HomeMy WebLinkAbout065_Lightweight Motor Vehicles_Amends Ord 35ORDINANCE NUMBER 65 AN ORDINANCE GOVERNING, REGULATING, RESTRICTING AND CONTROLLING THE USE, OPERATION AND DRIVING OF MOTOR SCOOTERS AND OTHER LIGHTWEIGHT MOTOR AND MOTOR PROPELLED VEHICLES; ESTABLISHING SPEED LIMITS; REQUIRING PROPER EQUIPMENT; PROHIBITING OPERATORS UNDER THE AGE OF SIXTEEN YEARS TO PERMIT OR CARRY ADDITIONAL RIDERS; PROVIDING AUTHORITY OF POLICE TO IMPOUND DEFECTIVE OR IMPROPERLY USED VEHICLES AS BEING A PUBLIC NUISANC AND HAZARD; PROVIDING PENALTIES FOR VIOLATIONS; MAKING THE OPERATION, CONSTRUCTION, SPEED, USE AND CONTROL REQUIRED A PART OF AND SUBJECT TO EXISTING TRAFFIC CODE OF THE TOWN OF OWASSO, OKLAHOMA; REPEALING AND/OR AMENDING PARTS OF EXISTING ORDINANCES; PROVIDING SEVERABILITY OF PROVISIONS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: Section 1. AMENDMENT OF ORDINANCE NUMBER 35, Section 4. That Section Fourt (4) of Ordinance Thirt-five (35) of the Town of Owasso, Oklahoma, be amended to read and provide as follows: "Section 4. OPERATION OF SCOOTERS SUBJECT TO TRAFFIC RULES. Except as otherwise herein provided, all rules, laws and ordinances governing the operation of and pertaining to the operation, maintenance, traffic regulations, controls, licenses, and driving of motor vehicles, and traffic code of the Town of Owasso, Oklahoma, now existing or hereafter amended, shall apply with full force and affect to the operation, speed, use, maintenance, construction and control of scooters or lighweight vehicles, being drivin or in use within the town limits of The Town of Owasso, Oklahoma,". Section 2. DRIVER UNDER AGE OF SIXTEEN (16) YEARS NOT PERMITTED TO CARRY PASSANGERS. No person underthe age of sixteen (16) years of age, while operating a scooter, motorbike or motorcycle, shall permit or allow any other person to ride with him or her as a passanger, or shall drive or operate such vehicle with any other person in, on or upon such vehicle or any side car attached thereto. Section 3. POLICE TO IMPOUND VEHICLE, WHEN, Any motor scooter, lightweight motor or motor propelled vehicle, motorbike or motorcycle being operated or used in violation of Section Two (2) of this ordinance, is hereby declared to be dangerous to other persons or property and to be a public nuisance affecting the safety, peace and welfare of the general public, and it shall be th duty of any police officer of the Town of Owasso, Oklahoma, to impound such vehicle and to hold the same in the custody of the Town Marshall to be delivered to a parent, guardian or other person having legal custody or control of the dirve of same, upon written request of such parent, gardian or other person. Section 4. SERVERABILITY. Should any part, section, paragraph or any section, or any part, phrase, sentence, or term, contained in this ordinance be declared, by a Court of competent jurisdiction, to be unlawful or unenforceable, then the rest, remainder and remaining part, parts, sections, parts of sections, paragraphs, phrases, sentences, or terms contained in this ordinance, not so adjudicated, shall remain in full force and effect. Section 5. PENALTY. Every person convicted of a violation of any provision or section of this ordinance, shall be punished by a fine not exceeding the sum of Twenty Dollars ($20.00) including costs. Section 5. Parts of Ordinance Number 35 Repealed. Section Five (5) of Ordinance Number Thirty-five (35), passed July 2nd, 1962, is hereby repealed, and the rest and residue of said ordinance and amendments thereto shall remain in full force and effect. EMERGENCY: WHEREAS, it being immediately necessary for the preservation of the peace, health and safety of the Town of Owasso, Oklahoma, and the inhabitants thereof, that the provisions of this ordinance be put into immediate force and effect, an emergency is hereby declared to exist, by reason of the existance of nuisances creating a hazard to health and safety, and by reason thereof, this ordinance shall effect and be in full force from and after its passage, as provided by law. Emergency clause voted upon separately and passed by unanimous vote of the Board of Trustees this 4th day of October, 1965.
