HomeMy WebLinkAbout133_Sidewalk_Driveway_Curb Cut RequirementsORDINANCE NUMBER 133 AN ORDINANCE RELATING TO SIDEWALK, DRIVEWAY SECTIONS AND CURB-CUTS; AUTHORIZING THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA, TO MAKE AND PRESCRIBE SPECIFICATIONS, MAPS, PLANS, CHARTS, DIAGRAMS, DRAWINGS AND PLATS, BY RESOLUTION, PERTAINING TO SAME, AND TO DESCRIBE AND DESIGNATE LOCATIONS, AREAS OR PLACES WHERE SAME SHALL BE SPPLICABLE; MAKING SAME AS REQUIREMENTS IN THE LETTING OF CONTRACTS FOR CONSTRUCTION; PROVIDING MANNER IN WHICH SUCH RESOLUTION SHALL BE PRESENTED AND EXECUTED; REQUIRING FILING FOR PUBLIC INFORMATION; PROHIBITING CONSTRUCTION OR USE OF DRIVEWAYS IN VIOLATION OF PLANS SET FORTH BY RESOLUTION OF THE BOARD OF TRUSTEES; PROVIDING PENALTIES FOR VIOLATION OF REQUIREMENTS AND PLANS ADOPTED BY BOARD, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, STATE OF OKLAHOMA: SECTION 1. The Board of Trustees of The Town of Owasso, Oklahoma, shall, by resolution, have the power and authority to prescribe specifications and make and adopt Plans, Charts, Maps, Diagrams, Drawings and Plates describing requirements for construction and/or use of sidewalk areas, driveway sections and curb-cuts, and to name the areas or streets to be subject to such requirements, and the places where cub-cuts are to be made and the premises or property affected thereby. SECTION 2. All specifications, maps, plans, charts, diagrams, drawings and plats shall be chart, drawing, and/or written form, to be adopted by the Board of Trustees, and upon adoption, a complete copy of same, bearing the number of the resolution, the words "sidewalk, Driveway and Curb-cut Requirements", together with a number indicating the exhibit so adopted and the data of adoption, and shall bear the signature of the President of the Board of Trustees and attested by the Town Clerk, who shall attach the Town Seal thereto, which shall be filed for the purpose of public inspection with the Town Clerk of The Town of Owasso, Oklahoma. SECTION 3. Specifications and Exhibits adopted as provided by Section "2" of this ordinance shall be applicable to the letting of all contracts for the construction of sidewalks, curbing and driveway enterances, and shall be so specified in such contracts; provided, that the Board of Trustees shall have the authority to at any time, by a majority vote, repeal or alter any resolution made pursuant to this ordinance. SECTION 4. Whenever a resolution has been adopted establishing the location of curb-cuts and driveways, the Town Clerk shall notify the owner or personin charge of the real estate or mrimises affected thereby, by registered mail of the application of such resolution, and describing the width of the driveway or curb-cut permitted. SECTION 5. Whenever curb-cuts have been established, the owner or person in charge of the land or premises affected thereby shall be confined to the use thereof for the passage of vehicles driving into or departing from said premises, and, except in cases of emergency, it shall be unlawful to drive or supper to be drived to enter upon or departed from such premises, except by way of such established curb-cuts and within the width and at the place where such plan or diagram adopted and prescribed shall provide. SECTION 6. Any person violating Section "5" of this ordinance shall, upon conviction be fined in any sum not to exceed Twenty Dollars ($20.00) including costs, and each day such violations are permitted to exist or continue shall be considered to be a separate offense. SECTION 7. That, by reason of immediate need for the protection of persons and property, an EMERGENCY is hereby declared to exist for the preservation of the public peace, health, and safety, by reason whereof this ordinance shall take effect immediately upon its adoption and approval. Passed, and the emergency clause ruled upon separately and passed by unanimous vote of the Board of Trustees of The Town of Owasso and adopted this 5th day of April, 1971.
