HomeMy WebLinkAbout223_Providing for Plumbing Inspector & Adopting Plumbing CodeORDINANCE 223 A111 ORDINANCE AMENDING SEC. 4-5 AND SEC. 4-6 OF ARTICLE 2, CHAPTER 4 CF TEE ONRSSO CITY CODE 1973 AND PROVIDING F POSITION OF PLUMBING INSPECTOR, PROVIDING STANDARDS AND ADOPTION OF SOUTHERN STANDARD PLUMBING CODE WITH EXCEPTIONS; AND PROVIDING FOR EONDS, FEES AND OTHER CHARGES; PROVIDING PENALTIES FOR FAILURE TO COMPLY THEREWITH AND DECLARING AN EMERGENCY, BE !T ORDAINED EY THE MAYOR AND CCUNCILMEN OF THE CITY OF CSIASSO, OKLAHOMA. Article 2. Plumbing: Water and Drainage. Sec. 4-5. Southern Standard Plumbing Code Adopjted- The current edition of the Southern Standard Plumbing Code, of which not less than three (3) copies are on file in the Office of the City Clerk, as hereby adopted, except as to those provisions uhich are prohibited by or in conflict Ath the laws of the State of Oklahoma. Said Code shall govern plumbing within the City of Owasso, Oklahoma, and shall have full force and effect as if same were fully set out herein, Sec. 4-5.1. Municipal Plumbing Inspector There is hereby created the Office of Plumbing Inspector ,Lose duty it shall he to inspect all plumbing installed in the jurisdiction of the City of Owasso. The City Manager shall appoint a person deemed by the City Manager to he quald for the office; provided, that when the City of Coasso shall have attained a population of more than 4,000 according to the last official Federal Decennial Census, then, a plumbing inspector shall be appointed who has had not less than five (5) years practical experience in the plumbing business and he shall not he interested, either directly or indirectly, in any firm or corporation engaged in the plumbing business, Sec. 4-6. The City Council by notion or resolution may establish registration fees, permit fees, inspection fees, bonds and any other fees or regulations provided within the Southern Standard Plumbing Code; provided that when fees set out in the Southern Standard Plumbing Code are in excess of those allowed by the laws of the State of Oklahoma, then the highest amount permitted to be charged by State law shall prevail and apply. Sec, 4-6.1. Fines - Violations. Any person, firm or corporation violate a provision of this Ordinance c therewith or with any of the provisions a detailed statement or plan submitted shall be guilty of a misdemeanor. Each be deemed guilty of a separate offense or agent who r fail to ca thereof, or and approved such person for each and shag, I nply violate thereunder, shall every day or portion thereof during which any violation of any of the provisions of the Southern Standard Plumbing Code, as herein adopted, is committed or continued, and upon convic- tion in the Court of Jurisdiction for any such violation, such person, firm or corporation shall be punished by a fine of not more than Thirty-Five Dollars C$35.00) for each offense. Sec. 4-6.2. Revocation of Plumbinq License or Permit. Non-compliance with the rules and regulations herein set forth shall be grounds for revocation of a permit or license to engage in the business of plumbing in the Citt 1-Y of Cwasso, Oklahoma, and the Plumbing Inspector is hereby empowered to revoke such plumbing rights or permits when the Plumbing inspector deems it is in the best interest of the City so to do, EmmencL. An emergency is hereby declared to exist for the preservation of the public peace, health and safety, by reason whereof this Ordinance shall take effect immediately from and after its passage, approval and publication.
