HomeMy WebLinkAbout165_W S & W Property_OZ 12_Rezoned BOOK 4099 PAGE 488 316745 CITY OF OWASSO, OKLAHOMA ORDINANCE NO. 165 AN ORDINANCE ACCEPTING, ADDING AND ANNEXING TO THE CITY OF OWASSO, OKLAHOMA, THE FOLLOWING TERRITORY, TO-WIT: THE SOUTH HALF OF THE SOUTHWEST QUARTER (S1/2 SW 1/4) AND THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER (NE1/4 SW1/4) OF SECTION TWENTY (20), TOWN SHIP TWENTY-ONE (21) NORHT, RANGE FOURTEEN (14)EAST, TULSA COUNTY, OKLAHOMA, LESS HIGHWAY RIGHT OF WAY; AND THE NORTH HALF OF THE NORTHEAST QUARTER (N1/2 NW1/4) AND THE NORTH HALF OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER (N1/2 SE1/4 NW1/4) AND THE NORTH HALF OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER (N1/2 NW1/4 SW1/4) OF SETION TWENTY-NINE (29), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE FOURTEEN (14) EAST, TULSA COUNTY, OKLAHOMA, LESS THE WEST 1,004 FEET OF THE NORTHWEST QUARTER OF THE NORTH- WEST QUARTER (NW1/4 NW1/4), SECTION TWENTY-NINE (29), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE FOURTEEN (14) EAST, TULSA COUNTY, OKLAHOMA, LESS HIGHWAY RIGHT OF WAY, PROVIDING THAT FROM AND AFTER THE PASSAGE AND PUBLICATION OF THIS ORDINANCE ALL OF SAID REAL PROPERTY HEREIN DESCRIBED SHALL BE A PART OF THE CITY OF OWASSO, OKLAHOMA, AND FURTHER PROVIDING THAT ALL PERSONS RESIDING THEREIN SHALL BE SUBJECT TO THE JURISDICTION, CONTROL, LAWS AND ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA IN ALL RESPECTS AND PARTICULARS, AND DECLARING AN EMERGENCY. WHEREAS, there was presented to the City Council of kthe City of Owasso, Oklahoma, a petition in writing, signed by not less than three-fourths of the legal voters and by the owners of not less than three-fourths (in value) of the property hereinafter described, the same being contiguous to the corporate limits of the City of Owasso, requesting that said property be annexed and added to the City of Owasso; and WHEREAS, notice of the presentation of said petition was given by the petitioner by publication at least once in each week for two successive weeks prior to this date -,in the Owasso Reporter, a newspaper of general circulation, published in the City of Owasso, Oklahoma; and WHEREAS, on the 6Vh$ day of November, 1973, said petition was duly considered by the City Council and was determined to have complied with the provisions of Section 482, et sea., Title 11, Oklahoma Statutes, and further, that proper legal notice of the presentation of said petition had been given by the petitioner and proof of publication having been duly filed, all as required by law; and WHEREAS, the City Council of the City of Owasso has determined the annexation of the property hereinafter described to be necessary and desirable and in the public interest of the residents and citizens of the City of Owasso® NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO: 000K4099 PACE 489 Section 1. That the following described territory line in Tulsa County, Oklahoma, which is contiguous to the present corporate limits of the City of Owasso and described in the petition presented to the City Council in accordance with the provisions of Section 482, et seq., Title 11® Oklahoma Statutes, and more particularly described as follows, to-wit: The South Half of the Southwest Quarter (S2 SWk) and the Northeast Quarter of the Southwest Quarter (NE4 SW4) of Section Twenty (20)® Township Twenty- one (21) North® Range Fourteen (14) East,Tulsa County, Oklahoma, less Highway Right of Way; OWN The North Half of the Northwest Quarter (N2 N-K4) and the North Half of the Southeast Quarter of the Northwest Quarter (N'-2 SE 1-4 NW4) and the'North- Half of the Northwest Quarter of the Southwest Quarter (N'-2 NW4 SWh) of Section Twenty -Nine (29), Township Twenty-one (21) North, Range Fourteen (14) East, Tulsa County, Oklahoma, less the West 1,004 Feet of the Northwest Quarter of the North- west Quarter (NWk Nw4)® Section Tlwenty-N-ine(29), Township Twenty-one (21) North, Range Fourteen (14) East, Tulsa County® Oklahoma® less Highway Right of Way, be and the same is hereby annexed to and added to the City of Owasso® Oklahoma, and the corporate limits be and are hereby extended to include the above described territory. That from and after the passage and publication of this Ordinance, the real estate described in Section 1 hereof shall be a part of the City of Owasso, Oklahoma® and all persons residing therein, and all property situated thereon® shall be and are hereby declared to be subject to the jurisdic- tion® control, laws and ordinances of the City of Owasso, Oklahoma, in all respects and particulars. I am the owner of approximately 227 acres in Sections 20 and 29, Township 21 North, Range 14 East, Tulsa County, Oklahoma, that are contiguous to and lie adjacent to the present city limits of the City ®f Owasso. Generally, this land may be described as: S/2 SW/4 and NE/4 SW/4 Section 20, less Highway, right of way; and the N/2 NW/4 and N/2 SE/4 NW/4 and N/2 NW/4 SW/4, Section 29, less certain lands abutting Highway 75 heretofore conveyed, a portion of which is already within the city limits of the City of Owasso The ownership and the lands concerning w hich this letter is written are shown in red on the plat attached hereto. This letter is my petition as owner of said land to the City Council of the City of Owasso requesting the annexation of said lands and their inclusion within the city limits of the City of Owasso.
