HomeMy WebLinkAbout128_Non-Intoxicating Beverages_Transport_FinesORDINANCE NUMBER 128 AN ORDINANCE MAKING IT AN OFFENSE TO TRANSPORT NONINTOXICATING ALCOHOLIC BEVERAGES EXCEPT IN ORIGINAL UNOPENED CONTAINER; PROVIDING EXCEPTIONS; PROVIDING FOR PENALTIES FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: Section 1. TRANSPORTING OF NONINTOXICATING BEVERAGES EXCEPT IN ORIGINAL, UNOPENED CONTAINER PROHIBITED - EXCEPTION. It shall be unlawful for any person to knowingly transport in any moving vehicle upon any public highway, street or alley, within the town limits of The Town of Owasso, any nonintoxicating beverage containing more than one half of one percent (1/2 of 1%) alcohol of volume and not more than three and two-tenths percent (3.2%) alcohol by weight except in the original container which shall not have been opened and from which the original cap or seal shall not have been removed, unless the opened container be in the rear truck or rear compartment, which shall include the spare tire compartment in a station wagon or panel truck, or any outside compartment which is not accessible to the driver or any other person in the vehicle while it is in motion. Section 2. PENALTIES. Any person convicted of a violation of any provision of this ordinance, shall be punished by a fine or not more than Twenty Dollars ($20.00), inculding costs. Section . EMERGENCY. An emergency is hereby declared to exist for the preservation of the public peace, health, safety and welfare, by reason whereof this Ordinance shall take effect from and after tis passage and approval as provided by law. PASSED by the Board of Trustees of The Town of Owasso, Oklahoma, with the emergency clause separately voted upon and passed by unanimous vote of the Board of Trustees of The Town of Owasso, Oklahoma, this 19th day of October, 1970.
