HomeMy WebLinkAbout062_Fire Department_Creation_RegulationsORINDNACE NUMBER 62 AN ORDIANCE CREATING A DEPARTMENT FOR THE PREVENTION OF FIRE AND PROTECTION OF LIFE AND PROPERTY, TO BE KNOWS AS THE "OWASSO FIRE DEPARTMENT" AND ESTABLISHING RULES, REGULATIONS, CONDITIONS, DUTIES AND AUTHORITY PERTAINING TO OFFICERS AND EMPLOYEES THEREOF; CONFERRING SPECIAL POLICE POWERS UPON MEMBERS OF THE SAID FIRE DEPARTMENT; CREATING THE OFFICE OF CHIEF OF THE FIRE DEPARMTNET; ALLOWING A PROVIDING FOR THE FORMATION OF A SOCIAL ORDER TO PROMOTE SOCIAL FUNCTIONS OF THE FIRE DEPARTMENT; AND DECLARING AN EMERGENCY TO EXIST BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTTES OF THE TOWN OF OWASSO, OKLAHOMA: Section 1. ORGANIZATION A department is ereby created to be hereafter known as the "Owasso Fire Department", for the purpose of fire prevention and the protection of life and property within the limits of The Town of Owasso, Oklahoma, and shall consist of a Chief, one Assistant Chief and other officers as the Chief and the Board of Trustees of the Town of Owasso may deem necessary for the effective operation of the Department. Section 2. APPOINTMENT OF OFFICERS ACCOUNTABILITY (a)The Chief shall be appointed by the Board of Trustees for the Town of Owasso, Oklahoma , for an indefinmite period of time, and his term of office shall depend upon his good conduct and efficiency. The Chief shall be techincally qualified by training and experience and shall have ability to comand men and hold their respect and confidence. he shall be removed only for just cause and after a public hearing before the Board of Trustees of the Town of Owasso, State of Oklahoma. (b) The Chief Shall be held accountable to the Board of Trustees of the Town of Owasso, Oklahoma, only, and shall make written and verbal reports thereto as the said Board of Trustees may require; All other Department and company Officers shall be accountable to the Chief only. (c) The Assistant Chief and all other Department and company officers shall be appointed by the chief, subject to the approval of the Board of Trustess of the Town of Owasso, Oklahoma. Such officers shall be accountable to the Chief, and subject to removal by him. Any dismissed officer may appeal for a hearing as is prescribed by this ordinance. Section 3. DUTIES OF THE CHIEF OF THE OWASSO FIRE DEPARTMENT. (a) The President of the Board of Trustees and the Chief of the fire deparment of the Town of Owasso shall formulate a set of rules and regulations to govern the Department, and the Chief shall be responsible to the Board of Trusteesof the Town of Owasso for the personnel, morales, and general efficiency of the Department. (b) The Chief shall determine the number and kind of companies of which the Department is to be composed and shall determine the response of such companies to alarms. (c) The Chief shall at least twice a month conduct quitable drills or instruction in the overation and handling of equipment, first aid and rescue work, salvage, a study of buildings in the Town of Owasso, Oklahoma. fire prevention, water supplies, and all other matters generally considered essential to the good firemanship and safety of life and property from fire. (d) The Chief is hereby required to assist the proper authorities in suppressing the crime of arson by investigationg or causing to be investigated the cause, origin, and circumstances of all fires, and make and file a report thereof as a permanent record. (e) The Chief is hereby empowered to enter any and all buildings and premises at any reasonable hour for the purpose of making inspections and to serve written notice upon the owner or occupant to abate, within a specified time, and all fire hazards that may be found. (f) The Chief shall provide that complete records are kept of all fire inspections, apparatus and minor equipment, personnel and otherinformation relating to the work of the department. (g) The Chief shall report monthly to the Board of Trustees of The Town of Owasso as to the condition of the apparatus and equipment, the number of fires during the month, their location and cause and date of same and loss ocasioned. thereby; the number and purpose of all other runs make; and the number of members responding to each fire or other run, and any changes in membership. (h) The Chief shall make a complete annual reoprt to the Board of Trustees of the Town of Owasso within one month after the close of the fiscal year, such report to include the information specified in sub-section "f", together with comparative data for previcus years and recommendations for improving the effectiveness of the Department. A copy of such report shall be sent to the Oklahoma Inspection Bureau. (i) The Chief of the fire department shall have full power, control and command over all persons whomsoever present at fires, and he shall direct the use of all fire apparatus and equipment, and command all firemen in the discharge of their duties. he shall take such measures as he may deem necessary in the preservation and protection of property and the extinguishing of fires. Section 4. MEMBERSHIP The membership of the Department shall consist of such person as may be appointed by the chief and shall be able-bodied male citizens residing withtin the Tow of Owasso, Oklahoma, perferabley owners whose business subdivities are normally within the confines of the town of Owasso, Oklahoma, and who have telephones in their homes. Determination of whether canidates for appointment are able-bodied shall be made by the Chief after a medical and physical examination has been made in a manner perscribed by the Chief and approve by the Board of Trustees; that if a vacancy cannot be filed by a qualifed resident of the Town, the Chief may appoint a member residing within a radious of five miles from the cental fire station, after request to and approval of the Board of Trustees of the Town of Owasso, as a temporary member, who may be removed with or without cause, if not a resident, by the chief or by order of the said board of trustees. Secion 5. SUSPENSION OR DISCHARGE OF MEMBER OF FIRE DEPARTMENT. Any member of the Department, except a member appointed on a temporary basis, may be suspended or discharged from the Department by the Chief at any time he may deem such action necessary for the good of the Department, and he may arbitrarily suspend or discharge a temporary member who is not a resident of the Town of Owasso, Oklhaoma; A suspended or discharged member shall be give a public hearing on charges brought by the Chief, on written notice to the Board of Trustees, filed with the Town Clerk within three days following a notice of suspension or discharge. Section 6. EQUIPMENT. The department shall be equiped with such apparatus and other equipment as may be required from time to time to maintain its efficiency and properly protect life and property form fore; recommendations of a paratus and equipment needed shall be made by the Chief. and after aproval by the Board of Trustees shall be purchased in such manner as may be disignated by the Board of Trustees. Section 7. CARE OF APPARATUS AND EQUIPMENT. All equipment of the Department shall be safely and coveniently housed in such placeses as may be designated by the Board of Trustees. Such places shall be heated durthing the winter season if any equipment is subject to damage by freezing. Section 8. FIRE ALARMS. Suitable aparatment on equipment shall be provided for citizens to turn in an alarm, and for notifying all members of the Department so that they may properly respond. Section 9. PRIVATE USE OF EQUIPMENT PROHIBITED. No person shall use any fire apparatus or equipment for any private purpose, not shall any appartus, uses in any way by the department be taken away or concealed by any person. Section 10. Section 11. Section 12. HIRING OUT OF RECVING APARATUS FROM TOWN LIMIS, PROOTED: EXEMPTANCE. Section 13. It is hereby made the special duty of the chief of police and/or other officers, wo may be on duty and available for fire duyu, yo respond to all fire alarms and assist the Departmenet in the protection of life and property, regulating traffic, maintaining order, and in enforcment obserse of all sections of this ordinance. Section 14. POLICE POWERS OF FIRE DEPARTMENT MEMBERS All regulary appointed members of the Department are hereby given the necessary special police powers for the purpose of enforcing the privisions of this ordinance and such other ordinances relating to fire prevention or traffic regulations concerning right of way of emergency vehicles. Section 15. MEMBERS MAY WEAR BADGE. Each member of the Department is hereby authorized to wear a badge designating his name and rank. Section 16. SIGNALS SIRENS. Each member of the Deparmtnet driving shall be issued a suitable isgnia to be attached to the car and is authorized to equipt his car with a siren for use when responding town alarm. Section 17. The Department may elect a President, Vice-President, Secretary and Treasurer to be known as Social Officers.
