HomeMy WebLinkAbout071_Plumbing Commission Created_Rules and Reg_appointmentsORDINANCE NUMBER 71 AN ORDINANCE CREATING A ZONING AND PLANNING COMMISSION; PROVIDING FOR THE APPOINTMENT AND TERMS OF OFFICE OF THE MEMBERS THEREOF: DEFINING THE POWERS AND DUTIES OF SAID COMMISSION; PROVIDING FOR ORGANIZATION AND RULES; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: SECTION 1. Planning Commission Created. A zoning and planning commission is hereby created to be known as the Owasso Planning Commission, of the Town of Owasso, Oklahoma, and shall be composed of six members, five of whom shall be nominated by the President of the Board of Trustees and confirmed by said Board. The President of the BOard of Trustees shall be an ex officio member of the Commission. Each appointed member shall hold office for a period of three (3) years, or until this successor takes office, except that in the first instance twho (2) members shall be designated and appointed for a term of three (3) years; two (2) for a term of two (2) years and one (1) for a term of one (1) years and future appointments made as such term expires, for respective terms for three (3) years. Vacancies occuring on the Commission shall be filled and appointments made to conform to the unexpired term of the office vacated. SECTION 2. Compensation and Qualification of Members -- Removal. Appointed members of the Owasso Planning Commission shall be nominated and appointed solely by reason of their fitness and without reference to party affiliation and shall serve without compensation, and , ex officio members shall receive no compensation for their servies other than the fixed salary of their office. Members may be removed by the Board of Trustees of the Town of Owasso only for inefficiency, neglect of duty, conviction of a felony under state or Federal law, or malfeasance in office. SECTION 3. Organization and rules. The Planning Commission shall elect a Chairman, a Vice-Chairman, and a Secretary-Treasurer and may create and fill such other officers as it may deem necessary. The term of officers shall be one year with eligibility for re-election. The Planning Commission shall conduct a Public Hearing for Business matter as determined. The said Planning Commission shall adopt rules for the transaction of business and shall keep a record of its regulations, transactions, finding ad determinations, which record shall be a public record. SECTION 4. SECTION 5.Quorum. Three members of the Planning Commission shall constitute a quorum for the transaction of business; shall hav the power and authority to emply clerks, attorney's, engineers and a secretary, or any other help deemed necessary, subject to approval of the Board of Trustees of the Town of Owasso, and salaries and compensation therefor shall be fixed by the BOard of Trustees of said Town of Owasso, and be paid out of the treasury of said Town as other officers and employees and legal, necessary expenses incurred by said Commission shall likewise be paid out of the treasury of said town, -- and, shall have such other powers and required to perform such othe rduties as may be required by Chapter Seven (7), Title Elevan (11) of the Oklahoma Statues for the year 1961 pertaining to Buildings, Zoning and City Planning Commissions. SECTION 6. Conflicting Ordinances. All ordinances and parts of oridinances in conflict herewith are hereby repealed. EMERGENCY: WEREAS there exists an immediate threat to the public peace, health, safety and property of said town and the inhabitants thereof, and it being necessary for the protection of the public peace, health, safety and property of the town and inhabitants thereof an emergency is declared to exist, and by reason thereof this ordinance shall take effect from and after its passage and approval as provided by law.
