AN ORDINANCE VACATING, DISCONTINUING AND ABANDONING A PUBLIC ALLEY LOCATED AND RUNNING THROUGH
THE CENTER OF BLOCK TWENTY-SIX (26) OF THE ORIGINAL TOWNSITE OF THE TOWN OF OWASSO, OKLAHOMA,
BETWEEN EAST SECOND AVENUE AND EAST THIRD AVENUE IN SAID TOWN OF OWASSO, AND VACATING ALL SEWER
AND UTILITIES UPON SAID ALLEYWAY; VACATING, DISCONTINUING AND ABANDONING A SEWER EASEMENT AND
SEWER LING EXTENDING FROM THE CENTER OF SUCH ABANDONED ALLEYWAY THENCE EAST TO MANHOLE ON THE
EAST SIDE OF BIRCH STREET IN SAID TOWN, ALL BEING MORE PARTICULARY DESCRIBED IN THE ORDINANCE;
DECLARING ABANDONED SEWER LINES TO BE PRIVATE PROPERTY OF OWNER OF THE LAND UPON WHICH SAME IS
LOCATED; DISCONTINUING FURTHER MAINTENCE OF SUCH ABANDONED SEWER LINES, AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA,:
WHEREAS, on the 3rd day of july, 1967, The Town of Owasso entered into a certain written
contract with the owners of Block Twenty-six (26) of the Original Townsite of The town of Owasso,
whereby such owners agreed to construct a sewer line along a part of East Second Avenue within
said town, and said tow agreed to abandon the alley way, sewer lines and easements within said
Block Twenty-six, upon satisfactory completion of said line aforementioned, all as is made to
more fully appear upon the records of the County Clerk for Tulsa County, Oklahoma, in Book 3748
at Page 1216, in said office, and
WHEREAS the owners have completed the construction of the sewerline, in compliance with the
terms of said contract, and said line has been approved and accepted by said Town of Owasso, and
said owners having requested that The Town of Owasso vacate and abandonthe alleyway and sewer
lines more fully described in this ordinance,
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA:
Section 1. That the public alley and alleyway located within the running through Block
Twenty-six (26), being a strip of land twenty (20) feet in width extending from the South line
of East Second Avenue to the North line of East Third Avenue, in said Town of Owasso, and running
in a North and South direction, is hereby vacated forever as a public throughfare or
public alley, together with all sewer lines and easements therein or thereon.
Section 2. That the sewer easement and sewer line extending from the center of the alley,
abandoned by Section 1 of this ordinance, in an Easterly direction and countinuing East to a
manhole located at a point located on the East side of birch Street at a point near the intersetion
of the alleyway running East and West in Block Twenty-three (23) of said Original
Townsite of The Town of Owasso, Oklahoma, is hereby vacated forever as a public easement and
use, and abandoned.
Section 3. The sewer lines and alleyway vacated and abandoned by this Ordinance number 131,
shall hereafter become the private sewer and property of the person, party or parties entitled
thereto under the Laws of the State of Oklahoma, and The Town of Owasso shall no longer be
responsible for the care, upkeep and maintence of same.
Section 4. The Town of Owasso approves the sewer line and facilities and constructed and
referred to in Section "1" of this Ordinance number 131, described as one manhole located at
a point where the alleyway running in an East and West direction through Block Twenty-Three
of the Original Townsite of The Town of Owasso intersects with Birch Street in said town, and
eight-inch sewer pipe line extending therefrom in a Southerly direction along said Birch Street
a distance of approximately Three Hundred Fifty-five feet and joins and connects at its termination
to the town's existing sewer system.
Section 5. EMERGENCY. That an emergency exists for the prservation of the public peace,
health, welfare and safety, by reason whereof this ordinance shall take affect from and after
its passage, approval and publication.
PASSED, and the Emergency Clause voted upon separately and passed by unanimous vote of the
Board of Trustees this 7th day of December, 1970.
