AN ORDINANCE PROVIDING FOR TEMPORARY PERMITS FOR USES AND STRUCTURES NOT CONFORMING
TO REGULATIONS PRESCRIBED FOR THE USE IN AREAS ZONED FOR RESIDENTIAL PURPOSES;
ESTABLISHING PROCEDURE FOR FILING AND OBTAINING PERMITS; REQUIRING PAYMENT OF FEES;
PROVIDING FOR NOTICES OF FILING OF APPLICATIONS; LIMITING DURATION OF TEMPORARY
PERMITS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA:
Section 1. - TEMPORARY PERMITS FOR NON-CONFORMING USES IN ZONED AREAS.
The Board of Trustees of the Town of Owasso, Oklahoma, May in its descretion,
upon proper application and compliances with the requirements of this ordinance,
grant, to owners, or lessees with the consent of the owners, of property within
additions to the Town of Owasso, Oklahoma, zoned for residential uses only, temporary
and conditional permits, for not more than one year, for structures and uses that do
not confor to the regulations provided for the use by ordinance number six (6) of
the said town of Owasso, Oklahoma.
Section 2. - APPLICATION FOR PERMIT.
Applications for temporary and conditional permits pursuant to this ordinance,
shall be in writing, designating the address, if established, and giving the legal
description of the property for which such permit is sought, and shall further state
in full the natute of the use and kind of structure intended. the application shall
be signed by the applicant or applicants, and filed with the Town Clerk of the Town
of Owasso, and must be accompanied by the payment of a filing fee in the sum of
twenty-five Dollars ($25.00).
Section 3. - NOTICES.
All applicants for temporary and conditional permits as authorized by this
ordinance, must give notice of the filing of such application, stating the location,
address (if established) and legal descrption, and intended use of the property
described in the application, by publication for one week in a newspaper of general
circulation of the county of Tulsa, Oklahoma. The Town clerk shall cause to be
posted on the property, the subject of the application, at least then days prior to
the date set for hearing of such application, a notice that an application has been
made to the board of Trustees for temporary non-conforming uses of said property,
and all persons interest may appear on behalf of or in protest to such application
on the sate set for hearing and argument as provided by this ordinance.
Section 4. - PROOF OF NOTICE.
Before any application shall be heard by the Board, an affidavit or certificate
of the pubisher of such newspaper, in which the notice prescribed by this ordinance
has been published, must be filed with the Town Clerk at any time during which the
Board has said application under advisement. if such proof of publication has not
been tendered to the Town Clerk by the time the hearing of argument for or
against said application, such application shall be dinied by the Board.
Section 5. - HEARING OF APPLICATIONS.
After an application for a temporary and conditional permit has been made to
the Town Clerk and the filing fee paid, as provided by this ordinance, the Town
Clerk shall then submit said application to the Board of Trustees at their next
regular scheudled meeting. The said Board shall then take such application under
advisement for a period of not less that two weeks nor morethat two months from
the time the Board meeting at which the application was submitted. When the
Board has had the application under advisement for the period set by it within the
time herein allowed, the Board shall at the next regular scheudled meeting hear all
arguments for or against the frading of the permit, and may rule on said application
after all arguments are heard or may rule not later that the next regularly
scheduled meeting. If the Board denies the application, a like application on the
same property may not be made again for a period of at least six months from the
date of the Board's ruling.
Section 6. - EMERGENCY.
That because of the present existance of conditions which constitute an
immediate threat to the safety of person and property and the peace and welface
of the general public within the Town of Owasso, Oklahoma, an emergent exits
for the preservation of public peace, health, safety and welfare, by reason whereof
this ordinance shall take effect from and after its passage, as provided by law.
Emergency clause voed upon separetely and passed by unanious vote of the
Board of Trustee this 16th day of July, 1962.
