AN ORDINANCE REQUIRING APPLICATIONS FOR CHANGE IN ZONINGCLASSIFICATIONS TO STATE TYPE,
KIND AND NATURE OF USE INTENDED, IF GRANTED; PROVIDING THAT CHANGE IN ZONE CLASSIFICATION
SHALL BE LIMITED AND CONFINED TO THE TYPE, KIND AND NATURE OF USE STATED IN AN APPLICATION
FOR SUCH CHANGE; REQUIRING THAT TOWN CLERK ENTER UPON THE MINUTES OF THE MEETING OF THE
BOARD OF TRUSTEES THE TYPE OF USE ALLOWED BY THE BOARD; DECLARING VIOLATION OF THIS AND ANY
OTHER ORDINANCE PERTAINING TO ZONING TO BE AN OFFENSE; PROVIDING PENALTIES; PROVIDING THAT
EACH DAY VIOLATION EXISTS SHALL BE A SEPARATE OFFENSE; AND DECLARING AN EMERGENCY TO EXIST.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA:
Section 1. APPLICATION TO CHANGE ZONING CLASSIFICATION -- CONTENTS.
Any person or person making application to change the classification of any
property within the town limits of the Town of Owasso, Oklahoma, to be zoned to a use other
than that existing at the time of filing such application, shall state, in addition to the
requirements contained in any other ordinance of the Town of Owasso pertaining to such
applications for the changing of zone classifications, the full and exact type, kind and
nature of the business and use for which such change in zoning is requested.
Section 2. LIMITATION OF USE -- TOWN CLERK TO ENTER BOARD RULING ON MINUTES
Whenever an application to zone any property within the town limits of The Town of
Owasso, Oklahoma, has been granted by the Board of Trustees as provided by the ordinances of
The Town of Owasso, such zoning classification shall be limited to the use stated in the
application, which facts shall be entered upon the minutes of the meeting of such Board by
the Town Clerk; Provided, that any other use, except the type, kind and nature stated and
described in the application, and the use existing under the immediate prior zone classification,
shall be and is prohibited.
Section 3. PENALTIES FOR VIOLATIONS
Any person or persons who shall violate any of the provisions of this ordinance
or any other ordinance of the Town of Owasso, Oklahoma, pertaining to the zoning regulations
of said Town, shall be guilty of an offense, and shall be punished by a fine not to exceed
Twnety Dollars ($20.00) including costs, and each day such violations shall be committed or
permitted to exist shall constitute and be punishable as a separate offense.
Section 4. EMERGENCT CLAUSE: That becuase of present existance of conditions which
threaten the safety and property of persons in the vicinity of the Town of Owasso, and the
peace and welfare of the general public within said Town, an emergency exists for the preservation
of public peace, health, safety and welface, by reason whereof this ordinance shall
take effect from and after its passage, as provided by law.
Emergency clause voted upon separately and passed by unanimous vote of the Board
of Trustees this 16th day of August, 1965.
