HomeMy WebLinkAbout091_Sewer Assessments District 4_Pursuant to Ord 83ORDINANCE NUMBER 91 AN ORDINANCE TO LEVY, ASSESS AND APORTION SPECIAL TAXES IN PAYMENT OF THE CONSTRUCTION OF A SANITARY SEWER IN SEWER IMPROVEMENT DISTRICT NO. 4 (ASSESSMENT) IN THE TOWN OF OWASSO, OKLAHOMA, AS CREATED BY ORDINANCE NO. 83; PROVIDING TIME AND MANNER OF PAYMENT AND ESTABLISHING INTEREST RATES; AMKING ASSESSMENT A LIEN UPON SUCH LOTS AND PARCELS OF LAND IN SAID DISTRICT SO ASSESSED, AND DECLARING AN EMERGENCY. WHEREAS, in pursuant to the request and consent of all property owners within Block Seven (7) of the Original town of Owasso, Oklahoma, and the Statutes of the State of Oklahoma, in such cases made and provided, The Town of Owasso, Oklahoma, did, by Ordinance No. 83, create and establish Sanitary Sewer Improvement distric Number Fourt (4); and WHEREAS, in further pursuance of the Statutes of the State of Oklahoma, aforesaid, it is deemed necessary by the Board of Trustees of The Town of Owasso to levy and asses the special tax upon the property liable to assessment in and the said Sewer District No. 4, by reason of the consturction of said sewer, and to pay for the same; and WHEREAS, the total cost of the construction of said sewer in said Sewer District Number Four (4) including extas, has been ascertained and is hereby declaried to be the sum of One Thousnand Dollars ($1,000.00), all of which is to be levied by special assessments against the lots and parcels of land benefited by the construction of said sewer in said dewer distric number 4; and WHEREAS, all legal requirements have been complied with to authorize levy of the assessments against said lots and parcels of land so liable for the cost of construction of said sewer in Sewer Distric No. 4, in the amount hereinafter specific by Section 1 of this Ordinance, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: SECTION 1. SPECIAL SEWER ASSESSMENT. That there shall be, and there is hereby apportioned to and levied upon and assesed against the several lots and percels of land in said Sewer District No. 4, in the town of Owasso, Oklahoma, so benefited by the construction of the sewer therein, the amounts respectively, as follows, to-wit: ORIGINAL TOWNSITE OF THE TOWN OF OWASSO, OKLHAOMA Lot Block Amount 1, and vacated Alley, 7 $125.00 2, 3, 4, 5, 6, 7, 8, SECTION 2. PAYMENT - LIEN. That the assessments hereby levied on each of the Lots and parcels of land set out in Section 1 of this Ordinance is hereby declared to be a lien upon such lots and parcels of land to the extent of other taxes and the same manner as to collection and enforcement as other taxes in and for The Town of Owasso; PROVIDED, however that any of the owners of the lots or parcels of land so assessed may, within 30 days following the first publication of this Ordinance pay to the town Clerk of the Town of Owasso the full amount of the assessment so levied against their said lots and parcels of land and hereby release ame from the lien of such assessment. SECTION 3. INTEREST - DELINQUENCIES. That each assessment levied as set forth in Section 1 of this Ordinance, unless paid in full as provided in Section 2 of this Ordinance, shall bear interest at the rate of six per cent. (6%) per annum, payable annually, and such assessments shall be payable in five (5) equal installments, the first of which shall become due and payable on the 1st day of September, 1967, and subsequent installments on the 1st day of September of delinquent unless paid for before the ist day of October of each year same shall become due and payable, and shall bear interest at the rate of twelve per cent. (12%) thereafter. SECTION 4. EMERGENCY. That an emergency for the preservation of the public health and safety hereby exists, by reason whereof this ordinance shall take effect immediately from and after its passage and publication. PASSED, with the emergency clause ruled upon separately and approved this 1st day of May, 1967. APPROVED this 1st day of May, 1967.
