AN ORDINANCE GOVERNING, REGULATING, RESTRICTIN AND CONTROLLING THE USE,
OPERATING AND DRIVING OF MOTOR SCOOTERS AND OTHER LIGHTWEIGHT MOTOR VEHICLES;
PROHIBITING USE, OPERATION AND DRIVING OF LIGHTWEIGHT MOTOR VEHICLES DIRING
NIGHTTIME HOURS; PROHINITING USE OF TRAILERS ATTACHED TO CERTAIN LIGHTWEIGHT
MOTOR VEHICLES; PROVIDING EXCEPTIONS; ESTABLISHING MAXIMUM SPEED LIMITS;
REQUIRING PROPER EQUIPMENT; PROVIDING AUTHORITY OF POLICE TO IMPOUD DEFECTIVE
OR IMPROPERLY EQUIPPED VEHICLES AS BEING A PUBLIC NUISANCE; PROVIDING PENALTIES
FOR VIOLATIONS; MAKING ORDNANCE A PART OF THE TRAFFIC CODE OF THE TOWN OF
OWASSO, OKLAHOMA; PROVIDING SERABILITY OF PROVISIONS; AND DELCARING AN
EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOOWN OF OWASSO, OKLAHOMA;
Section1. DEFINITIONS Words and phrases defined by section 1, chapter 12,
of Title 13 of the revised Ordinances for the town of Owasso, Oklahoma, 1957,
are adopted, shall apply and have the same meaning, when used in this ordiance,
and the following words and phrases shall have the following meaning ascribed
to them, towit:
Lightweight Motor Vehicle: Any motor propelled vehicle weighting less that
five hunder (500) pounds, exclusive of attached assessories, and designed to
travel on not more than three weeks in contact with the ground.
Motor: Any combustible engine; engine
Motorbike: A lightweight motor vehicle, including that produced by a manufacturer
or a manual operated vehicle having been converted to a power driven
vehicle.
Scooter: Motor scooter; (This definition shall render the terms motor
scooter, motorbike and lightweight motor vehicle synonymous and interchangeable.)
Town of Owasso: Town of Owasso, State of Oklahoma.
Trailer: A vehicle used to transport property or person, not being self -
propelled and esigned to be drawn by another motor vehicle.
Section 2. Nighttime Driving of Scooters.
It shall be unlawful for any person to drive or operate a scooter, motorbike
or other lightweight motor vehicle upon the strees or highways within the corporate
limits of the Town of Owasso, after the hours of 9:00 o'clock P. M. nor before the
hour of 8:-- o'clock A. M. of nay one day - - except when such vehicle is actually
being used for the purpose of necessary transportation or for commercial purposes
in carrying, deliving or transporting merchandise or delivering messages.
Section 3. Racing Motors.
It shall be unlawfor for any person upon the streets or highways of the
Town of Owasso, to race or unnecessarily accelerate the motor of any motor scooter
or motorbike, while the clutch is disengaged, or to cause such vehicle to emit
loud or annoying sounds or noises.
Section 4. Speed Limit.
No person shall drive a scooter, motorboke or lightweight motor vehicle
within the Town of Owasso on public property or private property open to the public
use, at a speed greater than twenty (20) mines per hour, or at a riate of speed
in excess of a lesser speed limit controlling other vehicles.
Section 5. Mufflers and Exhaust.
It shall be an offense to operate any motor scooter or lightweight motor
vehicle, upon the strees or highways of the Town of Owasso, which is not equipped
with an exhaust system and muffler of either equal or superior efficiency to that
of the original system and muffler provided by the manufacturer of the vehicle
to prevent motor noise.
Section 6. Ignition and Mechanical Adjustments.
It shall be an offense to operate upon the strees or highways of the Town
of Owasso any motor scooter or lightweight motor vehicle, the iginition timing or
other mechanism of which is not so regulated, adjusted, installed or constructed
so as to prevent explosion of duel or grasses within the muffler, exhaust pipe or
in the open air.
Secion 7. Attached Trailers to Lightweight Vehicles Prohibited.
It shall be unlawful to operate upon the strees or highways of the Town of
Owasso any motor scooter or lightweight motor vehicle, which has attached thereto
any car or trailer, to the rear or sides thereof; provided that it shall be
lawful to operate a motorcycle having one side cart or trailer attached to the
side thereof, which does not increase the combined width of motorcycle and cart
or tralier to more than five (5) feet.
Section 8. Police to Impound Defective Vehicles- Nuisance.
Any motor scooter, lightweight motor vehicle or motorbike being operated
on the strees or highways iwthin the Town of Owasso, which is not equipped with
a muffler and exhaust system or having a defective muffler or exhaust system, or
installed or is in such poor state of repair as to fail to comply with the requirements
of this ordinance, or is rendered dangerous to other person or property, or
distrubs the peace and quite of other person, is hereby declared to be a public
nuisance affecting the safety, peace and welface of the general public, and it
shall be the duty of any police officer to impound said vehicle and hold the
same in custody of the Town Marshall until such defect shall have been properly
remedied.
Section 9. Penalty.
Every person convicted of a violation of any provision or section of this
ordinance, shall be punished by a fine not exceeding the sum of Twenty Dollars
($20.00), including costs.
Section 10. Ordinance Cumulative.
This ordinance shall be cumulative and supplemental to and made a part of
the traffic code of the Town of Owasso, knowns as Title 13, of the revised
Ordinances of the Town of Owasso, Oklahom, 1957.
Section 11. Severability of Provisions.
Provisions of this ordinance shall be serable, and if any of the provisions
shall be held in contravention of the Constitution and laws of the State of
Oklahoma, the decisions of the Court shall not effect the validity of this remaining
portions. It is hereby declared to be the intent of this ordinance that the
same would have been adopted had such unconstitutional or unlawful provisions, if
any, not been included herein.
Section 12. EMERGENCY.
That because of the present existance of condidtions whch obviously
constitute an immediate threat to the safety of person and property and the peace
and welfare of the general pubic within the Town of Owasso, Oklahoma, an emergency
exists for the preservation of public peace, health, safety and wefare, by reason
whereof this ordinance shall take effect from and after it passage, as provided by law.
Emergency Clause voted upon separately and passed by unanimous vote of
the Board of Trustees this 2nd day of July, 1962.
Passed by the Board of Trustees of the Town of Owasso, Oklahoma this 2nd
day of July, 1962.
Approved by the president of the Board of Trustees of th Tow of Owasso,
