HomeMy WebLinkAbout194_Designating Refuse collectors_Amends Section 9.14_City CodeORDINANCE NO. 194 AN ORDINANCE AMENDING SECTION 9-14 OF THE OWASSO CITY CODE, REPEALING PORTIONS THEREOF, AND DECLARING AN EMERGENCY. Section 1® That Section 9-14 of the Owasso City Code, which presently reads as follows, to-wit: "Sec. 9 -14® Trash collecting by designated person; contract. (a) The city council of the City of Owasso, Okla- homa, is hereby authorized to designate some person or persons as city trash collector, or contract for the collection or removal of trash, rubbish, refuse and garbage, in or on behalf of the City of Owasso, Oklahoma, or to employ some person or persons for such purpose, at a salary or salaries to be specified by the city council® (b) Any contract let by virtue of this article, shall require the contractor to pay, monthly, to the City of Owasso, for the rights and privileges granted by such contract, a sum of money to be set by the council equal to not less than ten percent (10%➢ of gross revenue derived by such contractor. Said contract shall expire on the 30th day of June of each year, and may be revoked at any time by a majority vote of the council, because of negligent performance of services or failure of such contractor to comply with the terms of such contract® Before any contract issued pursuant to this article may be revoked, written notice shall be mailed to the holder of such contract at his last known mailing address at least five (5). days before the hearing, which hearing shall be not more than thirty (30) days from date of mailing, said notice shall inform the holder of such contract of the intention of the city council to revoke said contract by reason therefore, and the time and place at which such hearing will be held® Such contract shall not be transferrable except upon approval of the city council. (c) Said contract may be cancelled for any cause by either party upon giving written notice to other party sixty (60) days prior to cancellation.,, be amended to read in the following manner, to -wit® "Sec® ° -l4® Trash collecting by designated person; contract. Section 2. Emergency. That an emergency exists for the preservation of the public peace, health and safety, this Ordinance shall become effective immediately upon its passage, approval and publication.
