HomeMy WebLinkAbout050_Building Permits_Repealed ord 17ORIDINANCE NUMBER 50 AN ORDINANCE PERTAINING TO AND GOVERNING THE CONSTRUCTION AND ERECTION OF, ALTERING, REBUILDING, REMODELING, MOVING ONTO, OFF OF OR UPON ANY LOT OR TRACT OF LAND, ADDING TO OR DEMOLISHING ANY BUILDING, STRUCTURE OR APURENANCES THERETO, AND REQUIREING THAT AN APPLICATION BEMADE FOR AND A PERMIT BE OBTAINED THEREOR, BEFORE COMMENCING SAME; REQUIRING BUILDING OPERATIONS OR WORK DONE IN CONFORMITY WITH STATMENTS IN APPLICATION AND ORDINANCES OF THE TOWN OF OWASSO, OKLAHOMA, DEFINING PROWER AND DUTIES OF THE BOEARD OF TRUSTEES OF THE TOWN OFOWASSO, OKLHAOMA, PERTAINING TO SUCH BUILDING PERMITS; PROVIDING PROCEDURE FOR MAKING APPLICATIONS; REQUIRING PAYMENT OF FEES FOR ISSUING BUILDING PERMITS AND INSPECTION; PROVIDING FOR INSPECTIONS; PROVIDING FOR THE ORDERLY GROWTH AND DEVELOPMENT OF THE TOWN OF OWASSO, OKLAHOMA,; REPEALING ORDINANCE NUMBER SEVENTEEN (17) PASSED AND APPROVED JANUARY 16, 1961; PROVIDING PENALTIES FOR VIOLATIONS; RPOVIDING A SAVING CLAUSE, AND DELCLARING AN EMERGENCY. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHPMA: SECTION 1 - TEMPORARY INSPECTOR. Until such time that an office of building Inspector shall be created for the Town of Owasso, the Board of Trustees of the Town or any one of them designated by the BOard, shall so act as inspectors or inspector, whenever necessary to determine whether or not any building or construciton in progress within the corporate limits of the Town of Owasso, Oklahoma, is being done or purformed in compliance withthe requiredments and provision of this ordinance or other ordinances pertaining thereto; Provided, however, that the Board of Trustees shall be authorized to appoint any competent person to act as a temporary inspector, or such duties may be deligated by the Board to the Plumbing Inspector of the town. SECTION 2 - COMPENSATION - SPECIAL BUILDING INSPECTOR The Board of Trustees shall be authorized to pay to any person, except a member of the Board of Trustees or a person regularly employed by the Town of Owasso, a fee, not ot exceed the fum of Five Dollard ($5.00) for each inspection ordered to be made by the Board of Trustees, or by the President of said Board of Trustees, whenever deemed necessary by said Board or by said president of said board. SECTION 3 - BUILDING PERMITS REQUIRED Before any person shall commence the construction, erection, enlargment, alteration, repair, removal or demolition of any building or structure, or the remodeling of same, or for any wall, platform, staging or floring to be used for staging or seating pruposes, or move any building or structre off of, onto, or to change the psition or location of any building or structre upon, from or onto any premises within the Town of Owasso, he shall procure a permit therefor fromthe Board of Trustees of the Town of Owasso, to be issued by te Clerk, with the approval of said Board f Trustees; and, refusal, failure or neglect to obtain such permit before commencing such work shall be unlaful; providing that no permit shall be necessary for work, building or construciotion, the cost of which shall be less than One Hundreed Dollars. SECTION 4 - APPLICATION FOR BULDING PERMIT application for permits required by this ordinance shall bemade to the board of Trustees; such application shall be in writing upon a blank form to be furnished by the Town Clerk of the Town of Owasso and shall state the legal description, and address if any, of the proposed location of the building or structure or where work is to be done, the location of such building or structure upon the premises, the estimated cost thereof, the pupose for which the building or structure is to be used, the position and destription of plumbing and sanitary sewer line cnonection, the porbable time of completion of the proposed work, and wheather or not an existing building or sttucture is to be demolished or moved on, about, onto or from the premises; The Board of Trustees or the Building Inspector may demand additional drawings, specifications and details, when the information submitte din the application is not clear as to the material and work intended. The application shall be accompanied by an agreement that, if the permit is issued, the applicant will not deviate from the plans and specifications contained in or accompanying the applicatin, and will furnish the Board such additional drawings, plans and added specifications as may be reasonably demended -- and provided that at any time during the progress of the operations, pursuant to a permit, a new owner may be substituted, provided that new ownership is duly recorded on the Oringinal papyers by affidavit and assumes all the obligations of the original owner to whom the permit was issued. SECTION 5 - PERMIT FEES Before any bulding permit shall issue the following fees must be paid: If the estmated cost is more than One Hundred dollards ($100.00) and shall not exceed Five Hundred dollards ($500.00), the fee shall be Five dollards ($5.00); if such estimate is more than Five Hundred Dollars (500.00) and does not exceed One Thousand Dollards ($1000.00), the fee shall be Five Dollards ($5.00) plus Fifty Cents (.50) for each One Hundred Dollars. (100.00) or major part thereof in excess of Five Hundred Dollards (500.00); if more than One thousand dollars, the fee shall be seven dollars ($7.00) plus two and twenty-five one- hundreths dollars ($2.25) for each additional One Thousand dollars ($1000.00) or major part thereof, up to and including One Hundred Thousand Dollars ($100,000.00); if the estimated cost exceeds One hUndred Thousand Dollars ($100,000.00), the fee shall be Two Hundred Twenty-nine and Seventy-five One hundreth Dollars (229.75) plus one and Twenty-five one- hundredths Dollars ($1.25) for each additional One Thousand Dollars ($1000.00) over and above such one hunder thousand dollcars cost estimate. Payment of the fees provided by this ordinance shall be made to the Town Clerk of the Town ofOwasso, Oklahoma, payment of which shall apply only to acquireing a permity as herein provided, and distringushed separate and aparty and not to include any other fee, charge or assessment required to bepaid under any other ordinance of the Town of Owasso. SECTION 6 - ISSUANCE OF PARMITS - EXPIRATION - APPROVAL OR DISAPPROVAL. The granting of a permit shall be subjecto to the sole descretion ofthe Board of Trustees of the Town of Owasso, or such person as may, by the board, be appointed, and inspections and certificates shall be made or issued by said board of Trustees or by such person or persons as may, by the board, be appointed; provided, that when a permit or certificate has been approved and issued, the person approving or issuing same shall erport such fact to the BOard of Trustees to be read at the next regular meeting of the board following such approval and issuances. The Board of Trustees may, in their discretion, make such rulings, orders or decisions, with reference to the application and enforcement of this ordinance and procedure thereunder, as to gice it full force or affect or to carry out the spirit thereof, as intended, and to avoid injustices and unusual hardshps, and to grant exceptions in special cases, provided that the public interest and safety is fully protected. Any permit granted under this ordinance shall automatically expire and become null and void within one year from the date of issuance, unless the work, construction or thing to be done, as stated in such permit, has been commenced in good faith before the expiration of one year from the date of such permit. SECTION 7 - REVOCATION OF PERMIT Should the Board of Trustees find that at any time the work, under any permit issued, is not proceeding in accordance with the drawings, specifications, details and agreement of the application upon which such such permit was issued, but is proceeding in violation of any ordiance of the Town of Owasso, Oklahoma, it shall notify the owner or person in control of such work, in writing, that same fails to conform to such permit and ordinances, and that such failure must be corrected without delay. if such owner or person in control fails or refuses to make correction, the Board of Trustees of the Town of Owasso, or such person appointed by the board to make inspections, may order the permit to be revoked, and notify the owner or person in control of the work that such permit has been revoked and to stop the work in progress. Said notice of revocation of the permit shall be in writing and served upon the owner or person in control of the work, and it shall be unlawful for any person to proceed with any part of such work after notice of revocation of the permit has been served SECTION 8 - PERMIT DENIED, WHEN No building permit shall be approved or granted: (a) When it is made to appear that the material to be used, the manner of construction, the location or use of the proposed structure to be erected or moved, would, if permitted, be a menace to life, limb or property, or create a fire hazard or interfere with efficient fire fighting, or, if permitted, would be in violation of this or any other ordinance of the Town of Owasso, Oklahoma. (b) When the building operation contemplated by the application for permit includes any plumbing which will require a water service connection, ut fails to include and provide, in the specifications and drawings, accompanying or shown upon the application, for a sanitary sewer line and connection. SECTION 9 - PENALTIES Any person who shall violate any of the provisions of the oridnance or who shall fail or refuse to obey any of the provisions hereof, or any part, section or article hereof, or to act in accordance with the provisions herein contained, when the provisions herein are applicable to the conduct of such person, or who shall fail or refuse to obey any order or notice given by any person or officer authorized to make such order or give such notice as provided in this ordinance, shall be guilty of an offense and shall, upon convistion thereof, be fined in any sum not to exceed Twenty Dollars ($20.00), including costs, for each offense, and each day that any person violates any of the provisions of this ordinance shall be and constitutes a separate offense. SECTION 10 - REPEAL Ordinance number seventeen (17) passed and approved and enacted ont the 16th day of January, 1961, by the Board of Trustees of the Town of Owasso, Oklahoma, pertaining to building perimts, to and th same is hereby repealed. SECTION 11 - EMERGENCY. In the event any work, phrases, section or article of this ordinance shall be held in valid by any court of compentent jurisdiction, the remaining words, phrases, sections and articles, and the remaining portions thereof shall not be affected thereby. SECTION 12 - EMERGENCY. Whereas conditions exist which threaten the health, propert and welface of the inhabitants of the Town of Owasso, Oklahoma, it is immediately necessary for the preservation of the peace, health, safety and property of the Town of Owasso and the inhabitants thereof, that the provisions of this ordinance be put into full force and effect, and an emergecny is hereby decalred to exist, by reason thereof, this ordinance shall take efffect and be in full force from and after its passage, as provided by law.
