HomeMy WebLinkAbout123_Disposition of Stolen & Abandoned PropertyORDINANCE NUMBER 123 AN ORDINANCE AUTHORIZING DISPOSITION OF STOLEN AND ABANDONED PROPERTY IN POSSESSION OF POLICE, BEING HELD BY THE TOWN OF OWASSO; PROVIDING FOR PROCEEDURE AND METHOD OF SALE OR DISPOSITION OF SUCH UNCLAIMED PROPERTY; DEFINING WORDS AS USED IN THIS ORDINANCE; DIRECTING THAT MONEY RECEIVED THROUGH SALE OF SUCH PROPERTY BE DEPOSITED IN THE GENERAL FUND OF THE TOWN OF OWASSO; PROVIDING THAT SUCH UNCLAIMED PROPERTY MAY BE TRANSFERRED TO THE TOWN OF OWASSO, FOR THE USE BY THE TOWN OF OWASSO, OKLAHOMA, AFTER THE EXPIRATION OF TIME LIMIT FIXED BY THIS ORDINANCE, AND FIXING TIME SUCH PERSONAL PROPERTY SHALL BE HELD BEFORE DISPOSITION, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, STATE OF OKLAHOMA: Section 1. DEFINITIONS. The following words and phrases shall be used and given, when used in this Ordinance, the following meaning: a. "Chief of Police:" Means the Town Marshal of The Town of Owasso, Oklahoma b. "Police": Means and shall be used synonymously with the word "marshal". Section 2. STOLEN PROPERTY AND ABANDONED OR UNCLAIMED PROPERTY. All stolen property recovered by the Police of The Town of Owasso, Oklahoma, and all abandoned or unclaimed property that comes into the possession of the said Police, shall be turned over to the Chief of Police who shall return the same to any person making satisfactory proof of title. If such property is not reclaimed within ninety (90) days, then the Chief of Police shall advertise the same for sale for ten (10) days, by posting the three of the most public places in The Town of Owasso, a written notice which shall fully specify the article to be sold and the time when, and the place where such sale will take place, -- PROVIDED, however, that any of such unclaimed property which is adaptable for use by any department of the said town, the Chief of Police may transper same to the said town for use by it, after the expiration of the ninety days (90) above mentioned and notice of sale given as provided by this Ordinance, --and Provided that such notice of sale shall also be published one (1) time ten days before such sale in any newspaper published in said town, if any exists, which is authorized by the laws of the State of Oklahoma to publish legal notices. Section 3. SALE OF STOLEN, ABANDONED OR UNCLAIMED PROPERTY. At such time and placed stated in the notice of sale provided by this Ordinance, the property shall be sold to the highest bidder for cash; such sale shall take place between 9:00 A.M. and 4:00 P.M. at the time stated in the notice of sale, and shall be held at the City Hall of the Town of Owasso; provided, that as to property no one buys, such disposition may be made of the same as the Chief of Police may direct, and, provided that property to be transferred to the said Town of Owasso shall not be offered for sale, but ordered transferred to the said town. Section 4. RECORD OF SALE - USE OF FUNDS The Chief of Police shall keep a record of when such property came into the possession of the police force, where found, or from whom taken, a description of the same, when said is claimed and by whom, or when advertised, and when and for what amount sold and to whom delivered. All money arising from such sale shall be paid to the Town Treasurer to be deposited in the General Fund of said town. Section 5. EMERGENCY. That, by reson the accumulation of a volume of articles of personal property which have come into the possession of the Police over a long period of time and are deteriorating and creating a hazard, an emergency is hereby declared to exist for the preservation of the public peace, health, welfare and safety, by reason whereof this ordinance shall take effect immediately upon its adoption and approval. ADOPTED, and the emergency clause ruled upon separately and passed by unanimous vote of the Board of Trustees of The Town of Owasso, Oklahoma, and adopted this 2nd day of March, 1907.
