moved to approve the minutes of November 23, 2010 regular meeting, David Hall
seconded the motion to approve the minutes.

4. OBOA -10 -08 — Special Exception — Consideration and appropriate action related to a
request for approval of a special exception to allow a carport on property located at 303
East 16th Street, Owasso, Oklahoma.
Joe Ramey presented the item and Karl reviewed the staff report. The subject property is
located at 303 East 16 °i St. (Lot 19, Block 6, Ator Heights Addition). The surrounding
land use was described. The present zoning is RS -3 (Residential Single Family District).
The property owner seeks approval to place a carport in front of the front building
elevation. Letters were mailed to all property owners within three- hundred (300) feet of
the subject property and the request was advertised in the Owasso Reporter. Staff
received one objection concerning this request. Staff found other carports in the area of
similar style and construction as to what the applicant wishes to build. The staff
recommends approval of OBOA- 10 -08. The applicant was present to answer any
questions.
Tammy Laakso moved to approve the special exception OBOA- 10 -08. David Hall
seconded the motion. A vote on the motion was recorded as follows:

BACKGROUND:
The City of Owasso received a request for a Special Exception to allow the placement of a non-
permanent concession trailer on a property zoned CH. The property is located at 106 East 2nd
Street (76th St. N. just east of Main), on the some parcel as Owasso Pawn. The applicant intends
to sell BBQ from the trailer during the daytime hours and remove the vehicle at night.
SIZE OF LOT:
0.76 acres, (33,250 SF)

APPROVAL PROCESS
"The Board of Adjustment shall hold the public hearing and, upon the concurring vote of three
members, may grant the Special Exception after finding that the Special Exception will be in
harmony with the spirit and intent of the code, and will not be injurious to the neighborhood or
otherwise detrimental to the public; welfare. Provided that the Board in granting a Special
Exception shall prescribe appropriate conditions and safeguards, and may require such
evidence and guarantee or bonds as it may deem necessary to enforce compliance with the
conditions attached." -Section 1480.4 Owasso Zoning Code.
ANALYSIS:
The applicant desires to sell BBQ from a trailer that will be placed in the parking lot. The
applicant indicates that he will remove the trailer in the evenings. A use such as this, temporary
concessions trailer is essentially a temporary non - conforming use placed on an existing
conforming lot and thus requires approval from the Board of Adjustment According to the
Owasso Zoning Code.
Letters were mailed to all property owners within three - hundred (300) feet of the subject
property and the request was advertised in the Owasso Reporter. Staff received no objections
concerning OBOA 10 -09.
The applicant provided information as to the size and placement of the vehicle. According to
this information the vehicle is a 7' x 12' trailer and it will be parked towards the front of the
parking lot, behind the sidewalk next to the sign for Owasso Pawn. The size of the trailer is less
than a typical parking stall of 9'x19'.
Typically, with uses such as this, parking and avoiding the obstruction of the drive aisles are
usually the biggest factors that need consideration. Owasso Pawn is a 7,400 SF retail building
and requires 37 spaces according to the zoning code; staff visited the site and determined that
parking will not be impacted with the proposed concession trailer. Staff recommends that the
applicant park the trailer perpendicular to the frontage of 76th Street North to avoid taking more
than one parking stall.
Staff has concluded that the concessions trailer will not impact public safety and the welfare of
the community and could serve to potentially bring more people into the downtown area.
RECOMMENDATION:
Staff recommends approval of OBOA 10 -09

NOTICE OF A HEARING BEFORE THE BOARD OF
ADJUSTMENT OF THE CITY OF OWASSO, OKLAHOMA.

Notice is hereby given that a public hearing will be held before the
Owasso Board of Adjustment in the Old Central Building located at
109 North Birch, at 6:00 PM on January 25, 2011. The Owasso
Board of Adjustment will consider a request for a Special
Exception to the Owasso Zoning Code to ALLOW FOR A NON-
PERMANENT CONCESSION TRAILER on a property zoned
CH (Commercial High Intensity District). The property is Owasso
Pawn located at 106 East 2 " Avenue.
All persons interested in the above mentioned matter are hereby
notified to be present at the above mentioned time and place in
order to present their arguments for or against same.
