HomeMy WebLinkAbout117_Owasso Zoning Code AdoptedORDINANCE NUMBER 117 AN ORDINANCE TO ADOPT A CODE DESIGNED FOR THE PROTECTION OF HEALTH, SAFETY AND WELFARE OF CITIZENS OF AND PEOPLE WITHIN THE VICINITY OF THE TOWN OF OWASSO, OKLAHOMA, BEING PASSED AS ORDINANCE NUMBER 116 OF THE TOWN OF OWASSO, TO BE KNOWN AS "OWASSO ZONING CODE", INCLUDING PROVISIONS RELATING TO CONDITIONS OF DENSITY OF POPULATION AND BUILDING STRUCTURES AND USE OF LAND, AND PROVIDING RULES, REGULATIONS AND RESTRICTIONS RELATIVE THERETO, AND INCLUDING PROVISIONS FOR ENFOREMENT THEREOF AND PENALTIES FOR VIOLATIONS; PROVIDING WHEN SAID "OWASSO ZONING CODE" SHALL TAKE EFFECT; PROVIDING THAT SAID CODE SHALL SUPERCEED CONFLICTING ORDINANCES AND PROVISIONS; SAVING ALL PENDING PROCEEDINGS AND EXISTING RIGHTS AND REMEDIES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: Section 1. Adoptoiin of Zoning Code. That the Zoning Ordinance of The Town of Owasso, numbered 116, now on file in the office fo The Town clerk in manuscript form entitled "zoning Ordinance and Subdivision Regulations for Owasso, Oklahoma," prepared by Community Planning Associates of Tulsa, Oklahoma, and M. S. Sawyer, City Attorney, pursuant to the direction of, and by the authority of, the Board of Trustees of The Town of Owasso, Oklahoma, as of the date hereinafter specified. Section 2. Conflicting Ordinances. That where there may be a conflict between the provisions of the Owasso Zoning Code and provisions of any other ordinance of The Town of Owasso, the provisions of the code shall take president over, govern and supercede other conflicting ordinances enacting prior to the affective date of this ordinance. Section 3. Saving Clause. The repeal of any of the provisions of the "Owasso Zoning Code" shall not be deemed or construed to impair, modify, alter or affect any rights, right of action or cause of action, whether now pending in any court or not, but which are now existing, or which may arise or come into existance before the date when said "Owasso Zoning Code" shall take affect. Section 4. Effective Date of "Owasso Zoning Code". The "Owasso Zoning Code" shall take affect immediately upon the performance of these conditions, to-wit: (1) The Town clerk shall certify to the Board of Trustees that said Clerk has received not less than fifty (50) copies of the said "Owasso Zoning Code" in looseleaf form, and that they are true and correct copies of the original code of ordinance number 116 of the town of Owasso, Oklahoma, as passed and approved by the Board of Trustees of The Town of Owasso, and that said fifty (50) copies are in the possession of said Town clerk; (2) Upon publication of this ordinance in the Owasso Reporter, a qualifed newspaper publishe din The Town of Owasso, Oklahoma; (3) The Board of Trustees shall determine that the requirements of this section have been complied with, and their findings to that effect shall be entered upon the book of minutes by the said Town Clerk. Thereupon, the said "Owasso Zoning Code" shall be in full operation, force, and effect, and the Town Clerk shall insert in each volume a certificate that the provisions of this ordinance have been complied with and that said volume is published under authority and showing the effective date thereof. Section 5. Emergency. The passage of this ordinance being deemed necessary for the immediate preservation of the public safety, peace and welfare, an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its passage, approval and publication. The "Owasso Zoning Cide" shall take affect immediately upon the performance of these conditions to- wit: (1) The Town Clerk shall certify to the Board of Trustees RESOLUTION NO. 16 WHEREAS, at the request of the Board of Trustees of The Town of Owasso, Oklahoma, the Community Planning Associates, of Tulsa, Oklahoma, have compiled subdivision regulations for adopting by the board for The Town of Owasso, which regulations and provisions have been examied and approved by the Board, NOW, THEREFORE, BE IT RESOLVED that the subdivision regulations ocmpiled and submitted by community Planning Associates, of Tulsa, Oklahoma, be approved and adopted in their entirety, and adopted as the official subdivision regulations pertaining to land divisions within The Town of Owasso, Oklahoma. PASSED, APPROVED AND ADOPTED at regular meeting calle dfor such purpose this 7th day of August, 1969. President of the Board of Trustees of The Town of Owasso, Oklahoma, attest: Town Clerk Board Member, RESOLUTION NUMBER 15 WHEREAS a Comprehensive Plan has been submitted to the Board of Trustees of The Town of Owasso, pertaining to zoning, which plan has been examied by the said Board and approved, NOW, THEREFORE, BEIT RESOLVED that the Comprehensive plan, as outlined and prepared by Community Planning Associates of Tulsa, Oklahoma, be adopted as the official plan of The Town of Owasso, for the purposes for which it is intended. PASSED, APPROVED AND ADOPTED at regular meeting called for such purpose, this 7th day of August, 1969. NOTICE OF PUBLIC HEARING TO: All Parties and Citizens of The Town of Owasso, Oklahoma: TAKE NOTICE that the Board of Trustees of The Town of Owasso, Oklahoma, will, on the 7th day of August, 1969, at the hour of 7:30 o'clock, p.m., of said day, hold a public hearing at the Town Hall at 34-38 South Main Street, in Owasso, Oklahoma, for the purpose of considering and adopting an ordinance diving The Town of Owasso into Districs to be zoned to regulate and restrict the erection, construciton, re-construcion, alteration, repair or use of buildings, structures or land, and provide such regulations and restrictions of and the boundaries of such districts to be established and enforced, and for subsequent amendments, supplements and changes, and for the adoption of a master comprehensive plan thereof for The Town of Owasso, Oklahoma, at which time and place all parties in interest and citizens will have an opportunity to be heard in relation thereto and make suggections concerning same.
