AN ORDINANCE RELATING TO THE REGULATION, CONTROL, USE, OPERATION, DRIVING OF, RIDING IN OR
UPON, AND EQUIPMENT FOR MOTORCYCLES, MOTOR SCOOTERS, MOTOR BIKES AND OTHER MOTOR PROPELLED
VEHICLES; REQUIRING OPERATORS AND RIDERS OF CERTAIN MOTOR PROPELLED VEHICLES TO WEAR
HEADGEAR; ESTABLISHING TYPE AND KIND OF HEADGEAR REQUIRED; DESIGNATING EQUIPMENT, REQUIRED FOR
ALL SUCH MOTOR PROPELLED AND DRIVEN VEHICLES, WITH EXCEPTIONS; PLACING LIMIT ON CARRYING OF
PASSENGERS ON SUCH VEHICLES AND PROHIBITING THE CARRYING OF PASSENGERS IN CERTAIN CASES;
CONTAINING A SAVING CLAUSE; REPEALING ORDINANCE NUMBER NINETY-SIX (96) OF THE TOWN OF OWASSO,
OKLAHOMA, PASSED AUGUST 3, 1967,; PROVIDING PENALTIES FOR VIOLATIONS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA:
Section 1. HEADGEAR AND EQUIPMENT. In addition to equipment required by other
Ordinances of The town of Owasso, Oklahoma, all motorcycles, motor scooters, two or three
wheel motor propelled vehicles and motor driven bicycles, while being driven within the town
limits of The Town of Owasso, Oklahoma, except on actual trial rides conducted outside of
public roads, streets, highways or public places, the following equipment shall be required:
(a) No minor, a male person under the age of twenty-one (21) years or female person
under the age of eighteen (18) years of age, shall operate or ride upon any motorcycle,
scooter, motor driven bicycle or other vehicle covered under this section unless such person
is equipped with and wearing on the head a crash helmet of the type and design manufactured
for use by operators of such vehicles -- Recommend ASA Z90 minimum or those certified approved
by Snell foundation. All crash helmets must consist of lining, padding and chin straps, and
be of the type as not to distor and view of the driver.
(b) Each minor person wearing a crash helmet must have the chin strap in place and
firmly secure while vehicle is in motion.
(c)all vehicles covered under this section shall be equipped with a windshield of
sufficient quality, size and thickness to proect the operator from foreign objects, except
that in lieu of such windshield the operator shall war goggles or face shield of material
and design to proect him or her from foreign objects.
Section 2. CARRYING PASSENGERS LESS THAN TEN YEARS OF AGE PROHIBITED. No person shall
operate a motorcycle, scooter, or other motor driven vehicle, covered under this ordinance,
carrying a passenger which is less than ten (10) years of age.
Section 3. CARRYING PASSENGERS ON LIGHTWEIGHT MOTORCYCLES PROHIBITED. No person shall
permit any person on a lighweight motorcycle or motordriven bicycle, as a passenger, nor
permit such vehicle to be operated by a person who does not have in his mossession a valid
Oklahoma license to operate a lightweight motorcycle or a motordriven bicycle.
Section 4. VIOLATIONS -- PENALTY. Every person convicted of a ciolation of any provision
or section of this ordinance, shall be punished by a fine not to exceeding the sum of Twenty
Dollars ($20.00) including costs.
Section 5. PROVISIONS SEVERABLE. The provisions hereof are hereby declared to be
severable, and if any section, part of section, paragraph, sentence or clause of this ordinance
shall be held invalid or inoperation for any reason by any court of competent jurisdiction,
any other section, part of sectin, paragraph, sentence or clause shall not be affected thereby.
Section 6. REPEAL. Ordinance number Ninety-six (96) of the Town of Owasso, Oklahoma, is
hereby repealed.
Section 7. EMERGENCY. Because of increaded traffic hazards and congestion, obviously
constituting an immediate threat to the safety of persons and property within The Town of
Owasso, Oklahoma, an emergency is hereby declared to exist for the preservation of the police
peace, health, safety, and welfare, by reason whereof this ordinance shall take affect from
and after its passage and approval as provided by law.
PASSED by the Board of Trustees of The Town of Owasso, Oklahoma, with the emergency
clause voted upon separately and passed by unanimous vote of the Board of Trustees of The
Town of Owasso, Oklahoma, this 17th day of february, 1969.
