HomeMy WebLinkAbout040_Parkview AnnexedORDINANCE NUMBER 40 AN ORDINANCE ACCEPTING, ADDING AND ANNEXING TO THE TOWN OF OWASSO, OKLAHOMA, A PORTION OF THE NORTHEAST QUARTER OF THE TOWNSHIP TWENTY-ONE NORTH, RANGE FOURTEEN THEREINAFTER DESCRIBED; DECLARING THE EFFECTIVE DATE OF SUCH ANNEXATION TO BE JUNE 17, 1963, PROVIDING THAT FROM AND AFTER THE EFFECTIVE DATE OF THIS ORDINANCE, AL OF SAID THEREIN AND ALL PROPERTY SITUATED THEREON SHALL BE SUBHECT TO THE JURISDICTION, CONTROL AND ORDINANCES OF THE TOWN OF OWASSO, OKLAHOMA, IN ALL RESPECTS AND PARTICULARS, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF THUSTEES OF TH TOWN OF OWASSO, OKLAHOMA: WEREAS, on the 3rd day of June, 1963, a petition was filed by one j. Ray Smith and the Commerial Lunber Company, a corporation, as sole owners, petitiong and requesting that the following describded real proeprt, to-wit: "Beginning at a point in the north line of the se 1/4, of section 30, Township 21 Norht, Range 14 East of the I.B. & M., in Tulsa County, State of Oklahoma at a point 320.1 feet, more or less, east of the northwest corner of said corner of lot 9, block 6, smithview addition to the City of Owasso; thence east a distance of 879 feet, more or less, along the said north line of the se 1/4 of the ne 1/4of the highway right of way to a point; thence South a Distance of 624 feet, more or less, to the Northeast corner of Rayola Park, to a point; thence West to the Northeast corner of lot 1, Block 5, Marywood addition to the City of Owasso, Oklahoma, to a point; thence North a distance of 5 feet along the line of termination of East Sixth Street (formerly Turner Avenue) to a point; thence West a distance of 320 feet, more or less, along the North boundary line of East Sixth Street, to the Southeast corner of lot 2 block 2, Marywood Addition to said Town of Owasso, to a point; thence north along the East boundary line of block 2, Marywood Addition to the City of Owasso, a distnace of 573.34 feet, more or less, to the point of beginning, being all of the unplatted land saouth and east of smithview addition and north of marywood addtion and north of rayola park and west of the state highway right of way number 169, in the southeast quarter of the northeast quarter of section 306, township 21 north, range 14 east, tulsa county, Oklahoma," be accepted, added and annexed to the Town of Owasso, Oklahoma; and, notice of presentation of said petition having been duly and regulary given and published once in each week for two successive weeks in the Collinsville news, a newspaper fully qualified under the laws of the State of Oklahomaq for such publications, and published neaqrest to the Town of Owasso, Oklahoma, and proof of publication having been duly filed all as required by law, AND, WHEREAS said described property is adjacent to the present boundary line of the corporate limits of the said Town of Owasso, and it is to the mutual advantave, benefit and welfare of the Town of Owasso, Oklahom, and the said Commercial Lumber Comp;any, a corporation, and the said j. Ray Smith, Sole owners, that said peititon to be allowd and the request granted, Now, Therefore, it is ordained as follows: Section 1. That the request and peittion of j. Ray Smith and the Commercial Lumber Company, a corportion, hereinabove referred to be granted and allowed. Section 3. Section 3. From and after the effective date of this Ordinance, all of said real estate described herein shall be a part of the Town of Owasso, State of Oklahoma, and all persons residing therein and all property situated thereon shall be subject to the jurisdiction, control and ordinances of the Town of Owasso, Oklahoma, in all respects and particulars. Section 4. That an emergeny exists for the preservation of the public health, peach and safety, by reason whereof this ordinance shall take affect form and after its passage and approval, as provided by law. EME4RGENCT CLAUSE voted upon separately and passed by unanimous vote of the Board of Trustees this 17th day of June, 1963. Ray Smith, the owners of the following described real property, to-wit: Beginning at the Southeast Corner of Lot one (1) Block Seven (7), Smithview addition to the Town of Owasso, Tulsa County, Oklahoma. According to the recorded Plat thereof, Thence North 1108 Feet, Thence East 184.8 Feet to a pint, thence south- easterly 148.8 feet along the hghway right of way to a point, thence south 1006 feet thence west 413 feet to point of beginning. which land has been platted as parkview. That said plat is fild with Town Clerk of Town of Owasso. and do hereby make application to the Board of Trustees of the Town of Owasso, Oklahoma, to zone the above described property to a commercial use and that a date certain be set for the hearing of this application.
