HomeMy WebLinkAbout256_Relating to Rural Fire RunsORDINANCE NO3 256 AN ORDINANCE AMENDING CHAPTER 8, SECTION 8-25, AUTHORIZING THE CITY OF OWASSO, OKLAHOMA TO ENTER INTO CONTRACTS, OR AGREEMENTS WITH INDIVIDUALS, FIRMS, PRIVATE CORPORATIONS, OR ASSOCIATIONS, OR POLITICAL SUBDIVISIONS OF THE STATE FOR FIRE PROTECTION OUTSIDE OF THE CORPORATE LIMITS OF SAID CITY, WHICH WOULD INCLUDE AREA WITHIN A FIVE (5) MILE RADIUS THEREOF AND NOT WITHIN THE LIMITS OF ANY OTHER MUNICIPALITY OR FIRE PROTECTION DISTRICT; PROVIDING FOR FIRE RATES AND PAYMENT THEREOF; TO PROVIDE FIRE PROTECTION JOINTLY WITH OTHER ORGANIZATIONS AND MUNICIPAL SUBDIVISIONS OF THE STATE; REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENY. BE IT ORDAINED BY THE CITY OF OWASSO, OKLAHOMA: Section 1. The City of Owasso is hereby authorized and empowered to enter into contracts or agreements with individuals, firms, private corporations or associations, or political subdivisions of the State of Oklahoma for fire protection outside the corporate limits of said City of Owasso, and to contract to provide fire protection jointly with other organizations and municipal subdivisions of the State. Section 2. Any contract entered into by the City of Owasso-, Oklahoma, with an individual owner, firm, private corporation or association, for outside aid, or mutual aid for fire protection, shall provide for the payment by said owner, firm, private corporation, or association, or political subdivision to the City of Owasso, Oklahoma, for such fire apparatus and personnel as follows: a) For the attendance of the company of the apparatus and personnel first to report to the fire, such owner, firm, private corporation or association shall pay to the City of Owasso the sum of Two Hundred Fifty Dollars ($250.00) for the first hour of attendance, or any portion thereof, provided that, if such company shall attend the fire for a period longer than one hour, then for the attendance of such company for the period longer than one hour, such owner, firm, private corporation or association shall pay to the City, for LO such excess period, a sum of money computed N a at the rate of Two Hundred Fifty Dollars E ($250.00) per hour. Runs outside the City Limits and within the outside limits, as hereinabove defined, shall be made unless, in the opinion of the Fire Chief or Acting Fire Chief, it is inexpedient to do so on account of another fire in the City, broken apparatus, impassable or dangerous highways, or other physical conditions. Section 4. All firemen of the Fire Department of the City of Owasso, attending and serving at fires or doing fire prevention work outside the corporate limits of the City of Owasso, as herein provided, shall be considered as serving in their regular line of duty as fully as if they were serving within the corporate limits of the City of Owasso, and said firemen shall be entitled to all the benefits of any firemen's pension and relief fund in the same manner as if the fare fighting or fire prevention work was being done within the corporate limits of the City of Owasso. Section 5. The fire department of the City of Owasso answering any fire alarm, or call, or performing any fire prevention services outside the corporate limits of the City shall be considered as an agent of the State of Oklahoma, and acting solely and alone in a governmental capacity, and said municipality shall not be liable in damages for any acts of commission, omission, or negligence while answering or returning from any fire, or reported fire, or doing any fire prevention work under and by virtue of Sections 1, 2, 3 and 4 hereof. Section b. All motorized equipment of the fire department of the City of Owasso shall have the right of way over all other commercial and pleasure vehicles. Section 7e All ordinances or parts of ordinances in conflict herewith are hereby repealed. EMERSON, JR., MANAGER OKLAHOMA CITY June 15, 1979 SPECIAL FIRE PROTECTION RULES (For Properties Outside City Limits) OWASSO, OKLAHOMA Ordinance No. 256, adopted May 15, 1979, by the Mayor and Council of the City of Owasso, Oklahoma, authorizes and directs the Fire Depart- ment to respond to all fire calls outside the city limits to property within a five mile radius thereof but not within the limits of any other municipality. This Ordinance permits application of Rules for Classification of Public Fire Protection of Unincorporated Districts, which are as follows with respect to Owasso. Note: Distances from Fire Station and Public Fire Hydrants to risk must be measured over Highways accessible to Fire Apparatus in apply- ing the following Rules. 1. D14ELLING POLICY PROGRAM (located outside city limits): a. When these risks are WITHIN FIVE MILES OF THE NEAREST FIRE STATION AND WITHIN 1000 FEET OF THE NEAREST PUBLIC FIRE HYDRANT, 8th Class Rates apply. It was my understanding this ordinance was never considered as it was assumed with such an ordinance we could not charge for the runs. As you can see, it actually says in the ordinance what we will be charging for the runs. Shouse RE: Fire Run Ordinance/Rural Responses Dear Mr. Meyer, OWASSO, OKLAHOMA 74055 the subject of a Fire Run Ordinance, Rural Response and the possible creation of a Fire Protection District has been a delicate subject since the inception of the Municipal Fire Department in October of 1974. There are many circumstances, details and aspects that need to be explored before any final decision could be objectivly reached. The situations arising and implementation of any definite plan or system should be examined in infinate detail before any plan or system is devised. There is in existance, somewhere in Council Minutes, particular comments and semi — obligatory commitments from the Council to the newly created Department and the old Rural Owasso Volunteer Fire Department regarding continuation of service to the rural area. I will endeavor to research this item further and forward any findings to you. There are many factors involved in an undertaking of this nature: (A) Do we or don't we continue to respond to rural alarms? (B) Do we decrease the size of our response area, do we let it remain the same, or do we enlarge it? (C) Do we in fact create and establish such a Fire Protection District with a millage system to help subsidize the District? And, if in fact we do create such a District, what criteria do we use to establish the boundaries? Such possibilities are: "natural"boundaries, School district, Fence Line, or the Owasso "Trade Area". It is Tay personal .feelings that the City does in fact have certain moral obligations to our Rural Citizens. Our retail sales tax is derived from these Rural Citizens just as well as those who live within our corporate limits. Yet, as in all things — there must be limits. We have many unique factors in our community. (A) We have a "satellite" City separated by an unincorporated area (Meadowcrest, Hale Acres & German Corner), (B) Ie have a "satellite" rural area surrounded on three sides by m corporate areas (the Greenwood holdings), (C) We have a corporate "protrusion" surrounded on three sides by unincorporated areas (High School Complex) (D ) We have a school district with some of it's boundaries far too distant for us to Provide safe, adequate and reliable Fire Protection to, (E) At this time, we have only one Fire Station - which we have out - groom, and is inadequate in size to properly house and serve the needs of a growing Department, (F) We still exist with limited Salaried personnel and "un- bankable" Volunteer resources to implement our protective capabilities. I would be in favor of the creation of an "Advisory Board" to look into and study all avenues and possible means of serving our Community to the possible best of everyone's needs. Suggested members might be; yo urself the Mayo, myself, Lewis Harris, Alan Anderson, , Tom Kimball, David Kimball, Mayor- Bob Baker, Ruth Evans, D. M. Sokolosky. These citizens were listed as poss- ibilities because of their Civic involvement and concern. Also, it would provide a mixture of "City" as well as "Rural" citizens. I also feel we should give a discerning look at the INCCG -STUDY II report. I an not necessarily advocating that we follow that particular plan, but we could draw on that report for statistics, information and possible ideas leading to a workable, feasable and affordable solution. The Department can pride itself on never arbitrarily denying protection to anyone, nor being unable to respond when called, Yet as the population• grows so grows our volume of service rendered. Growth, monies, manpower, equipment, facilities and demand are critical areas which need constant monitoring and planning for future needs. I am confidant that we can find viable answers to endless questions that will enable us to arrive at, a positive_ plan of action.
