HANDLING FOOD; ESTABLISHING PERMITS, AND REQUIREMENTS FOROBTAININGTHEM, FOR PERSONS HANDLING
FOOD; PROVIDING FOR THEREVOCATION OF SUCH PERMITS; PROVIDING PENALTIES FOR THE VIOLATION OF
THIS ORDINANCE; AND DECLARING AN EMERGENCY.
Be It Ordained by the Board of Commissioners of the City of Owasso, Oklahoma, as follows
Section 1. A. Food Defined. The term "food" as used ehrein, shall include all articles
used for food, drink, confectionery, or condiment by man or animals, whether the same be simple
or compound.
B. Health Officer. The term "Health Officer" shall mean the Superintendent
of Health of Tulsa County or his authorized representative.
Sect�.on 20 Diseased Persons. No employer shall employ, permit or suffer any person to
work, in a building or room or vehicle occupied or used for the production, preparation, manu-
facture, packing, storage, sale, distribution and transportation of food, who is affected with
any contagious or Infectious disease.
Section 3. Permits. It shall be unlawful for any person who operates or works for a
business which produces, prepares, manufactures, sells or packages food, as defined in this
ordinanes, in the City of Owasso who does not have in his or her possession a current and un-
revoked permit approved by the Health Officer. A person working in an itinerant restaurant
shall also be required to secure a permit,
Section 4. It shall be unlawful for any person who conducts a business wherein food is
produced, prepared, ma-nufactured, or packaged, in. the City of Owasso to hire, or permit to be
hired, or permit to work gratis, any person who does not possess a current and unrevoked per-
mit approved by the Health Officer.
SactLom 5. Application for such a permit must be made in writing to the Health Officer
by such person. Prior to approval of such application, the Health Officer shall instruct
such person in approved sanitation practices in food handling; provided that the Health Officer
is hereby authorized, in lieu of the above, to require applicants for permits to attend a
course of instruction in sanitary practices of food service, prior to approval of such appli-
cation.
Section 6. Upon approval of such application by the Health Officer, the Clerk of the City
of OwassO shall. issue said person such permit; provided that there shall be a fee of $2.00 for
each such permit issued and said permit shall entitle such person to work as a food handler
during thc, fiscal year in which said permit is issued.
Section 7. The Health Officer is hereby authorized to issue temporary permits permitting
said applicant to work as foc:,d handler until the next regular course of instruction in sanitary
practices of food handling is conducted; provided that such temporary permits shall expire on
the the above-mentioned course of instructions begins,
Section 8. Before approval Of applications for permits, the Health Officer may require
such medical and laboratory examinations which he deems necessary to minimize the, possibility
of transmission of corknunicable diseases.
Section 9. Revocation of Permits. The Health Officer may at any time revoke the permit
of any person handling food for failure to comply with the provisions of this ordinance, or
for acts of indolence or for acts affecting the health ofa the public and may be reinstated only
by the Health Officsr
Section 10. Zenalty. Any person who shall violate any section or provision of this
Ordinance shall be guilty of an offense; or who shall violate any lawfully issued rule or
regulation made by the Superintendent of Healt1l, the Board of Health shall be, guilty of an
offense; or who shall refuse or fail to do anything herein commanded in this Ordinance or who
does that which is prohibited herein shall be guilty of an offense; and upon conviction shall
be fined in an amount not exegadlinig Twenty ($20.00) Dollars including the costs; provided that
each and svez violation and each day of such violation shall be a separate offense.

peace, health and safety, by reason whereof this Ordinance shall take affect from and after its
passage, approvall. End publication..
