AN ORDINANCE AMENDING CHAPTER 9, SECTION 9-11, OF THE OWASSO
CITY CODE (1973), PROVIDING FOR GARBAGE CANS, SPECIFICATIONS,
PLACEMENT AND USE, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE COUNCILOF THE CITY OF OWASSO, OKLAHOMA:
Section 1. That Chapter 9, Section 9-11, of the Owasso
City Code (1973) which presently provides:
"Sec. 9-11. Garbage cans - specifications, place-
ment, use. The owners, occupants or rental agents
of all premises in the City of Owasso shall place
all garbage in water-tight, metal or plastic con-
tainers that must be of sufficient size to hold
not less than 10 nor greater than 30 gallons with
close-fitting covers; said containers to be placed
not greater than 50 feet from the front street
curb line, not requiring the opening of gates or
doors to gain access thereto and not exceeding two
(2) in number."
be repealed and the following revision of said Section shall
be enacted in lieu thereof:
"Sec. 9-11. Garbage cans -..specifications, place-
ment, use. The owners, occupants or rental agents
of all premises in the City of Owasso shall place
all garbage in water-tight, metal or plastic con-
tainers that must be of sufficient size to hold
not less than 10 nor greater than 30 gallons with
close-fitting covers; said containers to be placed
not greater than 4 feet from the front street curb
line, or 8 feet from the edge of the roadway surface,
if there is no curb, not requiring the opening of
gates or doors to gain access thereto and not-ex-
ceeding two (2) in number. Alternate arrangements
for placement of the aforementioned containers
may be approved by the City Manager upon written
application by the aforementioned owners, occupants
or rental agents where the City Manager is satisfied
that the applicant is either an invalid or is bed-
ridden and the above-presented placement would work
a hardship on said owner, occupant or rental agent.
The City Manager's approval shall be transmitted,
in writing, to the City Trash Collector."
Section 2. It being immediately necessary for the preser-
vation of the public peace, health and safety, an emergency is
hereby declared to exist, by reason whereof, this Ordinance
shall take effect and be in full force from and after its
passage and approval.
