ORDINANCE NO, 239
AN ORDINANCE AMENDING SECTION A.08 OF APPENDIX A-IMPROVEMENTS OF THE OWASSO
SUBDIVISION REGULATIONS, (ORDINANCE NO. 116, ADOPTED AUGUST 7, 1969) PRO-
VIDING FOR STORM DRAINAGE IMPROVEMENTS AND FLOOD ELEVATION DATA, REPEALING
PORTIONS THEREOF, AND DECLARING AN EMERGENCY.
WHEREAS, Title II, Oklahoma Statutes, Sections 401 through 437 in-
clusive and its amendments empower the City to engage in Comprehensive City
and Regional Planning and Zoning and to enact suitable ordinances carrying
out the purposes of said acts; and
WHEREAS, the Owasso City Planning Commission has duely adopted the
Owasso Subdivision Regulation, Ordinance 116 and its amendments to carry
out the purposes of said acts; and
WHEREAS, the Planning Commission has reviewed and recommended an a-
mendment to said ordinance to carry out the purposes of said acts.
WHEREAS, the Owasso City Council deems it necessary for the carrying
out the purposes of said acts and of promoting the health, safety, moralS7,
or general welfare of the community to amend said Owasso Subdivision Reg-
ulations;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA:
Section 1. That Section A.08 of the OWASSO SUBDIVISION REGULATIONS
which presently reads as follows, to-wit:
Provisions shall be made for the disposal of all storm water.
Where initial construction does not provide for storm waters,
drainage ditches of adequate capacity shall be constructed.
Facilities for storm drainage should be of adequate capacity
to take care of surface run-offs originating within the sub-
division or flowing across it."
be amended to read in the following manner, to-wit:
"A.08 STORM DRAINAGE
Provisions shall be made for the adequate disposal of all
storm water® Facilities for storm drainage shall be of ad-
equate capacity to take care of surface run-offs, calculated
on the basis of one hundred (100) per cent upstream urbanization
or development, originating within the subdivision or flowing
across it9 Subdivisions shall be designed and developed so as
to minimize flood damage. All subdivisions or portions thereof
and improvements therein within a Flood Prone Area or Area of
Special Flood Hazard, as defined in Ordinance No® 233, Section
2, shall comply with the requirements set forth in Ordinance No®
233 and its amendments regarding floodplain management."
Section 2® That Section A ' 08 be added to the OWASSO SUBDIVISION
REGULATIONS to read as follows- to-wit.
"A.08.1 FLOOD ELEVATION DATA
All proposals for subdivisions and site development plans of
greater than 50 lots or 5 acres, whichever is the lesser, shall
include within such proposals Base Flood elevation data, as de-
fined in Ordinance No. 233, Section 2. All lots located in the
Flood Prone Area or Area of Special Flood Hazard shall have the
Building Pad Elevation provided for each lot on a copy of the
final plat prior to recording the final plat ®"

BACKGROUND:
On April 4, 1978, the Owasso City Council approval Ordinance No. 229, annexing a parcel of land
located north of E. 76' Street N. and west of the Owasso Expressway. Subsequent to the
annexation, the plat for Forest Drive Industrial Park, and subsequently, the replat for Forest Creek
Business Park have been approved by the Council.
Staff received a call recently from the Tulsa County Assessor's office regarding the original
annexation Ordinance No. 229, for which they could find no copy. Staff could also not find a copy
of the ordinance, although the minutes from the April 4, 1978 meeting does confirm the approval
by Council. Apparently the ordinance was never recorded with the Tulsa County Clerk.
Ordinance No. 229 Nunc Pro Tune would formally adopt the action taken by the City Council at
the April 4, 1978 meeting.
RECOMMENDATION:
Staff recommends approval of Ordinance No. 229 Nunc Pro Tune.
