AN ORDINANCE AMENDING CHAPTER 9 ARTICLE 1 , SECTION 9-3
AND SECTION 9-11 OF THE OWASSO CITY CODE, AND ADDING SECTION
9-14, PROVIDING FOR SERVICE FEES FOR COLLECTION AND
DISPOSAL OF GARBAGE AND REFUSE AND FREQUENCY OF SERVICE;
AND DESIGNATING CONTAINERS; SPECIFICATIONS; PLACEMENT;
USE; A;;OWING ADDITIONAL RULES AND REGULATIONS TO BE
IMPOSED BY OWASSO PUBLIC WORKS AUTHORITY SO LONG AS REFUSE
COLLECTION AND DISPOSAL IS LEASED TO OWASSO PUBLIC WORKS
AUTHORITY; PROVIDING FOR THE ENFORCEMENT THEREOF; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA:
Section 1. Chapter 9, Article 1, Section 9-3 of the Owasso
City Code is hereby amended to read as follows:
"Section 9.3 Service Fees - Residential; Frequency of
Service. Residential service shall consist of once weekly
removal of garbage and household refuse which has been
placed in containers in the manner hereinafter specified.
This service is deemed to be necessary to protect the
health, safety and welfare of the citizens of Owasso and
the fees for said service are deemed necessary to pay for
the removal of such garbage and household refuse, to pro-
tect the health of the occupant, owner, tenant or lessee
and others in the near vicinity by such removal. The fees
for such service shall be as the Council may determine
from time to time by resolution."
Section 2. Chapter 9, Article 1, Section 9-11 of the Owasso
City Code is hereby amended to read as follows:
"Section 9.11 Designating Containers; Specifications;
Placement; Use. The Owners, occupants or rental agents
of all premises in the City of Owasso shall place all
garbage in the containers provided by the City; and in
respect of residential service, said containers to be
placed on street curb line on the day specified for the
trash removal in each area.
Section 3. Chapter 9, Article 1, Section 9-14 of the Owasso
City Code:
"Section 9.14 Allowing additional rules and regulations
to be imposed by Owasso Public Works Authority so long as
refuse collection and disposal is leased to Owasso Public
Works Authority; providing for the enforcement thereof.
So long as refuse collection and disposal is leased to and
operated by or under the authority of the Owasso Public
Works Authority, the Owasso Public Works Authority shall
have the authority to establish or change rules or regula-
tions, other than rates now in effect that it deems nec-
essary to the proper operation of refuse collection and
disposal. Such rules and regulations shall be enforced
by the City as same are now enforced.
Section 4. By reason of the need for the immediate preserva-
tion of the peace, health and safety, an emergency is hereby
declared to exist and this Ordinance shall be effective imme-
diately upon its adoption.
PASSED and APPROVED and the_emergency clause ruled upon
separately thist_ day of 1979.
