AN ORDINANCE PROHIBITING DISCHARGE OF CERTAIN SUBSTANCES INTO THE TOWN SEWER SYSTEM; SETTING
FORTH DUTIES OF THE BUILDING INSPECTOR IN THE EVENT SAID SUBSTANCES ARE DISCHARGED INTO THE
TOWN SEWER SYSTEM; PROVIDING FOR APPLICATIONS FOR PERMITS FOR SEWER CONNECTIONS FOR INDUSTRIAL
WASTES; SETTING FORTH DUTIES OF THE BUILDING INSPECTOR WITH REGARD TO SEWER CONNECTIONS
WHICH DO NOT CONFORM TO THE PROVISIONS OF THIS ORDINANCE AT THE TIME OF PASSAGE; PROVIDING
FOR NOTICES TO OWNERS OR OCCUPANTS IN THE EVENT OF NON-COMPLIANCE WITH THIS ORDINANCE; PROVIDING
FOR ENFORCEMENT; PROVIDING FOR PERIODIC TESTING; CONTAINING A SAVINGS CLAUSE; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEE OF THE TOWN OF OWASSO, STATE OF OKLAHOMA:
Section 1. No person shall discharge or cause to be discharged the following substances
if it appears likely, in the opinion of the building inspector or the Board of Trustees of
the town, that such wastes can harm and sewers, the sewage treatment process, or equipment;
have an adverse effect on the receiving stream; or can otherwise endanger life, limb, or
public property, or otherwise consitute a nuisance. The prohibited substances are:
a. Flammable or explosive materials;
b. Water or wase containing fats, wax, grease, or oils in
ecess of 100 mg/1, or any substance which may solidify or
become viscous at tempatures highter than 32 F;
c. Any liquid or vapor having a tempature highter than 150 F;
d. Any garbage or food wase not properly shredded. The
installation and operation of any grinder or shredder equipped
with a motor or three-fourths horsepower (2/4 hp) or greater
shall be subject to review and approval by the building inspector
or such other person appointed by the board of trustees of the
town for that purpose;
e. Any waters or wastes containing the metals listed below or
other toxic substances in quantities determined by inspection
to be harmful:

Bismuth Iron Rhenium Uranium
Boron Lead Selenium Zink
f. any water or waste containing iron-pickling wastes or plating
solutions;
g. Any waters or wastes containing phenols or other taste or odor
producing substances;
h. Any radioactive wastes of a half-life or concentration determined
by the building inspector or person appointed by the board of Trustees
to make such inspection and determination;
i. Any water or wastes having hp lower than 5.5 or having a ph highter
than 10.5, or having any corrosive property capable of damaging
installations, equipment, or personnel or the sewerage works;
j. solid or viscous substanceof suh size or in such quantities
dcapable of causing obstruction of sewers or interferrence with
operation of sewage works, such as ashes, cinders, mud, straw,
shavings, metal, glass, rage, feathers, tar, plastics, wood,
unground garbage, whole blood, paunch manure, hair, fleshings,
entrails, and paper containers;
k. Wastes containing unusual concentrations of suspended solids, such
as fuller's earch, lime, or clay;
l. Wastes containing unusual concentrations of dissolved substances,
such as sodium chloride or sodium sulfate;
m. Water or wastes containing excessive coloration, such as that
cuased by dye wastes and tanning solutions;
n. Wates containing unusual concentrations of organic materials, such as
whey, milk, yeast, blood, or unusual biochemical oxygen demend (BOD),
chemical oxygen demand (COD), or chlorine requirements, constituting a
significant load on the sewage treatment process.
o. Material which cause unusual volume of flow or concentration of wastes
constituting slug which adversely affect the dewage treatment process.
Section 2. INSPECTOR FOR TOWN MAY ACT AND MAKE REQUIREMENTS. If any waters or wastes
are discharged or proposed to be discharged, or if in the opnion of the inspector might be
accidently discharged, which contain the substances described in Section 1 of this ordinance,
the building inspector, town's engineer or such person designated by the town to make inspections
of sewers, may prohibit their discharge; may require the establishment to alter or
initially construct its facilities so that accidental discharges may not occur; require the
responsibile party to pretreat the wastes before discharge; limit the quantity, rates, and
times of discharge; required the installation of a control manhole for observation, sampling,
and metering of the wastes; and assess a surcharge based ont he quantify and strenght of the
wates. If pretreatment is to be accomplished, the design, installation, and operation of
the plant and equipment shall be subject to the review and approval of such inspector.
Applications for permits for sewer connections for industrial wastes shall show the
following information:
a. A plat of the property showing all exiting sewers and storm drains;
b. Plans and specifications covering any work proposed to be done under
the permit;
c. A schedule of all process waters and industrial wastes produced or
to be produced, a description of the character of such waste, the
daily volume and maximum rates of discharge, and representative
analyses;
d. The name of the firm or person who will perform the work covered by
the application.
Section 3. Inspector TO SERVE NOTICE The Building inspector or inspector signified
by the town to serve notices relating to the administration of this ordinance, shall cause
to be served on the owner or occuypant of any establishement, having sewer connections which
do not confrorm to the provisions hereof at the time of passage of this ordinance, a notice
in writing advising that requirements must be met within 30 days. if after thiry (30)
days from the day of service of the notice the proper measures have not been taken, enforcement
action may be initiated as set forth elsewhere in this ordinance.
The building inspector or inspector mentioned in this section shall cause sample of
wastes from industrial establishments to be obtained and tested periodically, to determine
the quanity and composition thereof.
Section 4. DISCHARGE OF POLUTION INTO SEWERS A NUISANCE. The dischareg of such
substances named and described in Section 1 of this ordinance, into the sewer system of
The Town of Owasso, in violation of the provisions of this ordinance, shall be deemed to
be a nuisance, which may be abated by the town in any legal manner.
Section 5. PENALTIES FOR VIOLATIONS. Any person who shall continue any violation
beyond the time limit provided for in section 3 above shall be guilty of an offense, and
upon conviction thereof shall be fined in an amount not exceeding twenty dollars ($20.00)
including costs for each violation. Each day in which any such violation shall continue
shall be deemed a separate offense.
Section 6. SAVING CLAUSE. Should any provision of this ordinance or application
thereof be held invalid by any court or competent jurisdiction, the remainder of the ordinance
and each section or clause of any section, other than those as to which it or they
are held invalid, shall not be affecyed thereby, and such remaining parts of said ordinance
shall be valid and in full force and affect, it beiung hereby declared to be the intention
of this ordinance that the same would have been adopted has such part, section or clause
held invalid or unlawful provision, if any, not been included therein.
Section 7. EMERGENCY. That for the preservation of the prublic peace, health and
safety, an emergency is hereby declared to exit by reason whereof this ordinance shall be
in full force and effect immediately from and after its passage and approval.
PASSED by the Board of Trustees of The Town of Owasso, Oklahoma, this 6th day of December,
1971, and the Emergency clause voted upon separately and passed by unamious vote of said
Board of Trustees.
