeline located outside the public ROW and within a privately
owned easement. Construction of the relocation work is expected to be completed by August
2006.
RWD #3 UTILITY Y LOCATION:
The Rural District currently owns approximately I10 linear feet of waterline to be relocated
within the limits of the project. The total length is located outside the public ROW and within a
privately owned easement, thus, the City must bear the entire cost of relocation estimated at
$4,325.
The Agreement (see Attachment B) contains language outlining the terms of the relocation and
payment. The City Attorney has reviewed this agreement and found it acceptable.

THIS AGREEMENT, made and entered into be and between the City of Owasso, a
Municipal Corporation of the State of Oklahoma acting for and on behalf of the City of
Owasso, hereinafter called the "City" and Washington County Rural Water District #3
(RWD #3) with an address as: P.O. Box 70, Collinsville, Oklahoma 74021, hereinafter
called the "Utility Company",
WITNESS THAT
WHEREAS, the City proposed to improve the 86`r' Street North and North Mingo Road
Intersection, and such improvements will necessitate rearrangement of facilities of said
Utility Company, and
WHEREAS, the City reserves the right to cancel this Agreement at any time prior to the
beginning of the adjustment or relocation of the facilities of his Utility Company, and
WHEREAS, the City agrees to pay the Utility Company for the proportionate share of the
actual cost of preliminary engineering in preparing plans and estimates at the City's
request, if for any reason the City cancels this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants herein contained, the
Utility Company agrees:
To prepare a detailed estimate of the cost of work to be performed in accordance with
the Department of Transportation Utilities Manual and Accommodation Policy, and
such estimate of cost is attached and made a part of this Agreement. (Attachment No.
2.) The estimate will include: (1) The accounting system to be used in computing the
relocation costs; (2) Credit for Expired Service Life setting forth therein the
conditions on which such credit was determined or complete justification if the credit
is not applicable; and (3) Whether equipment costs are developed from experience
records.
2. Costs for backfill and compaction of any trenches or holes within the right-ofaway
limits will be included in the estimate of costs. The backfili will be placed and
compacted to a density not less dzan that of the adjacent soil, as directed by the City
Engineer.
3. To prepare drawings showing the present, temporary and proposed location of its
facilities with reference to the new street centcrlin(: in hod) plan �rnd prohic, and

Such drawings will be attached to and become a part of this Agreement. (Letter dated
May 16,2006 and Attachment No. 1.)
4. To begin the adjustment or relocation of the facilities as shown on the plans and
covered by this Agreement within a reasonable time, depending on the availability of
material and work forces, but the actual time must not exceed sixty (60) days after the
receipt of notice to do so, and in no event proceed with any adjustment or relocation
work until such notice is received. To inform the City's Engineer- of. (1) The
proposed starting date, before beginning the work, and to maintain continual liaison
with his office for the duration of the physical relocation; (2) Materials to be disposed
of by scrapping, or sale, and inform him of a time and place for his inspection thereof;
(3) Date of completion of the work.
5. a. That no contract with any individual will be entered into without meeting the
requirements of the Department of Transportation's Utility Manual.
b. That Contract work for technical services, professional services or other labor
classifications involved in the rearrangement of the plant proposed under this
Agreement will be supported by a statement to the effect that, "The Utility
Company is not adequately staffed or equipped to perform such with its own
forces." Proper approval will be obtained in accordance with the Department of
Transportation's Utilities Manual prior to executing a contract with any outside
firm.
6. To submit to the City within six (6) months after satisfactory completion of
rearrangement of its facilities under this Agreement, a certified statement of costs in
accordance with the provisions of the aforementioned memorandums.
7. It is understood this Agreement does not change the rights of the Utility Company as
they exist in accordance with present State law.
8. In consideration of the faithful performance by the Utility Company of the foregoing,
the City agrees:
To reimburse the Utility Company for actual costs of the completed work prorated on the
basis of the following percentages. All reimbursement is subject to approval and audit by
the City.

In accordance with your request we have summarized our understanding of the scope of
work and estimate of probable construction cost for the relocation of certain water system
infrastructure located west of the intersection of 86`h Street North and Mingo.
Scope of Work: As part of the City of Owasso's 86`h Street North and Mingo intersection
improvements project Washington County Rural Water District No. 3 (hereinafter referred
to as the "District") will make certain modifications to the existing water distribution system
infrastructure as described below and as depicted in Attachment No. 1 to this letter:
Modifications to existing 2-inch water line — The District has an existing 2-inch
water line located on the south side of 86`h Street North that currently extends to
a point located east of the Union Pacific Railroad crossing on 86`h Street North.
The District will modify the existing water line by cutting and plugging it near
Station 94+00. The work will include all the excavation and backfill along with
the necessary fittings and thrust blocking. The existing water line located east of
Station 94+00 will be abandoned in place.
2. Water Service Relocation — The District has an existing water service (i.e., service
line, casing, water meter, setter and can) that is located north of 86`h Street North
at approximate Station 92+90 that will be modified to accommodate proposed
grade adjustments. It is anticipated that the service will need to be relocated to a
point north of its current location. The work will include the extension of the
existing service line and casing; installation of new water meter, setter and can
and the reconnection work.
The estimate of probable cost to complete the proposed modifications to the Districts

The Owasso Police Department has noted a steady increase over the past few years in alarm calls
from both businesses and residences. The overwhelming majority of these alarms are false, and
only a very small percentage of the time expended by officers responding to these calls is
devoted to genuine and actual alarm calls. The time spent responding to false alarm calls is not
only a grossly inefficient use of the department's time and resources, but potentially prevents
officers from being available in genuine and life -threatening emergencies because they are
responding to false alarms. Officer morale affected by the number of false alarm calls the
department receives and officer safety is potentially compromised as well. When an officer is
required to respond to several hundred business and residential alarms that are unnecessary and
unmerited, an expectation of "false alarm" and resultant complacency are created. Clearly, the
expectation by an officer that a call is simply another false alarm, one of the thousands the
department receives annually, will eventually negatively affect the officer's vigilance and
jeopardize the officer's safety. In addition, continued tolerance of careless alarm maintenance
and use by commercial and residential users simply encourages alarm misuse and escalates the
number of false alarms. For these reasons, staff believes it is important to examine this issue and
pursue potential solutions.
The statistics showing false versus genuine alarm calls are compelling. For the twelve month
period beginning 6/25/05 and ending 6/25/06, the police department responded to a total of 2001
alarm calls, which were broken down by alarm type as follows:

The above response times and time on scene calculated together resulted in the following number
of hours spent in each category of alarm call:
Business (false) -- (4 + 5 minutes = 9 minutes) 9 x 1,229 = 11,061 minutes (184.35 hours)
Hold -Up (false) -- ( 3+4 minutes = 7 minutes) 7 x 23 = 161 minutes (2.68 hours)
Residential (false) — (6 + 4 minutes = 10 minutes) 10 x 747 = 7,470 minutes (124.50 hours)
Genuine Alarm — ( 2 + 47 minutes = 49 minutes) 49 x 98 minutes (1.63 hours)
Of the 313.01 hours devoted by the police department to alarm calls over this twelve month
period, only 1.63 hours were spent responding to genuine and valid calls. The other 311.38
hours were spent responding to false alarm calls. It should be noted that the statistics shown
above reflect the time expended by only one officer per call. The actual number of man hours is
significantly higher given that two officers are typically dispatched to each alarm call.
The staff believes the formation of a citizen's committee is the most effective method to examine
this growing problem and to recommend possible alternatives and solutions. Other cities have
addressed this problem in a number of ways, including education of alarm users, issuing permits
for alarm use, imposing fines for false alai -in calls and enacting ordinances requiring
confinnation of a crime in progress by the alarm company before an officer is dispatched to the
call. The proposed citizen's committee will review remedial measures taken by other
municipalities and prepare a report for consideration by the City Manager and the City Council.

The purpose of this memorandum and the item listed on the agenda is to allow for a Council
discussion of this issue prior to initiating any public discussion. In an effort to maximize input
before drafting rules and regulations for Council consideration, it is the staffs intent to form a
citizen's committee to examine the growing problem of false alarm calls and to prepare a report
exploring potential solutions and recommendations to address this problem.

In 2005, Tulsa County voters approved a one million dollar expenditure (under the "4®to®Fix the
County" program) as matching funding for the widening of E. 861h Street North between Main
Street and US Highway 75. Following the award, city staff began discussions with Tulsa County
to better define the scope of improvements due to the limitations in funding. Initial discussions
included enhancements to the road between Main Street and N. Mingo Road, serving to complete
improvements to N. 86tn Street North between US Highway 169 and N. Mingo Road.
Discussions led to the possibility of obtaining additional funding for this project from the
Oklahoma Department of Transportation (ODOT) through other program sources allocated for
Tulsa County projects. One example of a potential funding source is the ODOT's Urbanized
Area Surface Transportation Program which is currently administered by the Indian Nations
Council of Governments. Only members of the defined "Urbanized Area" may apply for such
funding, disqualifying the City of Owasso from seeking assistance on its own. In June 2006,
however, Tulsa County agreed to sponsor the E. 86t" Street North and Mingo Road Intersection
Improvements on behalf of the City of Owasso. Following approval of the project by INCOG,
funding for the work is being proposed under "FFY 2006 Transportation Improvement Program
(TIP) Amendment" for submittal to ODOT for inclusion in the Statewide TIP.
The allocation of additional TIP funding for E. 86tn Street North may enable the construction of
improvements west of N. Mingo Road, extending the widening project from Main Street to N.
Memorial Road. Further, staff is optimistic that in the next three to five years additional ODOT
funding — programmed for Tulsa County projects — may become available to Owasso for the
completion of widening improvements to US 75.
To enable timely use of ODOT funding, it is recommended that Engineering Design Services
begin immediately for the portion of roadway between Main Street and Memorial Road
(Attachment A). The design fees will be funded by Tulsa County "4®to-Fix" allocation. An
Agreement has been crafted to enable the use of such funding for this purpose.

TULSA COUNTY AGREEMENT:
On June 23, 2006, Tulsa County submitted an Agreement (Attachment B) to provide
improvements on E. 861h Street North, from Main Street to Memorial Road. Per the Agreement,
the City of Owasso consents to provide right-of-way, utility relocation and engineering services.
The County, in exchange, agrees to provide $1,000,000 in matching federal highway funding and
assist in the application for such federal funds and financing of engineering services.
DESIGN SERVICES AGREEMENT:
Following concurrence by Tulsa County and City of Owasso staff, C2A Engineering, Inc.
submitted a proposal for the performance of design work associated with improvements to E.
861h Street North between Main and Memorial. It is worth noting that the aforementioned
Engineer completed the design work for E. 86th Street North and N. Mingo Road and facilitated
discussions with ODOT, Tulsa County and INCOG which made possible the award of additional
funding.
In July 2006, C2A Engineering, Inc. submitted an Agreement for Engineering Services
(Attachment C) in the amount of $180,000 for the performance of engineering design work to
include preparation of documents for the construction of a four -lane roadway, complete with
sidewalk, curb and gutter and drainage improvements from Main Street to N. Memorial Road.
Tulsa County and Owasso staff have reviewed the proposal and found such fee to be fair and
reasonable for the performance of the scoped work.
FUNDING:
Funding is provided by Tulsa County 4-to-Fix Program in the amount of $1,000,000 and ODOT.
Matching City funding has been included in FY 2006-2007 Capital Improvements Fund (Line
Item 40-300-54210-013) in the amount of $300,000.
.ECOMMENDATIONS:
Item 1: Staff intends to recommend Council approval of the Interlocal Agreement with Tulsa
County to provide improvements on E. 861h Street North, from Main Street to Memorial Road,
and authorize the Mayor to execute the Agreement.
Item 2: Staff intends to recommend City Council approval of an Agreement for Engineering
Services (E. 861h North between Main Street and N. Memorial Road) in the amount of $180,000
for the completion of documents for construction of E. 86t1i Street North Widening
Improvements and authorize the Mayor to execute the Agreement.

THIS AGREEMENT, made the day of , 2006, by and between the Board of
County Commissioners of Tulsa County, Oklahoma, hereinafter called "County" and the City of
Owasso, Tulsa County, Oklahoma, hereinafter called "City".
WHEREAS, by virtue of 69 O.S., 1981, Section 1903, the Board of County Commissioners is
authorized to enter into agreements with municipalities to construct, improve, and repair any of the
streets of such municipalities, and;
