AN ORDINANCE PROHIBITING DRILLING OR MINING FOR OR PRODUCING OIL, GAS, COAL OR OTHER MINERALS
WITHIN THE TOWN LIMITS OF THE TOWN OF OWASSO, OKLAHOMA, DECLARING SUCH DRILLING, MINING AND
PRODUCING TO CONSTITUTE A NUISANCE, INJURIOUS TO THE HEALTH, SAFETY AND WELFARE OF THE TOWN OF
OWASSO, PROVIDING EXEPTIONS; PROVIDING SEVERABILITY OF PROVISIONS; MAKING VIOLATIONS OF THIS
ORDINANCE A MISDEMEANOR; PROVIDING PENALTIES; PROVIDING EACH VIOLATION EXISTS TO BE A SEPARATE
OFFENSE, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, STATE OF OKLAHOMA:
Section 1. DRILLING--MINING PROHIBITED. It shall be unlawful for any person, firm,
corporation or association or the agents, servants or employees thereof, to hereafter drill or
mine for or produce, or cuase to be drilled, mined or produced, any oil gas, coal or other
mineral within the corporate limits of the Town of Owasso, Oklahoma. any person, firm, corporation
or association, or the agents, servants or employees so acting are hereby declared to be
guilty of constructing, establishing or maintaining a nuisance against the public health,
safety and welfare of The Town of Owasso, and provided that each day such drilling, mining or
producing for or of oil, gas, coal or other minerals occurs shall constitute a deparate offense.
Section 2. CONSTRUCTION. It shall be unlawful and an offense for any person hereafter to
do or perform any work or labor of any kind upon or in connectino with the drilling, mining or
producing of oil, gas, coal or other products within the corporate limits of The Town of Owasso,
Oklahoma.
Section 3. ASSISTING IN VIOLATION OF ORDINANCE PROHIBITING NUISANCE. It shall be unlawful
and an offence for any person, firm, association or corporation to wilfully furnish, supply or
provide, transport or deliver, or cause to be furnished, providedsupplied, transfered or
delivered, any material, tools, pipe, machinery or supplies, with knowledge that same is to be
used upon or in connection with the drilling, mining or producing of oil, gas, coal or other
products within the corporate limits of The Town of Owasso, Oklahoma; provided that such act
shall be considered as assisting, and aiding in the creation of a public nuisance, and each act
shall be a separate offense.
Section 4. PUBLIC NUISANCE A MISDEMEANOR. Every person who maintains or cimmits any public
nuisance the pubishment for which is not otherwise prescribed, or who wilfully omits to perform
and legal duty relating to the removal of a public nuisance, is guilty of a misdemeanor.
Section 5. EXCEPTIONS. (a) Operations began Before Effective Date. The provisions of this
ordinance shall not apply to the operation or maintenance of any oil, gas or mining operations
being lawfully carried on prior to the effective date of this ordinance.
(b) Cleaning out or Plugging of Oil and Gas Wells. Nothing in this
ordinance shall be construed to prohibit the cleaning out or pluggin of oil and gas wells
within the corporate limits of The Town of Owasso, when said cleaning out of pluggin has been
determined by resoltion or ordinance governing body of The Town of Owasso to be in the
interest of the public health, safety and welfare.
Section 6. PROVISIONS SEVERABLE. The provisions hereof are bereby declared to be servable,
and if any section, part of section, paragraph, sentence or clause of this Ordinance is for any
reason held invalid or inoperative by any court or competent jurisdiction, such decision shall
not affect any other section, part of section, paragraph, sentence or clause hereof.
Section 7. PENALTY. any person, firm, corporation or association violating any provision
of this ordinance shall be guilty of an offense, and upon conviction shall be punished by a
fine in an amount not to exceed the sum of Twenty Dollars ($20.00), including costs; provided
that each day in which such ciolation takes place shall constitute a separate and distinct
offense.
PASSED, by the Board of Trustees of The town of Owasso, Oklahoma, and the Emergency Clause
voted upon separately and passed by unanimous vote of the Board of Trustees of The Town of
Owasso, Oklahoma, this 5th day of May, 1969.
