IN THE REGIONAL METROPOLITAN UTILITY AUTHORITY,
A PUBLIC TRUST, CREATED PURSUANT TO TITLE 60,
SECTIONS 176 TO 180, OF THE OKLAHOMA STATUTES
OF 1971, AS AMENDED, AND THE OKLAHOMA TRUST ACT;
AND DECLARING AN EMERGENCY.
WHEREAS, Sections 176 -to 180, both inclusive, of Title 60
of Oklahoma Statutes of 1971, as amended, and the Oklahoma Trust
Act authorize and provide for the creation of express trusts for
any authorized or proper function of a municipality or other
subdivision of the state; and,
WHEREAS, it is determined to be in the best interests of
the City of Owasso and the inhabitants thereof that a trust be
created to be known as the Regional Metropolitan Utility Authority,
and that the City of Owasso accept the beneficial interest therein.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF OWASSO, OKLAHOMA, AS FOLLOWS:
Section 1. That the beneficial interest in and to the
express -trust known as the REGIONAL METROPOLITAN UTILITY AUTHORITY
dated the 10th day of October, 1972, be and the same is hereby
accepted by the governing body of the City of Owasso acting by
and through the City Council thereof for and on behalf of said
city.
Section 2. The Mayor of the City of Owasso and all other
officers of said City are hereby authorized and directed to
sign, execute and deliver any, every and all instruments of
writing necessary or convenient to effect and accomplish the
trust purposes, and are hereby authorized to receive and accept
for the use and benefit of the City all of said benefits, monies
or emoluments that may be received or flow from said trust, all
as provided in the Declaration of Trust dated the l0th day of
October, 1972.
Section 3. By reason of the immediate need for the fur-
nishing of the facilities contemplated under said trust and for
the preservation and promotion of the public peace, health and
welfare, an emergency is hereby declared to exist, by reason
whereof this ordinance shall become in full force and effect
immediately from and after its passage and approval.
