HomeMy WebLinkAbout245_OZ 35_RezoningORDINANCE NO. 245 AN ORDINANCE AMENDING ORDINANCE NO 175, APPROVING REZONING APPLICATION NO OZ-35, AND CHANGING ZONING OF PROPERTY FROM AG AGRICULTURE DISTRICT, AND OM OFFICE MEDIUM INTENSITY DISTRICT AND OP PLANNED OFFICE PARK DISTRICT TO CS COMERCIAL SHOPPING CENTER DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY WHEREAS, public hearings have been held regarding the re- quested rezoning for the property herein described, and WHEREAS, the Owasso City Council has considered the re- commendation of the Owasso Planning Commission and all state- ments for and against the requested rezoning of 0Z -35, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA: SECTION 1. That the zoning classification of the follow- ing described property, to -wit: (1) Commencing at N. E. section corner of section 29, township 21 north, range 14 east, tulsa county, oklahoma, thence due west along the north section line a distance of 1290.52 feet, thence due south a distance of 60.00 feet to the point of beginning, thence due east a distance of 150.00 feet, thence due south a distance of 150.00 feet, thence due west a distance left having a tangent bearing of N05 decree 41'13"E, and having a radius of 1105.00 feet through a deflection angle of 5 degree 41'13" for an arc distance of 10968 feet, thence due north a distance of 40.50 feet to the point of beginning and containing 0.52 acres more or less. (2) Commencing at S.E. corner of E1/2 of SW1/4 of Section 20, township 21 North, Range 14 East. Tulsa County, Oklahoma, thence S89 decreeg 54'00"W a distance of 690.60 feet to the point of beginning, thence N 00 decree 01'11"W a distance of 855.00 feet, thence s49 decree 58'49"W a distance of 60.00 feet, thence on a curve to the left having a radius of 340.00 feet through a central angle of 60 degree 13'53" for an arc length of 357.42 feet, thence s 10 degree 15'04"E a distance of 148.52 feet, thence on a curce to the right having a radius of 2810.80 feet through a central angle of 10 decree 09'04"E a distance of 90.00 feet, thence N89 degre 54'00"E a distance of 640.00 feet to the point of beginning and containing 12.54 acres more or less, be and the same is hereby rezoned from an AG Agriculture Dis- trict, OM Office Medium Intensity District, and OP Planned Office Park. District to CS Commercial Shopping Center District classification. SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby expressly re- pealed EMERGENCY. An emergency is hereby declared to exist for the preser- vation of the public peace, health and safety, by reason. whereof Ordinance No. Page Two this Ordinance shall take effect immediately from and after its passage, approval and publication.
