HomeMy WebLinkAbout134_Erection_Maintenance of Signs and BillboardsORDINANCE NUMBER 134 AN ORDINANCE REGULATING THE CONSTRUCTION, MAINTENANCE, ERECTION AND USE OF BILLBOARDS, SIGNS AND PANELS INTENDED FOR DISPLAY; AUTHORIZING THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO TO, BY RESOLUTION, PRESCRIBE RULES AND SPECIFICATIONS AND ADOPT MAPS, PLANS, CHARTS, DIAGRAMS AND DRAWINGS PERTAINING TO BILLBOARDS, SIGNS AND PANELS; TO PERMIT AND AUTHORIZE THE BOARD OF TRUSTEES TO ESTABLISH AREAS IN WHICH CONTROL OF EXISTANCE OF BILLBOARDS, SIGNS AND PAELS APPEAR TO BE NECESSARY; TO AUTHORIZE SAID BOARD TO ESTABLISH SETBACK LINES, LOCATIONS, PLACES AND/OR AREAS WHENEVER IN THE OPINION OF SAID BOARD SAME SHOULD APPEAR NECESSARY; REQUIRING BUILDING PERMITS IN AREAS WHERE CONTROLS EXIST; EXCEPTIONS; PROVIDING MANNER IN WHICH SUCH RESOLUTIONS SHALL BE PRESENTED AND EXECUTED; REQUIRING FILING FOR PUBLIC INFORMATION OF SUCH RESOLUTIONS ADOPTED RELATING TO BILLBOARDS, SIGNS AND PANELS; PROHIBITING OBSTRUCTION OF VIEW OF TRAFFIC AT STREET OR ROAD INTERSECTIONS; PROVIDING PENALTIES FOR VIOLATIONS FOR RULES, REQUIREMENTS AND PLANS ADOPTED BY BOARD OF TRUSTEES, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, STATE OF OKLAHOMA: SECTION 1. The Board of Trustees of The Town of Owasso, Oklahoma, shall have the power and authority to, by resoltion, prescribe specifications and rules and make and adopt maps, plans, charts, diagrams and drawings and plats describing requirments for the construction, erection, maintenance and use of Billboards, signs and panels Intened for display, and to name the aread of districts within The Town of Owasso within which such resolution is to be applicable. SECTION 2. All specifications, rules, maps, plans, charts, diagrams and drawings and plats, and/or written form, to be adopted by the Board of Trustees, shall be presented to said Board, and, upon adoption, a complete copy of same, bearing the number of the resoltion, the words "Sign and Billboard Regulations", together with a number indicating the exhibit so addopted and the date of adoption, bearing the signature of the President of the Board of Trustees and attested by the Town Clerk, who shall attach the Town Seal thereto, shall be filed for the purpose of public inspection with the Town Clerk of The Town of Owasso, Oklahoma. SECTION 3. Whenever a resolution has been adopted as provided by Section "2" of this ordinance, the Town Clerk shall notify the owner or person in charge of the real estate or premises affected thereby, by certified mail, of the application of such resolution. SECTION 4. The Board of Trustees of The Town of Owasso, Oklahoma, shall have the power and authority to, by resolution, prescribe and establish setback lines controling the placement of Signs, Billboards and Panels, within areas or districts The Board of Trustees of the Town of Owasso may consider necessary, or proper. SECTION 5. All owners or persons in control of land or lots within an area subjected to rules and/or regulations by the Board of Trustees, as provided in this ordinance, shall obtain a building permit to build, erect, place or install any sign, billboard or panel, as provided by Ordinances of The Town of Owasso, Oklahoma, relating to construction of buildings or structures, before commencing installation of any sign, billboard or panel; Provided that temporary cardboard signs, which are no larger than two (2) square feet and not more than three (3) feet in height, shall be permitted without such building permity being obtained. The term "temporary, cardboard signs" as used in this Section shall be confined to political, sales or rental signs of premises upon which same are placed, notice of religious, scholastic, events or charitable purposes, and such signs shall not be permitted to remain on such land or permises for a period of time in excess of sixty (60) days during any six month period. SECTION 6. No elevated sign, billboard or panel shall be placed or constructed in such a manner as to create a hazard to pedestrain or vehicular hazard, either by reason of quality of construction or by obstruction of view at any street or road intersection. SECTION 7. PROVISIONS SEVERABLE. The provisions of this Ordinance, numbered 134, are hereby declared to be severable, and if any section, part of section, paragraph, sentence or clause of this ordinance shall be held invalid or inoperative for any reason and any court of competent jurisdiction, any other section, part of section, paragraph, sentence or clause shall not be affected thereby. SECTION 8. PENALTIES FOR VIOLATIONS Any person convicted of a violation of any of the provisions or sections of this ordinance, shall be punished by a fine not exceeding the sum of Twenty Dollars ($20.00) including costs, and each day such violation is permitted to exist or continue shall be considered to be a separate offense. SECTION 9. EMERGENCY That by reason of immediate need for the protection of persons and property, an Emergency is hereby declared to exist for the preservation of the public peace, health, and safety, by reason whereof this ordinance shall take effect immediately upon its passage and approval, PASSED5 and the emergency clause ruled and voted upon separately and passed by unanimous vote of the Board of Trustees of The Town of Owasso and adopted this 19th day of An ii 1971.
