HomeMy WebLinkAbout068_Traffic_Passing Rules and Regulations_FinesORDINAINCE NUMBER 68 AN ORDINANCE RELATING TO THE TRAFFIC LAWS OF THE TOWN OF OWASSO, OKLAHOMA, AMENDING SECTION FORTY-THREE (43) OF TITLE THIRTEN (13), CHAPTER SEVEN (7) OF THE REVISED ORDINANCES FOR THE TOWN OF OWASSO, OKLAHOMA, FOR THE YEAR 1957, BY ADDING THERETO SUB- SECTIONS DESIGNTED AS SECTION 43 "(h)", "(i)", "(j)", "(k)", "(l)", AND "(m)" PERTAINING TO VEHICLES PASSING UPON THE STREES AND ROADWAYS WITHIN THE CORPORATE LIMITS OF THE SAIED TH TOWN OF OWASSO, DEFINING TYPES OF STREES, HIGHWAYS AND ROADWAYS AFFECTED THEREBY; DEFINING THE WORDS AND PHRASES "CENTERLINE" AND "DOUBLE LINE"; PROVIDING PENALTIES FOR VIOLATIONS OF ANY OF THE PROVISIONS OF SAID SECTION 43 OF THE REVISED ORDIANNCES FOR THE TOWN OF OWASSO, OKLAHOMA; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: That Section 43, Title Thrieen (13), Chapter Seven (7) of the Revised Ordinances for the Town of Owasso, State of Oklahoma, 1957, be amended by adding thereto sub-sections to be deisgnated as part: "(h)", "(i)", "(j)", "(k)", "(l)", and "(m)", as follows: (h) NO driver shall drive to the left side of a center line of a four or more laned roadway to pass another vehicle traveling in the same direction, unless so directed by a police office directing traffic. (i) No driver shall overtake and pass another vehicle on the right side thereof, except under the following conditions: 1. When the vehicle being passed is making or about to make a left turn from a proper lane, and has so indicated by signal of such intention. 2. On a four or more laned roadway of sufficient width, with no obstructions or parked vehicles which would tend to narrow the roadway to less than a four lane roadway. 3. On a roadway of sufficient width, where traffic is permitted to travel in only one direction. (j) No driver shall pass another vehicle traveling in the same direction upon any roadway where "no passing" signes have been posted or where a solid, double line has been placed upon the roadway to indicate no passing shall be permitted. (k) The fact that a pained line upon a roadway has become obscure by reason of being covered by snow, dirt or other substaneces shall not consititute a defense to any charge of the cilation of any of the provisions of this section wherein such traffic lines are used or referred to therein. (l) DEFINITIONS: The following words and phrases, when used in this Chapter Number Seven (7), unless specifically given another meaning where used therein, shall have the meaning herein ascribed to them, to-wit: One Lane Street or Roadway: A street or roadway wide enough for only one vehicle or one line of vehicles to travel. Two Lane Street or Roadway: A street or roadway wide enough for only two vbehicles to be side by side with safe clearance between such vehicles. Three Lane Street or Roadway: A street or roadway wide enough for three vehicles to be side by side with a safe clearance between each vehicle Four Lane Street or Roadway: A street or roadway wide enought for four vehicles, with two lanes on the right side and two lanes on the left side of the street or roadway. CenterLine: A line in the center of a roadway, running parallel with the sides of such roadway, either visible or capable of being determined by observation of the width of such roadway. Double Line: Two painted or colored lines places side by side upon a street, highway or roadway indicating no passing on the left of such double line. (m) Penalty. Any person who shall violate any of the provisions of this section, shall, upon conviction thereof, be punished by a fine in any amount not to exceed twenty dollars ($20.00) including cost for each offense. EMERGENCY: That becuase of the present existance of conditions which constitute an immediate threat to the safety of persons and peroperty and the peace and welfare of the (l) DEFINITIONS: The following words and phrases, general public within the Town of Owasso, Oklahoma, an emergenct exists for the preservation of public peace, health, safety and welfare, by reason whereof this ordinance shall take effect from and after its passage, as provided by law. Emergency clause voted upon separately and passed by unanimous vote of the Board of Trustees this 20th day of December, 1965.
