NUISANCE*- GENERALLY
SECTION 1. It shall be unlawf ail l for any person to maintain or commit
any public nAisance, Nuisance being described as follows.-
A nuisance consists in unlamfully doing an act, or omitting
to perform a, duty, which act or omission either:
tends to obstruct, or renders dangerous for
passage, any lake or navi gable river, stream,
canal or basin, or any public park, square,
street or highway; or,
Fourth: In any way renders other persons insecure in
life, or in the use of property.
A public nuisance is one which affects at the same time an entire
community or neighborhood, or any considerable number of persons although
the extent of the annoyance lo.,r damage inflicted upon the individuals may
be unequal.
SE ON 2. Any person violating any provision of this Chapter by doing
that which is prohibited shall be guilty of an offense; upon conviction shall
be punished by a fine in any amount not exceeding Twenty ($20.00) Dollars,
including the costs.
An emergency exists for the preservation of the public
Peace, health and safety, and for the furtherence of the public health,
by reason whereof, this ordinance shall be in full force and effect from
and after its passage and approval.
