AN ORDINANCE MAKING IT AN OFFENSE FOR MINORS TO POSSES NON-INTOXICATING ALCOHOLIC BEER
OR BEAVERAGES; MAKING VIOLATION OF ORDINANCE A SEPARATE OFFENSE; PROVIDING FOR A PENALTY
FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE; AUTHORIZING POLICE OFFICER TO
CONFICATE SUCH ALCOHOLIC BEAVERAGES OR BEER, AND PROVIDING FOR DISPOSITION OF SAME; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA:
Section 1. POSSESSION BY MINOR OF NON-INTOXICATING ALCOHOLIC BEVERAGES. It shall be
unlawful and an offense for any male person, under the age of 21 years, ir any female
person, under the age of 18 years, to be in possession of any non=intoxicating alcoholic
beverage or beer of 3.2 per cent or less percent by weight or to carry on his or her person
or in any vehicle which he or she is operating, or in which he or she is riding as a passenger,
any non-intoxicating alcoholic beverage or beer of 3.2 o rless percent by weight,
unless such person is accompanied by his parents or legal guardian.
Section 2. PENALTY, Any person convicted of a violation of any provision of this
ordinance, shall be punished by a fine of not les than Five dollars ($5.00) nor more than
Twenty dollars ($20.00), including costs.
Section 3. NON-INTOXICATING ALCOHOLIC BEVERAGES TO BE CONFISCATED--WHEN. Any police
or law enforcement officer shall be authorized to confiscate any non-intoxicating alcoholic
beverage or beer found by him to be in the possession of a minor in violation of this
ordinance, as evidence of such violation, and upon final disposition of charges brought
under this ordinance in such cases, to release and deliver, such beverage or beer to the
parent or guardian of such minor charges, upon request, in writing, of such parent or guardian;--
Provided, that unless such request is made within three (3) months afterfinal
disposition of such case or cases, said beverage or beer shall be destroyed and disposed of
in a way or manner ordered by the court before which such case or cases were tried or by
the President of the Board of Trustees of the Town of Owasso, Oklahoma.
Section 4. EMERGENCY. An emergency is hereby declared to exist for the preservation
of the public peace, health and safety, by reason whereof this ordinance shall take effect
from and after its passage and approval as provided by law.
PASSED by the Board of Trustees of the Town of Owasso, Oklahoma, with the emergency
clause separately voted u pon and passed by unanimous vote of the Board of Trustees of the
Town of Owasso, Oklahoma, this 18th day of november, 1968.
