HomeMy WebLinkAbout096_Equipment_Light Motor VehiclesORDINANCE NUMBER 96 AN ORDINANCE RELATING TO THE REGULATION, CONTROL, USE, OPERATION AND DRIVING OF, RIDING IN OR UPON, AND EQUIPMENT FOR MOTOCYCLES, MOTOR SCOOTERS, MOTOR BIKES AND OTHER MOTOR PROPELLED VEHICLES; REQUIRING OPERATORS AND RIDERS OF CERTAIN MOTOR PROPELLED VEHICLES TO WAR HEADGEAR; ESTABLISHING TYPE AND KIND OF HEADGEAR REQUIRED; DESIGNATING CERTAIN REQUIRED EQUIPMENT FOR ALL MOTORCYCLES, MOTOR SCOOTERS, MOTOR DRIVEN BICYCLES AND OTHER MOTOR PROPELLED VEHICLES, WITH EXCEPTION; PROVIDING PENALTIES FOR VIOLATIONS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: Section 1. HEADGEAR AND EQUIPMENT. In addition to equipment required by other Ordinances of The Town of Owasso, Oklahoma, all motorcycles, motor scooters, two or three wheel motor propelled vehicles and motor driven bicycles, white being driven within the town limits of The Town of Owasso, except an actual trial rides conducted outside of public roads, streets, highways or places, the following equipment shall be required: (a) No person shall operate or ride upon any motorcycle, scooter, motor driven bicycle or other vehicle covered under this section unless such person is equpped with and wearing on the head a crash helmet of the type and design manufactued for use by operators of such vehicles -- recommend ASA Z90 minimum or those certified approved by Shell Foundation. All crash helmets must consist of lining, padding and chin straps, and be the type as not to distort the view of the driver. (b) Each person wearing a crash helmet must have the chin strap in place and firmly secure white vehicle is in motion. (c) all vehicles covered under this section shall be equipped with a windshield of sufficient quality, size and thckness to protect the operator from foreign objects, except that in lieu of such windshield the operator shall wear goggles or face shield of material and deisgn to protect him from foreign objects. Section 2. VIOLATIONS -- PENALTY. Every person conviced of a violation of any provision or section of this ordinance, shall be punished by a fine not exceeding the sum of Twenty Dollars ($20.00) including costs. Section 3. EMERGENCY. Becuase of increased traffic hazards, traffic congestion and existing traffic conditions, which obviously constitute an immediate threat to the safety of persons and property and the peace and welfare of the general public within The Town of Owasso, Oklahoma, an emergency is hereby declared to exist for the preservation of the public peace, health, safety and wefare, by reason whereof this Ordinance shall take effect from and after its passage and approval as provided by law. PASSED by the Board of Trustees of The Town of Owasso, Oklahoma, with the emergency clause separately voted, upon and passed by unanimous vote of the Board of Trustees of the Town of Owasso, Oklahoma, this 3rd day of July, 1967.
