HomeMy WebLinkAbout101_Owasso Lumber Company AnnexedORDINANCE NUMBER 101 AN ORDINANCE ACCEPTING, ADDING TO AND ANNEXING "THE NORTHWEST QUARTER OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER (NW1/4 SE1/4 SE 1/4), LESS THE WEST 330.00 FEET OF THE SOUTH 165.00 FEET THEREOF, OF SECTION 30, TOWNSHIP 21 NORTH, RANGE 14 EAST OF THE INDIAN BASE AND EMRIDIAN, ACCORDING TO THE GOVERNMENT SURVEY THEREOF, IN THE COUNTY OF TULSA, STATE OF OKLAHOMA, "BY AND TO THE TOWN OF OWASSO OKAHOMA; DECLARING THE EFFECTIVE DATE OF SUCH ANNEXATION TO BE JUNE 17, 1968, AND AFTER WHICH DATE ALL OF SAID REAL ESTATE SHALL BE A PART OF THE TOWN OF OWASSO, OKLAHOMA, AND ALL PERSONS RESIDING THEREIN AND ALL PROPERTY THEREON SITUATED SHALL BE SUBJECT TO THE JURISDICTION, CONTROL AND ORDINANCES OF THE TOWN OF OWASSO, OKLAHOMA, IN ALL RESPECS AND PARTICULARS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TURSTEES OF THE TOWN OF OWASSO, OKLAHOMA: WHEREAS a petition has been filed by the Owasso Lumber company, a corporation, and presented, by and through J. Ray Smiht, as President, joined and attested by its secretary, Vernon W. Lewis, as sole owner, petitioning and requesting that the following described real property, to-wit: the norwest Quarter of the Southeast Quarter of the Southeast Quarter (NW1/4)-(SE1/4)-(SE1/4), less the West 330.00 feet of the South 165 feet thereof, in Section 30, Township 21 North, Range 14 East of the Indian Base and Meridian, according to the Government survey thereof, in the County of Tulsa, State of Oklahoma be accepted, added and annexed to The Town of Owasso, Oklahoma; and, notice of presentation of said petition having been duly and regulary given and published once in each week for two successive weeks in the Tulsa Daily Legal News, a newspaper fully qualified under the laws of the State of Oklahoma for such publication, published nearest to the Town of Owasso, oklahoma and proof of publication having been duly filed all as required by law, AND, WHEREAS said described property is adjacent to the present boundary line of the corporate limits of the said Town of Owasso, and it is to the mutual advantage, benefit and welfare of the Town of Owasso, Oklahoma, and the said Owasso Lumber Company, a corporation, the sole owner thereof, that said petition be allowed and the request granted; and, there appears no opposition to the granting of the request of said petition, NOW THEREFORE, IT IS ORDAINED AS FOLLOWS: Seciton 1. that the request and petition of the Owasso Lumber Company, a corporation, herein referred to, be and the same is granted and allowed. Section 2.that the following tract and parcel of land, to-wit: "The Northwest Quarter of the Southeast Quarter of the Southeast Quarter (NW1/4 SE1/4 SE1/4), less the West 330.00 feet of the South 165 feet thereof, in Section 30, Township 21 North, Range 14 East of ht eindian base and Meridian, according to the U. S. government Survey thereof, in the county of Tulsa, State of Oklahoma, be accepted, added and annexed to The Town of Owasso, Oklahoma; and, notice of presentation having been lawfully given as provided by law, same is hereby admitted to the taken into the corporate limits of the Town of Owasso, State of Oklahoma, and make a part of said town. Section 3. that from and after the effective date of this ordinance, all of said real estate described herein shall be a part of The town of Owasso, State of Oklahoma, and all persons residing therein and all property situated thereon shall be subject to the jurisdiction, control and ordinances of The Town of Owasso, Oklahoma, in all respects and particulars. Section 4. EMERGENCY -- That by reason of the fact that there is an immediate need for adaquate law enforcement within the area, which affects the town proper, an emergency exists for the preservation of public health, peace, safety and welfare, by reason whereof ths ordinance will become affective immediately from and after its passage and approval, as provided by law. EMERGENCY CLAUSE voted upon separately and passed by unanimous vote of the Board of Trustees this 17th day of June, 1968. Notary,", Public PETITION TO HAVE LAND ANNEXED TO THE TOWN OF OWASSO TO THE HONORABLE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: The undersigned respectfully represents and shows to the Board of Trustees of The Town of Owasso, Oklahoma, as follows: That Petitioners is the sole owner of the following real estate, located adjacent to the town limits of The Town of Owasso, Oklahoma, to-wit: The Northwest Quarter of the Southeast Quarter of the Southeast Quarter (NW1/4 SE1/4 SE1/4), less the West 330.00 feet of the South 165.00 feet thereof, in Section 30, Township 21 North, Range 14 East of the Indiana Base and Meridian, according to the Government Survey thereof, in the County of Tulsa, state of Oklahoma, and that petitioner, as sole owner, constitutes the only occupant and owner, in value, of this said described real property. Your petitioner futher shows and represents to the Board of Trustees of the Town of Owasso that the above described real property is contiguouts to the Town of Owasso and adjacent thereto and not embraced iwthin the limits thereof, and it is the desire of petitioner that said property be, by ordinances, annexed to and be included within the limits of said Town of Owasso, and tohave the limits of said town etended to include said real property.
