HomeMy WebLinkAbout055_North School Second AnnexedORDINANCE NUMBER 55 AN ORDINANCE ACCEPTING, ADDING AND ANNEXING TO THE TOWN OF OWASSO, OKLAHOMA, A PARCEL OF LAND DESCRBIED AS "THESOUTH 586.7 FEET OF THE NORTHWEST QUARTER (NW1/4) OF THE SOUTHWEST QUARTER (SW1/4) OF THE SOUTHEAST QUARTER (SE1/4) AND THE SOUTHWEST QUARTER (SW1/4) OF THE NORTHEAST QUARTER (NE1/4) OF THE SOUTHEAST QUARTER (SE1/4) LESS THE SOUTH 132 FEET THEREOF, AND THE OUTH 256.7 FEET OF THE NORTH HALF (M/ 1/2) OF THE NORTHEAST QUARTER (NE1/4) OF THE SOUTHEAST QUARTER (SE1/4) ALL IN SECTION NINTEEN (19) TOWNSHIP TWENT-ONE (21) NORTH, RANGE FOURTEEN (14) EAST OF THE INDIAN BASE AND MERIDIAN, TULSA COUNTY, OKLAHOMA, ACCORDING TO THE UNITED STATES SURVEY THEREOF; DECLARING THE EFFECTIVE DATE OF SUCH ANNEXATION TO BE FEBRUARY 1, 1965; PROVIDING THAT FROM AND AFTER THE EFFECTIVE DATE OF THIS ORDINANCE ALL OF SAID REAL ESTATESHALL BE A PART OF THE TOWN OF OWASSO, OKLAHOMA, AND ALL PERSONS RESIDING THEREIN AND ALL PROPERTY SITUATED THEREON SHALL BE SUBJECT TO THE JURISDICTION, CONTROL AND ORDINANCES OF THE TOWN OF OWASSO, OKLAHOMA, IN ALL RESPECTS AND PARTICULARS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: THAT WHEREAS a petition has been filed by the Owasso School District Number 1-11, Board of Education, by and through John P. Gwartney, as Superintendent, joined and attested by its clerk of saild board, E. R. Green, as sole owner, petitioning and requesting that thte following described real property, to-wit: "The South 586.7 Feet of the Northwest Quarter (NW1/4) of the Southwest Quarter (SW1/4) of the Southeast Quarter (SE1/4) and the Southwest Quarter (SW1/4) of the Northeast Quarter (NE1/4) of the Southeast Quarter (SE1/4) less the South 132 Feet thereof, and The South 256.7 Feet of the North One-half (N. 1/2) of the Northeast Quarter (NE1/4) of the Sotheast Quarter (SE1/4), all in Section Ninteen (19) Township Twenty-one (21) North, Range Fourteen (14) East of the Indian Base and Meridian, in Tulsa County, Oklahoma, according to the United State Survey Thereof", be accepted, added and annexed to the Town of Oklahoma,; and, notice of presentation of said petition having been duly and regularly fiven and published once in each week for two successive weeks in the Collinsville News, a newspaper fully qualified under the laws of the State of Oklahoma for such publication, and published nearest to the Town of Owasso, Oklahoma, and proof of publication having been duly filed all as required by law, AND, WHEREAS saild described property is adjacent to the present boundary line of the corporate limits of the said Town of Owasso, and it is to the mutual advantage, benefit and welfare of te Town of Owasso, Oklahoma, and the said Board of Education, Owasso School District Number 1-11, the sole owner thereof, that said petition be allowed and request granted. AND, WHEREAS, there appears no opposition to the granting of the request of said petition, NOW, THEREFORE, IT IS ORDAINED AS FOLLOWS: Section 1. That the request and petition of the Board of Education, Owasso School District Number 1-11, herein reffered to, be and the same is granted and allowed. Section 2. That the following tract and parcel of land, to-wit: "The South 586.7 Feet of the Northwest Quarter (NW1/4) of the Southwest Quarter (SW1/4) of the Southeast Quarter (SE1/4) and the Southwest Quarter (SW1/4) of the Northeast Quarter (NE1/4) of the Southeast Quarter (SE1/4) less the South 132 Feet thereof, and The South 256.7 Feet of the North One-half (N. 1/2) of the Northeast Quarter (NE1/4) of the Sotheast Quarter (SE1/4), all in Section Ninteen (19) Township Twenty-one (21) North, Range Fourteen (14) East of the Indian Base and Meridian, in Tulsa County, Oklahoma, according to the United State Survey Thereof", be accepting, added and annexed to the Town of Owasso, Oklahoma; and notice of presentation having benn fully given as provided by law, same is hereby admitted to and taken into the corporate limits of the Town of Owasso, State of Oklahoma. Section 3. That from and after the effect date of this ordinance, all of said real estate described herein shall be a part of the Town of Owasso, State of Oklahoma, and all persons residing therein and all property situated thereon shall be subjecto to the jursidiction, control and ordinances of the Town of Owasso, Oklahoma, in all respects and particulars. Section 4. That by reason of said school buildings and premises being without adaquate police and fire protection, an emergency exists for the preservation of the public health, peace, safety and welface; by person where of this ordinance, Number 55, shall take affect from the after its passage and approval, as provided by law. EMERGENCY CLAUSE voted upon separately and passed by unanimous vote of the Board of Trustees this 1st day of February, 1965. PASSED by the Board of Trustees of the Town of Owasso, Oklahoma, this 1st day of February, 1965. Wester Auto Store That said notice, a true copy of which is attached hereto, was published in the regu- lar edition of said newspaper during the period and time of publication and not in a supplement, on the following dates of The Collinsville News, a weekly news- paper printed in the English language, in the City of COllinsville, Tulsa County, Ok- lahoma, having a general subscription circulation in vvith entrance into the United St3^tes as second class mail matter in Tulsa Coumy, and published and printed in said where delivered to the United States that said news- paper has been and uninter- ruptedly published in said during a period of one-hundred four con- secutive weeks irnmediately prior to the first publication of the attached notice, advertisement or . and that said newspaper comes within the requirements of Chapter 4 of Title 25, Oklahoma Sta- tutes 1951, as amended, and complies with all other requirements of the laws of Ok- lahoma with reference to legal publications.
