town of Owasso, Oklahoma, and increasing
and extending the city limits to include
the annexed terriory
WHEREAS, a petition filed by more than three
fourths of the legal voters and by the owners of more
than three fourths in value of the property hereinafter
described, requesting that said property be annexed to
the Town of Owasso, Tulsa County, Oklahoma, which property
is contiguous and adjacent to the Town of Owasso
and not hereinafter embraded within the city limits of
said Town, and,
WHEREAS, notice of the presentation of such petition
has been given by said petitioners by publication at least
once in each week or two successive weeks prior to this
date in the collinsville news, published at collinsville,
Oklahoma, which is nearest to the Town of Owasso, there
being no newspaper published in Owasso, and
WHEREAS, the Town Council deems it proper to annex
said territory and to extend and increase the Town limits
of the Town of Owasso,
The following described property is hereby annexed
to and made a part of the Town of Owasso, Tulsa County,
Oklahom, To-wit:
The Southwest Quarter of the
Northwest Quarter of the Northeast
Quarter and the south one-half
of the Northwest quarter
of the Northwest querter of the
Northeast quarter all in Section
Thirty, Township Twenty-one North,
Range Fourteen East, Tulsa County
Oklahoma.
as shown by the map thereof, attached hereto, and the
city limits of the Town of Owasso are hereby extended
and increased to include said property within the town
limits of Owasso. the president of the Town Council
is authorized and directed to file a copy of this Ordinance
in the office of the County Clerk of Tulsa, Oklahoma.

CONTRACT
This Contract, made and entered into at Owasso, Okla-
homa this 20th day of ;June, 1960, between C. B. Sherrill and
H. C. Sherrill, doing business as Sherrill & Sherrill of
Owasso, and the Town of Owasso, a municipal Corporation
in Tulsa County, Oklahoma, in which said parties in con-
sideration of the matters herein set forth have bound them-
selves upon the following terms and conditions, to wit:

For the purposes of this contract the Town of Owasso,
Oklahoma shall hereinafter be referred to as first party,
and C. B. Sherrill & H. C. Sherrill of Owasso, shall be
referred to as the second party.
That the Second Party is now the owner of the water
lines and mains in the Sherrill Estates Addition to the
Town of Owasso which the First Party desires to acquire
and which water lines and mains the Second Party is willing
to transfer and assign to said First Party, and it is fur-
Cher understood and agreed that the reasonable value of
said water lines and mains is the actual cost thereof, to-
wit: the sum of $8,841.40.

It is agreed that the First Party does not have on hand
sufficient funds with which to purchase the interest of said
Second Party in said water lines and mains and does not de-
sire to vote bonds for that purpose at this time; and that
the Second Party is willing that the amount due it under
the terms of this Contract may be paid from the receipts
from the water lines as hereinafter set forth. It is agreed

in this connection that the Town of Owasso is selling water
to the occupants of said Sherrill Estates Addition and has
been since the construction of said water lines and mains.
IV
It is further agreed that the Second Party has trans-
ferred and assigned and by these presents does hereby trans-
fer, set over and assign to the First Party all of its rights
and interest in the water lines and mains in Sherrill Estates
Addition which were constructed by the Second Party at a
total cost of $88841®40; that the Second Party is trans-
ferring the same at a discount of 25/ leaving a net balance
due and owing said Second Party in the amount of $68631.05
which sum is agreed between the parties to be the total
purchase price for said water lines and mains.

It is further agreed between the parties that the
First Party shall pay to the Second Party for said water
lines and mains the following sums of money upon the follow-
ing terms and conditions` to-wit:
Commencing on the day of g
19608 the gown of Owasso shall pay one-third
(1/3) of the receipts which it receives from
the consumers of water in Sherrill Estates
Addition, and the First Party shall make a
like payment of one-third (1/3) of the water
receipts to the Second Party each successive
month thereafter until such time as said
water lanes and mains shall be fully paid
fore The Second Party further agrees to as-
sign said water lines and mains on the above
terms and conditions and the signing of this
contract shall serve as an assignment of same.

VI
It is understood by the Parties hereto that the Second
Party is to receive one-third (1/3) of the receipts from
consumers of water in Sherrill Estates Addition as payment
toward the purchase of the water lines and mains by the
First Party. DTI
VII
It is further agreed that the Town of Owasso shall
furnish and sell water to the occupants of Sherrill Estates
Addition or to consumers in said Addition at the same rate
at which water is sold to other consumers in the Town of
Owasso. It is understood and agreed that the Town of Owasso
assumes no obligation for the payment of said water lines and
mains other than to pay one-third (1/3) of the receipts as
above set out and this agreement shall not be construed to
create any additional liability upon the Town of Owasso to
pay for said water lines and mains. Upon payment of the sum
of $6,631®05, without interest, this contract shall terminate
as to said water lines and mains and all the rights in said
water lines and mains shall thereupon vest in the Town of
Owasso free and clear of any and all claims of the Second
Party or its successors or assigns.

Gentlemen:
Upon the request of C. NB. Sherrill and Harriett C. Sherrill,
owner's of Sherrill Estates, Owasso, Oklahoma, we are submitting
evidence that all utilities in Sherrill Estates an
addition to Owasso, Oklahoma have bee completed as follows:
a. Spavinaw water systyem has been installed and
approved by the City of Owasso.
B. Sanitary Sewer System has been installed and
approved.
C. Concrete streets which consists of concrete
survacing, curbs and cutter have been completed
and inspected by FHS inspector.
All of the above utilities have been installed and completed
to our stisfaction. Thereofdre, we are accepting them as of
this daye for upkeep and maintenance.

If, in the specifications a maintenace
period of one year is called for, then automatically
our bond follows along the same line; therefore we
