AN ORDINANCE CONTROLLING THE DEPOSIT, COLLECTION AND DISPOSAL OF TRASH, WASTE AND OTHER
COMBUSTIBLE MATTER AND MATERIAL; PROHIBITING ACCUMLATION OF RUBBISH, WASTE OR OTHER
INFLAMABLE MATERIAL; PROHIBITING THE BURNING OF TRASH OR INFLAMABLE MATERIAL, EXCEPT
DURING PRESCRIBED HOURS OF THE DAY; REQUIRING AND PRESCRIBING TYPE OF CONTAINERS OR
BURNERS FOR THE KEEPING OR BURNING OF INFLAMABLE MATERIAL OR MATTER; PROHIBITING THE
BURNING OF GARBAGE, DEAD ANIMALS, EXCREMEMT AND CERTAIN OTHER SUBSTANCES AND MATERIAL;
PROVIDING HOURS WITHIN WHICH TRASH MAY BE BURNED; AUTHORIZING POLICE OFFICERS TO ENTER
UPON PROPERTY FOR THE PURPOSE OF EXTINGUISHING SMOLDERING OR LIVE FIRES EXISTING THEREON
IN VIOLATION OF THIS ORDINANCE; PROVIDING THAT IF ANY PROTION OF THIS ORDINANCE BE HELD
INVALID THE REMAINING PORTIS THEREOF SHALL NOT BE AFFECTED; PROVIDING PENALTIES FOR
VIOLATIONS, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTESS OF THE TOWN OF OWASSO, OKLAHOMA:
SECTION 1, Deposit Near Combustible Matter.
No person shall deposit ashes, smouldering coal or embersk greasy or oily
substances or other matters liable to create spontaneous ignition within ten feet of any
wooden or plaster wall, partition, fence, floor, lumber, rubbish or other combustible
materials, except in metallic or other on-combustible receptacles, placed on non-combustible
stands resting on a non-combustible floor or on the ground outside the building, and
in every case must be kept at least two feet distance from any combustible wall or partition.
SECTION 2. Disposal of Comustible Refuse.
Every person making, using or having charge of or control over any shaving,
loose hay, sacks, bags, boxes, litter, or any other combustible material of any character,
within the Town of Owasso, Oklahoma, shall at the close of each day cause the same to be
removed from the premises, or securely protected and disposed of so as to protect the same
from sparks and fire and to avoid the creation of a fire hazard.
No rags, paper, or waste substances of any description, which are liable to be
fired or which may cause fire by spontaneous combustion, shall be kept or stored excpet
ina fireproof container equipped with a tight fitting self-closing lit or a lit arranged
to automatically close in case of fire, provided, however, that strage within a manufacturing
or other establishment of sufficient packing cases, boxes, barrels, or other similar
containers to properly varry on its operaton, shall be permitted, but such storage shall
be ordly and not so located as to endanger any exit from the building, and such storage in
the open of packing cases, boxes, barrels or other similar comustibe containers shal not
be more than twenty feet in height, and shall be at least fifty (5) feet from the nearest
building. all such storage shall be ina compact and orderly manner.
SECTION 3. Accumulation of Rubbish Unlawful.
It shall be unlawful for any owner, occupant, or other person having control
of any building, privae way, storeroom, private way, yard or other private premises within
the Town of Owasso, Oklahoma to allow or permit any accumulation of old paper, rage, broken
or discarded boxes, weeds, grass, paper or other inflammable rubbish or wast, to be or
remain in or upon any such building, privat way or private premises, or in any cellar,
basement, area way, or other place connected therewith or adjacent hereto, but all such
material shall be promtly removed from such prmises, or shall be kept in a fireproof
receptacle or receptacles provided with close fitting lids which shall be kept closed
except for the deposit or removal of such materials.
SECTION 4. Vacant Buildings.
The owner or other person having control of any building in the Town of
Owasso shall, whenever the same or any part hereof becomes vacant or unoccupied, remove
therefrom forthwith all waste paper and other comnustible waste materials accumulated therein
and shall securely close and lock and deep closed and locked, all doors, windows, or other
openings into such building or portion thereof while the same remains unoccupied.
SECTION 5. Trash Burning.
It shall be unlawful for any person to start or maintan any fire or cause
any fire to be started or maintained ouside of a building and inside the corporate limits
of the Town of Owasso, Oklahoma, for the purpose of burning any trash, refuse, waste paper,
weeds, grass, hay, stray or other inflamable material or rubbish of any description,
except in inclosed burners constructed of incombustible material and so constructed and
equipped as to prevent the contents escaping therefrom, and then only between the hours
of six (6) o'clock A.M> and Elevan (11) O'clock in the forenoon of any one day. said
trash burners shall meet with the approval of the Board of Trustees of the Town of Owasso,
Oklahoma, and shall not be less than thirty (30) inches hight and shall not be located
within ten (10) feet from any fram or non-fireproof building or structure, If conditions
warrant, a stack shall be provided, if so ordered by said Board of Trustees of the Town
of Owasso or by the Chief Marshall or Police of said Town of Owasso.
SECTION 6. Prohibiting Burning of Certain Matter.
It shall be unlawful to burn or attempt to burn or cremate any garbage,
consisting of vegetable or animal matter, or the body or any part of any dead animal, or
any animal or human excrement, or to burn or attempt to burn any rubber or other material
which, when submitted to heat or flame, tends to discharge unusual and extreme obnoxious
oders or discharge gases which are injurious to public health.
SECTION 7. Authority of Police to Extinguish Fires.
The Town Marshall or any Law Enforcement Officer or member of the Fire
Deparment of the Town of Owasso, Oklahoma, may enter upon private property for the purpose
of extinguishing, or causing to be extinguished, any fire or smoldering embers thereon
existing in violation of the provisions and requirements of this ordinance.
SECTION 8. Invalidity.
In the event any word, phrase or section of this ordinance shall be held
invalid by any court of comretent Jurisdiction, the remaining words, phrases and sections,
and the remaining portions thereof shall not be affected thereby.

SECTION 9. Penalties.
Any person who shall violate any of the provisions of this Ordinance
shall be guilty of an offense and upon conviction thereof shall be fined in any sum not
to exceed Twenty Dollars ($20), including the costs. each separate day such persom
may be fuilty of violating any of the terms hereof, shall constitute a separate offense.
SECTION 10. Emergency.
Whereas, it being immediately necessary for the preservation of the
peace, health and safety of the Town of Owasso, Oklahoma, and the inhabitants thereof,
that the provisions of this Ordinance be put into full force and effect, and an emergency
is hereby declared to exist, by reason thereof of the existance of nuisances and conditions
creating a hazard to health, property and safety, and by reason thereof, this Ordinance
shall take effect and be in full force from and after its passage, as provided by law.
EMERGENCY CLAUSE voted upon separately and passed by unanimout vote of the Board of
Trustees this 4th day of November, 1963.
